Item 5 Matters Arising from previous meetings Councillor Mark Glover (Chair) asked that Item 5 of the previous minutes be

amended to “the chair asked a member of the noise team to attend the next community council meeting”.

The minutes of the meeting for May 7th 2008 were agreed as being accurate and true record and was duly signed by the chair

Item 6 Matters Arising Item 6a Report back on Consort Road/Brayards Road/Gordon Road The Chair asked Councillor Susan Jones to report back on Consort

Road/Brayards Road/Gordon Road. Cllr Jones said that she had presumed that an officer would be at the meeting to report on it. The Chair asked Nadine James (community Involvement coordinator) to make enquiries about this and report back to the next meeting.

The Chair asked Cllr Jones to report back on Item 6b. Cllr Jones said that while she had received a letter a month previously from an officer, she had not received any notification that she had been expected to report back on this matter. A copy of this letter was then found and the Chair then said he would come back to this item once Cllr Jones had re-read the correspondence.

Item 6c Report back from BT re the phone box outside the White Horse pub & Troy Town Residents

The Chair said that a letter had been sent to BT in respect to this but he had not yet received a response.

Item 6d Dog Control Order for One Tree Hill - Jon Sheaff - Parks The Chair said that this item had been moved to the next Nunhead & Peckham

Rye Community Council Meeting on October 1 2008. Item 6e Street Leader Scheme update - Barry Assinder, Street Leader Project

Manager - Public Realm Barry Assinder gave a quick overview of the Street Leader scheme which

started approximately 5 years ago as environment Street Leader scheme under Dave Taylor. Mr. Assinder had become Project Manager working on the housing sector of the street leader scheme about a year ago and since then had been trying to bring the Housing and Environment Schemes together. There had been a month’s consultation last January and they had now managed to find a way of producing individual statements and not one covering the whole of Southwark. This was being trialed for about six months, after which he would seek feedback from street leaders on whether or not this was the preferred way. The Street Leader scheme was still in operation; currently there were 385 environment street leaders and 135 housing street leaders and Dave works with 750 junior street leaders. They were still recruiting people.

Q1 A Resident said she was glad that the Street Leader scheme was still up and running and that they would now receive individual statements. She also wanted to know if the special Street Leaders hot line system was still working.

Q2 A Resident asked when the call centre would be fully informed about street leaders and what they do. The resident said that whenever she calls the centre she was continually asked for her name and postcode even though she gives her street leader number. She was also unhappy about the amount of time it took to resolve things. One incident regarding the clearance of some dog fouling, took 38 minutes over 5 days on the phone. A request for a visit to the call centre to be arranged for them to see how it works.

A1 & A2 Mr Assinder said that the priority line does work however; street leaders were not given absolute high priority. There were some higher priorities an example being Anti-Social Behaviour. Your call was on behalf of other residents so would be given a high priority. There was a vast amount of calls coming into the call centre but, accept they do need more training. The Housing scheme had only 3-4 staff dealing with street

leaders so they knew about the scheme, the environment scheme had 60-70 staff who dealt with all calls.

Q3 A street leader said that they need training regarding private land. In May she reported fly tipping on private land and in June found out that nothing had been done. Street leaders need training on how to deal with this. Was there anyone in Housing that carried out visual audits? She had made several observations regarding this over the last two years and nothing ever happened.

Q4 A street leader said receiving a statement of what was happening in the whole borough was better; he could not see the value in individual ones. Also he had not heard from the Project Leader for months nor had there been any meetings. There used to be so many ideas and information shared at these meetings, the scheme had lost its value.

A3/A4 Mr. Assinder said that as there were about 1200 issues raised a month they could not produce one document any more, however, the individual statements would include information about the top 10 issues raised and examples/ information. They were looking towards produce statements by ward/community council area sometime in the future. Regarding fly tipping – the Council was obligated to remove fly tipping from public land and highways, however, when dealing with private land they need to find out who owns the land and then request them to take appropriate action. The Chair summed up and asked people to register their interest for a visit to the call centre with Nadine James. The Chair also asked Mr Assinder to inform the community council of meeting dates so that they were aware and could also pass the information on at cc meetings.

The Chair then went back to item 6(b) Item 6b Noise nuisance activities on Walton Rd Cllr Jones said that on May 7 2008 a statutory nuisance was witnessed and a

warning letter was sent regarding this on May 27 2008. Cllr Jones said that she would report back if there were any more updates.

7 Community Slot Item 7a Local Involvement Networks (LINKS) - Paul Bruce, Corporate Strategy Paul Bruce reported that LINKs was a government initiative which gives

members the ability to watch over and observe the delivery of health and social care across services including GP services, residential care and other services. The council had been looking to procure a host organisation to manage this new initiative. Residents were already involved and approximately 20 residents so far wanted to be actively engaged. It was about giving a voice regarding any concerns. Those involved would have powers to enter residential care premises and speak to residents and review the service, even in hospitals. If you don’t

like the service you could report it to the committee who had overview and scrutiny powers. Residents were encouraged to become involved as this really affects everyone. The council should know, by the beginning of August, which organisation will host LINKS. The final meeting for the current group was on the 22nd of July at the Town Hall and everyone was invited to come along.

Q1 Do you have a website or email where you could be contacted? A1 Details were on the flyer and on the Southwark Alliance website. Item 7b New Community Venue in Nunhead & Peckham Rye - Nadya Smith –

Group of parents of the students of Ivydale School Nadya Smith spoke about a new community space to be made available for

public use. It was available for hire at a cost of £6 an hour. It was based at ground floor of the old school keeper’s house at Ivydale Primary School on Ivydale Road. See Appendix 1 for programme of activities.

Q1 A resident asked if they had contact information. A1 Ms Smith had no details but this would be provided later.

The Chair asked that the information be circulated at the next meeting.

Q2 A Resident asked if Ms Smith was part of a community group. A2 Ms Smith said that they were a group of parents of the students of Ivydale

School

Item 7c Community Games Summer Programme - Tim Hetherington, Environment and Leisure

Tim Hetherington manager of Southwark Community Games said he managed a large community Sports team across Southwark. Community Games have been organised on housing estates, open spaces and schools. They operate in 8 schools in the Nunhead area. In 2006-07, 8,010 individuals were involved, making a total of 33000 visits. This improved by over 1,000 visits in the 2007-08. Each session runs for an hour. Disability Sport 2008, commissioned this for adults with disabilities who were not active. Community Games works in partnerships with schools. Currently young people have the opportunity to play on Nintendo sports games to encourage participation in active sports. From 28th of July to 22nd of August community games will be working across Southwark on approximately 40 sites 3, 400 metre Athletic tracks specifically marked will be provided. There should be 6 venues, 10 sessions in Nunhead. A

60 metre portable athletics track had also been proposed. Mr. Hetherington introduced Sampson Oni, one of Community sports trainers, as a high jumper and a potential Olympic candidate.

Q1 A resident asked if the team operated only from Monday to Friday or if they worked weekends as well?

A1 Mr Hetherington responded that during the summer as well as run sessions in the week, they take part in the large events at weekends.

Q2 A resident said that people over 60 need exercise too. With health problems and many too poor to pay for a tutor, there should be exercise classes in venues not too far from home.

A2 Mr. Hetherington said that there was opportunity for shared resources and people should be given the opportunity to make use of venues.

Q3 Cllr Graham Aubyn showed his appreciation for the work the sports group was doing across Southwark, especially engaging young people.

Q4 A resident said that Clifton Estate which the Lane Ward Councillors know about, had not had any activities arranged for the youth this summer, could something be arranged for that estate?

A4 Mr. Hetherington said he would look into it. Item 8 Cleaner Greener Safer(CGS) Update: Tim England - Environment &

Housing The Chair said that the decisions for the CGS schemes would be announced

that evening. Tim England, with the use of presentation slides, showed all the projects to attendees at the meeting. There were several questions but as Mr England was new to this position he spoke to residents with questions during the break.

Item 9 Cleaner Greener Safer (CGS) Decisions The Chair said that there had been a meeting on the 1st of July to give

applicants the opportunity to say a few words about their schemes. Overall, there was £368, 000 to allocate to schemes. The Chair explained that they had been able to fully fund some schemes, whilst others would be partly funded. CGS schemes funded were listed as follows No. Scheme Ward Amount

Item 11 Update on planning enforcement – Dennis Sangweme, Regeneration The Chair requested that Dennis Sangweme update the community council on

planning enforcement. At the last meeting planning enforcement was a big issue so members decided to put it under ‘community scrutiny’ for the next 4 to 5 meetings. Mr. Sangweme said that Planning would be preparing a quarterly report on planning enforcement for the Community Council The Planning department had the statutory powers to investigate unauthorised developments. Mr Sangweme said that at the previous meeting there had been a request for an updated report on 5 sites Mr Sangweme went through each oneas listed below.

1-4 Holly Grove Alleged Breach: (i) Unauthorised fascia signage (ii) Use of premises as a meet and fish market without planning permission. Progress:

(i) The offending signs side elevation of the building facing Rye Lane fish market had now been removed.

(ii) Retrospective planning application, 08-AP-0428 to retain the use hadbeen validated and was currently under assessment by Victoria Lewis the Case Officer Extension (55410). Seven letters of objection hadbeen received in respect of the development so the application wouldmost likely be determined by the Nunhead & Peckham RyeCommunity council in the event that Officers recommend approval. A successful outcome would allow the continuation of the use whilst refusal would result in Enforcement action to cease usage.

207 Rye Lane Alleged Breach: (i) deliveries being made prior to 8am Progress: The Planning Enforcement case in respect of this address had now been closed. The Bakery does not have any formal conditions restricting the hours of its deliveries. The former user of the site was a hardware store. Hardware stores fall under Class A1 Retail, Class 1 Use of the Land Use Gazetteer (Volume 1), as does the Bakers Shops. An application for the new use was therefore not necessary. Environmental Health Enforcement had therefore agreed with Mr. Ismail that deliveries should not occur before 7:00am. Mr Ismail had informed ADM Milling of this restriction and an advisory note had been placed on Mr Ismail’s account. Every dispatch note for deliveries from ADM Milling to 207 Rye Lane makesnote of this restriction for the drivers’ attention. Constituents had been advised to contact the 24 hour number for noise complaints on 020 7525 5777 should noise continue to be a problem at the site. If noise complaints continue, Environmental Health would consider moving the delivery restriction to 8:00am. 90 Astbury Road

Alleged Breach: (i) unauthorised change of use from dwelling house to children's home Progress: This site was currently the subject of Enforcement action and a detailed report would be provided for the next NPR Meeting. 121 Bellenden Road Alleged Breach: (i) unauthorised use of premises as a hot food take away (A5). The use of this address as an A5 take-away shop had now ceased and the Enforcement Notice had been complied with. The case had been closed and the site would be monitored to ensure that another A5 use would not commence. 153, 167, 171, 173, 177, 189 and 193 Queens Road were all being reviewed. Planning history for each one of these addresses had been collated and respective Enforcement action would be forthcoming if Planning applications were not received where they were required. It was also noted that there was an unsightly hoarding at 171 Queens Road which was currently the subject of another Enforcement case by our Special Projects Officer, Melissa Shipman. Reports on each address to be provided for the next NPR CC. Ashosh House, 179-181 Queens Road There were several issues surrounding uses at this address which were the subject of enforcement action. Unauthorised signage, a place of worship, a mini-cab office and alterations to a garage were being investigated by our Special Projects Officer. A detailed report to be provided for the next NPR CC.

Q1 A resident stated that the bakery “does not start at 7am, it starts at 5am”. Deliveries were still being made at the back of the street.

The Chair asked for the planning enforcement team to speak to the proprietor again to give them another warning.

Q2 Cllr Jones asked why that particular business was loading and unloading behind a residential area? She said that she had written numerous letters requesting an investigation into the breach to be done properly. Cllr Jones felt that the breach had not been dealt with in a satisfactorily way.

Q3 Cllr Althea Smith shared her concern about 90 Astbury Road, and wondered why it was that planning enforcement had suddenly noticed this long ongoing breach?

A3 Mr Sangweme said that they recognised this breach and were duty bound to

investigate, and would be reporting back on it fully at the next meeting. Q4 A resident stated that they had been trying to get information from the Council

about it for long enough and residents in Astbury were wondering when something would be done.

Q5 Cllr Dominic Thorncroft – asked if an update could be provided for 46 Gibbon Road?

A5 Mr Sangweme said that there had been a letter from the solicitors about this but the planning department had not been able to gain access to establish this Enforcement would deal with it as soon as they gained access.

Q6 A resident said that Cllr Gordon Nardell had said he would arrange a meeting with the key officers and agencies in the area; could there be a report back for the next community council?

A6 Mr Sangweme acknowledged the need for information sharing around enforcement issues.

Cllr Fiona Colley said that it was one of the topics chosen to be scrutinised this year. They would be looking at planning enforcement practices and outcomes and Peckham would be used as a case study.

Item 12 Public Questions The Chair invited Keith Hoy to put forward his case. Mr. Hoy said that he

wanted to personally thank the Councillors on this matter. He had been issued with a Fixed Penalty Notice for throwing out rubbish and fly tipping. The day the council picked up rubbish had been changed but he had not been informed of the change and had been putting out his rubbish on the old day for some time, then he got the notice. He appealed against it and got the help of Councillors especially Cllr Nardell who had written a letter on his behalf.

The Chair said that this would be followed up. The Chair said that ‘Susan’ had raised a question about the closure of the one

O’clock play room which would take 3 years to be reopened. Susan was not present and the Chair said that a written reply would be provided.

The Chair then asked for Cherrie to raise her question. Cherrie had already left but her question was why Nunhead & Peckham Rye CC had not invited Children’s Services along to talk about items such as the joint area review as items on the agenda were always similar. The Chair said that this item would be raised again.

On behalf of the residents, Cllr Jones raised the issue of street drinking and anti-social behaviour on Choumert Road Cllr Jones had spoken to Cllr Nardell about this and he said the Council could treat this around the whole issue of nuisance. Cllr Jones said she would request something be done over the summer and a proper written statement about the nuisance that appears to be groups of people socialising outside people’s houses which affects residents trying to enjoy the peace and quiet of their own homes.

A resident wanted to know about the new 24 hour parking charge at Choumert Road car park.

Cllr Jeff Hook said that he was not aware of these charges and would come back on reporting this issue.

Item 13 Southwark Environment & Transport Strategy - Cllr Hook - Executive Member

Cllr Hook told the meeting that Southwark makes a yearly bid called the Local Implementation Plan (LIP) to Transport For London to make improvements around the borough. He said that there had been consultation with community councils on improvements they would like to see in their area and a bid had gone to TFL. TFL look at how the schemes fit into their own transport strategy they then award money accordingly. Public Realm then carries out the works. An example of this would be improvements to the stations in Nunhead and Peckham Rye. Southwark had just submitted projects for 2009 -2010, a bid for £1.35 million had been submitted to TFL for the area. They had been successful in gaining £843,000 for this particular community council area for 2008-2009. Funding included 20 mph zones; Cycle training; addressing local transport trends; safety trends; cycling schemes; repairing the general condition of road and transport infrastructure. Other monies such as Developers contributions to S106 agreement; Capital money from the Council goes towards improvement to stations etc. There was a Capital £5M fund for potholes and other minor improvements across the borough 2008/9 £843,000 for NPR. Two of the big items were road safety schemes around Peckham Rye/Sternhall/ Nigel Road which cost £350 - road improvement is not cheap. A new pedestrian crossing costs upwards of £100k. There were many safety measures being put in place in NPR. For 2009/10 what residents prioritised had been taken on board and a bid for £1.35m had been submitted. Again largely road safety schemes. Cllr Hook told the meeting that Southwark were expanding the London cycle network costing £250, 000, and they had put in a bid for Peckham North East costing £160,000 to tackle speed in the area. With the regeneration to South end of Peckham including Queens Road, building on Section 106 and other funding schemes that cost another £200k. They had been working closely with the rail people to obtain further funding for Queens Road station. With regard to Nunhead Station, - neighbourhood funding had been acquired for the cosmetic improvements to the entrance of the station. Peckham Rye station regeneration ongoing. Rye lane improvements, etc.

Cllr Hook said he had taken over the executive post in May and had not realised how much people were unaware about the improvement schemes in the borough and their local area. He had laid plans for an interactive website which would keep everyone informed of various improvements, ongoing and future, throughout the borough and their local area in detail.

Q1 Cllr Dominic Thorncroft was concerned about the way funding was allocated. Having met with residents and officers to prioritise issues in the past, unfortunately, none of which was ever followed through. NPR was looking at this again; what assurances could Cllr Hook give that funding would be provided for projects prioritised by residents/community council?

A1 Cllr Hook responded that there was a need to look at what award and criteria Transport for London had provided this year. TFL would only give Southwark a certain amount of funding which was aligned to their priorities.

Q2 Cllr Glover said that NPR needs more money, places like Borough & Bankside receive a lot of money we need to get the message across.

A2 Cllr Hook said that works in Borough & Bankside was usually S106 money

Q3 A resident asked about plans regarding the rat run in Queens Road? She had previously spoken to Mr Downes, who asked for information to be sent to him whom she e-mailed but he had not acknowledged her. When the new traffic scheme comes in from New Cross to Peckham things would get worst.

A3 Cllr Hook said that would have to be looked into. Wherever possible, S106 money was used to sort out issues like rat runs such as the one Queens Road.

Q4 Cllr Colley - said that regarding the area of transport, it was very difficult to find information. People feel that they make suggestions and they just go into a black hole. They do not know or understand how decisions were made

A4 Cllr Hook said that he was trying to improve communications – everything would be captured on the website and people would be able to see what had been bid for, where, and at what stage in planning it was at that time.

Q5 Cllr Colley asked Cllr Hook his view of the effectiveness of existing 20mph zones. There had been complaints about measures taken such as road humps which were not working.

A5 Cllr Hook said that he regularly drove around the borough and was aware of the dangers of the 20mph roads with the cushions, not the humps, as people swerve to avoid the cushions. They were looking to technology to help; average speed cameras were an example. The 20mph had to be self enforcing; police would not enforce it so presently looking at other measures.

A Resident from Clifton Estate said that the temporary surface by Consort Road

/ Peckham High Street had worn off in a week and the tarmac by the bus garage was so damaged it was causing buses to slide and skid into pavements. She also felt that the speed humps from Consort Road to Nunhead were wasted. The resident said that she had requested rules for blue badge holders for estates and had been waiting for a response for more than three months.

Q6 A resident said that she was thrilled that an executive member was attending the community council meeting. She asked about the role of the Southwark Consultative Transport Forum and how to engage more people from different community council areas to be represented on it. She hoped that Cllr Hook listened with regard to the poor planning enforcement in the Peckham area. Finally as there had been such a delay on the Peckham Area Action Plan and there had been no information provided, the local public had no idea what was going on.

A6 Cllr Hook said that he tried to attend meetings when invited. He said that he was looking to merge the Environment Forum with the Transport Forum as there was a cross over of issues. Items could then be fed into the strategic board; everyone was welcome to attend these Forums.

Cllr Glover spoke about the new transport group and that any issues from it would need to be fed into something but not sure what or where the group fits in.

Cllr Hook said that issues from the transport group could be sent with representatives to the forums to pass on be given to those concerned along with any written reports to be fed in. The forum was for everyone.

Q7 The Chair asked about the issue of the temporary bridge over Camberwell Grove which needs to be properly repaired. He also mentioned the issue of stabbings in the area and the concern of a victim’s parent regarding CCTV in the area being used for traffic purposes only and not as part of enforcement.

A7 Cllr Hook said that the CCTV was paid for by the traffic people who people have agreed that when they were not policing traffic items they could be used for crime detection on the request of the police.

The Chair asked Cllr Hook if he could send a note regarding items requested and those he promised feedback on.

RECOMMENDATION(S)

1. It is recommended that the local parking schemes detailed in the appendices to

this report be approved for implementation subject to the outcome of any necessary statutory procedures.

BACKGROUND INFORMATION 2. This report presents proposals for a number of local parking amendment schemes,

which are matters reserved to Community Council for decision. 3. The origins and reasons for the proposals are discussed in the main body of the

report.

KEY ISSUES FOR CONSIDERATION Gordon Road (0809Q2010) 4. The network development team received an enquiry in June 2008 by Cllr Colley in

regard to obstructive parking, on the public highway, at the junction of Gordon Road and entrance to Cossall Estate Car Park.

5. Network development made a site inspection and noted the road layout and street

furniture. At the time of the site visit it was noted that no vehicles were parked causing any obstruction to sightlines, however, it was reported that the problem exists in the evenings and at weekends.

6. The parking pattern is similar at the junction of Gordon Road and Maya Close

(opposite Cossall Walk) and for this reason network development is including this junction as part of the same item.

7. To ensure that sight lines are maintained for all road users it is recommended that

parking is prevented at the junction of Gordon Road and its junctions with the Cossall Estate car park and Maya Close shown in Appendix 1

POLICY IMPLICATIONS 8. The recommendations contained within this report are consistent with the

polices of the PEP and associated Local Implementation Plan (LIP).

9. The proposals will support the council’s equalities and human rights policies and will promote social inclusion by:

• providing improved access for emergency vehicles, refuge vehicles, residents

and visitors; • improving sight lines for all road users; and • improving junction and pedestrian safety, especially those with limited mobility

or visual impairment. COMMUNITY IMPACT STATEMENT 10. The policies within the Parking and Enforcement Plan are upheld within this

report have been subject to an Equality Impact Assessment (EqIA).

RESOURCE IMPLICATIONS

11. The Head of Public Realm has confirmed that any costs arising from implementing the proposals, as set out in the report, will be fully contained within the existing budget.

CONSULTATION 12. No informal consultation has been carried out. 13. Should the community council approve the item, statutory consultation will take

place as part of the making of the traffic management order. A proposal notice will be erected in proximity to the site location and a press notice will be published in the Southwark News and London Gazette. If there are objections the proposal or a modified proposal will be re-submitted to the community council.

14. The road network and parking manager has been consulted on the proposals and

has no objections. 15. No consultation or comment has been sought from the borough solicitor &

1. It is recommended that the proposed disabled parking bay and revision to the

existing residential doctor’s parking bay as set out below are approved for implementation subject to the outcome of any statutory consultation.

BACKGROUND INFORMATION

2. This report presents proposals following representation by The Gardens Patient

Participation Group and consultation with The Gardens General Practitioners Centre, for a local traffic management scheme, which are matters reserved to Community councils for decision.

3. The Gardens Patient Participation Group raised concern that no disabled parking provision was available for those patients with mobility problems who use The Gardens GP Centre, located in an area subjected to free on street parking. In considering this request, a review of the existing resident doctors parking bay has been carried out to reflect their requirements for parking Monday to Friday only

KEY ISSUES FOR CONSIDERATION 4. The reasons for the proposed traffic schemes are set out in the Appendix B.

5. The proposals are consistent with the policies set out in the draft Parking and Enforcement Plan, which in turn reflects the Council’s policy priorities as set out in the Community Strategy and the emerging Transport Plan.

6. The proposals will support the Council’s Equal Opportunities Policy and will promote social inclusion:

by providing improved access for emergency vehicles and residents for disabled drivers increasing parking provision

RESOURCE IMPLICATIONS 7. Implementation of the proposals can be undertaken within existing budgets.
