Definit ions

' T H E A C T " means the Environment Protection Act 1993.

" T H E A U T H O R I T Y " means the Environment Protection Authority established under Division 1 of Part 3 of the Act.

" A U T H O R I S A T I O N F E E P A Y M E N T D A T E " means the anniversary of the grant or renewal of this authorisation.

" C O N S I G N M E N T A U T H O R I S A T I O N " means an approval which includes a unique identifier granted by an agency or a facility delegated by an agency in the jurisdiction of destination to allow the movement of Controlled Waste.

" C O N T R O L L E D W A S T E " Waste as defined in the National Environment Protection (Movement of Controlled Wastes between States and Territories) Measure 1998.• ~ , : ' . r

" E N V I R O N M E N T A L H A R M " means the same as is defined in section 5 of the Environment Protection Act .1993. ,

"LIQUID W A S T E " Waste classified as liquid waste in accordance with the assessment process set out in the guideline Liquid waste classification test, 2003. Note: Liquid waste that is liquid at 20 degrees Celcius regardless of whether or not it is packaged or otherwise contained, and irrespective of whether or not the packaging or container is to be disposed of together with the liquid that it contains.

1. THIS L I C E N C E IS A M E N D E D DURING T H E T E R M O F T H E L I C E N C E , P U R S U A N T T O C O R R E S P O N D E N C E S E N T 22 F E B R U A R Y 2011, A N D L I C E N S E E ' S C O N S E N T GIVEN O N 25 F E B R U A R Y 2011 (BY EMAIL).

2. This licence does not permit any activity in breach.of any other approval by any other authority. For example, this licence does not permit any activity on the Premises which is not authorised under the Development Act 1993. It is the responsibility of the Licensee to ensure that any action or activity referred to in this licence is permitted by, and is carried out in compliance, with, statutory requirements.

3. This licence is subject to the Act. '

4. Conditions of this licence can be varied by the Authority in accordance with section 45 of the Act.

5. This licence can be suspended, cancelled or surrendered during the term of the licence in accordance with sections 55 and 56 of the Act.

6. T h e Licensee must report to the Authority (on E P A emergency phone number 1800 100 833) all incidents causing or threatening serious or material environmental harm, upon becoming aware of the incident, in accordance with section 83 of the Act . .

7. .The Licensee must be aware of, and comply with: .1, the requirements of the Environment Protection Policies which operate pursuant to the Act; and 2. the requirements of any National Environment Protection Measure which operates as an Environment Protection Policy under the Act. NB: These requirements govern permissible procedures and protocols,"emission or concentration levels, as well as operation and/or maintenance standards of plant and equipment.

8. Should the conditions of this licence require that the.Licensee submit a report or other information to the Authority, then that report or that information becomes the property of the Authority.

9. T h e Authority undertakes to provide written advice within 14 days of receipt of all information required for assessment. . \

The Licensee is authorised to conduct the prescribed activities as described in this iicence on the Premises nominated, subject to the following conditions:

(212-31) T E M P E R A T U R E A N D T H E R M A L LOADING '

The Licensee must ensure that:

• 1. the average weekly temperature rise across all operating units • measured at the "condensers does not exceed' 10.5 degrees-

Centigrade under normal conditions where two cooling water pumps are in operation for each unit (the maximum thermal load);

2. water temperatures are measured immediately before and after the condensers by resistance thermometers;

• 3. in the event of abnormal unit operation caused by nori-availability of a • cooling water pump the combination of condenser temperature rise and flow rate represents a thermal load that does not exceed the maximum thermal load; and

4. ; the Authority is advised in writing within one working day of the , Licensee becoming aware of an exceedance of the maximum . thermal load. . .

2. (212-46) - U S E O F M E X E L 432 T O D O S E C O N D E N S E R C O O L I N G W A T E R

The Licensee, in the event of the sodium hypochlorite generation plant being unavailable, is authorised to dose Mexel 432 into the • condenser cooling water system provided that:

1. the concentration of Mexel 432 in the discharge cooling water does not exceed 0.5 milligrams per litre; arid

2. Mexel 432 remains an approved chemical for this purpose by the Australian Pesticides and Veterinary Medicines Authority.

3. (305-489) MONITORING P L A N . •

The Licensee must:

1. maintain a monitoring programme to the satisfaction of the Authority in relation to its discharges into the marine environment, particularly with respect to thermal load;

2. verify the monitoring programme every two years, according to E P A Guideline 649/06 entitled 'Regulatory monitoring and testing

independant verification requirements' dated December 2006; and

3. submit a copy of the independant verifiers report to the Authority, within 28 days of receipt.

4. (315-463) C O N T I N G E N C Y P L A N

The Licensee must implement and maintain the document entitled 'Torrens Island Power Station Emergency Procedures', identified by the number 174036.

5. (400-15) N O D I S C H A R G E T O C O A S T A L W A T E R S

T h e Licensee must not allow the discharge, emission or deposit of pollutants into coastal waters that causes any visible debris, oil scum or other'objectionable matter or odour at the discharge site.

6. (80-48) F R I A B L E A S B E S T O S M A N A G E M E N T

The Licensee must:

1. Store and handle friable asbestos in accordance with the document entitled ' C o d e of practice for Asbestos-Work (Excluding Removal) and the C o d e of Practice for the Safe Removal of Asbestos.

2. When bags containing friable asbestos are to be removed from an elevated position, lower those bags in a harness, net or secure handling device;

3. T o reduce bag handling, place loaded bags in crates or metal drums, as specified in paragraphs 4 and 5, as soon as practicable, but in any case within 2 days of production.

4. C R A T E S

Only place bags containing friable asbestos within crates that:

4.1. are not more than 1.2 metres in height, 1.6 metres in width and 3 metres in length;

4.2. are constructed of materials capable of containing the weight of the asbestos without collapsing when mechanically lifted;

4.3. are lined internally with polyethylene sheeting of no less than 200 micrometres thick;

4.4. have a lid that can be secured and will remain intact and in place during transportation and handling;

4.5. have the lid.naiied or bolted shut and have been banded with metal straps equally spaced twice around the width and length of the crate;

4.6. are sealed with duct tape,

4.7. are clearly labelled on two sides and the top with the words:

5.6. are clearly labelled on the outside surface with:

5.6.1. the word "Asbestos"

5.6.2. the U N No. 2212,

5.6.3. a class 9 label and

5.6.4. the name and address of the consignor.

6. Only use secondhand drums if they have been painted to eliminate the description of previous contents.

L is ted Waste Management Condi t ion(s)

(80-45) L ISTED W A S T E M A N A G E M E N T

T h e Licensee must:

1. Store listed waste in accordance with the relevant Australian Standards that applies to that waste.

2. Ensure that listed waste is transported to a waste depot licensed by the Authority to receive that waste by:

2.1. A person who is licensed by the Authority to transport that waste, or

2.2. A person who is not transporting that waste for fee or reward.

3. Provide an emergency spill kit at the collection and loading point of listed waste:

4. Store any substances that, by their nature or amount, have the potential to cause environmental harm to surface waters or groundwater, in accordance with the E P A Guideline entitled 'Bunding and Spill Management' updated June 2007.

8. (400-203) I M P O S E O R V A R Y L I C E N C E CONDIT IONS - L ISTED W A S T E

T h e Authority may impose or vary conditions during the term of this licence relating to handling and disposal of Listed Wastes.

Abras ive Blast ing Condit ion(s)

9. (30-16) A B R A S I V E B L A S T I N G

T h e Licensee must:

1. undertake all abrasive blasting of items within an approved blast chamber that:

1.1 are not permanently fixed to a building or structure; or

1.2 do not weigh more than 25 tonnes; or

1.3 are of a size that allows movement within a blast chamber;

2. ensure that particles generated during blast cleanining within a blast booth are collected and directed to a suitable pollution control device;

3. undertake all abrasive blasting of items outside of an approved blast chamber that:

3.1 are permanently fixed to a building or structure; or

3.2 weigh more than 25 tonnes; or .

3.3 are o f a size that prevents movement within a blast chamber;

4. notify the E P A in writing at least two working days prior to undertaking abrasive blasting outside of the blast chamber;

5. when undertaking abrasive blast cleaning outside of a blast chamber:

5.1 use aluminium oxide (or a silica free abrasive);

5.2 ensure that all the abrasive blast cleaning area is enclosed or screened with 'Power Clad' plastic sheeting or impervious reinforced synthetic sheeting or heavy duty tarpaulin to minimise dust or drift from the blasting area;

5.3 erect signs at the blasting site, clearly warning of the dangers of airborne dust; and

5.4 ensure that spent abrasive and particle matter is effectively collected and removed from the blast site at the end of each day of blasting activity; ^

N O T E : With respect to paragraph 4 of this condition - In the event the Licensee needs to undertake unscheduled abrasive blasting outside of the blast chamber (to secure supply of electrical power or the need arises during maintenance activities), prior notification is not required. However, the Licensee must notify the Authority in writing on or before the next working day as to the unscheduled abrasive cleaning conducted and the nature of the circumstances that required such abrasive blasting without prior notice.

Waste Transporter Management Condit ion(s)

10. (80-43) L ISTED W A S T E T O B E T R A N S P O R T E D WITHIN S A

1. The Licensee must not cause or permit any waste on list 1, attached to this licence, to be removed from the Premises for transport to a place within South Australia unless:

. 1 . 1 the Licensee has completed Part 1 of a W T C regarding that waste; and

1.2 the transporter has completed Part 2 of that W T C , and

1.3 the transporter has provided the pink and green copy of that W T C (with parts 1 and 2 completed) to the Licensee.

2. The licensee must:

2.1 retain the green copy of W T C s for no less than 12 months; and .

2.2 provide the white, yellow and blue copies o f the 'WTC (with parts 1 and.2 completed) to the transporter at the.time of collection of the waste; arid

2.3 provide the pink copy of the W T C (with parts 1 and 2 completed) to the Authority within seven days of collection of the waste.

3. The Licensee must not cause or permit any waste on list 2, attached to this licence, to be collected from the Premises for transport to a place within South Australia unless a W T F is completed regarding that waste.

4. .The Licensee must retain the green copy of W T F s for not less than 12 months.

11. (80-44) P R O D U C T I O N O F C O N T R O L L E D W A S T E T O B E T R A N S P O R T E D F R O M S A T O A N O T H E R S T A T E O R T E R R I T O R Y

1. The Licensee not cause or permit any Controlled Waste, as detailed-^ in the list attached to this licence, to be collected from the Premises

for transport to a place outside South Australia unless:

1.1. The licensee has:

1.1.1. obtained a consignment authorisation from the appropriate environmental agency in the state or territory of destination of that

. waste, a n d . . ,

1.1.2. completed Part 1 of W T C regarding that waste, and

1.2. The transporter has: .

1.-2.1. completed Part 2 of that W T C , and ,

1.2.2. has provided the pink and green copy of that W T C (with parts 1 and 2 completed) to the Licensee.

2. The licensee must:

2.1. retain the green copy of W T C s for no less than 12 months, and

2.2. Provide the white, yellow and blue copies of the W T C (with parts 1 arid 2 completed) to the transporter at the time of collection of the waste, and

2.3. provide the pink copy of the W T C (with parts 1 and 2 completed) to the Authority within seven days of collection of that waste, and

2.4. complete the green tear off slip at the bottom of the W T C and provide it to the appropriate environmental agency in the state or territory of destination of that waste within seven days of collection of that waste.

G e n e r a l Administrat ive Condit ion(s)

12. (400-338) If the Licensee's name or postal address (or both) changes, then the Licensee must inform the Authority within 28 days of the change occurring.

13. (400-339) The Licensee must display a copy of this licence on a notice board at the Premises.

14. (400-215) The Licensee must ensure that every employee, agent or contractor responsible for carrying out any task controlled by this licence is properly advised as to the requirements of this licence and the general environmental duty under section 25 of the Act that relate to that person's tasks and responsibilities as employee, agent or contractor.

15. (400-201) IMPOSE O R V A R Y CONDIT IONS

The Authority may during the term of this licence impose or vary conditions:

in relation to testing, monitoring and reporting referred to in section 52(1 )(a) of the Act;

which require the Licensee, in accordance with section 53 of the Act, to prepare a plan of action to be taken in the event of an emergency;

which require the Licensee to develop an EIP as set out in section 54 of the Act and to comply with the requirements of the EIP;

which relate to provision of information relating to the Licensee or any agent or contractor undertaking any activity on behalf of the Licensee pursuant to this licence; and

which relate to provision of information relating to the activity subject to the licence including the levels of inputs and outputs and the amounts of pollutants or waste generated by the activity.

16. (400-347) C H A N G E to P R O C E S S EMISSIONS or W A S T E

The Licensee must:

1. not undertake changes to operating processes at the Premises

without written approval from the Authority, where such changes:

1.1 have the potential to increase the emissions, or alter the nature, of pollutants or waste currently generated by or from the licensed activity; or

1.2 have the potential to increase the risk of environmental harm; or

1.3 would relocate the point of discharge of pollution or waste at the Premises;

2. ensure that written application is submitted to the Authority on the E P A form entitled'Application for Change to Process Emissions or Waste', that details the proposed changes; and

3. pay the prescribed application fee indicated on the Application form.

N O T E 1: The Authority may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

17. (400-348) A L T E R A T I O N S to P L A N T and E Q U I P M E N T

The Licensee must:

1. not construct or alter a building or structure, or, install or alter any . plant or equipment at the Premises, without written approval from the Authority, where such changes:

1.1 have the potential to increase the emissions, or alter the nature of pollutants or waste currently generated by, or from the licensed activity, or

1.2 have the potential to increase the risk of environmental harm, or

1.3 would relocate the point of discharge of pollution or waste at the Premises;

2. ensure that written application is submitted to the Authority on the E P A form entitled 'Application for Alterations to Plant and Equipment' that details the proposed changes; and

3. pay the prescribed application fee indicated on the Application form.

. N O T E 1: The Authority may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

N O T E 3: In some circumstances installation of plant and equipment may be subject to consent under the provisions of the Development Act, which may have priority over the obligations of this condition -check with the licence coordinator for advice prior to completing the Application form.

18. (400-78) The Licensee must:

1. submit an annual return at least 90 days before the authorisation fee payment date, if this, licence is for a term of two years or more; and

2. pay the annual authorisation fee by the authorisation fee payment date.

19. (400-79) A n application for renewal of this licence must be made at least 90 days before the expiry date of this licence.
