BENEFIT CUTS
It is now well documented that a
number of welfare benet cuts
have been imposed following theGovernment comprehensive
spending review. Nowhere are
the eects felt more than in peo-
ple who are ill or disabled. Rich-
ard Hawkes, chief execuve of
the disability charity Scope, said:
"The government has not deliv-
ered on its promise to support
disabled people into work, pe-
nalising those on ESA and
jobseekers' allowance who have
worked and paid naonal insur-
ance in the past and who now
cannot rely on geng the sup-
port they need when they need
it, in an increasingly dicult em-
ployment market. Disabled peo-
ple and their families do not
have 'broad shoulders', so why
are they bearing the brunt of
these cuts?"
As any adviser dealing with cli-
ents on Employment and Sup-
port Allowance (ESA) will be able
to tell you, the situaon is reach-
ing crisis point. Advisers are now
spending vast amounts of their
me aending appeal tribunals
for ESA.
ESA replaced Incapacity Benet
and is for people who have a lim-
ited capability for work due to an
illness or disability. It can be ei-
ther contributory or income-
related, and claimants either get
the work-related acvity compo-
nent or the support component.
Claimants on the work related ac-
vity component are subject to
regular medical and work capabil-ity assessments, where they are
assessed on a number of funcons
relang to mobility and cognive
funconing.
The descriptors are very limited
and dont cover issues like inca-
pacity due to severe mental
health problems.
Many of our clients have been
aected and have had their ESA
stopped aer aending an assess-
ment. We are appealing on their
behalf and have several rst-er
tribunals coming up, and predict
more and more as the benet cuts
really take hold. So far we have
been successful on behalf of our
clients. We eecvely challenged
the decision in the case of N, a
young Ethiopian woman with se-
vere learning dicules who can-
not even write her own address,
and yet she was assessed as t for
work. The DWP accepted our sub-
mission and made a decision inMiss Ns favour without going to
tribunal.
We have just had a successful out-
come at the tribunal regarding the
case of Mr H, a Sri Lankan client
with a severe heart condion,
hearing impairment and mentalhealth diculty who was deemed
t to work.
These clients are lucky in that
they have someone advocang
for them.
How many more are there who
have no one to speak up for
them? What will happen to those
people?
The needs of clients who have
had their benet stopped far out-
weighs the resources of organisa-
ons dealing with the problemand its only going to get worse
when the Universal Credit comes
into eect.
