HOW TO APPLY A person can apply by making a request for information under RTI Act
in writing or through electronic means in English or Hindi or in the official
language of the area with the prescribed fee to the Central Public Information
Officer or the Assistant Public Information Officer, as the case may be.
WHAT IS THE TIME PERIOD The Central Public Information Officer, on receipt of a request, shall as
expeditiously as possible, shall within thirty days of the receipt of the request
either provide the information or reject the request for any reasons specified in
Section 8 and 9.
EXEMPTION FROM DISCLOSURE OF INFORMATION UNDER SECTION 8 AND 9 There shall be no obligation/binding to give any citizen –
(a) Information, disclosure of which should affect the sovereignty
and integrity if India, the security, strategic, scientific or economic interest
of the state relation with foreign state or lead to incitement of an offence.
(b) Information which has been expressly forbidden to be published by
any Court of Law or Tribunal or the disclosure of which may constitute
Contempt of Court.
(c) Information, the disclosure of which causes breach of privilege of
Parliament or the State Legislature.
(d) Information including commercial confidence, trade secrets or
intellectual properly. The disclosure of which harm the competitive
position of a third party, unless the Competent Authority is satisfied that
Layer Public interest warrants the disclosure of such information.
(e) Information available to a person in his fiduciary relationship unless
the Competent Authority is satisfied that the Layer Public interest warrants
the disclosure of such information.
(f) Information received in confidence from foreign Govt.
(g) Information, the disclosure which would endanger the life of physical
safely of any person or identity the source of information or assistance
given in Confidence for law enforcement or security purpose.
(h) Information which would impede the process of investigation or
apprehension and other officers.
(i) Cabinet papers including records of deliberation of the Council of
Ministries, Secretaries and other officers.
(j) Information relates to personal information, the disclosure of which
has no relationship to any public activity or interest, or which would cause
unwarranted invasion of the privacy of he individual unless Central/State
Information Officer or State Public Information officer or the appellate
Authority is satisfied that larger public interest justifies the disclosure of
such information.
Accordingly to Section 9 Central/State Public Information officer may
reject request for information where such request involves infringement of copy
right subsisting in a person other than state.
COST OF PROCESSING THE INFORMATION
1. A request for obtaining information under sub-section (1) of Section
6 should be accompanied by an application fee of Rs. 10/- by way of cash
against proper receipt or by Demand Draft or Bankers Cheque payable to
the Accounts Officer of the Public Authority.
2. For providing information the fee shall be charged by way of cash
against proper receipt by Demand Draft or Bankers Cheque payable to the
Accounts Officer of the Public Authority at the following rates.
(a) Rupees two for each page (in A4 or A3 size paper) created or
copied.
(b) Actual charge or cost price of a copy in larger size paper
(c) Actual cost or price for samples or models and (d) For inspection of records, no fee for the first hour; and a fee of
Rs. 5/- for each subsequent hour (Or fraction thereof)
(e) For information provided in diskette or floppy Rs. 50/- per
diskette or floppy
(f) For information provided in printed form at the price fixed for
such publication or Rs. 2/- per page of photocopy for extracts from
publication.
The applicant who are denied information sought or he is not satisfied with

SOP FOR HANDLING OF RTI APPLICATIONS AT NCC DTE ODISHA
INTRODUCTION
Right To Information Act, 2005
1. The Right to Information Act, 2005 was enacted with the approval of Parliament
and published in the Gazette of India by Ministry of Law and Justice(legislative
Department, New Delhi) on 21 Jun 2005.It is an Act to provide for setting out the
practical regime of right to information for citizens to secure access to information under
the control of public authorities, in order to promote transparency and accountability in
the working of every public authority, the constitution of a Central Information
Commission and State Information Commissions for matters connected therewith or
incidental thereto.
2. The RTI replies need to be time bound in order to avoid penalty for delays. It is
therefore, essential that the RTI cases are monitored at appropriate levels. Besides, to
ensure correct information, it is necessary that the same are vetted at appropriate
levels. The orders in the succeeding paragraphs lay down the organization of RTI Cell
at NCC Dte Orissa and procedure for handling RTI applications.
Salient Features
3. The salient features of the RTI are as follows:-
(a) One can seek information from any department of the central or state
government, from Panchayatraj institutions and from other organizations and
institutions(including NGOs) that are established, constituted, owned, controlled
or subsequently financed, directly or indirectly, by the State or Central
Government [section 2(a) & h)].
(b) Information sought from Public Information Officer (CPIO) has ordinarily to
be provided or refused within 30 days. Information regarding the life or liberty of
an individual has to be provided within 48 hours[7(1)]. That sought information
from an APIO has ordinarily to be provided or refused within 35 days[5(2)].
(c) In case a person fails to get a response from the CPIO within the
prescribed period or is aggrieved by the response received, he/she may file an
appeal within 30 days with an officer superior in rank to the CPIO [19(1)].
(d) In case the appeal is allowed, the information shall be supplied. If it is not,
then the applicant has the right to appeal within 30 days to the Central or State
Information Commission for information regarding the central or state
government, institutions respectively[19(3)].
(e) If a CPIO fails to furnish the information asked for under the Act or fails to
communicate the rejection order, within the time specified, the CPIO shall be
liable to pay a penalty of Rs. 250/- per day for each day of delay, subject to a
maximum of Rs. 25,000[ 20(1)].
(f) There is however, a clause in the RTI that extension of up to 30 days is
permissible, whenever it involves a large number of records or searching through
a large number of records and meeting the 30 day limit would unreasonably
interfere with operations; extra-departmental consultations are required that
cannot be reasonably completed within the 30 days; or third party notifications is
required.
ORGANISATION AT NCC DTE ODISHA
4. Appellate Authority & RTI Cell at NCC Dte Orissa The following officers have
been nominated as Appellate Authority, CPIO and APIO at NCC Dte Odisha :-

Duties
6. Whenever an RTI is received, AD(P&C)(APIO) will process & put up within 2
working days receipt of RTI to CPIO who will process within 2 working days & reply aftr
perusal of DDG(AA) to complainant.

HANDLING OF RTI APPLICATIONS AT NCC DTE ORISSA
Procedure
8. On receipt of an RTI application, CPIO is to forward it to the concerned Branch at
the Dte, who in turn is to prepare a suitable reply, get it approved from Nominated
Authority(from Branch Officers) and forward to Appellate Authority (DDG) for approval.
CPIO is to send the approved reply to the applicant.
9. All concerned are to keep in mind the need to adhere to the stipulated time limits
and in case, some information is required to be obtained from Gp HQs/Units, the same
is to be done expeditiously.
Detailed Modalities
10. On receipt of an application, CPIO is to forward it to the concerned Branch within
three working days. He is to specify the time limit for submitting the reply, keeping the
modalities of the case in mind.
11. (a) The concerned Branch is to prepare the reply and obtain the approval of
the CPIO.
(b) The reply should invariably cover all points/queries raised in the RTI
application, ensuring that neither any vague or additional info is provided.
12. The approved reply received from the concerned Branch will be forwarded by
CPIO to the applicant.
13. It is the responsibility of the concerned Branch at Dte to monitor and
expeditiously obtain the reply/inputs from Gps/Units, if required, keeping stipulated time
limits in mind. The info so received is to be analysed by the concerned Branch at Dte for
correctness in terms of existing rules and endorsed accordingly while recommending
approval.
14. In case of a likely delay, an interim reply is to be forward every week by the
concerned Branch till the final reply is submitted.
15. In case any application requires inputs from more than one Branch then:-
(a) CPIO is to nominate a Branch having maximum relevance with the
subject application to prepare the over all reply. Other Branches are to send their
portion of the information to the concerned Branch.
(b) In case more than one Branches are required to reply to the major
portions of the application, CPIO is to collate and finalise the reply before putting
up for approval of Appellate Authority.
(c) Irrespective of the type of case, the Branches are to individually obtain the
approval of Director before submitting the reply.
16. Concerned Branch officers will put up the replies to the Appellate
Authority(DDG), for final approval thereof. Draft replies will be put up to Dy DG at the
discretion of CPIO.
17. CPIO is to send the approved replies to the applicant under a covering letter.
185. At all levels of processing within NCC Dte of Odisha, an unambiguous record of
receipt and dispatch is to be maintained by all concerned.
Delay & Extension
19. There is however, a clause in the RTI that an extension of up to 30 days is
permissible (Para 3(f) above refers). In all such cases, the concerned Branch is to
obtain the approval of CPIO giving detailed reasons for delays and intimate the same to
the applicant after approval of CPIO.
20. In case of delays beyond 30 days extension(total 60 days), the Chief Information
Commissioner(CIC) is to be intimated. In which case also, the procedure at para 17
above is to be followed.
DUTIES/ RESPONSIBILITIES – RTI CELL
21. The members of RTI Cell nominated by the Dte are to keep themselves abreast
of all ongoing cases pertaining to their respective Branches.
22. The RTI Cell is to meet CPIO as per his direction and depends upon the volume
of RTI cases.
23. Each Branch is to maintain a separate record of Progress on the RTI applications
and submit a monthly report as on 01st of every month as per format below to Director
for information of Dy DG.

24. The following is reiterated :-
(a) In case the appeal is allowed, the information shall be supplied. If it is not,

communicate the rejection order, within the time specified, the CPIO shall be
liable to pay a penalty of Rs. 250/- per day for each day delay, subject to a
maximum of Rs. 25,000/- [20(1) ]
(c) All replies to RTI applicant will be forwarded by concerned Branch Officers
and any liability of payment of penalty etc on account of default will rest with the
defaulting Branch/Officer.
(d) In case of any default and if there is a summon for attending a hearing in
the Central Information Commission, then the dealing officer from the concerned
Branch/Nodal Branch will be nominated to attend the same on behalf of NCC Dte
Odisha.

25. These guidelines are to be brought into with immediate effect and are to be
strictly adhered to, so as to avoid any default in replying to the RTI application.
