Proposed Change (if applicable - variation only): We would like to propose changes to the following clauses: 21. The supply of alcohol at the premises shall
only be to a person seated taking a table meal there and for consumption by such a person as ancillary to their meal. 22. The supply of alcohol shall be by
waiter or waitress service only. Our facilities are sports facilities with limited seating facilities and limiting sales of alcohol to address this condition is quite
challenging. What is more, our facility has a lot of perfect spots for picnic that people take advance of in summer months. Allowing our customers to have a
glass of Pimms on a picnic blanket would make a big difference to us. Our customers visit the centre to take part in sports activities and allowing customer to
have a drink while taking part in games like lawn bowls would be appreciated. It is not so common that our visitors purchase a sit down meal and them move
on to playing sports. Allowing a leisurely drinks for our customers while exploring and taking advantage of the outdoor facilities would translate into more
customers coming to use our facilities and while doing so, they would remain active. As part of our operations we also run sports events during summer
months. Many of them revolve around sports activities where the guests are after the activity, not the sit down meal. The clause about alcohol being sold by
waiter or waitress service only is also very challenging for us. The current size of our cafe stipulates the size of our catering team and waiting service is
currently not offered, with the exception of the supply of alcohol. It is not likely that the increased consumption of alcohol would translate into any alcohol
related issues and our staff are regularly trained on our alcohol policy. We feel that amending these clauses would be a win-win change for everyone involved.

Saturday and 08:00 to 23:00 on Sunday. The applicant also sought the sale of alcohol 10:00 to 23:00 Monday to Thursday, 10:00 to 00:00 Friday to Saturday
and 10:00 to 22:30 on Sunday.
The Applicant’s Representative advised that his client was seeking provisional statements to enable a degree of certainty for licensable activities; the tenants,
once in place would then submit their own licence application. The Sub-Committee were then taken through a presentation of the development and premises

units, which illustrated the old site and what the new completed development would look like. A representative for the applicant explained that the
development would consist of both residential and office spaces, two restaurants, two deli/cafes and one bar.
The applicant’s representative advised the Sub-Committee that the current development has been built on a proportion of the demolished Weatherspoon’s
and his client currently hold the premises licence. When discussing the bar, the applicant’s representative felt that exception should be granted, referring to a
50% reduction in capacity, surrendering the current licence, no outside seating and WCC policies 2.4.6 and 2.4.7.
The Sub-Committee queried if the applicant would consider conditions MC66 for the restaurant’s and MC38 for the deli/café’s, with additional conditions to
safeguard residents. The Sub-Committee also queried the types of tenants that the applicant had considered for the development/units. The Metropolitan
Police maintained its objections because in the CIA, however were not able to add any conditions at this stage not knowing who the final operators will be.
Environmental Health were satisfied with the application, however sought more reassurance that the restaurants and deli/cafe’s would comply with MC66 and
MC38. The Licensing Authority maintained its objections advising that the restaurants were not compliant with full MC66 conditions and the bar was contrary
to policy in the CIA.
The Sub-Committee granted all five applications. In determining the applications, the Sub-Committee noted that exception had been, proved referring to
WCC polices 2.4.6 and 2.4.7. The Sub-Committee ensured that the proposed hours were brought in line with core hours; MC66 and MC38 were added to the
restaurants and deli/café’s respectively, with additional conditions not allowing for the take away of hot food. The Sub-Committee were also satisfied that
both the Police and Environmental Health concerns had been addresses and that development would not add to the CIA.
Queens Ice Club, 17 Queensway, London, W2 4QP/ Lancaster Gate Ward/Queensway & Bayswater Cumulative Impact Area
This was an application to vary the premises licence, remove, amend and vary licensable conditions for a new refurbishment. The applicant was not seeking
any changes to hours or capacity, but for the addition of 25 private functions and to serve alcohol in its new cafe’s. The Sub-Committee were most concerned
with the cafe’s serving alcohol after 7pm where this was not ancillary to a meal; they were also concerned with ensuring that the nature of the premises would
not be changed.
Environmental Health maintained its objections and sought more information on the 25 private functions. The licensing Authority also maintained its
objections with concerns that the cafe’s could become drink lead after 7pm. The applicant maintained that this was a family premises, which promoted

culture, history, family entertainment and physical activity. The Police had earlier withdrawn its representation and unusually the applicant was supported by
SEBRA, who were able to provide the Sub-Committee with the history of the premises.
The Sub-Committee granted the application. In determining the application, the Sub-Committee noted no increase in hours or capacity and no residents had
objected. It also noted the history and that this was the only permanent ice rink in central London. The Sub-Committee also considered that the Police had
withdrawn their representation and felt that the conditions added to the premise licence would assist the applicant in upholding the principles of the licensing
objectives.
29 Duke Street, London, W1U 1LF, Marylebone High Street Ward /not in cumulative impact area
This was an application for two Temporary Event Notices to allow extended use of the outside area for licensable activities during the summer period. The
applicant sought to extend its hours from 23:00 to 01:00 on 29.06.18 and 06.07.18, with all the conditions attached to the current licence remaining. The
Applicant’s representative advised that there was no evidence premises would cause a public nuisance, the bar opposite the applicant’s had a licence that
allowed them to operate outside until 01:00 and that his client would stop serving alcohol at 23:00 in compliance with current licence.
The Police had earlier withdrawn its objections, however Environmental Health maintained their objections advising this was contrary to policy and that there
had been a number of resident complaints in relation to the bar opposite the applicant’s premises.
The Licensing Sub-Committee upheld the objections and issued a counter notice to stop the event. In making its decision, the Sub-Committee acknowledged
that the application was not in line with policy and would cause a public nuisance.
