The Chairman welcomed the members and initiated the discussion. The subjects discussed and the decisions made under each of the agenda point are as follows:

106.1 Confirmation of the proceedings of 105th SEIAA Meeting held on 26th September 2015.

Proceedings of 105th SEIAA Meeting held on 26th September 2015 was read and as there were no comments the same was accepted.

106.2 Action Taken reports on the proceedings of 104th SEIAA Meeting held on 14th September 2015.

The Authority perused and taken note of the action taken on the proceedings of 104th SEIAA Meeting held on 14th September 2015.

106.3 Deferred Projects:

Construction Project:

106.3.1 Expansion and Modification of Mixed Use Development Building, at Sy. Nos. 32/1(P), 32/2(P), 32/3, 32/4, 35, 37, 38, 39, 40, 41, 42/1, 42/2, 43/1, 43/2, 44, 45, 46, 47, 48, 49, 50, Chokkanahalli Village, Yelahanka Hobli, Bangalore North Taluk, Bangalore of M/s. Bhartiya City Developers Pvt. Ltd (SEIAA 146 CON 2014)

It is a proposal for expansion and modification of Mixed Use Development Building Project on a plot area of 4,29,068.00 Sq.mts and with total built up area of 17,40,201.95 Sq.mts including the proposed expansion of 6,87,992.18 Sq.mts. The total water requirement is 6573 KLD.

The Authority noted that the SEAC during the 121st SEAC meeting held on 11th, 12th, 13th, 14th, 15th Nov 2014 have decided to issue model TORs along with the additional TORs for the preparation of EIA by the project proponent. Accordingly TOR was issued on 22-12-2014. The proponent has submitted EIA report on 13-04-2015.

The subject was discussed in the SEAC meeting held on 7th and 8th May 2015, 30th June and 1st July 2015 and 24th, 25th, 27th, 28th and 29th July 2015. The Committee has recommended for issue of Environmental Clearance, after appraising the proposal along with the EIA report, subject to submission of following information.

1. Contour levels of the mother valley with duly marking the ridges. 2. Undertaking to provision for a dedicated in house primary fire station.

The Authority during the meeting held on 14th August 2015 had perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to get the following information for further consideration in addition to information sought by SEAC.

1) Justification for all the features of 3rd Expansion.

2) Details of the provision made for recreational ground area at least to an extent of 15% of the plot area as per NBC norms.

3) Details of Green Belt area along with landscape plan. 4) Compliance on the EC issued for 1st and 2nd expansion. 5) Revised parking calculation as per BBMP, MOEF and BHK norms,

parking plan and details of internal circulation.

6) Comparative drawing superimposing of 1st, 2nd and 3rd Expansions.

7) Present level of construction along with the latest dated photographs.

The Authority also decided to invite the proponent.

The Authority perused the reply submitted by the proponent vide letters dated 25.08.2015 and 14.09.2015. The proponent appeared before the Authority and explained the proposal in brief.

The Authority after discussion decided to clear the proposal for issue of

Environmental Clearance subject to submission of the following information:

(1) Explore the possibility of providing centralized waste water treatment, specially for treating waste water from laundry and floor wash.

(2) Details of structures already issued with E.C. and the proposed expansion in the tabular form.

(3) Details of Recreational Ground Area,

(4) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements and parking plan for corresponding number of vehicles.

(5) Explore the possibility of establishment of upgrading the STP to the level of tertiary treatment for ensuring better utilization of treated water.

(6) Specific social commitment plan with budget, activity and time frame.

106.3.2 Expansion for Aromatic Chemicals manufacturing industry at Plot No.9A, 9B, 10, Nanjangud Industrial Area, Nanjangud of M/s. Padmini Aromatic Pvt. Ltd. (SEIAA 27 IND 2013)

This is a proposal seeking Environmental Clearance for expansion for Aromatic Chemicals manufacturing industry at Sy. No. 9A, 9B, 10, Nanjangud Industrial Area, Nanjangud Taluk, Mysore District under Schedule B(1) of EIA notification, 2006 under Category-B. The total plot area is 6.5 Acres and the total built up area 3,844 Sqm. The total project cost is Rs. 19.72 Crores.

The project proponent has obtained EC from SEIAA vide letter No. SEIAA 17 IND 2011 dated: 02.06.2012.

The KSPCB has issued CFE (Exp) valid for 3 years vide Order dated 26.12.2012.

The Authority noted that the SEAC during the 114th SEAC meeting held on 23rd and 24th July 2014 have decided to issue model ToRs along with the additional TORs for the preparation of EIA by the project proponent. Accordingly the ToR was issued on 04.09.2014. The proponents have submitted the EIA report on 17.03.2015.

The subject was discussed in the SEAC meeting held on 7th & 8th May 2015, 30th June & 1st July 2015 and 17th & 18th August 2015. The Committee has recommended for issue of environmental clearance, after appraising the proposal along with the EIA report, subject to submission of following information:

1. Undertaking that the proponent shall give the high TDS effluents to the CETP

2. Revised soil analysis report

The Authority during the meeting held on 29th August 2015 had perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to get the following information in addition to the information sought by SEAC for further consideration:

(1) Compliance on the earlier Environmental Clearance along with report submitted to KSPCB with regard to consent conditions.

(2) Incremental pollution load on the air/water due to the proposed expansion.

(3) Justification for the proposed infrastructure in relation to the proposed expansion.

(4) Existing / Proposed online monitoring of Air & Water quality parameters..

(5) Risk evaluation, Assessment & Management plan in place in respect of the activities that are being undertaken since 1989 with regard to environment and workers health.

The Authority also decided to invite the proponent.

The Authority perused the reply submitted by the proponent vide letter dated

12.09.2015 and 14.09.2015. The proponent appeared before the Authority and explained the proposal in brief.

The Authority after discussion decided to clear the proposal for issue of

Environmental Clearance subject to submission of the following information:

(1) Technical details & analysis related to the arrival of the efficiency of the existing treatment plant

(2) Capability details of the existing treatment plant to receive the additional load of the proposed expansion

(3) Copies of reports of monitoring of Environmental parameters

(4) Proposed hazardous waste management plan.

106.4.1 Building Stone Quarry Project, Sy.Nos. 39 of Kanivenarayanapura Village, Chikkaballapura Taluk & Dist. (1-10 Acres) (QL No.98) of Sri Ismail, Ward No.14, Kandaur, Chikkaballapura Taluk & District. (SEIAA 890 MIN 2015)

This is an existing proposal submitted seeking Environmental clearance for quarrying of Building Stone in 1-10 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 21st September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 50% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind and with a condition that, an undertaking to make the approach road pucca by asphalting. The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of Building Stone limiting the production to 50% of the proposed production, as recommended by SEAC and with a condition to make the approach road.

106.4.2 Building Stone Quarry Project, Sy.Nos. 528 P of Halekote Village, Siruguppa Taluk & Bellari Dist. (5-0 Acres) (QL No.BLR 336) of Sri C Yanthrodharaka, D.No.138, Sabhapathi Street, Ballari - 583101. (SEIAA 895 MIN 2015)

This is an existing proposal seeking Environmental clearance for quarrying of Building Stone in 5-00 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 21st September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 80% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind, after submission of the following information.

1. An undertaking to preserve the top soil in buffer zone and greenery will be developed over it.

2. Revised EMP budget making provision for garland canal, dust suppression and CSR.

The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of building stone limiting the production to 80% of the proposed production, as recommended by SEAC and subject to submission of information sought by SEAC.

106.4.3 Building Stone Quarry Project, Sy.No.59 of Hosahalli Village, Tumkur Taluk & Dist. (16 Acres) of M/s. Akshaya Stone Crushers, Vinay Land & Others, Sri Daiva Krupa Complex, 2nd Floor, 1st Cross, New Mandipet, Tumakuru - 572101.(SEIAA 896 MIN 2015)

This is a proposal submitted seeking Environmental clearance for quarrying of Building Stone in 16-00 Acres, Gomala Land.

This is an existing proposal, seeking Environmental clearance for quarrying of Building Stone in 1-00 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 21st September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, after submission of the following information.

1. Audit report from 2007 to 2010.

2. The distance from the quarry boundary to River and details of lake nearby.

3. Revised EMP budget making provision for min. 2 check dams to prevent silting up of river & lake.

The Authority noted that the cluster declared by the Senior Geologist, Hassan vide Notification dated 5th August 2015 has two proposed lease areas out of which one is yet to be notified and application is under examination. It is further noted that the reason attributed for declaration of cluster is not appropriate and do not fulfill the statutory requirement and the principles underlined for declaration of cluster. The Authority therefore decided to seek clarification in this regard from the proponent and provide an opportunity to clarify the above issues.

It is a proposal seeking Environmental Clearance for Development of "Nadaprabhu Kempegowda Residential Layout" on a total area of 4043 Acres and 27 Guntas. Total water requirement of project is 52.5 MLD.

The Authority noted that the SEAC during the 133rd SEAC meeting held on 20.3.2015 have decided to issue standard ToRs along with the additional TORs for conducting EIA study by the project proponent. Accordingly the ToR was issued on 31.03.2015. The proponents have submitted the EIA report vide letter dated 10.09.2015.

The Authority observed that it is a residential layout on a large area of 4043 Acres and 27 Guntas forming 40,539 residential plots and high rise buildings on 450.22 Acres. The proposed layout encompasses a large number of water bodies and sensitive places. The Authority after discussion decided to get the following information for further consideration:

(1) Legible layout plan clearly indicating the following aspects on A0 size

drawing:

(a) Residential plots (horizontal growth) (b) Residential 2 - high rise (Vertical growth) (c) Commercial (d) Civic community. (e) Area earmarked for decentralized solid waste management and

handling facility, sewage treatment plant and provision for encouraging re-use of treated water including dual plumbing facility, multi-level car parking in the proposed commercial areas, hospital, crematoria, etc.

(f) Area earmarked for Greenbelt development. (g) Buffer zone proposed around solid waste management facility, STP,

water bodies, etc.

(2) Conformity of the proposed layout to the Revised Master Plan-2015 and deviation if any with reasons and ratification of such deviations if permissible.

(3) Details of sensitive zones indentified in the Revised Master Plan-2015 and proposed action plan to protect such sensitive areas.

(4) Source of water and plan of action to ensure supply of the required water.

(5) Proposal for tapping renewable energy at least for the common utility areas.

106.6.1 Development of 2.5 MW Fuel Cells Technology based Power (FCTP) Project as part of expansion of Intel’s SRR Campus (Intel’s Sarjapur Ring Road) at Deverabeesanahalli, Varthur, Hobli Block, Bangalore South Taluka, Bangalore Urban District by Intel Technology India Private limited. (SEIAA 153 CON 2015)

M/s Intel Technology India Private limited have been given Environmental Clearance from the Authority for construction of SRR 3 Building in G + 9 floors for expansion of Intel's SRR Campus on a plot area of 17.28 Ha with the total built up

area of 1,00,250.8 Sq.mts. vide letter No. SEIAA 197 CON 2013 dated 3rd October, 2013 and the corrigendum dated 03.09.2015. The proponents have now sought Environmental Clearance for setting up of 2.5 MW Fuel Cells Technology based Power (FCTP) Unit as part of expansion of Intel’s SRR Campus.

The proponents have not proposed any new construction or increase / modification in the approved project, except for incorporating setting up of 2.5 MW Fuel Cells Technology based Power Unit. The Authority noted that the Fuel Cells Technology based Power Unit is not included in the Schedule of EIA Notification, 2006 and therefore do not attract the said notification if it is a standalone unit. However, the Authority opined that since it is a modification of E.C. issued in favour of the proponent it has to be reappraised with addition of the proposed new component. The Authority therefore, decided to forward the proposal to SEAC for appraisal duly following the procedure in accordance with the law.

106.6.2 Complaints from Shri Nagesh Naika regarding Environmental Clearances issued for mining granite in Sy. No. 184 of Jyothigowdanapura Village, Chamarajanagara Taluk & District.

Shri Nagesh Naika have filed a complaints against some of the mining companies stating that the E.C issued in this regard are not in accordance with the law. The complainant have questioned validity of the quarry lease and other permissions granted. The complaints dated 29.09.2015 is placed before the Authority for discussion and further order. The Authority noted the complaint and decided to send it to the Deputy Commissioner, Chamarajanagar for further necessary action. 106.7 With the permission of Chair: 106.7.1 Industrial Project Expansion of Sugar Industries from 5000 TCD to 10000

TCD, 30 MW cogeneration unit to 65 MW and also installation of incineration boiler to generate 5 MW power at Sy.No. 148, 144-151 of Mygur Village and Sy.No. 238, 239 of Hippargi and Sy.No. 26,27 of Albal village, Jamakhandi Taluk, Bagalkot District of Sri Rajshekhar S. Nuli, CEO, Shri Sai Priya Sugars ltd. (Unit of Nirani Group of Companies) (SEIAA 6 IND 2015)

This is a proposal seeking Environmental clearance for Development of Expansion of Sugar Industries from 5000 TCD to 10000 TCD, 30 MW cogeneration unit to 65 MW and also installation of incineration boiler to generate 5 MW power.

The Authority noted that the SEAC during the 129th meeting of SEAC held on 9th, 10th & 11th February have decided to issue standard ToRs Standard ToR for conducting EIA study in accordance with EIA Notification 2006 and the relevant

guidelines after duly incorporating outcome of the public consultation. Accordingly the ToR was issued on 03.03.2015. The proponents have submitted the EIA report on 07.09.2015. The subject was discussed in the SEAC meeting held on 28th September 2015. The Committee has recommended for issue of environmental clearance, after appraising the proposal along with the EIA report, subject to submission of following information:

1. Full usage of bio gas and usage of slurry from the ETP plant. 2. Method of prevention of leakage if any from molasses storage tank. 3. Permission letter from Explosives department for storage of sulphur. 4. Project Proponent to plant suitable native tree species. 5. Bi Provision for de fluorination to be included in CSR. 6. Improvement of approach road.

The Authority perused the proposal and took note of the recommendation of

SEAC.

The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information in addition to the information sought by SEAC:

(1) Revised water balance chart clearly indicating various components including mode of disposal of treated water.

(2) Details of storage and transportation of molasses as per the IRC guidelines and the Hazardous Waste (Management & Handling) Rules.

(3) Treatment proposed for defluoridation of water. (4) Commitment for implementation of environmental safeguard

measures proposed in the EMP.

106.7.2 Building Stone Quarry Project of Sy.No.252 (P) of Uragahalli Village, Ramanagara Taluk & Dist. (15-0 Acres) (6.070 Ha) of M/s. M. R. Granites & Minerals Pvt. Ltd., No.540/14, Opp. Sub Register Office, Mysore Road, Kengeri, Bangalore - 560 060. (SEIAA 380 MIN 2015)

This is a proposal seeking Environmental clearance for quarrying of Building

stone in an area of 15-0 Acres, Government Gomala land.

The Authority during the meeting held on 14.08.2015 decided to issue Environmental Clearance for extraction of Building stone limiting the production to 60% of total production as per the recommendation made by the SEAC.

The Environmental Clearance is yet to be issued.

In the meantime the proponent on 07.10.2015 have requested for issue of E.C for the quantity proposed in the quarry plan duly approved by the Department of Mines & Geology.

The Authority perused the representation and opined that the quarrying as per the approved quarrying plan would be sustainable from the environmental point of view. The Authority therefore decided to issue Environmental Clearance for undertaking the quarrying activity as per approved quarry plan.

106.7.3 Building Stone Quarry Project, Sy.No.1118/4 of Bangaramakki Bengre II Village, Bhatkal Taluk & Uttara Kannada Dist. (0-20 Acre) of M/s. Siddartha Stone Crushing Industries (SEIAA 337 MIN 2015)

This is a proposal seeking Environmental clearance for quarrying of Building Stone Quarry in 20 Guntas, Patta Land.

The subject was discussed in the SEAC meeting held on 13th & 14th July 2015

and the committee noted that mining activity in a small area of 0-20 Acres may not be sustainable from the environment safety point of view and also scientific mining cannot be done after provision of buffer zone. The Committee therefore recommended the proposal to SEIAA for rejection of environmental clearance.

The Authority during the meeting held on 25th July 2015 have decided to close the file and delist from the pendency.

Subsequently, the proponent vide letters dated:13.08.2015 & 05.10.2015 have submitted the exemption letter from DMG informing that the quarry site is only 20 guntas and buffer zone area can also be used for mining purpose. The proponent have requested for issue of E.C considering the revised quarry plan.

The Authority perused the request and decided to reopen the file assigning running file number keeping the old file as a back file after the payment of Processing Fee and uploading the details in the online portal.

The Authority also decided to forward the reopened file to SEAC for

appraising on priority as it is a reopened file. 106.7.4 Black Granite Quarry Project, Sy.No.42 of Melur Village,

Chamarajanagara Taluk & Dist. (2-19 Acre) of Sri Madappa (SEIAA 883 MIN 2015)

This is a new proposal seeking Environmental clearance for quarrying of Black Granite in 2-19 Acres, Patta Land.

The subject was discussed in the SEAC meeting held on 5th September 2015. The proponent has given a letter stating that the DMG has declared a cluster combining four quarry leases adjoining each other of same village (883 MIN 2015, 884 MIN 2015, 885 MIN 2015 & 886 MIN 2015) and all the four will do a common EMP and submit the report.

The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 70% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind and subject to submission of the following.

1. An undertaking from the proponent that approach road will be asphalted. 2. Scheme of disposal of wastage.

The Authority during the meeting held on 26th September 2015 had perused the proposal and took note of the recommendation of SEAC. The Authority noted that this is a proposal having a lease area of 2-19 Acres. As per SCHEDULE II A of the Karnataka Minor Mineral Concession (Amendment) Rules, 2013, minimum area for grant of quarry lease in case of Ornamental and decorative building stones is 2-20 Acres. Therefore, this lease area does not meet the minimum requirement of the said Rules. The Authority further noted that the Director, Department of Mines & Geology vide cluster Notification dated 23.07.2015 have declared Melur Cluster. However, no details of other leases coming under the said cluster or whether all such leases result into cluster situation as defined in the O.M. No. J-13012/12/2013-IA.II (I) of the Ministry of Environment and Forests, Government of India dated 24th December 2013 is forthcoming in the said Notification. No information with regard to formation of cluster association as required under Rule 8-R of the Karnataka Minor Mineral Concession (Amendment) Rules, 2013 is formed for the collective implementation of approved Environment Management Plan is forthcoming from the proposal. In view of the above observations, the Authority decided to refer the proposal back to SEAC for further appraisal with all the relevant details. The Authority re-considered the proposal based on the representation dated 28.09.2015 and 08.10.2015. The Authority noted that a decision was taken to refer the file back to SEAC as the information furnished by the proponent with regard to fulfillment of criteria for declaration of cluster, permissibility of the quarrying activity and the recommendation of the Department f Mines & Geology that the sum total of the mining leases within 500 meters from the boundary of the proposed area do not exceed 5 Ha , etc. was not available in the file. The proponent in the above said letter have submitted that all the above said information were provided to SEAC. The proponent have supplied the copy of such documents in proof of submission already made to SEAC. The Authority after perusal of the said documents decided issue Environmental Clearance as recommended by SEAC, subject to submission of information sought by SEAC. 106.7.5 Black Granite Quarry Project, Sy.No.43/4 of Melur Village,

Chamarajanagara Taluk & Dist. (1-14 Acre) of Sri Sadashivappa (SEIAA 884 MIN 2015)
