Reading Of The Reconciliation Statement And PrayerFabienne Thewlis, Manager Governance & Corporate Support, read the following reconciliation statement: We acknowledge that we are meeting on the traditional land of the Boonwurrung and Wurundjeri people and offer our respects to the elders past and present. We recognise and respect the cultural heritage of this land.

The meeting began with a prayer at 7.00pm.

F. Correspondence – (only if related to council business)Cr Chandler tabled the following correspondence:

An email (3.10.16) from a resident thanking Council Officers for the installation of rubbish bins on the Yarra River frontage and highlighting particular areas of rubbish pollution. The email points out that there are no rubbish bins on the opposite side of the Yarra River. Cr Chandler asked Council Officers to liaise with the City of Yarra in relation to this matter.

Road, Malvern, on grounds including: lack of time for residents to object; failure to provide visual transition from GRZ to NRZ; lack of landscaping in backyard; neighbourhood character issues; and contravention of the Garden Suburban 3 Guidelines.

Cr Koce tabled the following correspondence:

A series of emails (12, 13 & 17.10.16) and a letter (9.9.16) from residents of Woodmason Street objecting to Item 2 - 4 Woodmason Street, Malvern, on grounds including: overlooking of private space; and mass planting of bamboo. An email states that 71% of houses in the street request the removal of a lemon scented gum on the subject property.

An email (7.10.16) expressing disappointment about the Melbourne Metro Rail Authority’s (MMRA) response to the IAC about the Metro Rail Project and urging Council to take issue with MMRA assertions. The email notes: lack of recreational space in Forrest Hill; car parking in Arthur Street; structures in Osborne Street; and the impact of the Project on residents.

A series of emails (1, 10 & 13.10.16) from a resident requesting that a red light camera be installed at the Punt Road / Pasley Street, South Yarra, primary school pedestrian crossing on the grounds of: cars speeding through red lights; danger to pedestrians, including school children; and a number of near misses.

An email (7.10.16) from a resident of Malcolm Street complaining of: noise from two large construction sites at 663 Chapel Street seven days a week; lack of warning to residents about noise; and noise up to 8.00pm.

Financial Statements including Audit Report, Stonnington City Brass Inc. Cr Koce noted that he had attended the Stonnington City Brass AGM on behalf of the Mayor, Cr Ullin,.

G. Questions to Council Officers from Councillors

A STREET SURVEY RUSHMEAD STREET, MALVERN Cr Jami Klisaris noted that she planned to table two petitions from residents of Rushmead Street, Malvern requesting changes to the current parking restrictions. One was submitted in December 2013, one in October 2015. The petitions gave lengthy information requesting parking changes, noting: a nearby Korean Community Centre; and commuters leaving cars during the day and overnight. This is a very small street with 10-15 houses. Cr Klisaris said she didn’t understand why the parking restrictions were not changed at the time of the petitions and asked that a report come to the new Council as soon as possible. She asked that Council Officers survey the street by December 2016 or February 2017.

The General Manager Assets and Services, Simon Thomas, took the question on notice.

B TRAFFIC SURVEY BEAVER STREET, EAST MALVERN

Cr Jami Klisaris said that later in the meeting she would table a letter with 17 signatures from Beaver Street, East Malvern, requesting a traffic and parking survey. Residents have no consensus about the type of restrictions requested, but ask for a survey of the area.

The General Manager Assets and Services, Simon Thomas, said he would investigate the matter.

C REDEVELOPMENT - 1131 DANDENONG ROAD, MALVERN EAST

Cr John McMorrow asked a question about a recent Compulsory Conference at VCAT in relation to a development at 1131 Dandenong Road, Malvern East, where Council

requested an increase in the rear setback; and there were issues about car parking and drainage. Cr McMorrow said he could not find reference to a consultative meeting despite there being 10 objections.

The General Manager, Planning and Amenity, Stuart Draffin, said that this permit was refused by Council under delegation. He took the question about the VCAT consultative process on notice.

D PLANNING APPLICATION FOR 280 WAVERLEY ROAD, MALVERN

Cr John McMorrow asked for clarity about the following matters relating to a Planning Application for 280 Waverley Road, Malvern: dispensation for 84 car parks; and work not starting by the required commencement date.

The General Manager, Planning and Amenity, Stuart Draffin, said that permits usually have two years in which to commence and an extension can be sought. He took the question on notice.

E PARKING IN SILVER STREET, MALVERN Cr John McMorrow raised an issue in relation to parking in Silver Street, Malvern, which had been the subject of a petition. He noted that there was further parking congestion in that area and asked that a response come to the new Council.

F PARKING CHAOS IN REPTON ROAD, MALVERN EAST

Cr John McMorrow said he had been advised of parking chaos in Repton Road, Malvern East. He has received correspondence about the lack of success of a yellow no parking line Council installed outside a house.

The General Manager Assets and Services, Simon Thomas, took the question on notice.

G CONDITION OF THE LANE BETWEEN BEAVER LANE AND LARA STREET, MALVERN EAST

Cr John McMorrow asked for clarity about the unsafe condition of the lane between Beaver Lane and Lara Street, Malvern East, where there were parking issues and a general deterioration of the laneway.

The General Manager Assets and Services, Simon Thomas, took the question on notice.

H ISSUES RAISED BY RESIDENT

Cr John McMorrow said he had been contacted by a resident of Cairnes Crescent noting issues including: graffiti, the non-removal of a tree stump from a street tree; the gardens facing Monash freeway; and dumping of rubbish on VicTrak land.

in Parslow Street. Cr McMorrow asked how these issues could be resolved.

J RECENTLY INSTALLED LIGHT AT THE CORNER OF CHAMBERS STREET AND PENNY LANE

Cr John Chandler said that at the last Council meeting he had tabled correspondence in relation to issues with the illumination from the recently installed light at the corner of Chambers Street and Penny Lane. He asked for an update.

The General Manager Assets and Services, Simon Thomas, said that the street light had been erected in response to a request, but unfortunately had caused intrusion of light into the living space of a neighbour. The light has been switched off and Council Officers are seeking to install a suitable diffuser to direct the light downwards.

K PORTLAND PLACE - NEW CROSSOVER THAT DOES NOT MATCH THE HERITAGE BLUESTONE KERB

Cr John Chandler said he had tabled correspondence at the previous Council meeting from a resident in Portland Place about a new crossover that does not match the Heritage bluestone kerb. He asked if any action had been taken.

The General Manager Assets and Services, Simon Thomas, said that in cases where bluestone kerb and channelling causes vehicles to scrape when entering or exiting property, Council usually installs an asphalt wedge. There are very limited treatments to offer residents and no treatments which don’t mask or interfere with bluestone. Such matters tend to be listed on the Street Reconstruction Program and when the area is reconstructed the kerbs and channels are raised to ease access.

Cr Chandler said he understood that no action had been taken. He said that he did not believe it was a particularly difficult grading problem and suggested that the problem is at the property and not where the asphalt paving is sloped down.

L WILSON STREET AND GARDEN LANE Cr John Chandler asked a question about Wilson Street and Garden Lane where potholes and builders’ scaffolding and hoarding were getting in the way of sightlines.

The General Manager Planning and Amenity Stuart Draffin took the question on notice.

M LANDSCAPING ON THE CORNER OF TIVOLI ROAD AND TOORAK ROAD

Cr John Chandler said that there had been a request for landscaping on the corner of Tivoli Road and Toorak Road near the Shell Service Station. Council had agreed to put in a tree and were looking into the possibility of a garden bed on the Tivoli Road frontage. He asked for an update.

The General Manager Assets and Services, Simon Thomas, said that garden bed was on private property and, after a great deal of effort, Council Officers have gained agreement from the Coles Property Manager to plant out that small garden. The proposed planting is Cypress-type specimens which will be planted in the next month or so. The only thing holding up the planting is obtaining the plant stock.

Cr Chandler asked if plants from the Council Depot could be planted as a temporary measure.

The General Manager Assets and Services, Simon Thomas, said that the resident had asked for a particular plant stock for that garden bed which Council Officers were sourcing.

Cr Chandler said he was hearing that this would take a month or more and asked that some greenery be planted immediately.

The General Manager Assets and Services, Simon Thomas, said that this would be done.

H. Tabling of Petitions and Joint LettersCr Klisaris tabled a petition from 17 residents of Beaver Street, East Malvern, which has no parking restrictions, but abuts streets with parking restrictions. The petition notes that the street is used for parking by non-residents. The petitioners request that Council conduct a full traffic and parking survey, including an assessment of traffic volumes, parking frequency, duration and behaviour, origin of travel and destination following parking, and recommend a solution, consulting with Beaver Street residents.

Cr Klisaris tabled two petitions from residents of Rushmead Street, Malvern, one previously tabled in 2013 and the other tabled in 2015 in relation to parking in that street. Both petitions request that the current permit side be extended to 7 days a week and the other side of the street be restricted to two-hour parking, 9.00am – 6.00pm seven days a week.

The Mayor, Cr Ullin, welcomed Mrs Carole Stubbs, wife of the late Cr Adrian Stubbs and former Mayor of the City of Stonnington who unfortunately passed away while in office during this term of Council, when doing a very valuable job. Cr Ullin said that Cr Stubbs had been a wonderful Mayor. His sudden death had shaken all at Council and it was very hard to recover from it. Adrian had been a person of great substance and provided important energy for this Council. He thanked Mrs Stubbs for attending this last Council Meeting.

K. Reports of DelegatesCr Sehr reported on a Strategic Planning Advisory Meeting chaired by Cr Jim Athanasopoulos held on 10 October 2016, giving the following updates:

Updates of Interest: Panel Hearings into: the Melbourne Metro Rail Project (MMRP); and the C233 - 878 High Street heritage. The MMRP report is to go to the Minister for Planning after the last hearing day. Council eagerly awaits the results of that. The panel has supported that application of the C233 Heritage Overlay.

Updates on Activity Centre Planning: C233 Glenferrie Road High Street Activity Plan – over 200 submissions were received. Issues included objections to proposed heights, increased population and parking pressures.

Projects proposed for new Council consideration: These include: permanent heritage controls for 29-31 Phoenix Street; and heritage protection for four federation homes.

Solar Panel Overshadowing: It was disappointing that the Minister has said that there will be no new guidance across Victoria in relation to this matter until Plan Melbourne and other energy strategies are released. Cr Sehr tabled the minutes.

Cr McMorrow reported on a Prahran Mission Meeting and AGM in the past week as follows: Major Changes: As of 3 October 2016 all 31 merging UnitingCare agencies will be handed

over to the new Uniting Vic/Tas Board under the UnitingCare Network Project (UCNP). This will bring massive changes, but the CEO will continue to lead Prahran Mission and all services in Stonnington will continue as usual. Between now and July 2017 all merger agencies will use their current ABN, logo and identification. The official new brand name will be ‘Uniting’ but the local presence will remain.

1 PLANNING APPLICATION 1102/15- 3 NICHOLLS STREET, MALVERN - CONSTRUCTION OF A NEW DWELLING ON A LOT LESS THAN 500 SQUARE METRES IN A NEIGHBOURHOOD RESIDENTIAL ZONE.

MOTION: MOVED CR MELINA SEHR SECONDED CR TINI ATHANASOPOULOS

That a Notice of Decision to Grant a Planning Permit No: 1102/15 for the land located at 3 Nicholls Street, Malvern be issued under the Stonnington Planning Scheme for construction of a new dwelling on a lot less than 500 square metres in a Neighbourhood Residential Zone subject to the following conditions:

1. Before the commencement of the development 1 electronic copy of plans drawn to scale and fully dimensioned, must be submitted to and approved by the Responsible Authority. The plans must be generally in accordance with the plans prepared by Daryl Pelchen Architect known as Drawing No.s: TP0.01-TP0.06, TP1.01-TP1.08, TP2.01, TP2.02, TP3.01 TP3.03, TP5.01 and TP5.02 Council date stamped 17 June 2016 and Landscape Plan, Council date stamped 2 December 2015 but modified to show:

a) The deletion of the second floor.b) Dimension all the setbacks of the ground and first floors from all

boundaries. c) Increase the dimensions of the car parking area to 10.3m in length. d) A revised landscape plan that incorporates the proposed changes to the

plans.

All to the satisfaction of the Responsible Authority.

2. The layout of the site and the size, levels, design and location of buildings and works shown on the endorsed plans must not be modified for any reason (unless the Stonnington Planning Scheme specifies that a permit is not required) without the prior written consent of the Responsible Authority.

3. Before the occupation of the development, the landscaping works as shown on the endorsed plans must be carried out and completed to the satisfaction of the Responsible Authority. Landscaping must then be maintained to the satisfaction of the Responsible Authority, including that any dead, diseased or damaged plants are to be replaced.

4. A report for the legal point of discharge must be obtained from Council and a drainage design for the development must be prepared by a suitably qualified Engineer in accordance with that report prior to a building permit being issued.

5. Any poles, service pits or other structures/features on the footpath required to be relocated to facilitate the development must be done so at the cost of the applicant and subject to the relevant authority’s consent.

6. The level of the footpaths must not be lowered or altered in any way to facilitate access to the site.

7. Prior to the occupation of the building, fixed privacy screens (not adhesive film) designed to limit overlooking as required A15 of Clause 54.04-6 in accordance with the endorsed plans must be installed to the satisfaction of the Responsible Authority and maintained to the satisfaction of the Responsible Authority thereafter for the life of the building.

8. Prior to the occupation of the building, the walls on the boundary of the adjoining properties must be cleaned and finished to the satisfaction of the Responsible Authority.

9. The project must incorporate the Water Sensitive Urban Design initiatives detailed in the endorsed site plan and/or stormwater management report.

10. This permit will expire if one of the following circumstances applies:

a) The development is not started within two years of the date of this permit. b) The development is not completed within four years of the date of this

permit.

In accordance with Section 69 of the Planning and Environment Act 1987, a request may be submitted to the Responsible Authority within the prescribed timeframes for an extension of the periods referred to in this condition.

NOTES:

i. This permit does not constitute any authority to carry out any building works or occupy the building or part of the building unless all relevant building permits are obtained.

ii. Nothing in this permit hereby issued shall be construed to allow the removal of, damage to or pruning of a significant tree (including the

roots) without the further written approval of Council.

“Significant tree” means a tree:

a) with a trunk circumference of 180 centimetres or greater measured at its base; or

b) with a trunk circumference of 140 centimetres or greater measured at 1.5 metres above its base; or

c) listed on the Significant Tree Register.

Please contact the Council Arborists on 8290 1333 to ascertain if permission is required for tree removal or pruning or for further information and protection of trees during construction works.

iii. At the permit issue date, Section 69 of the Planning and Environment Act 1987 stated that the Responsible Authority may extend the periods referred to if a request is made in writing within the following timeframes:

a) Before or within 6 months after the permit expiry date, where the development allowed by the permit has not yet started; and

b) Within 12 months after the permit expiry date, where the development allowed by the permit has lawfully started before the permit expires.

3. Concurrent with the endorsement of development plans a tree management plan prepared by a suitably qualified arborist must be submitted to and approved by the Responsible Authority. The tree management plan must detail measures to protect and ensure the viability of the significant Lemon Scented Gum (referred to as Tree 2 in the Arboricultural Assessment and Tree Preservation Strategy prepared by McLeod Trees) located within the front setback of the subject site.

Without limiting the generality of the tree management plan it must have at least three sections as follows:

a) Pre-construction – details to include a tree protection zone, height barrier around the tree protection zone, amount and type of mulch to be placed above the tree protection zone and method of cutting any roots or branches which extend beyond the tree protection zone.

b) During-construction – details to include watering regime during construction and method of protection of exposed roots.

c) Post-construction – details to include watering regime and time of final inspection when barrier can be removed and protection works and regime can cease.

Pre-construction works and any root cutting must be inspected and approved by the Parks Unit. Removal of protection works and cessation of the tree management plan must be authorised by the Parks Unit.

4. Before the occupation of the development, the landscaping works as shown on the endorsed plans must be carried out and completed to the satisfaction of the Responsible Authority.  Landscaping must then be maintained to the satisfaction of the Responsible Authority, including that any dead, diseased or damaged plants are to be replaced.

5. The project must incorporate the Water Sensitive Urban Design initiatives detailed in the endorsed site plan and/or stormwater management report.

6. Prior to the occupation of the building / commencement of use, the walls on the boundary of the adjoining properties must be cleaned and finished to the satisfaction of the Responsible Authority.

7. A report for the legal point of discharge must be obtained from Council and a drainage design for the development must be prepared by a suitably qualified Engineer in accordance with that report prior to a building permit being issued. The drainage must be constructed in accordance with the Engineer’s design.

8. The existing footpath levels must not be lowered or altered in any way at the property line (to facilitate the basement ramp). This is required to ensure that normal overland flow from the street is not able to enter the basement due to any lowering of the footpath at the property line.

9. Any poles, service pits or other structures/features on the footpath required to be relocated to facilitate the development must be done so at the cost of the applicant and subject to the relevant authority’s consent.

10. The applicant must at their cost provide a stormwater detention system to restrict runoff from the development to no greater than the existing runoff based on a 1 in 10 A.R.I. to the satisfaction of Council’s Infrastructure Unit. Alternatively, in lieu of the stand alone detention system, the owner may provide stormwater tanks that are in total 2,000 litres greater than those tanks required to satisfy WSUD requirements for the development. Those tanks must be connected to all toilets.

11. All utility services to the subject land and buildings approved as part of this permit must be provided underground to the satisfaction of the Responsible Authority by completion of the development.

12. All plant and equipment (including air-conditioning units) must be located or screened so as not to be visible from any of the surrounding footpaths and adjoining properties and shall be baffled so as to minimise the emission of unreasonable noise to the environment in accordance with Section 48A of the Environment Protection Act 1970 to the satisfaction of the Responsible Authority.

13. No vehicular or pedestrian access, trenching or soil excavation is to occur within the Tree Protection Zone without the written consent of the Responsible Authority. No storage or dumping of tools, equipment or waste is to occur within the Tree Protection Zone.

14. All costs for the removal and replacement of the street tree are to be borne by the permit holder and paid for at the time of applying for a crossover permit. All works (removal, species selection and planting) in this regard will be undertaken by Council.

15. Prior to the occupation of the building, fixed privacy screens (not adhesive film) designed to limit overlooking as required by Standard B22 of Clause 55.04-6 in accordance with the endorsed plans must be installed to the

7. No vehicular or pedestrian access, trenching or soil excavation is to occur within the Tree Protection Zone without the written consent of the Responsible Authority. No storage or dumping of tools, equipment or waste is to occur within the Tree Protection Zone.

8. Concurrent with the endorsement of any plans pursuant to Condition 1 a Sustainable Management Plan (SMP) must be submitted to and approved by the Responsible Authority. Upon approval the SMP will be endorsed as part of the planning permit and the development must incorporate the sustainable design initiatives outlined in the SMP to the satisfaction of the Responsible Authority. Amendments to the SMP must be incorporated into plan changes required under Condition 1. The SMP must be generally in accordance with the Sustainability Management Plan prepared by Ark Resources dated 5 August 2016 but modified to show:

a) The STORM report updated to accurately reflect the number of bedrooms within the development.

b) The energy ratings reports provided as an appendix.

All works must be undertaken in accordance with the endorsed Sustainability Management Plan to the satisfaction of the Responsible Authority. No alterations to the Sustainable Management Plan may occur without written consent of the Responsible Authority.

9. Prior to the occupation of the development approved under this permit, a report from the author of the Sustainability Management Plan, approved pursuant to this permit, or similarly qualified person or company, must be submitted to the Responsible Authority. The report must be to the satisfaction of the Responsible Authority and must confirm that all measures specified in the Sustainability Management Plan have been implemented in accordance with the approved plan.

17. Prior to the commencement of use of the permitted development, redundant vehicle crossovers onto Malvern Road must be removed and the kerb, channel, footpath and nature strip reinstated to the satisfaction of the Responsible Authority.

5 INFRASTRUCTURE VICTORIA 30-YEAR STRATEGY - SUPPLEMENTARY SUBMISSION

MOTION: MOVED CR JOHN CHANDLER SECONDED CR MATTHEW KOCE That Council:1. Note the release of Victoria’s Draft 30-Year Infrastructure Strategy October 2016,

by Infrastructure Victoria (IV) with submissions on this draft due by 31 October 2016;

2. Authorise officers to examine the recommendations by IV with particular reference to recommendations which may impact on the City of Stonnington so as to lodge a Council submission by the 31 October 2016 deadline, with the following guidance:a) Support recommendations which are consistent with Council‘s existing

policy and advocacy position;b) That officers in responding, critically examine the IV draft in not supporting

an interchange station at South Yarra as part of the Melbourne Metropolitan Rail Project as per previous Council submissions;

3. That Council authorise the CEO to approve the final submission.Carried

The Mayor, Cr Ullin, gave a summary of his year as Mayor. He noted that the past year had been outstanding in terms of achievements. He had begun the year identifying major areas of concern, including: rate capping; the Local Government Act Review; the authority of VCAT; reduction of cars within the municipality and parking issues; intensification of development; and the South Yarra Railway Station interchange. Many of these areas have been the subject of considerable debate with successes in some areas, but no movement in others.

He summarised achievements including: acquisition of additional open space; the campaign for the South Yarra Interchange Railway Station; ongoing protection of heritage buildings; advocacy with governments and peak bodies; completing the Harold Holt Swim Centre works; revamping Prahran Pool; transferring staff from Prahran to Malvern offices; advances in the Cato Street carpark redevelopment; renovation of Malvern Town Hall and Northbrook; planning for new netball courts; development of the Horace Petty Adventure playground; implementing the Biodiversity Program; LED street lighting; development of the Arts and Cultural Program; upgrading Chapel Off Chapel; and support of Melbourne’s major festivals.

The Mayor, Cr Ullin, noted that he was personally involved in many groups, panels and organisations. He thanked fellow Councillors for their support and magnificent participation in many meetings and events, and their involvement with the community. He said he thought it had been an outstanding year – very harmonious and cooperative – the best he could remember in his 25 years on Council.

The Mayor thanked the CEO, Warren Roberts, for his leadership and all Council Officers, noting that without their good advice and support Council would not have been able to achieve so much. He said all on Council had been enormously supportive and that a harmonious Council was wonderful.

The Mayor thanked the Minute takers, Sue and Ruth. He said he could not do his job without the support of his fabulous PA, Rhonda, Fabienne, Judy and Matt. He thanked those who attended Council week by week in the gallery, especially mentioning Phyllis McCrae and Ann Reid.

Cr Ullin said he was retiring from Council after 25 years and 5 mayoralties. He said he was grateful to have had the opportunity to serve this great City and said he would miss this beyond measure. He is confident that the new Council will carry on from the superb groundwork that has been created by past Councils.

The individual Councillors then spoke on their appreciation of Cr Ullin and his work and support of them and the community over his Councillor years and his friendship. They also spoke on the current Councillors that they considered had set the standard of how a Council should work together and she expressed the hope that this would continue into the new Council.

The Mayor, Cr Ullin, thanked everyone for their kind words. He said he couldn’t have worked with a better bunch of people. He particularly noted the help of the CEO, Warren Roberts, with whom he had such good discussions which brought him back to earth.

The CEO, presented the Mayor, Cr Ullin, with a certificate acknowledging his 25 years on Council and all his mayoral years. He also presented the Mayoral book which highlighted Cr Ullin’s term as Mayor, together with copies of the histories of the Cities of Prahran and Malvern as gifts from Council and staff. These presentations were acknowledged with acclamation.

Cr Chandler noted that he and Crs Tini and Jim Athanasopoulos had attended the Seniors Dance on Monday 10 October. He thanked Phyllis McCrae for her hard work in organising these dances.

Cr McMorrow tabled a letter for consideration by the new Council in relation to the East Malvern Men’s Shed, requesting the use of Phoenix Park as a Grant in Kind.

Cr McMorrow noted that he had attended the 2016-17 official opening of the Victorian Blind Cricket Association (VBCA). He tabled an email (13.10.16) from the President of the VBCA which suggests that the Blind Cricket World Cup to be held in Australia in 2022 would be an exciting opportunity for the City of Stonnington.

Cr McMorrow tabled an email (11.10.16) encouraging Council to provide a volunteer Service or Volunteer Coordinator to link local people to volunteer organisations.

The CEO, Warren Roberts, reflected on Council’s four year term, 2012-2016. He said that the new Council would have big shoes to fill as there had been many significant achievements over the past four years. He thanked Cr Ullin for his contribution to the City of Stonnington. In particular he noted Cr Ullin’s support, insight, and preparedness to tackle hard issues; strategic perspective, community values, respect and friendship; general meeting focus; and the many hours at Council meetings.

The CEO gave a summary of this term noting that there had been: 174 Council meetings; 259 consultative meetings; capital expenditure of $163m; 3,946 planning applications with a total value of $4.2b; 362 appeals; 84 major community events drawing over 200,000 people; 89,228 tonnes of waste; 41,772 tonnes of recycling and 13.5m bins emptied. He noted the many energy and water efficiency measures and the Yarra River Biodiversity Project which cost $3.5m. Over this term there were 11 Councillors who all had the community interest at heart and gave tirelessly. Councillors were prepared to think and act strategically with a view to addressing current and long term issues. He said that Councillors should be proud of their achievements and legacies. He thanked them and wished them the best for the future.

The Mayor, Cr Ullin, then presented to Mrs Carole Stubbs a Councillor Book that recognised each Councillor from this term of Council, including the late Adrian Stubb’s The presentation was acknowledged with acclamation.

N. Urgent BusinessThe General Manager, Planning and Amenity, Stuart Draffin, noted that a matter related to 558 Waverley Road seeking interim heritage protection was an item of Urgent Business.

In light of the threat of demolition of the dwelling at 558 Waverley Road, Malvern East proposed in planning application 459/16; and Context’s recommendation to pursue heritage protection on an individual basis, that Council:1. Requests that the Minister for Planning prepare Amendment C247 to the

Stonnington Planning Scheme in accordance with Section 8 (1) (b) and 20 (4) of the Planning and Environment Act 1987, to provide interim heritage protection to 558 Waverley Road, Malvern East.

2. Applies to the Minister for Planning to obtain authorisation to prepare Amendment C248 to the Stonnington Planning Scheme in accordance with Section 9 (3) of the Planning and Environment Act 1987, to apply permanent heritage protection to 558 Waverley Road, Malvern East.

3. Applies to the Minister under Section 20 (1) of the Planning and Environment Act 1987 for an exemption from the requirement to give notice under Section 19 (2) of the Planning and Environment Act 1987 for Amendment C248.

4. Authorises Council officers to prepare Amendment C248 documents for authorisation and exhibition.

5. Once authorisation is received, exhibit Amendment C248 in accordance with the Ministers requirements.
