There is no cure for
the disease and treatment

not as deadly as dengue,

Chikungunya had

the 1990s but increase of
cases were noted in the
last two years.
We advise the pub-

Cerro said chikungu-

rash similar to dengue and
mostly affects adults.
According to the
World Health Organiza-

is a viral disease spread by
mosquitoes that causes fe-

Its symptoms include
muscle pain, headache,
nausea, fatigue and rashes.

Assessed values of lands ofsome Leyte municipalitiesare even higher, Lim added.
The BLGF has been re-minding local officials toupdate their local revenuecode every ve years and re-vise the schedule of marketvalues once in every threeyears.
It has also encouragedlocal government units tointensify the collection oflocally sourced revenue toreduce its dependence fromIRA (internal revenue allot-ment).
The move of the citygovernment to adjust taximposes to real properties
raised negative reactions, particularly by some oppo-sition members of the citycouncil.
TACLOBAN CITY Atop ofcial of this city gov-ernment said that contrary
to claims of others, thereis no adjustment made ontaxes but rather increase onthe market value of lands.
This was clarified bycity administrator TecsonJohn Lim amid furor ofincrease on taxes pertainingto real properties.
He also said that theincrease on land valuationmade under the adminis-tration of Mayor AlfredRomualdez was encour-aged by the Bureau of Lo-cal Government Finance(BLGF).
We were told byBLGF to raise the marketvalue by 200% but wewill only implement 25%.
But city treasurer ZosimaCordao said that with thismove, the city government
could generate a higher in-come for this year.
In fact, she said, the ad-justment could result to anadditional income of aboutP120 million to the citycoffers.
The increase of the realproperties taxes was mainlydue to the enforcement of anordinance passed by the citycouncil in 2011.
Those who will paytheir real property taxesthis month will avail a 20%discount. That means theywould only pay 5% increase
this month, Cordao added.(SARWELL Q. MENIANO)

But even if were able tolower our poverty incidence, the government will not stop
because we want to ensure toattain zero poverty incidencein our country, Soliman

Normalcy
As I said, we will ex-haust all legal remediesavailable to us under thelaw, Governor Garcia toldreporters in Capitol, whereshe received updates on thehearing rom her daughter.
Garcia said she hopes tosee the issue resolved today(Friday) so things at Capitolcan return to normalcy andthe image o Cebu that hasbeen so badly tarnished canbe once again reurbished.
Her brother, Repre-sentative Pablo John Garcia(Cebu, 3rd) said LPs ac-tions against the governorrun counter to the partysthrust to ollow the straightpath or matuwid na daan.
He said politics will notbe won through a suspen-sion or charges in court butthrough an election.
Garcias camp insisted
that the suspension orderviolated a provision o theLocal Government Codegiving the President 30 daysrom the submission o thendings in an administra-tive case to issue an order.
Politics
But President Benig-no Aquino III denied onWednesday that politicswas the reason behind thesuspension, saying Garciawas aorded due process.
In response, Salvadorsaid: Tere is political
color in this exercise. im-ing is really suspect.
Garcias allies in theUnited Nationalist Alliance(UNA) had said the casewas politically motivated, especially that the vote-richprovince is controlled by
o irreparable injury as itcan no longer ully enorcethe six-month penalty.
He also said that asiderom going against thedisciplinary power o thePresident, Garcia is stillsuspended should the CA12th division accede to herrequest to issue a RO.
No more noise
Noting Garcias repeatedmedia interviews decry-ing her suspension, Velosoasked the governor not tomake noise anymore.
Why cant she (Garcia)allow this Court to resolvethis case expeditiously andwith no anare? he saidduring the hearing o theoral arguments o the Gar-cia camp and governmentlawyers at the CA on Turs-day.
During the hearing,Garcias lawyer ranquilSalvador III said the Mala-canangs suspension orderran counter to Section 16,Article III o the 1987 Con-stitution, which guaranteesevery person the right tospeedy disposition o casesbeore all judicial, quasi-judicial or administrative
bodies.
Number of days
In a PowerPoint pres-entation, Salvador said thecomplaint or grave abuse oauthority led by Sanchezallegedly took 474 daysto be resolved despite the120-day limit provided un-der the Local GovernmentCode and AdministrativeOrder 23 o the Oce o thePresident.
Interviewed by report-ers aer the hearing, Gwensdaughter, lawyer Cristina
Frasco, said Veloso did notcategorically state the ap-peals court has no jurisdic-tion over their petition.
He (Veloso) simply il-lustrated other options thatare available to us, Frascosaid.
MANILA (Updated)-- Te Court o Appeals(CA) 12th division submit-
ted Tursday or resolutionGovernor Gwen Garciaspetition to stop her six-month suspension.
No temporary restrain-ing order (RO) was issued.
CA Associate JusticeVicente Veloso, who is as-signed to pen the decision, advised Garcia not to makenoise anymore and wait orthe appellate court to re-solve her petition withoutanare.
He also said Garcia canrecover her back wages iit is later ound out thatMalacaang gravely abusedits authority when it sus-pended her last month oroverstepping the powers othe Oce o Vice Governor.
Garcia has been sus-pended by the Oce o thePresident or alleged abuseo authority since Decem-ber 17 last year.
Trough her lawyers, she insisted on her rightto speedy resolution othe cases, arguing that theMalacanang directive didnot observe the requiredperiod o investigation andresolution o an administra-
tive complaint.Te complaint againstGarcia was led in Novem-ber 2010 by the late Cebuvice governor GregorioSanchez Jr.
Certiorari
Veloso, chair o thethree-man division, alsosaid Garcia should haveled a petition or certiorariunder Rule 65 o the Ruleso Court, where the CA canissue a RO and at the sametime, rights o parties willbe protected.
Garcia has invoked Rule43 as she asked or a ROon the ground o irrepara-ble injury.

The wet season is here and every
time the rains pour, families in low-

hazards brought about by ooding.
The fear and insecurity these fami-
lies feel during such situation have
escalated when the City experienced
heavy rains in March of last year and
there were loss of lives and destruc-
tion of properties. The opening of the
new year has been met with LPAs
and ITCZ, compounding the problem
on too much precipitation. This lead
the government to do double time in
mitigating emergency-situations as
constant rainfall loosens the soil and
result to landslides. In other areas, it
brings oods and destruction of prop-

practical and the best move

important. Other areas have
done the same including those
who have criticized the city

On a macro consideration,
the Mayor from the start had
been serious in pursuing ood
control and the rehabilitation
of the citys drainage system.
It was one of the high-priority
projects he wanted to undergo
to alleviate peoples lives and
safety. It is just sad that some
of his nemesis in the legisla-

lic, he has the right to own a gun. Such is given
for practical reasons. The call stems from several
shooting incidents that claimed the lives of inno-
cent citizenry. Deaths that resulted from shootingsdone inadvertently or advertently by both the irre-
sponsible and lawless elements are enough reasons
for change and must spur calls for a stricter re-
view and implementation of gun laws in the coun-
try. More importantly, it warrants a strict evalu-
ation on who must be given license to own a gun
or weaponry and who must be denied. This is a
crucial factor that must be done since statistics of
incidents would probably show that those involved
in the fatal shootings were either bad elements or
people who regard guns simply as toys, other-
wise they would not engage their gun on wild
shootings just to meet the New Year.
The reaction of the President, I lead by ex-

FINAL WITNESS OF THE BAPTIST
Jesus and his disciples went into the region of Judea, where hespent some time with them baptizing. John was also bapt izing in Aenonnear Salim, because there was an abundance of water there, and peoplecame to be baptized, for John had not yet been imprisoned. Now a dis-pute arose between the disciples of John and said to him, Rabbi, theone who was with you across the Jordan, to whom you testied, herehe is baptizing and every one is coming to him. John answered andsaid, No one can receive anything except what has been given himfrom heaven. You yourselves can testify that I said [that] I am not theMessiah, but that I was sent before him. The one who has the bride isthe bridegroom; the best man, who stands and listens for him, rejoicesgreatly at the bridegrooms voice. So this joy of mine has been madecomplete. He must increase; I must decrease.
THE REVEALER OF GOD
Mortal eyes can see only those things that are mortal. For instance, you cannot see your own spirit; there fore, how can you behold its Crea-tor? When the spiritual eyes are opened, then surely you can see theone who is Spirit, and all spiritual realities as well. Who can open ourspiritual eyes to see God? It is Jesus Christ. We know that the Sonof God has come and has given us understanding to know him who istrue (1 Jn 5:20). St John the Baptist conrmed that Jesus Christ wassent by God to reveal him as he is, when he said to his own discipleswho complained about the baptism by Jesus, No one can receive any-thing except what is given him from heaven(Jn 3:27). It is Jesus whogives us not only the spiritual eyes to see God, but also a heart to ex-perience Gods presence. Take a piece of charcoal: however much youmay wash it, its blackness will not disappear; but let the re enter intoit and its dark colour vanishes. So also, when we receive the re of theSpirit of Christ, all the blackness of evil is driven away from our heartand thus we are able to experience Gods presence. How fortunate are
we who have been baptized by the re of Christ to be able to recognizeand experience the true living God! This gift of awareness of God is nott be hoarded and kept to ourselves. We are to share this gift with others. If people refuse to listen to us, we can still pray for them to the Father.(His Word is Life by Vima Dasan, S.J. published by Paulines. they were involved
in the illegal opera-
tions. This leaves the
Philippine National
Police as an organi-zation in a bad light;
and such must all the
more be their motiva-
tion to clean-up their
ranks and to make
their selection process
more rigid and strict.
Police entrants must
undergo more psy-
chological and neu-
rological tests aside
from the usual IQ
tests that would show
in a way the maturity
level of the individual.
The National Police
Commission which
gives the eligibilities
of the police has toshow a brave stand
and must show that it
cannot be cracked by
hooligans just as the
Civil Service Eligibil-
ity Examinations are
given and the other
professionals needing
licenses are given by
the Professional Reg-
ulation Commission.
As is, there are allega-
tions that people who
are not supposed to
be peace ofcers are
admitted to the force
when they are sons,
nephews and in-
aanaks of superiors
and other high-rank-
ing ofcials.
If it is not possibleto curtail freedom
and rights of people
to own guns, these
individuals together
with others who are
mandated to have
guns must be subject-
ed to more stringent
tests just to deter-
mine their capability
to manage ownership
for something that is
out of the ordinary. Now, the drainage and
ood control program will be
implemented in time with the
rainy season, a scenario most
probably desired by people
who do not have the gift of
vision. These are people who
cannot see beyond their noses.
Had the project been imple-
mented when the Executive
branch took this up as early
as 2010, we would have been
free of the menace by now.
Moving for the City of
Tacloban to be a highly ur-
banized city was easy with
the overwhelming help ofthe people who supported the
move. But for the people to
enjoy the city as a Highly Ur-
banized City (HUC), it needs
the support and cooperation of
everyone especially those who
purport to lead. The public de-
rive greater benet when there
is congruence between the ex-
ecutive and legislative agenda.

ers must paddle uniformly
towards similar direction.

But at the beginning
of creation God made them
male and female. For this
reason a man will leave his
father and mother and be
united to his wife,and the
two will become one esh.
So they are no longer two,
but one. Therefore what God
has joined together, let mannot separate. (Mark 10:
6-9)
Upon this Scriptural
verse, a sizeable population
of Roman Catholic faith-
ful is strongly opposed to
the legalization of divorce
in the Philippines. Beyond
it, though, there are other
reasons that underpin this
disapproval among which
the effect of the dissolu-
tion of marriage the impact
of which is much like that
of a broken family. Others
still attack it on the moral
and psychological aspects, the burden of which falls on
the shoulders largely of the
common children of divorc-
ing couples, besides the fact
that it is an affront to the
family values of deeply in-
grained in Filipino culture.
Calling the recent enact-
ment of landmark legisla-
tions that are onesidedly
labeled anti-life as propaga-
tion of the culture of death,
the recent developments in
the countrys socio-political
landscape is creating a dent
in the relationship betweenthe Roman Catholic Church
and the national government
led by Pres. Noynoy Aquino.
Although this divorce bill is
not viewed by Malacaang
Palace as one that neces-
sitates the stamp-mark of
urgency, the Church and
her people, individual or in
collegial bodies, are in agile
stance to make the public
aware of the ills of divorce.
The pro-divorce advo-
cates leave no stone un-
turned, as well. Identifying
themselves as pro-life Cath-
olics, people who are push-ing for divorce claimed this
proposed law to be a pana-
cea to the blight that strikes
the nucleus of the basic unit
of the society. They con-
tended that there is no point
of prolonging the agony be-
tween the couple if living
under one roof would only
cause misery to either or both
of them and eventually their
offspring. This divorce, they
added, is not anyway a free-
for-all privilege.
In the introduction of the
bill, authors Rep. Luzvimin-
da C. Ilagan and Emerencia-
na A. De Jesusof Gabriela Womens
Party-List stated: The bill
seeks to introduce divorce in
Philippine law with a strong
sense of condence that it
will be used responsibly by
Filipino couples. This con-
dence stems from the expe-
riences of Filipino families
that show that separation
is usually the last resort of
many Filipino couples whose
marriage has failed. Cases of
battered women also support
this. Battered women invari-
ably seek separation only
after many years of tring tomake the marriage work.
Separation only becomes im-
perative for them when they
realize that it is necessary for
their and their childrens sur-
vival.
Divorce could actually
provide protection to bat-
tered women and their chil-
dren from further violence
and abuse. With the pre-
dominance of the Catholic
faith in the Philippines, the
fear that divorce will erode
personal values on marriage
appears unfounded. The ex-perience of Italy, where the
Vatican is located, and Spain,
two predominantly Catholic
countries which practice di-
vorce, supports this. Those
countries have a low rate of
divorce. Italy registers a 7%
rate while Spain registers
15%. The gures reect the
strong inuence of religious
beliefs and culture on indi-
viduals in deciding to termi-
nate marital relations.
In House Bill No. 1799,
which further amends Ex-
ecutive Order No. 209, oth-
erwise known as The Fam-ily Code of the Philippines
and introduced by GABRI-
ELA Womens Party, divorce
could only prosper on the
following grounds: (1) The
petitioner has been separat-
ed de facto from his or her
spouse for at least ve years
at the time of the ling of the
petition and reconciliation is
highly improbable; (2) the
petitioner has been legally
separated from his or her
spouse for at least two yearsat the time of the ling of the
petition and reconciliation is
highly improbable; (3) when
any of the grounds for legal
separation under paragraph
(a) of this article has caused
the irreparable breakdown of
the marriage;
(4) when one or both
spouses are psychologically
incapacitated to comply with
the essential marital obli-
gations; and (5) when the
spouses suffer from irrecon-
cilable differences that have
caused the irreparable break-
down of the marriage. The proposed law con-
versely provides grounds on
which legal separation or
divorce shall be denied such
as: (1) When the aggrieved
party has condoned the of-
fense or act complained of;
(2) Where the aggrieved
party has consented to the
commission of the offense or
act complained of; (3) Where
there is connivance between
the parties in the commis-
sion of the offense or act
constituting the ground for
legal separation or divorce:(4) Where both parties have
given ground for legal sepa-
ration; (5) Where there is
collusion between the parties
to obtain the decree of legal
separation or divorce; or (6)
Where the action is barred by
prescription.
It should also be noted
that even before divorce is
introduced, the Philippine
legal system has already put
in place remedies for couples
who could not help but dis-
regard their vow of loving
each other in sickness and
in health, in richer or poorer, till death do us part. The
implementation of RA 9262
(Violence against Women
and their Children Act of
2004) adds up to remedies
provided under the Family
Code of the Philippines, such
as Legal Separation, Decla-
ration of Nullity of Marriage
and Annulment of Marriage.
The VAWC law likewise
in protecting the wife from
further bodily harm inicted
by the husband is granted the
temporary protection order
that could ripen into a per-
manent one. The husband isto stay away from the wife
and their common children
for a particular distance like
150 meters. This is in effect a
separation of the couple from
bed and board and love that
should have been present at
the outset of marriage and
supposed to bloom as the
couple journeys through life,
will soon die.Although be it gratifying
to some, the Church could
not allow divorce to destroy
the bedrock of the society
the family. In a text message,
Rev. Fr. AmadeoAlvero
stated, Nullity is to declare
that there was no marriage at
all from the very beginning.
Had there been a marriage
that happened, then it cannot
be nullied, it cannot be dis-
solved because marriage is
indissoluble. Divorce there-
fore is not allowed, not only
by the Church, but by God
Himself. Divorce is prohibit-ed by Divine Law, stressing
once more, What God has
united, let no man separate.
The Church, through the
Matrimonial Tribunal, how-
ever, acknowledges some
grounds for the dissolution

Citing Supreme Courtjurisprudence, governmentlawyers said the proo o ser-
vice was completed whenthe rst attempt to serve the
suspension was initiated inGarcias o ce.
Tey said Garcia was notentitled to a RO since sheailed to establish that hersuspension would causeher clear and unmistakabledamage.
Te O ce o the Presi-dent, they said, substantial-ly established that Garciaviolated the Revised PenalCode or hiring consultantswithout the concurrencerom the PB and slashingthe budget o the vice gov-ernors o ce. (Sunnex)
Palace decision suspendingGarcia or six months wasurnished to the Cebu Pro-
vincial Legals O ce, he said.Salvador also said no
amount o salaries wouldcompensate or the be-smirched reputation and theloss o time that the governorcould have used to serve her
constituents, in the event theCA would not stop the sus-pension order.
MootBut government lawyers
asked the appellate courtto deny Garcias plea or is-suance o a RO or beingmoot and academic.
Tey said DILG-CentralVisayas Chie Ananias Villa-corta tried to serve a copy othe suspension order on Gar-cia, but decided to post it inthe hallway o the governorso ce since she (Garcia) wasnowhere to be ound.
Garcias staers reused to
Garcia was authorized by lawto slash the allocation or the
vice governors o ce.Citing a resolution passed
by the Cebu Provincial Board(PB) in 2010, Salvador saidActing Governor Magpale, who was PB member thattime, even signed the docu-ment that reduced the budgetin the vice governors o ce.
He dismissed the govern-ment lawyers argument thatthe service o suspension was
constructive since therewas an attempt to serve theorder on Garcia personally.
Salvador also decried theharshness o the suspen-sion, considering that Garciawill only have two remainingweeks, i the RO is not is-sued.
Not original copy
Salvador said the serviceo suspension was invalidsince local interior o cialsserved a photocopy, andnot original or certied truecopy, o the suspension orderon Garcias staers.
On the other hand, the
constitutional rights sincethe Palace order was not an-chored on substantive evi-dence.
He also said the suspen-sion violated the Local Gov-ernment Code and Admin-istrative Order 43, whichprovides that an administra-tive case be resolved within30 days.

2010 and the probe was ter-minated on August 31, 2011.Te case, the lawyer
pointed out, was resolved onDecember 11, 2012, or about474 days since the complaintwas led.
Speculative
Salvador said Garcia didnot abuse her authority whenshe hired several Capitolconsultants, saying that theCivil Service Commission al-lows her to appoint new gov-ernment employees.
Te suspension order isspeculative procedurally
fawed, he said, adding that
a governor who is not al-lied with the ruling LiberalParty.
