reputed, most experienced khabaries for the disposal of the unserviceable, obsolete condemned

non-e-waste items, mentioned at Annexure-I without any guarantee, measurement, weight and

Submission of on-line bids:

1. Bids should be submitted only through on-line mode at CPPP website, i.e.

http://eprocure.gov.in/eprocure/app.

2. Bid documents may scan with 100 dpi with black and white option which helps in

reducing size of the scanned document.

3. The e-auction notice shall be submitted online in a single bid system. All the

pages of bid being submitted must be signed wherever required, and sequentially

numbered by the bidder irrespective of nature of content of the documents before

uploading. The offers submitted by Telegram/Fax/E-mail shall not be considered. No

correspondence will be entertained in this matter.

4. The bidders are required to submit soft copies of their bid electronically on the

CPP Portal, using valid Digital Signature Certificates. Make photocopy of EMD,

tender cost and “ 25% of bid price quoted in Bid form” in a single paper and

upload the same in CPPP.

5. Not more than one bid shall be submitted by one contactor or contractors having

business relationship. Under no circumstance father and his son(s) or other close

relations who have business relationship with one another (i.e. when one or more

partner(s) director(s) are common) will be allowed to tender for the same contract

as separate competitors. A breach of this condition will render the tenders of

both parties liable to rejection.

6. Tenderers who have downloaded the tender form the ITPO‟s web site

(www.inditrade fair.com) and Central Public Procurement Portal (CPPP) website

(https://emrocure.gov.in/epprocure/app) shall not modify the auction form

including downloaded price bid template in any manner. In case if the same is

found to be tampered/modified in any manner, tender will be completely rejected

and EMD will be forfeited and tender is liable to be banned from doing business

in future with ITPO.

7. Intending bidders are advised to visit ITPO website www.indiatradefair.com and

CPPP website https://eprocure.gov.in/eprpcure/app at least 3 days prior to

closing date of submission of tender for any corrigendum/addendum/amendment

as per the schedule as given in document control sheet/critical data sheet.

8. Bidders are required to enroll on the e-Procurement module of the Central Public Procurement Portal (URL: https://eprocure.gov.in/eprocure/app) by clicking on the link” On line bidder enrollment” on the CPP Portal which is free of charge.

General Terms and Conditions:

1. ITPO is the owner/seller/principle, will be hereinafter referred to as PRINCIPAL. 2. Cost of bidding: The Bidder shall bear all costs associated with the preparation

and submission of its bid and ITPO shall in no event or circumstance be held

responsible or liable for these costs, regardless of the conduct or outcome of the bidding process.

3. An Earnest Money Deposit, Tender Cost and 25% of bid price quoted in Bid

Form - (EMD) of Rs. 1, 49, 000 /- (Rupees one lakh forty nine thousand only),

25% of bid price to be quoted in the bid form as well as Cost of Auction

Document of Rs. 2100 /-(Rupees two thousand one hundred only) shall be

furnished in the form of only Demand Draft drawn on any scheduled commercial

bank in favour of "India Trade Promotion Organization” payable at New Delhi.''

4. The only hard copies of Demand Draft of E.M.D, cost of tender document & 25%

of bid price quoted in bid form must be placed in the sealed envelope- super-

scribed with “Tender Amount for Disposal of Scrap/Surplus / Unserviceable

/Obsolete non- e-waste Items”, plus tender reference no., 27-ITPO(6)/ST/2016-

2017 dt. 09/06/2017 shall be deposited on or before closing date and time by

yourself or your representative in tender box, kept in Store Division, Prantik

Building, Near Gate No.-01, Pragati Maidan, ITPO, New Delhi-110001. In case,

the hard copies of said documents like, EMD, Tender cost, 25% of bid price

quoted in bid form sent through courier or speed post, should reach the above

address sufficiently in advance of the closing date and time of tender.

5. The bidder should note that other relevant documents asked along with EMD,

tender cost and “25 % of bid price quoted in bid form” are to be submitted

through on line only. Instead of submitting the same through on-line, in case the

bidder will submit the hard copy of relevant documents and instruments asked

and the bid application will summarily be rejected.

6. Offer in the form of Cheques or Cash shall not be accepted towards and earnest

money deposit, cost of Tender Document and “25% of bid price quoted in bid

form” under any circumstances and in such cases, Tender document will not be

considered/rejected on the spot.

7. Tender, without EMD, “25% of bid price quoted in the bid-form” and Cost of Tender document will not be considered and rejected outright. Certified document will under no circumstances be entertained for relaxation of EMD and tender cost, if to do so, bid application will be rejected.

8. The EMD and “25% of bid price quoted in the bid form” of the unsuccessful Bidders, without bearing any interest, shall be released after the finalization of the tender.

9. The tender cost is non-refundable and non-transferable.

10. The EMD will be forfeited: If a bidder withdraws his/her bid during the period of validity or in case of a successful bidder, if the bidder fails to comply with the terms and conditions of the tender document.

GENERAL INSTRUCTIONS:

1. The bidder shall ensure that each page of the tender documents and all other

enclosures appended to it are numbered, signed and stamped by the person

authorized to sign the tenders, as a token of having read and understood the

terms and conditions contained therein.

2. All the tenders shall be prepared as per the prescribed format and submitted through on line in accordance with instructions in the tender document.

3. Inspection: Scrap non-e-waste items shall be kept open for inspection. The

interested tenderers accompanying with stores official may inspect the auctioned

items between 11.00 am to 5.00 pm. on all working days till 21/06/2017 except on

Saturday, Sunday and Public Holidays. The Tenderer(s) will be permitted to inspect

the items only once and they will not be entertained for a second/subsequent time.

Further they may not be allowed to take any photograph for auctioned items. The

tenderers should thoroughly satisfy themselves about the nature, conditions and

quality of material at the time of inspection.

4. Tenders will not be accepted after the time and date fixed for the receipt of tenders as set out in the Tender Notice or subsequent extensions, if any.

5. Conditional or Incomplete bid will not be considered and the same shall be rejected.

6. The highest acceptance responsive bidder will be decided on the basis of total

price value quoted in the bid form.

7. It shall be implied and taken for granted that the party has carefully gone through and understood the terms and conditions of E-Auction including the amendments, if

any, prevailing at the time of bid. No complaints or objections shall be entertained by

ITPO or the Authorities after the Bid is opened/accepted.

8. ITPO does not give any warrantee or guarantee for the quality, chemical

composition of the lot or about the end use or fitness for a particular purpose.

9. All bidders are requested to scan all the auction document along with Annexure I-

IV, copies Pan Card, Address Proof like, Voter-Id Card/Aadhar Card/Driving License/

Pass port, Colour Photograph of bidder and would upload the same duly signed and

stamped in CPP Portal. In case, ITPO reserves the right to verify the original

document, as and when required.

LEGAL:

1. ITPO shall not be responsible for any injury or death of any worker at site due to

accident or malfunctioning of the equipment or by negligence of staff during the

course shifting of condemned items from Pragati Maidan.

2. No payment will be made to the bidder for damage caused by rains or other

natural calamities during execution of the work and no such claim reduction in bid

amount on this account will be entertained.

3. The individual/firm shall be responsible for proper entry of workmen at the entry

gate of Pragati Maidan and should get register them in entry register kept with the

guard. Gate entry passes will be issued from ITPO to Successful Bidder for

removing the auctioned items.

4. No man power shall be engaged below 18 year of age.

EVALUATION CRITERIA:

1. Bids shall be opened by the Committee. Bidders or their authorized

representative along with proof of Identity (not more than one) may attend, if they

wish at the time of down loading from CPPP.

2. E- Auction Result/Status

Immediately after successful closing of E-Auction, an intimation will be issued by

e-mail to the Highest Bidder advising him to contact further course of action with

ITPO, as per Auction Notice. Also Price quoted in each Bid Form (on-line) will

automatically be visible to participating bidders.

General Information:

1. The contact point for visit or for any inquiry would be Manager (Stores), or in

charge of Stores, Prantik Building, ITPO, Near Gate no.-01, Pragati Maidan, New

Delhi-110001.

2. The items shall be sold to the highest responsive bidder by way of “as is where is

basis and whatever there is basis”.

3. The category of the most items, which are to be auctioned, are given in

Annexure- “ I ” by way of “as is where is basis and whatever there is basis”.

4. The Earnest Money Deposit (EMD) of successful highest responsive bidder, if

agreed, shall be adjusted from the full & final remaining payment to be deposited

with ITPO.

5. The successful bidder must arrange full balance payment after adjusting “25% bid

price quoted in bid form” and EMD, if agreed, in the form of Demand Draft in favour

“India Trade Promotion Organization”, payable at New Delhi within two days after

confirmation, failing which the offer will be cancelled and the EMD & 25% quoted bid

price shall be stand forfeited. No further correspondence will be entertained in this

regards.

6. No item once disposed off to the successful bidder shall be taken back by this

Office on any condition whatsoever.

7. The successful bidder will be required to lift all the items from the disposal sites

within seven days after making the full & final balanced payment. On failure to do so,

this Office shall have the rights to forfeit the entire amount of the bidder and dispose

the items to next higher bidder. The Purchaser(s) will be allowed to take delivery of

stores during office hour of ITPO with prior intimation.

8. It will be the responsibility of the appointed firm to meet transportation, food,

medical and any other requirements in respect of the persons deployed by him. The

tools and tackles will be arranged by the firm itself.

9. No damage should be caused to the existing property of ITPO, or any other

Offices in the premises, roads, drains etc., while removing the auctioned articles

from the site.

10. This Office shall not be responsible for damages, losses, claims, financial or

other injury to any person deployed by successful bidder during the course of their

performing the functions/duties, or for payment towards any compensation/ accident

suffered by any person due to negligence or action of the successful bidder and his

authorized worker/supervisor will have to be indemnified by the successful bidder.

11. The successful bidder will have to take away all condemned/scrapped non-e-

waste items by way of “as is where is basis and whatever there is basis” at its own

cost and expenses and not selectively. The successful bidder shall not be provided

with any manpower or any equipment or expenditure etc. by owner (ITPO) for

dismantling/loading/unloading etc. No claim shall be entertained by ITPO for

shortage / inconvenient / condition of any items, if any.

12. The bidder should quote the rate in Indian Currency both in figures and words.

Any overwriting or erasing in the figures shall not be considered for acceptance of

the rates offered by the bidder. Rates should be quoted for the entire items in one

lot. Part rate or conditional rates will not be considered for acceptance.

13. Bidder must enclose copy of address proof (Voter Id Card/ Aadhar Card/Driving

License/ Pass port), colour photograph and PAN Card along with e-bid application.

14. All Taxes and Duties should be paid extra, as applicable, at the time of taking out

the materials from Pragati-Maidan.

15. The amount of the bid price shall be valid for a period of 90 days for acceptance

from the date of opening of the bid.

16. Bidders cannot withdraw/amend their offer once it is submitted to ITPO, Pragati

Maidan, New Delhi-110001.

17. The personnel employed for the disposal action (job) shall strictly obey the Safety

Rules in force while working in Pragati Maidan, New Delhi. Smoking and Drinking of

Alcohol is prohibited within precinct of Pragati Maidan, ITPO.

18. The successful tenderer with highest bid price will be issued a “sale release

order” and must arrange full balance payment in the form of Demand Draft within 2

days. Any additional payment, if required, the same shall be made to ITPO before

taking delivery of the material on the “as is where is basis and whatever there is

basis”.

19. In case the bidder fails to pay the full payment within 2 days of receipt of sale

order, his/her EMD & 25% of bid amount quoted are liable to be forfeited and his bid

will be cancelled. The agency will be barred participating from any future auction of

ITPO.

20. The bidders are required to indicate their PAN Number in their offer since it is

mandatory.

21. ITPO, New Delhi also reserves the right to accept/reject the offers or cancel the

whole tender proceedings without assigning any reason whatsoever. The decision of

ITPO, New Delhi will be final and binding on the bidder(s). Bidders are not entitled to

claim any damage or compensation in case of such cancellation.

22. In case the opening day of tender becomes a holiday, the tender shall be

opened on the following working day at the same time and venue.

23. Tender form in Pencil, overwriting illegible or erased will not be considered.

24. The successful bidder will not be entitled to resell any of the articles/items while

they are still lying within the premises of this Office and no delivery would be

affected by this Office to any person or person(s) other than the bidder whose

name/names are mentioned in the Order.

25. ITPO Employees and their families are not allowed to participate in the e-auction.

26. QUALITY & QUANTITY: The items are offered purely on „“as is where is basis and whatever there is basis”. Pick and choose method of collection is strictly

prohibited.

27. The Purchaser(s) must not indulge in any corrupt or unlawful practice while

executing the contract. If any such case is reported and established, the ITPO will

have full rights to forfeit the Security Money and “25% of bid price quoted in bid

form” and cancel the contract besides initiating action as per legal provisions.

28. In case the purchaser/bidder intends to take delivery of auctioned material

through his representative, he should give the letter of authority duly counter signed

by him.

29. The Organisation will not take any responsibility for arranging export permit,

transport and wagon etc. to purchaser/bidder.

30. In the event of infringement of any terms and condition by the purchaser/bidder,

the ITPO at its discretion, may forfeit the security money, and “25% of bid price

quoted in bid form” made by the purchaser/ bidder.

31. ARBITRATION/JURISDICTION: The contract shall in all respect be construed

and operated as an Indian Contract and in accordance with the Indian Laws in force

and subject to exclusive jurisdiction of Delhi High Court.
