Citation and Commencement

1. (1) These regulations may be cited as the Licensed LandSurveyors Regulations 2011.

(2) These Regulations come into operation on 1st October2011.

Interpretation “Articles” means an agreement in the form prescribed in theSixth Schedule, made between a licensed land surveyor and anarticled person;

“articled person” means a person seeking to qualify himselffor registration as a land surveyor who has entered into Articleswith a licensed land surveyor;

“office training” means a training provided to an articledperson in the office of a licensed land surveyor;

“plan” means a graphic display produced, derived or compiledby any mode depicting details, results or other data of a titlesurvey; 8

Interpretation

“Director of Survey” means a Director of Survey of theDepartment of Survey in the states of Peninsular Malaysia,and includes an officer acting in his behalf;

“examination” means an examination conducted by theBoard for the test of professional competence of a personseeking to obtain a certificate of competency; and

“Secretary” means the person appointed by the Boardunder section 7 of the Act.

Tafsiran

2. Dalam Peraturan-Peraturan ini, melainkan jika konteksnyamenghendaki makna yang lain:

“Artikel” ertinya suatu perjanjian dalam bentuk yang ditetapkandalam Jadual Keenam, yang dibuat antara seorang juruukurtanah berlesen dengan seorang orang berartikel;

“orang berartikel” ertinya seseorang yang ingin melayakkandirinya untuk didaftarkan sebagai seorang juruukur tanah yangtelah membuat Artikel dengan seorang juruukur tanah berlesen;

“latihan pejabat” ertinya suatu latihan yang diberikan kepadaorang berartikel di pejabat seorang juruukur tanah berlesen;

Tafsiran “pelan” ertinya suatu paparan grafik yang dihasilkan, diperolehatau disusun dengan apa-apa kaedah yang menunjukkan butir-butir, keputusan atau data lain bagi ukur hakmilik;

“Pengarah Ukur” ertinya Pengarah Ukur bagi Jabatan Ukur dinegeri-negeri di Semenanjung Malaysia dan W.P. Labuan, dantermasuklah seorang pegawai yang bertindak bagi pihaknya;

“peperiksaan” ertinya peperiksaan yang dikendalikan olehLembaga bagi menguji kecekapan profesional seorang yangbercadang untuk mendapatkan perakuan kecekapan; dan

“Setiausaha” ertinya orang yang dilantik oleh Lembaga di bawahseksyen 7 Akta. 11

Application for Registration

3. Every person entitled to be registered under subsection9(1) of the Act shall apply to the Board in the form asprescribed in the First Schedule accompanied with paymentof the fee as prescribed in the Second Schedule.

Permohonan Pendaftaran

3. Tiap-tiap orang yang layak didaftarkan di bawahsubseksyen 9(1) Akta hendaklah memohon kepadaLembaga dalam borang yang ditetapkan dalam JadualPertama dengan disertakan pembayaran fi yang ditetapkandalam Jadual Kedua.

Application for Licence to Practice

4. (1) An application for a licence to practice undersubsection 10(1) of the Act shall be made to the Board inthe form as prescribed in the Third Schedule accompaniedwith payment of the fee as prescribed in the SecondSchedule.

(2) An application for a licence mentioned in sub-regulation(1) shall be accompanied with such further information asmay be required by the Board.

Permohonan Lesen Amalan

4. (1) Sesuatu permohonan lesen amalan di bawahsubseksyen 10(1) Akta hendaklah dibuat kepada Lembagadalam borang yang ditetapkan dalam Jadual Ketiga dengandisertakan pembayaran fi yang ditetapkan dalam JadualKedua.

(2) Suatu permohonan lesen yang disebut dalamsubperaturan (1) hendaklah disertakan dengan apa-apamaklumat lanjut sebagaimana yang dikehendaki olehLembaga.

Issuance of Licence to Practice

5. Upon payment of the fee under sub-regulation 4(1), theBoard shall issue a licence to practice in the form asprescribed in the Fourth Schedule, and the Board mayimpose any conditions as it thinks fit on the licence.

Pengeluaran Lesen Amalan

5. Apabila fi di bawah subperaturan 4(1) dibayar, Lembagahendaklah mengeluarkan suatu lesen amalan dalam borangyang ditetapkan dalam Jadual Keempat, dan Lembaga bolehmengenakan apa-apa syarat yang difikirkannya patut bagilesen itu.

Renewal of Licence

6. (1) An application for renewal of licence to practice shallbe made to the Board in the form as prescribed in the ThirdSchedule accompanied with payment of the fee asprescribed in the Second Schedule within three monthsbefore the expiration of the licence.

(2) A licensed land surveyor applying for the renewal oflicence to practice shall furnish such further information asmay be required by the Board.

(3) The Board may, when renewing the licence, impose suchconditions as it thinks fit.

Pembaharuan Lesen

6. (1) Suatu permohonan untuk pembaharuan lesen amalanhendaklah dibuat kepada Lembaga dalam borang yangditetapkan dalan Jadual Ketiga disertakan dengan pembayaran fiyang ditetapkan dalam Jadual Kedua dalam tempoh tiga bulansebelum habis tempoh lesen.

(2) Seorang juruukur tanah berlesen yang memohon untukpembaharuan lesen amalan hendaklah mengemukakan apa-apamaklumat lanjut sebagaimana yang dikehendaki oleh Lembaga.

(3) Lembaga boleh, apabila membaharui lesen itu, mengenakanapa-apa syarat yang difikirkannya patut.

Restoration of Name to the Register

7. (1) Any person, whose name has been removed from theRegister pursuant to subsection 8(6) of the Act for failure torenew his licence to practice before the first day ofFebruary in any year, shall apply in writing to restore hisname to the Register and state the particulars of hisemployment or occupation as on the date of his applicationto the Board.

(2) The application made under sub-regulation (1) shall beaccompanied with the payment of restoration fee asprescribed in the Second Schedule.

Pemasukan Semula Nama Pada Daftar

7. (1) Mana-mana orang, yang namanya telah dikeluarkandaripada Daftar menurut subseksyen 8(6) Akta kerana tidakmembaharui lesen amalannya sebelum hari pertama dalambulan Februari dalam mana-mana tahun, hendaklah memohonsecara bertulis untuk memasukkan semula namanya dalamDaftar dan menyatakan butir-butir penggajian atau pekerjaannyasetakat pada tarikh permohonannya kepada Lembaga.

(2) Permohonan yang dibuat di bawah subperaturan (1)hendaklah disertakan dengan pembayaran fi pemasukan semulayang ditetapkan dalam Jadual Kedua.

Firm Name8. (1) A licensed land surveyor who desires to practice in thename of a firm shall make an application to the Board in writingaccompanied with the payment of registration fee as prescribedin the Second Schedule.

(2) Upon approval of the name of the firm under sub-regulation(1), the Board shall issue a certificate of registration asprescribed in the Fifth Schedule and may impose such conditionsas it thinks fit.

(3) The Board may cancel the certificate of registration issuedunder sub-regulation (2) if the licensed land surveyor to whomthe certificate of registration has been issued has failed tocomply with any conditions upon issuance of the certificate ofregistration. 23

Nama Firma8. (1) Seseorang juruukur tanah berlesen yang berhasrat untukmenjalankan amalan atas nama sesebuah firma hendaklah membuatpermohonan secara bertulis kepada Lembaga berserta pembayaran fipendaftaran yang ditetapkan dalam Jadual Kedua.

(2) Apabila nama firma diluluskan di bawah subperaturan (1), Lembagahendaklah mengeluarkan suatu perakuan pendaftaran yang ditetapkandalam Jadual Kelima dan boleh mengenakan apa-apa syarat yangdifikirkannya patut.

(3) Lembaga boleh membatalkan perakuan pendaftaran yangdikeluarkan di bawah subperaturan (2) jika juruukur tanah berlesenyang kepadanya perakuan pendaftaran telah dikeluarkan tidakmematuhi mana-mana syarat semasa perakuan pendaftaran itudikeluarkan. 24

Surrender of Firm’s Certificate of Registration

9. (1) Where the certificate of registration issued under sub-regulation 8(2) is cancelled pursuant to sub-regulation 8(3), thelicensed land surveyor to whom the certificate of registration hasbeen issued shall, within fourteen days from the date of serviceof the notice of cancellation of the certificate of registration,surrender the certificate of registration to the Board.

(2) A licensed land surveyor to whom the certificate ofregistration has been issued may surrender the certificate ofregistration on his own initiative by forwarding the certificate ofregistration to the Board with a written notice of the surrenderof the certificate of registration.

Surrender of Firm’s Certificate of Registration

(3) The surrender of the certificate of registration shall takeeffect fourteen days from the date the Board receives thecertificate of registration and the written notice.

(4) Upon the surrender of the certificate of registrationunder this regulation, the Board shall not refund any feespaid by the licensed land surveyor to whom the certificateof registration has been issued under sub-regulation 8(1).

Penyerahan Balik Perakuan Pendaftaran Firma

9. (1) Jika perakuan pendaftaran yang dikeluarkan di bawahsubperaturan 8(2) dibatalkan menurut subperaturan 8(3),juruukur tanah berlesen yang kepadanya perakuan pendaftaranitu dikeluarkan hendaklah, dalam tempoh empat belas hari daritarikh penyampaian notis pembatalan perakuan pendaftaran itu,menyerahkan balik perakuan pendaftaran itu kepada Lembaga.

(2) Juruukur tanah berlesen yang kepadanya perakuanpendaftaran telah dikeluarkan boleh menyerahkan balikperakuan pendaftaran itu atas inisiatifnya sendiri denganmenghantar perakuan pendaftaran itu kepada Lembaga dengansuatu notis bertulis mengenai penyerahan balik perakuanpendaftaran itu.

Penyerahan Balik Perakuan Pendaftaran Firma

(3) Penyerahan balik perakuan pendaftaran itu hendaklahberkuat kuasa empat belas hari dari tarikh Lembagamenerima perakuan pendaftaran dan notis bertulis itu.

(4) Apabila perakuan pendaftaran diserahkan balik di bawahperaturan ini, Lembaga tidak akan membayar semula apa-apa fi yang telah dibayar oleh juruukur tanah berlesen yangkepadanya perakuan pendaftaran telah dikeluarkan dibawah subperaturan 8(1).

Maintaining a Branch Office

10. (1) Where a licensed land surveyor practising in the name ofa firm maintains a branch office:

(a) such branch office shall operate in the name of the firm; and(b) such branch office shall continuously manned by a licensedland surveyor.(2) The Board may, by notice in writing, direct a licensed landsurveyor who has a branch office in contravention of sub-regulation (1) to close the branch office.(3) The licensed land surveyor shall, within six months from thedate of service of the notice under sub-regulation (1) or anyextension of time approved by the Board, take appropriateaction to close the branch office.

Penyenggaraan Pejabat Cawangan10. (1) Jika seorang juruukur tanah berlesen yang beramal atas namasuatu firma menyenggara suatu pejabat cawangan:

(a) pejabat cawangan itu hendaklah beroperasi atas nama firma itu;dan(b) pejabat cawangan itu hendaklah diuruskan secara berterusan olehseorang juruukur tanah berlesen.(2) Lembaga boleh, melalui notis secara bertulis, mengarahkanjuruukur tanah berlesen yang mempunyai suatu pejabat cawanganyang melanggar subperaturan (1) untuk menutup pejabat cawanganitu.(3) Juruukur tanah berlesen itu hendaklah, dalam tempoh enam bulandari tarikh penyampaian notis di bawah subperaturan (1) atau apa-apalanjutan masa yang diluluskan oleh Lembaga, mengambil tindakansewajarnya untuk menutup pejabat cawangan itu. 30

11. The Board may institute disciplinary proceedings againstany licensed land surveyor if the issuance of licence topractice under regulation 4 or the approval of renewal ofthe licence under regulation 6 was induced by a falserepresentation of fact.

Register12. (1) The Board shall keep a Register in accordance withsection 8 of the Act which shall contain detailed informationrelating to:

(a) licensed land surveyor;(b) registered land surveyor; and(c) articled person.(2) A certified copy of an entry in the Register made undersubsection 8(4) of the Act shall be subjected to fee as prescribedin the Second Schedule.(3) The Board shall, where the name of a licensed land surveyorhas been removed from the Register under subsection 8(5) or (6)of the Act and the survey fee has been deposited under sub-regulation 26(1), cause the surveys to be completed. 33

Daftar

12. (1) Lembaga hendaklah menyenggarakan suatu Daftarmengikut seksyen 8 Akta yang hendaklah mengandungimaklumat terperinci yang berhubungan dengan:

(a) juruukur tanah berlesen;(b) juruukur tanah berdaftar; dan(c) orang berartikel(2) Salinan terperaku suatu entri dalam Daftar yang dibuat dibawah subseksyen 8(4) Akta hendaklah tertakluk kepada fi yangditetapkan dalam Jadual Kedua.(3) Lembaga hendaklah, apabila nama seorang juruukur tanahberlesen telah dikeluarkan daripada Daftar di bawah subseksyen8(5) atau (6) Akta dan fi ukur telah didepositkan di bawahsubperaturan 26(1), menyebabkan pengukuran itu disiapkan. 34

Application for a Practicing Certificate

Sole proprietor or partnership which intends to provideland survey services in West Malaysia and Labuan isrequired to apply to the Board for a Practice Certificate.

A licensed land surveyor shall apply to the Board inwriting accompanied with the payment of RM1000.00.

Upon approval of the name of the practice, the Boardshall issue a certificate and may impose such conditions asit thinks fit.

Applying for a Licence

A registered surveyor which intends to provide surveyservices is required to have a licence granted by the Board.

Renewal of License

(a) An application for renewal of license must be submittedto the Board within three months before expiration of thelicense.

Application shall consist of: Application For Licence To Practice Payment of RM500.00 CPD Log Book Other information as may be required by the Board.

(b) Failure to renew license to practice before the 1st

February in any year, shall have to apply in writing and statethe particulars of his employment or occupation as on thedate of his application to the Board.
