    PURSUANT TO COURT ORDER

    Without waiving any objection or appealable issue as to the grounds upon which the

    Court determined a monitor was necessary and/or appropriate, pursuant to the Court’s Order

    dated October 2, 2013 (Dkt#606) (“the Order”) at ¶ 121, Defendants herein file with the

    Court their slate of three (3) candidates for Court to consider for appointment as monitor.

    By way of background, pursuant to the Order at ¶¶ 120-121, Defendants disclosed to

    Plaintiff on November 19, 2013, the resumes of six (6) prospective candidates for the

    monitor position so that Plaintiffs would have sufficient time to independently interview,

    consider, and analyze whether any of the six prospective candidates were agreeable to

    Plaintiffs. The three candidates listed on this filed slate were included on the November 19,

    2013 disclosure to Plaintiffs.

    On or about November 21, 2013, Plaintiffs provided Defendants with the resumes of

    two (2) prospective candidates for the monitor position.

    On or about November 25, 2013, Plaintiffs advised Defendants that none of the six

    prospective candidates were agreeable to Plaintiffs. The two prospective candidates

    proposed by Plaintiffs are not agreeable to Defendants. Accordingly, the parties are at an

    impasse on agreement regarding the joint selection of a monitor and the following are the

    three (3) candidates Defendants propose the Court consider for appointment to the monitor

    position:

    1.  Howard Safir at Vigilant Resources. Mr. Safir’s resume, as well as the

    qualifications for his proposed team is attached as Exhibit 1. Mr. Safir and his

    team proposed a blended hourly rate of $385.00.

    2.  Ronald C. Sanchez at Veritas Assurance Group, Inc. Mr. Sanchez’s resume, as

    well as the qualifications of Daniel R. Koenig, who subcontracts with Veritas, are

    attached as Exhibit 2. Mr. Sanchez and his team proposed an hourly rate that

    would not exceed $250.00.

    3.  Joseph R. Wolfinger at Wolfinger and Company, Inc. Mr. Wolfinger’s resume is

    attached as Exhibit 3. Mr. Wolfinger proposed an hourly rate of $250.00.
