    A Waukesha County Circuit Court judge ruled in favor of thevillage of Menomonee Falls July 24 in its action against theremaining partners of Lodging Investors of Menomonee Falls.

    As part of a tax incremental finance (TIF) district that includ-ed the Radisson Hotel, in April 2010 the village provided a$17.6 million loan to Lodging Investors of Menomonee Falls,LLC, the ownership group that was to construct and manage the

    hotel. The ownership group defaulted on the loan and the vil-lage is currently owed approximately $14 million.

    The hotel is currently operating under a receivership follow-ing a motion by the village of Menomonee Falls in WaukeshaCounty Circuit Court that was granted in November 2011.

    On April 15, the village filed a motion seeking a summaryjudgment against defendants James Heyden, Constance L.OMara Heyden and L.A.C. Concepts, the remaining partnersin the Lodging Investors group. In its motion, the village arguedthat it is not in dispute that the ownership group does not havethe funds necessary to pay its obligations.

    This is not where anyone wanted to be in April 2010, butits where we are today and we must move forward from thisplace, Randall Crocker, an attorney representing the village,said at the start of the July 24 hearing. All attempts at a reso-lution appear to have been exhausted.

    Crocker said that court documents show that there is no dis-pute that the Heydens and L.A.C. Concepts are in default and

    The Germantown High School Warhawkand Boosters will host its 11th Annual Golfuting on Monday, Aug. 26, at Scenic Viewountry Club, 4415 Club Drive, Slinger.

    Sign-in for the popular community eventegins at 10 a.m., with a shotgun start following11 a.m. Golfers of all ability levels will play 18

    oles in a scramble format and enjoy lunch dur-

    ing their round. At 4:30 p.m., participants willgather at the clubhouse for dinner, an awardspresentation, raffles, and a performance by theGermantown High School Wall of Sound march-ing band.

    Golf, lunch, dinner, drink tickets and enter-tainment are included in the $80 fee; however,an option to attend the evening dinner and enter-

    She said a sale would reduce the judge-ment against the Heydens and L.A.C.Concepts. Kieffer said the court could notdictate to the village how proceed with itslawsuit, and the village indicated a longtime ago that it wanted to proceed with apartial summary judgement.

    Muellers arguments drew a pointedresponse from Crocker.

    Ms. Mueller has done an admirablejob of attempting to raise issues of lawwhere in fact none exist, he said.

    Crocker said the village borrowedmoney from commercial investors, which aredue in 2014. However, payments are due

    under the mortgage note signed by the bor-rowers, with payments of $700,000 everysix months. There is a payment defaultbecause no payment has no been made.

    Crocker said the village is desperatelytrying to seek the sale but that was opposedby the Heydens.

    Kieffer ruled in favor of the villagesmotion. Afterward, Crocker said the rulingis the end of a lot of the problems and nowwe think we can move forward.

    We now have a good plan to move for-ward. The impediments are out of the way,we think this will come to an end prettyquickly, he said.

    Crocker said the ruling means the vil-

    lage is entitled to foreclose on the propertyand recover the funds that it lent. He addedthere are other options besides foreclosureproceedings that will be examined. He saidthe village plans to sell the property in amanner thats designed to get the highestand best price for the benefit of the village,which is the creditor.

    A blood drive that was scheduled earli-this year will take on added importance

    A blood drive will be held at theenomonee Falls Public Library, W1568436 Pilgrim Rd., from 10:30 a.m. to30 p.m. Aug. 9.

    This drive is particularly important nowecause the Red Cross has issued an emer-ency blood donation request after there

    was a significant decrease in the month ofJune, blo od dri ve organi zer Emi lySuetholz said in an email. The Red Crosshad a 10% decrease in the number ofblood donations throughout the month ofJune, and they received about 50,00 0 lessdonations then they had expected. To giveyou an idea about what these numbersmean, on average of about 44,000 blooddonations are used in one day.

    Suetholz said the event was planned beforethe shortfall but said it is now important toget large amount of donors at the even sothe Red Cross can recover from the previ-ous month.

    Suetholz first became involved in blooddrives when she joined the Health CareAcademy program while a sophomore atMenomonee Falls High School. Sheexplained that students in the academy puton two blood drives each year, one through

    the Red Cross and one through BloodCenter of Wisconsin. Suetholz has volun-teered for four blood drives over the pasttwo years.
