    Sec. 18-70 - Purpose and authority.

    I t is the purpose of this article to:(1) Regulate theentertainment business in order to promote the health,safety , andwelfare of thecitizens of thecity; and(2) Establish reasonable and uniform regulations to prevent the harmful effectsassocia ted with late night entertainment businesses or nightclubs.

    Sec. 18-71 - D efinitions.

    The following words, terms and phrases, when used in this article,shall have the meaningsascribed to them in thissection,except where thecontext clearly indicates a differentmeaning:

    Breach ofthe peace means an act that disturbs the public order, including, but not limitedto, assault, unlawful possession of dangerous or deadly weapons, discharge of firearms andhomicide.

    Public EntertainmentBusinessshall not include taverns, bars, lounges,cocktail lounges andother drinking establishments with a capacity of less than one hundred fifty (150) persons.Thisexception does not apply when such establishments are hosting or sponsoring spec ia levents.

    EntertainmentPermitmeans the publicentertainment business permit required by thisCode.

    Secur ity Personnelmeans any person(s) who perform(s) security rela ted tasks on behalf ofthe permittee including, but not limited to: removing problem patrons from the premises,removing illegal contraband from patrons at the premises,checking identifications ofpatrons to ensure minimum agecompliance with local and sta te laws, and escortingpatrons from the premises.

    Sec. 18-71.1. - Exceptions.

    An entertainment business permit shall not be required for personsconducting, managingor operating a place of publicentertainment which isconducted in accordance with any ofthe following criteria:(1) On outdoor public property owned or controlled by thecity;(2) In city owned or controlled facilities; or(3) As an incidental or accessory use to the operation of a bona fide publiceating

    establishment .

    Sec. 18-72.- Permit required; application for permit.

    (a) No entertainment businessshall be allowed to operate without a valid publicentertainment permit issued by thechief of police . It shall be unlawful for anyperson to operate or cause to be operated a publicentertainment business withoutthe permit or without the presence of an operator who has been d isclosed pursuantto subsection (b)(9) of thissection.

Thecompleted application shall contain thefollowing information and shall be accompanied by the following documents:(1) The full true name of the applicant;(2) The full true name under which the publicentertainment business will be

    operated and, if the business will be operated in a name other than tha t ofthe applicant , a ce rtified copy of the assumed namece rtificate prepa red andrecor ded in the office of thecounty register of deeds pursuant to G .S. 66-68et seq.;

    (3) The type of publicentertainment business the applicant intends to operate or

    ;(4) Whether the applicant intends to serve alcoholic beverages at the publicentertainment business and/or apply for an A B C permit;

    (5) The address where the publicentertainment business is to be operated andwhere the books and recor ds are maintained and available for examinationby the tax collector;

    (6) If the owner of the real property upon which the publicentertainmentbusiness is to be operated is not the applican t, the name and address for theowner of the real property upon which the business is to be operated and acopy of the lease or rental agreement;

    (7) The principal telephone number to be used by theentertainment business;(8) If the applicant is:

    a. An individual, the applican t shall appear in person and deli ver acompleted and signed application form and provide the followinginformation:i. His present residence and business addresses and telephone

    numbers;ii . A valid driver's license or other government-issued p ictu re

    identification;ii i. Socia l security number; andiv . Date of birth, to include month, day, and year ;

    b. A partnership ,corporation, or limited liability company, theapplican t shall designate one of its general partners, office rs, ormanagers to act as its agent . Such person shall appear in person anddeli ver a completed and signed application form and shall provide thefollowing information:i. His present residence and business addresses and telephone

    numbers;ii . A valid driver's license or other government-issued p ictu re

    identification;ii i. Socia l security number; and

    e. A limited liability company , the person designated as agent in thelimited liability companys application for a permit shall also provide

    the following information:i. A ce rtified copy of the articles of organization, a certified copy

    of thece rtificate of authority, and a ce rtified copy of the mostrecent annual report filed with thesec retary of sta te;

    ii . The name, residence address and telephone number ,socia lsecur ity number , and date of birth, to include month, day , andyear , of each of itscurrent members, and of any memberholding 10 percent or more in terest in thecompany; and

    ii i. The name and address of thecorporation's registered agent forservice of process.

    (9) The name, residence address and telephone number ,socia l security number ,and date of birth, to include month, day, and year , of each individual whowill be an operator of the business;

    (10) A federal tax identification number assigned to the publicentertainmentbusiness and a completed tax information authorization form (IRS Form8821) authorizing only the verification of such number; and

    (11) A sketch or diagram showing theconfigura tion of the premises, including asta tement of total floor space occupied by the business. Thesketch need notbe to scale but must provide accurate measurements.

    (c) The application shall besworn to be true and cor rect by the applicant.(d) An applicant for a permit under thissection shall have a continuing duty to

    promptly supplement the application information required by thissection if theinformation changes in any way from what issta ted on the application. The

    applicant shall supplement the application on file with the vice and narcotics bureauwithin 30 days from the date of such change.

    (e) If the vice and narcotics bu reau determines or learns at any time that the applicanthas improperly completed the application for a publicentertainment permit, it shallpromptly notify the applicant of such f act and allow the applicant ten days to

    (f) The applican t shall be required to pay a nonrefundable application andinvestigation feeestablished by thecity manager .

    (g) Issuance of a publicentertainment permit does not excuse a permittee fromcompliance with any other applicab le ordinance, regulation, or statute. By issuing apublicentertainment permit, thechief of police has not determined that therec ip ient is in compliance with any applicab le local ,sta te, or federal regulation orlaw or that the rec ip ient is otherwiseengaged in a legal activity or operating abusiness in a legal manner .

    Sec. 18-73.- Issuance of permit.

    (a) Wi thin 30 days af ter receipt of a completed application for a publicentertainmentpermit, thechief of police will approve or deny the application for a permit. Upontheexpir ation of the 30th day, un less the applicant requests and is granted areasonableextension of time, the applicant shall be permitted to begin operating anentertainment unless and until thechief of police notifies the applicant of a denial ofthe application and sta tes the reason for the denial.

    (b) Thechief of policeshall deny the application for any of the following reasons:(1) An applicant or any individual identified in the application under section 18-

    73(b) (8) or (9) is under 18 years of age;(2) The application and investigation fee has not been paid;(3) An applicant or any individual identified in the application under section 18-

    73(b) (8) or (9) has refused to allow an inspection of the premises asauthorized by section 18-73;

    (4) An applicant or any individual identified in the application under section 18-73(b) (8) or (9) has overdue permit fees associa ted with the operation of apublicentertainment business;

    (5) An applicant or any individual identified in the application under section 18-73(b) (8) or (9) has a permit under this article that issuspended or revoked;

    (6) An applicant failed to provide the information necessary to determine thequalifications of the applicant or any individual identified in the applicationunder section 18-73(b)(8) or (9) for issuance of the permit, or providedmaterially false or misleading information on the application form;

    (7) An applicant or any individual identified in the application under section 18-73(b) (8) or (9) has been convicted of a cr ime:a. Involving:

    i. Any felony;ii . Any misdemeanor offense of or equivalent to G .S. 14-190.9,

    indecent exposure; G .S.14-202,sec retly peeping into room

    or the da te of release from confinement imposed for theconviction, whichever is the la ter date, if theconviction is for amisdemeanor offense;

    ii . Less than five years haveelapsed since the da te of convictionor the da te of release from confinement for theconviction,whichever is the la ter date, if theconviction is for a felonyoffense; or

    ii i. Less than five years haveelapsed since the date of the lastconviction or the date of release from confinement for theconviction, whichever is the la ter date, if theconvictions are fortwo or more misdemeanor offenses or combination ofmisdemeanor offenses occur ring within any 24-month period.An applicant who has been convicted of an offense listed insubsection (b)(7)a of thissection may qualify for a publicentertainment permit only when the time period required bysubsection (b)(7)b of thissection haselapsed. The fact that aconviction has been appealed has no effect on the denial of thepermit; or

    (8) The application demonstrates or reveals information showing that theproposed business fails to meet the requirements of this article.

    (c) The permit must be posted in the publicentertainment in a conspicuous placeat or near theentrance to the businessso that it can be read easily at any time.

    Sec. 18-74.- Annual permit fee .

    The annual permit fee of a publicentertainment businessshall beestablished annually bythe City Manager .

    An applicant or any individual identified in the application under section 18-72 (b)(8) or (9)shall permit entry of the City of G reensboros officers and employees for the purpose ofinspecting the publicentertainment premises and ensuring compliance with this articlepr ior to the issuance of a permit under this article.

    Sec. 18-76.- Waiting lines.

    The permitteeshall at all times manage waiting lines outside the premises to ensure thereare no impediments to pedestrian travel in the pedestrian walkway, no blockage of

    ace.

    Sec. 18-77.- On-site Operator.

    A t least one operator shall be on the premises at all times whileentertainment is beingprovided. Said operator shall cooperate fully with thechief of police , or any city officia lresponsib le for enforcing the provisions of thiscode, with any inquiry, inspection,reasonable request, or investigation necessary to implement the requirements of thiscodeor to enforce any other local,sta te or federal law.

    Sec. 18-78.- R eporting requirement .

    The permitteeshall report to thechief of police any conditions on the premises thatsubstantially affect the publicsafety which the permittee or the manager knows orreasonably should know exist at the time of occurrence .

    Sec. 18-79.- Public nuisance prohibited.

    The permitteeshall not conduct the permitted business in a manner that creates or resultsin a public nu isance, as defi ned in Chapter 17 of the Code of the City of G reensboro andthe North Carolina General Statutes.

    Sec. 18-80.- Event Promoters.

    Event promoters may only be used when such promoter knowingly and willingly agrees, inwriting, to abide by the provisions referenced herein . Theexistence of an event promotershall not absolve the owner of the publicentertainment business from any liability orresponsibility for violations of this Art icle that occurred dur ing the promoted event.

    Sec. 18-81.- Notices.

    Any notice required or permitted to be given by thechief of police or thecity managerunder this article to any app licant, permittee , owner , or operator of a publicentertainmentbusiness may be given either by personal deli very or by ce rtified United States mail,

Notices mailed as provided in thissection shall be deemed given uponthei r deposit in the United States mail and shall be presumed to have been received on thethird regular postal deli very day thereaf ter .

    Sec. 18-82.- Notice of violation and suspension of permit.

    (a) Thechief of policeshall issue a notice of violation if he determines that a permittee ,owner , operator , or employee has violated or is not in compliance with any sectionof this article. The noticeshall spec ify thesection of this article that has been

    (b) Thechief of policeshall initially suspend a publicentertainment permit for a periodof seven (7) calendar days if the violation has not been cor rected or abated withinfourteen (14) calendar days af ter the notice of violation has been received by thepermittee , owner , or operator. Thesecond violation will result in a suspension ofthir ty (30) calendar days. Any further violations will result in a suspension of one (1)year .

    (c) A dec ision by thechief of police to suspend a licenseshall not become final untilfourteen (14) calendar days af ter notice of the dec ision has been received by thepermittee , owner , or operator.

    (d) It shall be unlawful for any person to operate or cause to be operated a publicentertainment business and such person knows or should know that the business hasa permit which has been suspended.

    Sec. 18-83.- R evocation of permit.

    (a) Thechief of policeshall revoke a publicentertainment permit if a suspension of thepermit becomeseffecti ve following a notice of violation that was issued within 12months of theeffecti ve da te of a previoussuspension .

    (b) Thechief of policeshall revoke a publicentertainment permit if he determines that:(1) An applicant or permittee provided materially false or misleading

    information in the material submitted in the application process;(2) A permittee , owner , operator, or employee has knowingly allowed thesale,

    possession , or use of controlled substances in or on the premises;(3) A permittee , owner , operator, or employee of an adult publicentertainment

    hasserved alcoholic beverages to a patron in or on the premises in violationof G .S.ch. 18B;

    (4) A br each of the peace has occurred in or on the premises;(5) A permittee , owner , operator, or employee has knowingly permitted dancing

    or a live performance in or on the premises dur ing a period of time when thepublicentertainment permit wassuspended; or

    (6) A permittee , owner , or operator isconvicted of an offense listed in section 18-73(b) (7) a since the permit was issued. The fact that a conviction is beingappealed shall have no effect on the revocation of the permit.

    (c) A dec ision by thechief of police to revoke a permit shall not become final untilfourteen (14) calendar days af ter the permittee , owner, or operator has received

    (d) When thechief of police revokes a permit, the revocation shall continue for oneyear , and the permitteeshall not be issued a publicentertainment permit for oneyear f rom the date the revocation becameeffecti ve.

    (e) It shall be unlawful for any person to operate or cause to be operated a publicentertainment business and such person knows or should know that the business hasa permit that has been revoked.

    Sec. 18-84.- Appeal of denial,suspension , or revocation of permit.

    (a) After a denial of an application for a publicentertainment permit, a denial of an

    ion orrevocation of a publicentertainment permit, the applicant or permittee may appealthe denial,suspension , or revocation in wr iting to thecity manager with in 20 daysaf ter notice of the denial,suspension , or revocation has been received. Thecit ymanager shall hold a hear ing on whether to issue/renew the permit or uphold thedenial,suspension , or revocation within five days af ter the receipt of the appeal . Theapplicant or permitteeshall have the right to present evidence at the hearing. Thedec ision to issue/renew the permit or uphold the denial,suspension , or revocationshall be based solely on thecr iteria set forth in this article. Thecity manager shallrender a dec ision on the appeal within five business days af ter the da te of thehearing.

    (b) Upon receipt by thecity manager of a written appeal pursuant to subsection (a) ofth issection, a denial of an application for renewal of the permit or a suspension orrevocation of the permit shall bestayed until a dec ision is rendered by thecit ymanager . In addition, upon receipt by thecity manager of a written appealpu rsuant to subsection (a) of thissection, the denial of an initial app lication for apermit by any publicentertainment existing prior to theeffecti ve da te of theordinance from which this article derivesshall bestayed until a dec ision is renderedby thecity manager .

    (c) The dec ision of thecity manager issub ject to review in thesuperior cour t of thecounty by proceedings in the nature of ce rtiorari. Any petition for a writ ofce rtiorar i for review shall be fi led with theclerk of superior cour t within 30 daysaf ter notice of the dec ision has been received by the applicant or permittee. A denialof an application for renewal of the permit or a suspension or revocation of thepermit shall bestayed until a dec ision is rendered by thesuperior court or the timeto petition thesuperior court for a wr it of certiorari hasexpired. In addition, thedenial of an initial application for a permit by any publicentertainment businessexisting prior to theeffecti ve date of the ordinance from which this article der ivesshall bestayed until a dec ision is rendered by thesuperior court or the time topetition thesuperior court for a wr it of ce rtiorari hasexpired. The following shallapply to any appeal to superior cour t from a dec ision of thecity manager:

    (d) An appeal by an applicant or permittee from thesuperior cour t of thecounty shallbe governed by the North Carolina Rules of Appellate Procedure but , un less a courtof competent jurisdiction otherwise provides,such appeal shall not stay any actionta ken with regard to the permit.

    Sec. 18-85.- Transfer of permit.

    (a) A permitteeshall not transfer a publicentertainment permit to another person or toother premises. The transfer of a publicentertainment permit shall automaticallyand immediately revoke the permit.

    (b) Each publicentertainment permit shall expire one year f rom the date of issuanceand may be renewed only by making application, as provided in section 6-253, andpaying the annual permit fee , as required by section 6-255. Application for renewa lof the permit shall be made at least 30 days before theexpir ation date, and whenmade less than 30 days before theexpir ation date, theexpir ation of the permit shallnot be affected.

    (c) When thechief of police denies renewal of the permit, the applican t shall not beissued a permit under this article for one year from the date of denial. If,subsequentto the denial, thechief of police determines that the basis for the denial has beencorrected, the applican t shall be granted a permit.

    (d) It shall be unlawful for any person to operate or cause to be operated a publicentertainment and such person knows or should know that the business has apermit that hasexpired.

    Sec. 18-87.- Persons less than 18 prohibited in adult publicentertainments.

    I t shall be unlawfu l for a permittee , owner , operator, or employee of a sexually orientedbusiness or an entertainment establishment that serves alcohol.

    Sec. 18-88.Security.

    (a) The following security shall be provided at all publicentertainments:

" On site " means and includes al lpatrons within the premises and waiti ng in line to enter the premises;

    (3) Thesecurity personnel shall providesecurity inside the premises, along theoutside perimeter of the premises, and at parking sites immediately adjacentto the premises and used by patrons;

    (4) If found ,security personnel shall remove any illegal contraband frompatrons, report itsexistence to the G reensboro police department , identifythe person in possession of the il legal contraband and immediately turn it

    ;(5) All security personnel must be licensed as private protecti veservicesprofessionals pursuant to Chapter 74C of the North Carolina GeneralStatutes;

    (6) At closing time, thesecurity personnel shall be responsib le for clearing thepermittees patrons from the sidewalk and street areas in front of the

    premises and f rom other areas accessib le to persons around the per imeterand within one hundred and fifty feet of the premises;

    (7) While on duty, al l security personnel shall have a nameplatecontaining thesecurity personnels full name and the word SECURITY printed in bold,

    capital letters. The nameplateshall beexhibited prominently on theclothing,at chest level, and shall be visib le and easily read at all times. The nameplateshall be a minimum of two inches high and four inches wide, with therequired information pr inted in capital letters, at least three-fourths incheshigh and in a contrasting color . As an alternative to a nameplate, thesecuritypersonnels name and the word SECURITY may be embroidered on the

    meeting the abovespec if ications and located a t chest level;(8) The permitteeshall not allow any security personnel to, and no security

    personnel shall,sit at the ba r,consume alcoholic beverages or any controlledsubstance , be under the influence of alcoholic beverages or any controlledsubstance , or engage in any other violations of law while on duty;

    (9) The permitteeshall not allow any security personnel to be, and no securitypersonnel shall be, in possession of any fi rearm while on the premiseswithout first having obtained a license from the appropriatesta te or localagency authorizing thesecurity personnel to be in possession of a firearm;and

    (10) Security shall be responsib le for maintaining order at the premises and shallensure the patrons do not carry concealed weapons, including but not limitedto guns and knives.

    (b) No person shall operate a publicentertainment in violation of any applicab lesectionof this Code which pertains to fire prevention and protection or occupancy limits.Failure to pay fines assessed for violations of the F ire Code when dueshallconstitute a violation of this article and are grounds for revocation or non renewa lof the Public Entertainment Permit.     Sec. 18-91.- Penalties and remedies.

    Any person who knowingly violates any of the following sections of this articleshall beguilty of a class I misdemeanor and, upon conviction,shall be fined up to $500.00. Eachviolation shall beconsidered a separate and distinct offense, and each day of continuedviolation shall beconsidered as a separate offense. The issuance of a notice of violation or asuspension or revocation of a publicentertainment permit shall not prohibit the impositionof a civil penalty, and the imposition of a civil penalty shall not prevent the issuance of anotice of violation or a suspension or revocation of the permit.

    Sec. 18-92.- Civil injunction.

    In addition to the issuance of a notice of a violation, thesuspension or revocation of apublicentertainment permit, or a prosecution for criminal violations, any person whoviolates th is article may besub ject to all civil and equitable remediessta ted in G .S. 160A-175.
