A RESOLUTION approving the Joint Committee Report of Committee on Urban Planning & Development and Laws and Government denying the request for issuance of clearance upon the request of Mr. Antonio Limcauco for the construction of the proposed "Gasoline Station Building (DO Shell Station)" to be located at Santa Rosa Commercial Complex, Barangay Balibago, City of Santa Rosa, Laguna as provided for in the herein attached Joint Committee Report marked as ANNEX "D".

In principle, the specific · location of a gasoline: . station as . within the premises_ of the commercial complex coupled with the admission that it will sell oil and fuel products disqualify ·· the . applicant from· establishing said business operation, and, therefore,. the City Council is now forced to adopt the. doctrine of a General Welfare , Clause and so · deny for the application of the ordinance allowing the business to reside ip the premises of Balibago Complex in Santa Ilosa C~ty as dangerous and risky to the conununity.

It ~ehooves us, that the application letter expressly ~dniitted that the situs of a gasoline station "Ang lote nan1in 01 nasa kalooban ng isang commertial complex at hindi residentiql subdivision" such admission gave us the irnperative notion to reject the application for the issuanc~ of an ordinance allowing the establishment of a gasoline Shell Sta~o~. ' ·.

Th~s the herein City. Council is authorized by its power to enact such ordinances and make regulations, not repugnant to law, as may be necessary to . carry into effect and discharge the . powers . and duties conferred
