Setting the Stage: Just What is the Cannabis Industry, and How Does it Impact Your Property.

Who better to help us define and understand the cannabis industry than those who operate in it daily. For those currently leasing to a cannabis tenant, has the property been adequately prepared? What if you acquire a new portfolio and a cannabis client comes with it? You don’t know what you don’t know, and what you don’t know can be costly. In this session, attendees will learn the terminology unique to the cannabis industry, as well as specific data around utilization and cost when building and maintaining a property leased by a cannabis tenant.

Mr. McDonald has successfully built businesses in the cleantech, energy efficiency and HVAC industries over the past 10 years. Before joining Surna, Inc., Mr. McDonald was Vice-President-Sales and outside advisor for SunTech Drive LLC, a solar energy equipment supplier located in Boulder, Colorado. He is also the author of Cleantech Sell: The Essential Guide To Selling Resource Efficient Products In The B2B Markets.

Cannabis tenants require special leasing knowledge because their industry requires special building, utility and security needs. Real estate professionals should know what language to use, and what provisions must be considered to produce a lease that protects everyone involved.

Mark N. Tschetter is the Senior Managing Partner of the Tschetter Hamrick Sulzer Law Firm. Mark’s primary focus has been on landlord-tenant matters, and is regarded as one of the top legal experts in landlord-tenant law in the country. Mark believes in educating his clients and has created and personally teaches many workshops in Basic Fair Housing and Advanced Fair Housing, a particular area of interest for him.

HR, IRS, and Other Pitfalls: What Makes a Healthy Cannabis Tenant?

Being able to identify the health of a tenant can be somewhat normalized in most retail, industrial and commercial environments... it is not normalized in the cannabis industry. Real Estate professionals must understand that the cannabis industry requires a higher level of questioning and a unique understanding of policies and practices to ensure a profitable and long-term real estate business partner.

Mr. Tubbs has over 7 years of experience working in the cannabis industry and is the Retail Chair and Secretary Officer of the OSHA Safety Compliance Committee for The Clinic Colorado. In this role he has developed an initial corporate safety-training program, written safety SOPs in accordance with the specific OSHA, DOL and DORA standards for retail facilities. Gustin was the first responder and integral to the completion of The Clinic’s first OSHA inspection.

Melissa Kuipers-Blake as the Chair of Emerging Regulatory Industries will provide a perspective of how state and local governments around the country are addressing legalized cannabis in their own way and what we’re learning moving forward.

Melissa Kuipers Blake has been dubbed “The Negotiator” by ColoradoBiz Magazine and a “power lobbyist” by Colorado Politics, and is a leading lobbyist and seasoned political strategist with more than 20 years of national political experience at the local, state and federal levels of government. In addition to her national lobbying practice, Melissa serves as co-chair of Brownstein’s Cannabis & Industrial Hemp industry group, which helps shape legislative policies for these industries. Having worked on cannabis issues since day one of legalization in Colorado, Melissa has a foundational perspective on the growth of the industry and its players.

It Isn’t Easy Being the First! The Ups and Downs of Colorado’s Path to Legalization & How We’re Turning Lessons to Leadership.

As more and more states legalize both medical and recreational cannabis, many look at one of the leaders – Colorado – for guidance. David Blake was Colorado’s Deputy Attorney General from day one, a position which provided him with a front-row seat to the development and growing pains of a brand new industry. There are stories of the wins, the losses and what Colorado learned from the process.

David Blake previously served as Deputy Attorney General for Legal Policy and Government Affairs in the Colorado Department of Law. Prior to joining the Colorado Department of Law in 2010, Mr. Blake worked for the Office of Legislative Affairs and in the National Security Division, serving as a Special Assistant U.S. Attorney in the District of Columbia, acting as counsel to the Guantanamo Detainee Review Task Force, and working as a trial attorney in the Civil Division. Mr. Blake is a 2007 graduate of the George Mason University School of Law and a 1996 graduate of the Virginia Polytechnic Institute and State University. David Blake is currently partner at Squire Patton Boggs, chairing their State Attorneys General Practice.

Cannabis, as the nation’s fastest growing industry, is impacting real estate in profound way. Without a clear understanding of how the cannabis industry operates and what their concerns are, it makes building relationships difficult. Today’s panel will begin to bring the concerns, surprises, and misunderstandings into focus by leveraging seasoned and experienced professionals in the real estate and cannabis industries.

Dana Coffield is the senior editor for The Colorado Sun, a journalist-owned, ad-free news outlet based in Denver but which strives to cover all of Colorado so that our state — our community — can better understand itself. Dana has also worked as an editor and reporter at a variety of publications along the Front Range including The Rocky Mountain News and The Denver Post, where she directed coverage of the Aurora theater shooting that led to the Post’s 2013 Pulitzer Prize for breaking news.

Dr. Mark Lee Levine is a full professor at the Burns School of Real Estate and Construction Management at the Daniels College of Business. He has been a real estate broker, attorney, investor and professor for more than 40 years, lecturing throughout the U.S. and internationally. He is a two-time Fulbright Scholar to China, has written 52 books and more than 300 articles.

John Lord is owner and CEO of LivWell Enlightened Health, one of Colorado’s leading cannabis companies with 14 locations and more than 600 employees. John leveraged his prior business experience to catapult LivWell, blending marijuana culture and solid business principles to create a company that has a strong brand presence in a very cluttered market space.

Jason Thomas is the Founder and CEO of Avalon Realty Advisors, Inc. Avalon’s core competencies are in cannabis real estate lease/sales, valuations, expert testimony and other consulting requirements. Jason has over 20 years of real estate experience as a broker, property, asset and project manager for companies including CBRE, Inc., Cushman and Wakefield, Inc. and Grubb and Ellis, Inc.

David Wunderlich is a Sr. Attorney at McAllister Garfield, counseling marijuana, hemp, and CBD businesses to help them navigate the complicated waters of federal and state cannabis laws and propel them forward. David focuses his practice on business formation, regulatory compliance, real estate, and intellectual property. David is proficient in Spanish and applies his wide base of experience to the various legal issues that face cannabis businesses.

Show Me The Money! Risk and Rewards.

The difference between perceived risk vs actual risk may create opportunities for the well-informed Investor, Lender, Real Estate Manager, and Realtor. “How do I get paid?’ and “How do I handle transactions involving money?” The answers to those questions may not be what you think. There are risks in investing in or lending against properties involved with cannabis that need to be considered.

Robert (Bob) Amter is the President and founder of Montegra Capital Resources, LTD. Montegra Capital was formed in 1971 and has been funding loans secured by first mortgages on cannabis tenanted properties since 2014. Montegra has funded significantly more loans against this type of collateral property than most other Colorado private money lenders and has experienced few problems.
