RE: HERRERA INVESTIGATION
As some of you may know, Roland Herrera, a Public Works employee has been on paid administrative
leave. During that time, the City has been completing an investigation. Below is information regarding
the current status of that investigation. In addition to you, Department Directors and employees who work
directly with Mr. Herrera (Public Works & Finance) will also receive this information. Please contact me
or Rob Kissler if you have any questions:
A preliminary investigation regarding Roland Herrera has been completed. We will NOT be
making any decisions until Roland has been afforded his Due Process rights (opportunity to
review and respond to the results of the investigation prior to final decision). The results of
the investigation are en route to Roland at this time but he may not yet have the materials so
we must ask you not to share any information with others or to initiate any contact with
Roland at this time.
During the time the investigation was pending, Roland was prohibited from contacting others
regarding the subject matter of the investigation. However upon receipt of the results of the
investigation, Roland is notified that the prohibition has now been lifted. Roland will remain
on paid leave at this time but is allowed to collect information he determines relevant to
respond to the investigation. Consequently, you could be among those who are contacted
either directly by Roland or through a representative. In an effort to maintain Rolands
confidentiality during this process, we are not sharing information about the subject matter
of the investigation.
We all know that Roland is well-liked in the community and even previously named Citizen ofthe Year. The issue is not what Roland did to be named Citizen of the Year or how well-liked
he is in the community. The issue is whether he engaged in conduct that violated City
policies. Because we have maintained confidentiality to the extent thats practical, this
means you do not know the facts of this case. Consequently, we strongly urge you to limit
your comments only to known facts in deference to the process we are undertaking. We also
ask for your support in ensuring Roland is treated in the same way any other employee would
be treated under similar circumstances. Out of respect for Rolands confidentiality, please
assist us in discouraging gossip and rumor. Also, please notify us if there are any issues of
concern that arise as we continue through this process.
