President’s Message: Stan Hill

As I write this article I am preparing to travel to Boston to repre-sent you at the NAR Annual Convention. This has me thinking about a leadership training seminar that our RASCW Board of Directors was able to participate in last week.

We were facilitated by a national trainer who led our group in discussing various traits and qualities of leadership. The following is a list of some of the qualities of a leader:

Confidence; the ability to unify a group; to set an example and model behavior; adaptability and flexibility; being assertive with-

out being dogmatic; being both a teacher and a learner; finding common ground; the ability to encourage individuality; and not being afraid to fail.

These are some of the traits we voiced when encouraged to put our minds to the ques-tion of what makes a good leader. There are more, certainly, but you can see the direc-tion the group was taking. This discussion was followed by several scary story problems which were very instructive. I found the training session to be uplifting and hopeful.

Speaking of leadership, that session immediately followed on the heels of the RASCW Election of Officers for next year. I know you will be served well when I step down in January and pass the gavel to your next president, Scott Walker. Congratulations to Scott, and to Vice President-elect Sommer Von Behren, and Treasurer-elect Mike Lenz. Please wish them well when you see them.

On November 15th I will have the honor of addressing the attendees of the RASCW Annual Meeting at the Sheraton Hotel Madison. I hope to see many of you there. At that time we will hear a re-cap of 2018 and also hear from our guest speaker, Mike Theo, President and CEO of the Wisconsin REALTORS® Association.

And, believe it or not, we are only a few short weeks away from the RASCW Holiday Party, which this year is being held once again at the Beacon Lounge at Bonfyre Grill on December 3rd. Bring a toy, as this event doubles as a gift gathering drive for Toys for Tots. Marines in dress uniform will be there to assist with the drive.

As we enter into the holiday season I want to wish all of you well both personally and professionally.

New Rule for Listings Not to be Put on MLSFor all residential single family/ condominium list-ings with effective dates of November 15, 2018 or after, that the Seller has directed to be with-held from the SCWMLS database, the listing broker shall be required to submit the fully exe-cuted listing contract along with a completed Seller Certification to the SCWMLS office within 4 days of the effective date. Failure to do so may result in a fine.

In recent times, pocket-listings and other off-market approaches have become a concern, especially in markets with inventory shortages. These practices have drawn the interest of the United States Department of Justice as well as others in the real estate industry. Concerns over fiduciary, fair housing and ethical responsibilities are raised when these listings are not provided with the fullest possible market exposure.

SCWMLS Participants agree to enter their listings to the SCWMLS database unless the Seller spe-cifically directs otherwise. In order to document the Seller’s decision to prohibit submission of the listing to the SCWMLS database, the Board of Directors approved at their September meeting the use of a form - Seller Certification Authorizing Exclusion of Listing from SCWMLS. Please submit this form, along with the listing contract to the MLS via [email protected].

Recent Paragon™ Enhancements-The ability to measure distance from one point to another when searching using the map has been added. This measurement can be saved along with the map shape(s) as a point of reference. The new measure tool can be found under the Draw option within the map toolbar. Usage tip: After selecting the measure tool, single click on the map anywhere while you have a cross as your cursor….when your cursor turns into a hand, this will select listings, not draw measurement. -A share to Twitter option has been added along with the Share to Facebook option within Listing Maintenance. Find this new option under Integrations within the Select an Action box while in Maintain Listing. All Active, Pending, and Sold listings for which you are a listing agent can be selected to share via Twitter or Facebook. After clicking on Share to Twitter, you will be given a url to share. Add any message you want and select to Tweet. You will need to have a Collab Center site set up before you can take advantage of this new feature. If you are not currently using Collab Center, you can set up your site under Preferences (in the menu bar at the top of the screen).

-Agents with standard agent level security can now update the directions field, and the items included/excluded fields on their listings within Paragon™. In addition to these fields, agents have had the ability to update all pick list features, room dimensions, room levels, other room names, public remarks, broker-to-broker remarks, show-ing instructions, photos, virtual tours, associated documents, map location, open house date/time, broker open date/time/comments, and assess-ment/tax info for their listings.

Membership Renewal Notice

Thank you for renewing your Membership in the REALTORS® Association of South Central Wisconsin for 2019. By now you should have received your Membership Renewal invoice at your preferred mailing address.

As your local Association, it is our responsibility to collect dues on behalf of the Wisconsin REALTORS® Association (WRA) and the National Association of REALTORS® (NAR). Your Membership Renewal reflects the following:

• NAR dues are $150 plus a $35 Special Assessment for the Consumer Advertising Campaign for a total of $185.

• WRA dues are $333 for REALTOR® Members and $306 for State Affiliate Members. Renewals received after December 31, 2018 will be subject to the WRA reinstatement fees of $75 for REALTORS® and $25 for Affiliates.

• RASCW dues are $170 for both REALTOR® and Affiliate Members. Renewals received after December 31, 2018 will be subject to a $25 RASCW reinstatement fee.

There are three voluntary contributions included on your Membership Renewal.

• The first is a $15 contribution to the RASCW Housing Foundation. The Foundation is your non-profit corporation dedicated to mak-ing homes affordable by providing low interest, deferred payment loans to qualified individuals to be used for the down payment and/or closing costs associated with the purchase of a home. Contributions to the Foundation are tax deductible as a charitable contribution. Please consider making a contribution to assist a new home owner in 2019. • The second is a $35 contribution to RPAC. At the direction of the RASCW Board of Directors, these funds may be contributed on a nonpartisan basis to candidates for public office who support and protect the rights of home ownership and real estate interests important to your business.

• Lastly is a $20 voluntary contribution to the Wisconsin REALTORS® Foundation. Contributions to the Foundation are tax deductible as a charitable contribution.

Paying 2019 Membership Renewals

Please note that credit card payments will only be accept-ed online.

To pay by VISA or MC, go to www.rascw.org and click on the Pay Dues Online link at the top of the page. This service is handled by the National Association of REALTORS® (NAR) and is only available through December 31, 2018.

Exceptions to paying online: • The online service is not available to local Affiliate

Members (State Affiliate Members are able to use the online service.) Local Affiliate Members, please call the RASCW office at 608-240-2800 if you wish to pay your dues by credit card.

To pay by check, detach the lower half of your Renewal Notice and send check payable to RASCW, 4801 Forest Run Road, Suite 101, Madison, WI 53704.

All Membership Renewals received after December 31, 2018 will be subject to reinstatement fees. No exceptions will be granted.

New Senior and Elder Members

Are you eligible to be a Senior Member? You are if, on January 1, 2019, you are 60 years of age or older and have been a continuous Member of RASCW for at least 20 years. This means that you can reduce your local RASCW dues by 1/3 for 2019.

If, on January 1, 2019, you are 65 years of age or older with 25 or more years of continuous membership in RASCW or you are 70 years of age or older with 10 or more years of continuous membership in RASCW, you are eligible for Elder Status. Your local RASCW dues are then just $12.00 for 2019.

Please suPPort Your rasCW Housing Foundation!Included on your Membership Renewal is a voluntary $15 contribution to the REALTORS® Association of South Central Wisconsin Housing Foundation. Down payment assistance like our Housing Foundation Home Start program can help to improve affordability of a home for many buyers. Your dollars help individuals and families own their homes, which ben-efits all.

The RASCW Housing Foundation, a non-profit 501(c)(3) organization, makes available to qualified applicants a low inter-est, deferred payment loan to be used for the down payment and/or closing costs associated with the purchase of a home. Since 1991, the Foundation has given out over $2.6 million in loans to individuals and families in Southwest and South Central Wisconsin with family incomes at or below 80% of the county median income. The main source of the Housing Foundation’s funds come from the generous donations of RASCW REALTOR® and Affiliate Members. Because the Housing Foundation is a charitable organization, all donations are 100% tax deductible. In turn, we are able to give out 99% of the contributions we receive in the form of loans to borrowers due to the administrative sup-port we receive from RASCW, our parent organization. You can be assured that your contribution is being used to help provide affordable housing to those who need it most.

Reminder: Code of Ethics Training Required for all REALTORS® by Dec. 31, 2018

REALTORS®, including appraisers holding REALTOR® membership, are required to complete ethics training of not less than 2.5 hours of instructional time within two-year cycles. A new two-year cycle began January 1, 2017. The deadline for this cycle is December 31, 2018.

There are three ways to complete this training requirement:

New Member OrientationA REALTOR® completing Ethics Training as a part of the New Member Orientation is not required to complete additional ethics training for this period. We will have record of you completing this requirement if you have attended the RASCW New Member Orientation since January 1, 2017.

Continuing Education ClassesIf you have taken the 2017-2018 Continuing Education Course 4, Ethics and Best Practices, offered by the Wisconsin REALTORS® Association, we will have record of you completing this requirement.

Continuing Education providers other than the WRA may or may not meet the NAR requirements for course objectives and mini-mum criteria. You will need to confirm with your provider that approval has been received. If you have met the Ethics Training requirement by taking the CE course through a provider other than the WRA, please notify Beth at the RASCW office at [email protected] so it can be noted in your Membership record.

Opportunity Zones Proposed Rules ReleasedBy: Erin Stackley, Evan Liddiard, NAR Washington Report

On October 19, the Treasury Department released proposed rules for Qualified Opportunity Zones, a federal program created by the Tax Cuts and Jobs Act in 2017. The program incentivizes investment and development in distressed communities, desig-nated as "Qualified Opportunity Zones" (QOZs) through tax benefits for investors. These benefits include deferral of federal capital gains tax on qualified capital gains reinvested into a QOZ (via an "Opportunity Fund"), and potential reduction in the tax ultimately paid on those gains (if held for five years they receive a step-up in basis of 10%; if held for seven, 15%). In addition, gains accrued on investments while in an Opportunity Fund and invested into a QOZ may be exempted from federal capital gains tax, if the investments are from a proper deferral election (reinvested capital gains that the tax is deferred on) and held for at least ten years.

The proposed rules provide important clarifications for interested investors, including the type of gains eligible for tax deferral (capital only), how investments into Opportunity Funds made of both capital gains proceeds and non-gains funds are treated, the overall timeline for the program, how to certify an Opportunity Fund and meet the "90% asset requirement" (that 90% of a fund’s assets be held in a QOZ), and how they will determine that an Opportunity Fund has "substantially improved" a QOZ business property. Further proposed rules are expected on other aspects of the program, and the IRS will hold a hearing on the issue on January 10, 2019.

NAR is closely monitoring this issue and will provide feedback on the proposed regulations to ensure the program is successful. This topic was featured at the November 2018 REALTORS® Conference & Expo in Boston.

6 Things Professional Burglars Don’t Want You to Know

Even though a burglary occurs every 20 seconds in the U.S., you can still protect yourself without installing top-dollar security features.

Home burglary generally has a pattern; criminals are looking for an easy target they can rob fast. Learn from the pros. Here are six tips from career burglars you can use to defend your home and prevent break-ins.

1. Nighttime Burglaries Aren’t the Best TimeBurglars like to break in to homes during daytime hours—the last thing criminals want is to encounter someone at home. Weekdays are ideal for thieves, since weekend schedules are too unpredictable. Between 12:30 p.m. and 2:30 p.m. are the most popular times because there’s a high chance people will be away at work or school.

2. They Know When You’re Not Home—Thanks to Social MediaWhile it’s tempting to post about your vacation to your social media feed, wait to share those trip photos and exotic location check-ins until you’re back home. Criminals scout public social media accounts like Twitter, Instagram, Facebook, and Foursquare to find victims.

Locating someone’s home address using basic information from their social media profile is surprisingly easy. In one survey of convicted burglars, more than 10 percent say they used social media to determine who was out of town. The same survey found one burglar stole over $250,000 in electronics and jewelry from 33 women he saw in public—he used GPS data embedded in photos they posted online to find their homes.

Even if all your accounts are private, that old friend from high school or new neighbor down the street could be a potential criminal. Never post what times you’re not home or how long you’ll be out.

3. They Don’t Like Your Security PracticesBurglars want nothing to do with alarm systems (whether they’re from the best home security companies or not). Homes without a security system are almost 300 percent more likely to be targeted for a break-in. If you do install an alarm system, make sure you guard it with a strong code. Don’t use your house number or birthday, and clean any dirt or grease off your keypad so a burglar won’t guess your code based off the numbers you’ve hit the most. Unlocked windows, unused deadbolts, poorly lit homes, and residences without security systems are prime targets for burglars, so make sure you are using the security features you already have.

Also, tricks that make it look like you’re home really work, professional burglars reveal. Burglars run from properties that look like people are inside. Motion sensor lights, bright flood lights, and timed lights are inexpensive security features for a home’s exte-rior that scare criminals away. TVs or radios left on, as well as cars parked in the driveway, make burglars nervous that someone is home.

4. Great Targets Advertise Their Weapon SupplyIf you’re a proud gun owner, that won’t scare away burglars—it entices them. A gun is stolen roughly every two minutes in the U.S., so homeowners should be sure to always lock up their guns. NRA bumper stickers on a car or Smith & Wesson signs on a house advertises that there are lots of guns to steal.

5. Shrubs and Architecture Make Great Hiding SpotsTall bushes are favorites of burglars since they offer an obstructed view from the street and an easy way to hide from neighbors. Keep shrubs and large landscaping features trimmed. If you want big plants by your windows, choose something thorny that will detract a burglar, like roses or cacti.

Think twice about large architecture features, too, like fences, half walls, and big fountains. Thieves are searching for crimes of opportunity, and such decor elements give a burglar more time to hide and plot their method of entry. The best defense is a clear view of your front porch.

6. Valuables in the Open Help Them Decide on a TargetKeep your expensive items out of sight. You’re making it too easy for a burglar by advertising the type of valuables they can steal. Don’t leave a new MacBook in front of your first-floor kitchen window, iPads on your living room ottoman, or even a nice car in a garage window with a clear sight line to the street. Key hooks—especially with labels for each key—need to be concealed out of view from windows, too.

"A burglar appreciates such kindness, but you will find it expensive when you have to replace all the locks after a break-in," says Mike Fraser, former professional burglar and host of the BBC show Beat the Burglar.

Fraser also advises to leave large family calendars out of view. You’re inviting a break-in by detailing when you’ll be away, Fraser says. This advice goes for any ID documents, too. Mail or other personal information left in plain view is a gold mine for a criminal looking to easily steal your details for identity theft.
