Preface

This Integrated Fisheries Management Plan was developed as a result of a series of formal negotiating meetings between a small team of local DFO staff and representatives of the Area 19 snow crab licence holders. This negotiation process was the key element in ensuring the development of a plan that fishing industty, the local community, the province and the Department could accept The basic formula for this negotiating process included the following:

• a DFO team with a history of involvement in the management of the fishery;

• a well-established fishers' organization representing a vast majority of the fleet sector's licence holders;

• both sides mandated and empowered to negotiate;

• mutual trust and respect for each other's position;

• mutually-established clear guidelines on how the negotiating would take place;

• willingness to consider any and all suggestions from both sides;

• all discussions kept confidential until "points of agreement'' reached;

• all requests for information transmitted through the appointed team leader for each group;

• an understanding that the DFO team was negotiating on behalf of a wider "community" interest;

• an understanding that the DFO team was negotiating within the context of the legislation that existed at the time;

• a clear understanding of the approval process once agreement in principle was reached including the need for consultations with other interested parties and that the Minister's approval of the resultant plan was required;

• no formal minutes kept; instead a final set of "points of agreement" were submitted for consultation with interested parties and eventual approval/ratification by both sides;

• an understanding that any proposed changes resulting from consultations would be returned to the negotiating table.

It was only after the points of agreement were finalized and approved/ratified that a Joint Project Agreement and this Integrated Fisheries Management Plan documents were developed.

Introduction

This Integrated Fisheries Management Plan will be in effect for 5 years, from the 1996 fishing season until the end of March 2001. Because the TAC is established yearly and this Integrated Fisheries Management Plan covers 5 years, no annual harvesting levels are included in this document The TAC and other annual information can be found in the Area 19 Snow Crab Annual Fish Harvesting Plan available from DFO.

This Plan is intended to operate in conjunction with a Joint Project Agreement between DFO and the Area 19 Snow Crab Fisherman's Association. The Joint Project Agreement, which is for the same period as this Plan and having parts that are subject to re-negotiation each year, outlines the roles and responsibilities of each party and their financial contributions to the management of this fishery.

1. OVERVIEW OF THE FISHERY

The snow crab fishery along the west coast of Cape Breton, now an inshore fishery using baited traps, was initially fished in the mid-1960's by a group of Danish seiners based in Cheticamp with fishers from Quebec and New Brunswick fishing sporadically in the area. With the increase in the commercial value of snow crab in the late 1970's, the fishery gradually expanded to cover all fishing grounds along the west coast of Cape Breton Island. In 1978 the Department declared an area known as "the gully'' (now Crab Fishing Area 19) an exclusive inshore zone. The Area 19 snow crab fishery was the first in Atlantic Canada to adopt individual quotas (IQ's) as a management tool. From an initial6licences, the fishery expanded over time by reducing boat quotas and increasing the number of inshore licences. For example in 1984 boat quotas were reduced from 82,000 lbs. per vessel to 50,000 lbs. per vessel to allow the number of licences to increase from 27 to 61. These licences were issued to existing inshore bonafide fishers, i.e., fishers holding licences for major species such as lobster, groundfish, etc. By 1992, the number of licensed fishers involved in the fishery had reached 74 (59 permanent and 15 temporary licences). Due to significant price increases, heavy pressure remained to increase the number of participants. As a result of this pressure, DFO developed a pilot project to deal with the sharing of this lucrative fishery. This pilot project was to come into effect in 1995. Both licensed crab fishers and non-crabbers rejected the pilot project concept and were subsequently challenged by DFO to come up with an alternative plan. In the spring of 1995 the Area 19 Snow Crab Fisherman's Association came up with a sharing proposal to reduce their individual trap allocations from 20 to 18 and their ITQ's from 50,000 lbs to 43,000 lbs. They suggested that a portion of this reduction go towards conservation and that the remainder be used to increase the number of participants by 37 new licences with each new licence holder receiving a 4-trap licence and approximately 8,000 lbs. ITQ's. In 1995 the proposal was implemented by DFO (with some slight modifications to accommodate a reduced TAC) with 37 new participants issued temporary permits.

1.1 Ptuticipants There are 111 commercial licences issued for Crab Fishing Area (CF A) 19 and it is estimated that an additional150 fishers who work as crew members are also involved in the harvesting sector. Six of the commercial licences are held by Native bands. The Administrative List of of the original participants in this fishery is included as Annex VI. Because the information is subject to change as fishers enter and exit the fishery and transfer trap/shares between themselves, current information is provided in the Area 19 Snow Crab Annual Fish Harvesting Plan available from DFO. As this is an inshore fishery, all vessels are 45' and under. There are 3 processing plants located in CF A 19 which process snow crab into a variety of products. However, an important quantity of crab is shipped to out-of-province plants.

The historical market for southern Gulf snow crab was mainly for frozen meat in the U.S. However, during the 1980s, the Japanese market developed considerably to the point where frozen sections with in-shell products represent about 90% of the value of the southern Gulf production. Japan is by far the most important market (88% of export values in 1995), followed by the US (11 %). Between 1993 and 1995, the Japanese

market for the southern Gulf snow crab was vecy favourable due mainly to a decline in landings of Alaskan opilio crab and the appreciation of the Japanese yen in relation to the Canadian dollar. These factors helped contribute to high prices paid to fishers in 1995.

1.5 Consultative Process The main forum for consulting on management issues for CF A 19 has been the Area 19 Snow Crab Working Group. This consultative committee was composed of representatives of the licensed crabbers, processors/buyers, the Nova Scotia Department of Fisheries (NSOOF) and, unlike many similar committees, it also included representatives of core fishers not holding crab licences. The committee was chaired by the local DFO Area Manager and made recommendations to the Regional Director of Fisheries Management in Moncton on all aspects of fisheries management for the Area 19 snow crab fishecy.

In late 1995 DFO launched a partnering pilot project with CFA 19licence holders to seek a long-term management solution for the fishecy. The consultative process used to seek this partnering arrangement was for DFO to enter into formal negotiations directly with the Area 19 Snow Crab Fisherman's Association. These negotiations were carried out by a DFO negotiating team led by the Area Manager and supported by members of the Fisheries Management Branch and Science Branch. The Area 19 Snow Crab Fisherman's Association was represented by their six-member executive and legal counsel. (It should also be pointed out that Aboriginal bands involved in the CFA 19 fishecy are also members of the Area 19 Snow Crab Fisherman's Association.) The result of these negotiations was the development of a document describing the major points of agreement reached during the negotiations. These "points of agreement" were communicated by DFO to other interested parties (non-crabbers, province, etc.) who were given an opportunity to make representation to DFO with respect to the agreement. All parties were advised however that changes to the points of agreement could only be made at the DFO/Snow Crab Association negotiating table.

This "points of agreement" document became the basis of a Joint Project Agreement and provided the guiding principles for this multi-year Integrated Fisheries Management Plan. Unless otherwise set out in this Plan, the Joint Management Committee, the members of which are set out in Annex V, shall make decisions regarding implementation of this Plan and the Joint Project Agreement. The Joint Management Committee may consult with other industcy groups, processors, or provincial fisheries departments, at any time the Committee agrees to such consultation and deems it necessacy. The Minister of Fisheries and Oceans may undertake independent consultations with the understanding that the terms set out in the Integrated Fisheries Management Plan and the Joint Project Agreement will be given priority consideration.

1.6 M1111agement Style This fishecy is managed using a Total Allowable Catch (T A C) system whereby the amount to be fished is determined by using scientific and industry input. The TAC is usually based on harvesting a percentage (exploitation rate) of an estimate of the commercially available biomass (fishable biomass) so as to optimize the yield while at the same time not exposing the resource to risk of over exploitation. Once the TAC is set, the Individual Transferable Quotas (ITQ's) are established based on the percentage that each licence holder is entitled to. In addition to the above output controls (T AC, ITQ), several input controls are also applied in this fishecy such as trap limits, size limits, no females retained, number of fishers, etc.

2. STOCK STATUS

2.1 Biology Snow crab (Chionoecetes opilio) are crustaceans (like lobster and shrimp), with a flat circular body and five pairs of spider-like legs. As crab grow, the hard outer shell is periodically shed in a process called molting. At this stage, crab have a soft-shell for a period of time and are called soft crab (early postmolt stage) and white crab (all postmolt stages). Unlike lobster, male and female snow crab do not continue to molt throughout their lives. Females stop molting when they acquire a wide abdomen for carcying eggs, which occurs at shell widths less than 95 mm. Male snow crab stop molting when they acquire relatively large claws on the first pair of legs, which can occur at shell widths as small as 40 mm. This stage is called the terminal

molt. Female crab produce eggs that are carried beneath the abdomen for approximately 2 years. The eggs hatch in late spring or early summer and the tiny newly hatched crab larvae spend 12-15 weeks drifting freely in the water. At the end of this period they settle on the bottom. It then takes at least 8-9 years for snow crab males to reach legal size. It is considered that the entire southern Gulf is a single stock.

2.2 Environment It is known that snow crab prefer water temperatures between -1 °C and 3°C and the increased extent of cold water may mean that there has been an increase in the habitat suitable for adult crab over the past 6 years. Bottom water temperatures were unusually cold relative to the average in the southern Gulf during 1995: 40% of the southern Gulf was less than 1 °C; and 1995 had the greatest extent of subzero water in the past 25 years. The past 6 years have had consistently large amounts of cold bottom water. This colder water may be conducive to snow crab abundance.

2.3 Species Interactions Groundfish species (cod and hake) are known as major predators of snow crab. However, little is known about the actual quantities of crab consumed by any predator. The actual impact that predators can have on crab stocks remains uncertain.

2.4 Assessment The assessment is based on an analysis of fishing activities and a research trawl survey. Fishers' logbooks are used to describe the distribution of fishing effort and to estimate relative abundance of mature crab. The trawl survey is undertaken immediately following the fishery and provides estimates of large-clawed, soft-shell males larger than 95mm that will be part of the exploitable biomass in the following year as new recruits. The survey also provides estimates of uncaught mature crab and the abundance of male and female crab at smaller size intervals, or pre-recruits.

2.5 Resetu'ch Survey and mapping techniques used to estimate biomass of snow crab have agreed closely with fishing performance as measured by catch per unit of effort (CPUE) and proven to be a useful tool for stock assessment. However, further refinements need to be made to increase the accuracy and reduce the uncertainty of the biomass estimate, particularly at survey boundaries.

Although available biomass and recruitment to the fishery for the following season can be predicted from the biomass of large claw and small claw males larger than 95 mm carapace width, the prediction of recruitment more than one year ahead remains uncertain because of the complex growth mechanisms of this species. In addition, factors affecting the cyclic recruitment pattern that has been observed by the trawl survey since 1988 are still unknown. In depth analysis of population dynamics and biological investigations on the entire life cycle of the species are necessary to improve the capability of predicting long-term changes in recruitment.

2.6 Prospects from 1996 to 2001 This fishery depends on the arrival and strength of unpredictable pulses of recruitment. The current high level of biomass is the result of a good recruitment of several size groups of small crabs which were first observed in the 1988 survey. Once the recruitment of juveniles appears in the trawl survey catch, it takes approximately 5-6 years for the recruitment to enter the commercial fishery. A new recruitment pulse in this fishery has also been observed in 1995. It is likely that the stock will decrease in abundance untill998-1999. A flexible management strategy is required in order to take advantage of these fluctuations in abundance. As part of a series of publications known as the Atlantic Fisheries Stock Status Reports, the status of the snow crab stock in CF A 19 is presented annually in the Maritimes Region Stock Status Report for Southern Gulf Snow Crab which is available through DFO offices.

3. LONG-TERM OBJECTIVES FOR FISHERY

Long-term objectives for CFA 19 are as follows:

• Once the new Fisheries Act is proclaimed, the signing of a long-term Fisheries Management Agreement with the Area 19licensed crab fishers.

• Continued harvesting at the optimum sustainable level. • Further increasing Area 19licensed fishers' level of participation in the management of this fishecy. • Fine tuning the stock assessment process to increase the accuracy of stock predictions.

4. GENERAL MANAGEMENT OBJECTIVES

4.1 Conservation/Sustainability • To promote and ensure the conservation and protection of snow crab stocks. • To gather timely and accurate data essential to assess the status of the stocks. • To optimize the use of a limited resource while achieving profitability and sustainability. • To promote the development and use of good fishing practices to reduce discarding at sea.

4.2 International Considerations There are no significant international considerations in this fishecy as it is fished by a Canadian fleet within Canadian waters.

4.3 Domestic Considerations a) Aboriginal Fishery

As part of the overall departmental strategy to increase native participation in commercial fisheries, three temporary commercial licences for Area 19 snow crab were granted to native bands in 1992. In 1996 these licences become regular 18-trap crab licences and three additional4-trap licences were granted. These licences are issued under the Atlantic Fisheries Regulations, 1985 and participants follow the same rules as all other participants in the CF A 19 fishecy.

b) Recreational There are no recreational fisheries considerations involved.

c) Commercial The following provide the objectives for the commercial fishecy: • Stabilize the process used to allocate the resource. • Maximize revenues keeping in mind that fishers must harvest the full range of snow crab available

including older and less valuable animals. • Allow fishers the flexibility to manage their crab fishing activities as multi-licensed enterprises.

d) Exploratory/Experimental There is no exploratocy fishety taking place in CFA 19. However, the midshore fishecy is exploring in other areas, one of which (Zone F) is adjacent to Area 19. There is some evidence of crab movement between Area 19 and Zone F and further study is required to determine the nature of these migrations.

5. CURRENT MANAGEMENT ISSUES

5.1 Issue: Protection of New Recruits (Soft-shelled Crab) Although the crab population is aging, it is important to note that as new recruits enter the fishecy, there is a possibility of increased incidence of soft crab, particularly if the commercial biomass is low. As a result, the industry must optimize catches in the short term and/or spread catches over a period of years in such a way as to maximize their income, taking into account the quantity and quality of available crab.

Soft crab is the future recruitment to the fishery and should be protected. It is critical to use at-sea observers to monitor the fleet at a level identified by DFO to determine the extent of the problem as well as maintain a measure to close the fishery when the level of soft shell in the catch exceeds 20%.

5.2 Issue: Determining Fuhable Biomass Over the past years, DFO's Science Branch has developed a methodology using trawl surveys to determine the state of the crab stocks in the southern Gulf of St. Lawrence. With current budget constraints, this tool can no longer be carried out by DFO thus leaving older, less reliable methods of determining the state of the snow crab stocks.

Approach: By entering into a long-term Joint Project Agreement and with this five-year Integrated Fisheries Management Plan, the fishers see their future as being more stable. They have therefore decided to fund this important survey as they see themselves as benefiting directly from the resulting information.

5.3 IS81le: Sharing of the Resource The Area 19 snow crab fishery developed from a few licensed participants in the early 1960's to 74 inshore multi-licensed enterprises in 1992. This growth was due to a number of factors; however, the major determining factor in this constant change was the increased value of snow crab in the world market. As the fishery became more lucrative an attempt was made to share this wealth with other fishers in the community. This sharing was ad hoc and unplanned and as the Area 19 history unfolded, there were more and more demands to continue the sharing process. While these demands to share the resource increased, crab fishers called on DFO to stop the process or at least get it under control so they could have some long-term stability in their industry.

Approach: To resolve the sharing issue and provide some stability to the Area 19 snow crab industry, the Joint Project Agreement and this multi-year Integrated Fisheries Management Plan set out a comprehensive sharing arrangement as follows: to the 74 existing licences are added 37 new licences each fishing 4-trap shares. There is an Individual Transferable Trap system administered by industry which allows crab resource in the form of trap/shares to be transferred between the Ill licence holders but more importantly from the original 74 licence holders to the new 37 licence holders. There is also a sharing mechanism set out to share the resource with additional new participants should the value of the resource increase above established levels. Finally, the ITQ system is set up in such a way as to prohibit a licence holder from obtaining another licence (minimum 4 trap/shares per licence) thereby stabilizing the number of licences at 111 with the possible addition of temporary permits when higher values allow.

6. GENERAL MANAGEMENT MEASURES FOR 1996 to 2001

6.1 Quota Allocations The total allowable catch (T AC) is determined yearly by multiplying the exploitation rate as established under Paragraph 6.3 below by the fishable biomass as estimated by DFO's Science Branch in their Stock Status Report. The TAC will be allocated through a transferable trap/share system, with each trap/share being allocated 1/1480th (.0675%) of the TAC as per the sharing arrangement described in paragraph 6.6 below. Specific information about the fishable biomass, the exploitation rate and the T AC will be provided in the Area 19 Snow Crab Annual Fish Harvesting Plan.

6.2 Fuhing SeiiSons Fishing seasons to remain as traditionally established from mid-July to mid-September with actual opening date to be established by industry in consultation with DFO.

6.3 Exploitation Rate Industry will have the responsibility to set the exploitation rate within the range of 40% to 50% of the exploitable biomass. Exploitation rates above or below this range require consent ofDFO.

6.4 Monitoring All landings are subject to independent third-party monitoring by a DFO approved Dockside Monitoring Company.

6.5 Conservation MeiiSIIre A!J per the DFO protocol, should the incidence of immature crab (soft shell or white crab) taken at sea exceed 20 % at any point in the season in any year of the agreement the fishery will close for that year. The level of observer coverage required to implement this measure will be established through the Joint Management Committee and will be set out in the Area 19 Snow Crab Fish Harvesting Plan.

6.6 Sharing A"angement In 1996, there will be 111licences in this fishery. The licences consist of the 59 regular crab licences and the 15 temporary licences first issued in 1992 which now become regular licences. These 74 licences will be valid for 18 trap/shares each. In addition, 37 new regular 4-trap/share licences will be issued by a draw. Permanent transfers of trap/shares are allowed. • Each trap/share will have a direct relationship to the TAC. • Total number of trap/shares to be 1480. • One trap will be allocated to fish each share. • Maximum number of trap/shares any one fisher can hold is 26; the minimum is 4. • No fisher who holds a snow crab licence can obtain a second one, therefore the last 4 shares held by any

fisher may only be reissued to a core fisher or to a qualified new entrant not already holding a snow crab licence (as per Commercial Fisheries Licensing Policy for Eastern Canada).

• The fixed number of licence holders is 111, no more, no less. • Fishers are permitted to combine up to 26 traps to be fished on one vessel; however, all licence holders

involved must be on board during all fishing operations. • Area 19 Snow Crab Fisherman's Association in cooperation with DFO will administer the transferring of

trap/shares and advise DFO of all transactions at least two weeks prior to the opening of the fishery each year.

6. 7 Additional Sharing a) Mechanism

This process establishes how :further sharing will take place should stock levels and/or prices increase the fishery's value to abnormally high levels. • To implement this mechanism a "Trigger Level" has been established based on the landed value of the

1995 fishery. • • Base year value is equal to $13,320,000. • This "Trigger Level" will increase by $133,200 (1% of the base year value) in 1997 and each subsequent

year of the agreement. The following chart shows the value of the "Trigger Level" for the respective years (subject to review in 1999).

b) Process • TAC to be established each year as per Paragraph 6.1 and 6.3 above. • A projected price will be established at least one month prior to the opening of the fishery based on best

information available and will be multiplied by that year's TAC to establish an estimated dollar value for that year's fishery.

• Should this dollar value be less than 90% of that year's trigger value, 100% of the quota will be allocated to the 111 licence holders. In the event the projected value of the fishery is in excess of 90% the following steps are taken.

Step 1: Allocate 90% of that year's trigger value to existing fleet. Step l: After two weeks fishing, price to be confirmed in consultation with fishers. Step 3: Allocate remaining quota required to reach the trigger value to existing fleet. Step 4: Share additional quota above trigger value: 50% to existing fleet and 50% as temporary

permits to core fishers for a possible late summer fishery. Portion allocated to the core fishers is done at the Department's discretion.

6.8 Other Relevflllt Elements to the Management Plan a) Licensing

The snow crab licences in CF A 19 are issued under the absolute discretion of the Minister as per section 7 of the Fisheries Act. The policies governing the issuance of these licences including licence reissuance, licence splits, vessel replacement, fisher and vessel registrations, general policy guidelines , etc., are all included in the Commercial Fisheries Licensing Policy for Eastern Canada document which is available from any DFO Licensing Service Center. Appropriate guidelines and procedures are also in place regarding the issuance of any supplementary licence condition schedules which may have to be attached to each licence for CF A 19 prior to the opening of the fishery.

b) Key Legislation The key legislation that applies in managing the fishery is as follows:

- Fisheries Act - Atlantic Fisheries Regulations, 1985 - Fishery (General) Regulations

Other relevant legislation includes: - Fisheries Development Act, 1985 - Financial Administration Act.

It is important to note that this management plan can be altered at any time by the Minister for the purpose of conserving and or protectina the fishery resource.

7. ENFORCEMENT ISSUES AND STRATEGIES

7.1 Overview The primary enforcement focus in the Area 19 crab fishery is on the overall quota. This is achieved by the requirement for accurate log records, dockside observers on land and surveillance by fishery officers. Surveillance is done using vehicles, planes and vessels within the crab zone. Other enforcement issues include the monitoring of trap size and tagging requirements, individual quotas, licensing requirements, highgrading and crab size limits and other restrictions. Fishery officers are also responsible for verifying the dockside monitoring company's work.

7.2 Main Program Activities The main programs for enforcement are fishery officers on land and at sea, the Dockside Monitoring Program, the At-Sea Observer Program, air surveillance, dockside monitoring, and patrol vessels.

7.3 FIShery Patrol Vessels In the Gult: there are five permanent zones/areas and two experimental zones and past experience has seen fishers from other zones encroaching on unauthorized zones. Patrol vessels are used mainly to monitor the boundary lines. They also provide a platform for fishery officers to verify trap legalities, board fishing boats and inspect catches, gear, log books, licences, registrations, Vessel Registration Number, etc.

ANNEX ill DFO/Industry Advisory Committee

Area 19 does not have an "advisory committee" per se. However, for the duration of this plan and the Joint Project Agreement and unless otherwise set out in this Plan, the Joint Management Committee, the members of which are set out in Annex V, shall make decisions regarding implementation of this Plan and the Joint Project Agreement. The Joint Management Committee may consult with other industry groups, processors, or provincial fisheries departments, at any time the Committee agrees to such consultation and deems it necessary. The Minister of Fisheries and Oceans may undertake independent consultations with the understanding that the terms set out in the Integrated Fisheries Management Plan and the Joint Project Agreement will be given priority consideration.

JOINT PROJECT AGREEMENT

This Joint Project Agreement is made in duplicate

BETWEEN: HER MAJESTY THE QUEEN IN RIGHT OF CANADA, as represented by the Minister of Fisheries and Oceans ("the Minister")

AND: AREA 19 SNOW CRAB FISHERMAN'S ASSOCIATION, a body duly incorporated under the Societies Act of Nova Scotia, with a head office located at P.O. Box 477, Cheticamp, Nova Scotia (''the Association").

WHEREAS the Minister and the Association ("the Parties") wish to undertake a joint project to efficiently manage the fishery in Snow Crab Fishing Area 19 in Nova Scotia through a long term co-operative relationship, fostered by trust and respect, and based on principles of conservation and environmental sustainability ("the Project");

AND WHEREAS this Joint Project Agreement may establish the basis for further discussion on partnering arrangements, should the anticipated amendments to the Fisheries Act come into force;

NOW THEREFORE, in consideration of the premises and the mutual covenants hereinafter set forth, the Parties agree as follows:

1. THE PROJECT

1.1 This Project is described in Schedule A hereto. The responsibilities of each Party with respect to the Project are described in the Annual Work Plan, attached as Schedule B, which shall be revised each year in accordance with Clause 3 .1.

2. THE MANAGEMENT COMMITTEE

2.1 Upon the coming into force of this Agreement, a Management Committee shall be formed by the Parties to oversee the management and administration of this Project. The Management Committee shall consist of :

a) Representatives of the Minister: Area Manager, Gulf Shore Nova Scotia (co-chair); Chief Conservation & Protection, Gulf Shore Nova Scotia; Resource Management Officer, Gulf Shore Nova Scotia; and One Science Representative

b) Representatives of The Association: President (co-chair); and A maximum of 6 Members of the Association Working Group

2.2 The Management Committee may call upon such other persons for assistance as it considers necessary.

2.3 During the term of this Agreement, the Management Committee shall meet at least once in each period running from April1 to March 31 (''the fiscal year").

3. DUTIES OF THE MANAGEMENT COMMI'ITEE

3.1 The Parties shall ensure that the Management Committee:

a) by Man:h 31 of each year, develops an Annual Wolk Plan for the following fiscal year, specijying the activities to be undertaken and the monetaiy and in-kind respomibilities of each Party with respect to this Project;

b) monitors the progress and pelformance of the Parties under the Annual Wolk Plan; and c) verifies the costs and expenditures of each Party in connection with this Project

4. OBLIGATIONS OF THE MINISTER

4.1 Funds paid to the Minister by the Association as specified in Part II of the Annual Wolk Plan, together with the monetaty and in-kind responsibilities of the Minister as specified in Part I of the Annual Wolk Plan, shall be used by the Minister to perform the activities specified therein.

4.2 The monetary and in-kind respomibilities of the Minister towards this Project for fiscal year 1996/1997 shall be $96,700. It is expected that the monetaiy and in-kind responsibilities of the Minister for each subsequent :fiscal year of this Agreement shall be in the order of$96,000.

4.3 Once each Annual Wolk Plan has been accepted and signed by the Parties, the monetaiy and in-kind respomibilities of the Minister as itemized therein shall be binding upon the Minister for that fiscal year.

4.4 Funds received by the Minister shall be accounted for in accordance with applicable Treaswy Board Regulations. Any amount remaining from the funds paid to the Minister under the Joint Project Agreement shall be repaid to the Association in accordance with the Repayment ofReceipts Regulations.

5. OBLIGATIONS OF THE ASSOCIATION

5.1 The Association shall pay the funds to the Minister and shall pelform the activities and fulfil the monetaty and in-kind responsibilities specified in Part II of the Annual Wolk Plan.

5.2 The monetaiy and in-kind respomibilities of the Association towards this Project for fiscal year 1996/1997 shall be $100,040. It is expected that the monetaiy and in-kind respoDSibilities of the Association for each subsequent fiscal year of this Agreement shall be in the order of $145,000.

5.3 Once each Annual Wolk Plan has been accepted and signed by the Parties, the monetaiy and in-kind responsibilities of the Association as itemized therein shall be binding upon the Association for that fiscal year.

5.4 Within five (S) days of the acceptance and signing by both Parties of each Annual Wolk Plan, the funds payable by the Association to the Minister shall be paid to the Minister. The paying instrument shall be made payable to the Receiver General for Canada.

6. AUDITING AND MONITORING

6.1 The Minister and the Association agree to maintain books, records, documents, and other evidence pertaining to all costs and expenses incurred and expended and funds aaprired under this Agreement to the extent and in such detail as will properly reflect all costs, direct and indirect, of labour, materials, equipment, supplies and services. Records and documentation shall be retained by each Party for a period of three (3) years after the termination of this Agreement for whatever reason. Both Parties agree that all records pertaining to this Project shall be made available, subject to the provisions of the Access to Information and Privacy Acts, to the other Party for verification and audit upon request

8.1 Subject to the Access to Information and Privacy Acts, Project Data and any other Project-related information shall be freely available to both Parties to this Agreement and may be used, dissemiiU!tM or published, by either Party, at any time. Any material which is to be published by either Party shall be provided to the other Party prior to public dissemination.

8.2 Each Party shall retain the right to have the name of any of its employees who may have been involved in specific scientific projects, analysis or report writing, named as a co-author of any scientific publication resulting therefrom.

9. COMING INTO FORCE AND TERM

9.1 This Agreement shall come into force on the date on which it has been executed by both Parties and, other than Schedule B, shall remain in force unti131 March 2001, unless terminaterl sooner in accordance with Clause 10.

10. TERMINATION

10.1 This Agreement may be terminaterl at any time with the consent ofboth Parties.

10.2 Termination for Cause:

a) The Association may terminate this Agreement. upon written notice to the Minister:

i) if the Minister breaches the terms or conditions of this Agreement; or ii) if the IntegratedMmagementPlanfor Area 19 Snow Crab 1996-2001 is amended.

b) The Minister may terminate this Agreement, upon written notice to the Association:

I) if the Association breaches the terms or conditions of this Agreement; ii) if the Association is bankrupt, files for bankruptcy, or is involved in any bankruptcy

pf'ON"f'ding; or iii) if the Minister, in his or her opinion, is unable to :fulfill the obligations under this

Agreement

11. EVENTS UPON TERMINATION

11.1 Upon termination of the Agreement, the following events shall occur:

a) the Minister shall return to the Association the unused portion of the funds received from the Association under this Agreement, after deducting all amounts required to pay for goods and seiVices and other commitments which the Minister is unable to cancel.

b) the Minister shall make available to the Association any and all data, reports or analyses generated pursuant to this Agreement

12. INDEMNIFICATION

12.1 The Minister shall indemnii}' and save harmless the Association and all of its officers and employees from and against any loss, damage, expense or cost of whatsoever nature and kind arising out of or resulting din:d:ly or indirectly from any negligent acts committed by the Minister or his or her employees or agents acting on his or her behalf under or in connection with this Agreement

12.2 The Association shall indemniiY and save harmless Her Majesty, the Minister, and all of his or her employees from and against all claims, actions, causes of action, loss, damage, expense and cost of whatsoever nature and kind arising out of or resulting din:d:ly or indirectly from any negligent acts committed by the Association or its agents or employees acting on the Association's behalf under or in connection with this Agreement

13. NOTICE

13.1 Any notice under this Agreement shall be in writing and shall be addressed to the appropriate Party as follows: ·

14. DISPUTE RESOLUTION

14.1 Where a dispute arises as to the interpretation of this Agreement or of matters relating to its termination, or of performance hereunder, the Parties shall attempt in good fdith to resolve the dispute through negotiation Should negotiation prove unsuccessful, the Parties shall submit the matter to a mutually acceptable third party for mediation The costs of the mediation shall be divided equally between the Parties.

15. NOAGENCY

15.1 Neither the Association nor any of its personnel or agents is an employee, servant or agent of the Minister or ofHer Majesty and shall not hold themselves out to be so. The Association is alone respoDSJ.ble and liable for all claims, demands, losses, costs, debts, actions, damages, suits or other procm'lings brought against it in any way arising out of or attributable to its obligations under this Agreement.

16. HOUSE OF COMMONS OR SENATE

16.1 No member of the House of Commons or Senate shall be admitted to any share of this Agreement or to any benefit arising herefrom.

17. PUBLIC SERVANTS

17.1 A present or former public servant or public office holder who is not in compliance with the applicable provisions of the Conflict of Interest and Post-Employment Code for Public Office Holders or the Conflict of Interest and Post-Employment Code for the Public Service shall not derive a direct benefit from this Agreement

• Validate fishery data (catch, effort, size distribution, catch composition and trap catchability) using data obtained from previous years

Trawl Survey • Survey a total of 53 stations in Crab Fishing Area 19 and vicinity.

Statistical Analysis • Estimate the abundance of various classes of crab, including soft-shelled males and females, and produce

Data Analysis and Reporting • Estimate biomass of different categories of crab (juvenile, primiparous, multiparous and barren females,

juveniles, physiologically mature, morphometrically immature and morphometrically mature males) to provide basic information to industry for short term catch projection

• Provide long term catch projection based on quantitative and qualitative information from juvenile crabs • Provide charts showing commercially exploitable crabs • Provide spatio-temporal distribution of different categories and sizes of crab to elucidate crab population

dynamics • Improve accuracy of biomass estimates and sampling techniques • Conduct ad hoc biological investigations (e.g. carapace disease, biological abnormalities, stomach

contents, condition and quality of carapace, etc.)

Consultation with the Association • Conduct timely consultation with Association Working Group • Distribute scientific information (charts and predictions) and hold meetings with Association membership • Maintain contact with Association members and encourage input from fishers regarding catch experience

and other knowledge regarding crab stocks • Permit Association representative to observe and video tape the trawl survey and other scientific field

projects undertaken in Area 19 involving snow crab • Whenever possible, train and educate fishers about snow crab biology, statistical and measuring

MIFFLIN ANNOUNCES CO-MANAGEMENT APPROACH FOR SNOW CRAB

OTTAWA - Fred Mift1in. Minister of Fisheries and Oceans, today announced a co-management strategy for snow crab in Area 19, located on the northwest coast of Cape Breton Island. The new arrangement, consisting of a five year integrated management plan for that fishery and a financial agreement, has been endorsed by the Area 19 Snow Crab Fisherman's Association.

"This new approach represents the sort of cooperation which I believe should guide relationships between the Department of Fisheries and Oceans (DFO) and the fishing industry," Mr. Mift1in said. "The agreement will provide industry with greater input into decisions affecting management of the fishery, and will result in improved conservation and a more stable fishery for the benefit of fishers and their communities."

A five-year, clearly defined Integrated Management Plan has been adopted for management of the fishery. Crab fishers have agreed to share the resource, resulting in an increase in participants to 111 from the present 74. The 37 new licence holders will be chosen from eligible core fishermen based in Area 19 who have vessels less than 45 ft. in length and who have not previously held regular snow crab licences. The sharing arrangement will also allow additional temporary participants into the fishery in years when the value of the fishery exceeds an established trigger level.

"I am impressed that Area 19 crab fishermen have offered to share the resource on a permanent basis even though the 1996 biomass has declined from last year's level. This demonstrates the concern of the fishermen for distributing the wealth of the resource."

The Integrated Management Plan also calls for the establishment of a maximum of 1,480 trap shares. Each share would represent one trap and .07 per cent of the annual quota. Existing licence holders will begin the 1996 fishery with 18 trap shares each and new entrants will have four trap shares each. The new system will allow for the permanent transfer of trap shares between participants, up to a maximum of 26 traps and 1.82 per cent of the quota. Fishermen will be required to retain a minimum of four trap shares to participate in the fishery.

Under the agreement, industry members will have the responsibility of setting the annual exploitation rate of the estimated harvestable biomass within the 40 to 50 per cent range. Exploitation rates above or below this range will still require the Minister's approval. If necessary, the exploitation rate will be altered to reflect conservation concerns.

"Such a comprehensive co-management approach could only have been achieved through close cooperation between representatives of the Area 19 snow crab fleet and Department officials," Mr. Mift1in said. "This co­management approach establishes the basis for further discussions on partnering arrangements, once the Fisheries Act amendments are passed.

For 1996, the Area 19 snow crab fishery will commence in mid-July with a Total Allowable Catch (I'AC) of 1,113 tonnes.

The financial agreement component of the co-management approach, to be signed by both DFO and industry representatives, outlines significant participation of the industry in such areas as scientific assessment, trap tags, enforcement, dockside monitoring, log books and data entry.

Sanctions, enforcement plans and conservation measures will be clearly stated in the Integrated Management Plan and monitored by DFO staff to ensure that conservation is not jeopardized. For example, the fishery will be closed if soft-shelled crab reach 20 per cent of catches.

"Conservation is our primary focus and the Integrated Management Plan can be modified at any time to ensure that this priority is met," Mift1in said.

Le Plan integre de gestion de Ia peche a ete elabore a Ia suite d'un certain nombre de reunions de negociations officielles auxquelles participaient une petite equipe du personnel local du MPO et des representants des titulaires de perm is de peche du crabe des neiges de Ia zone 19. Ce processus de negociations a ete I' element cle qui a permis d'arriver a !'elaboration d'un plan que l'industrie de Ia peche, Ia collectivite locale, Ia province et le Ministere jugeaient acceptable. Les conditions de base du processus de negociations etaient les suivantes :

• une equipe de membres du MPO ayant des antecedents dans le domaine de Ia gestion de Ia peche;

• une association de pecheurs bien etablie, representant une majorite des titulaires de permis de ce secteur de Ia flottille;

• deux parties ayant le mandat et le pouvoir de negocier;

• un climat de respect et de confiance reciproques;

• des !ignes directrices etablies en commun, pour le deroulement des negociations;

• Ia volonte d'etudier toutes les propositions faites par l'une ou !'autre partie;

• le maintien du caractere confidentiel des entretiens jusqu'a ce qu'on en arrive aux «points d'entente »;

• Ia transmission de toutes les demandes d'information par l'entremise du chef d'equipe de chaque groupe;

• !'acceptation que l'equipe du MPO negocie au profit d'une plus grande« collectivite »;

• I' acceptation que I' equipe du MPO negocie dans le contexte des lois existantes a ce moment;

• une bonne comprehension du processus d'approbation, une fois qu'il y a entente de principe, notamment Ia necessite de consulter d'autres parties interessees et d'obtenir !'approbation par le Ministre du plan qui en decoulera;

• pas de proces-verbal officiel, mais plutat une serie de« points d'entente » sownis pour consultation aux parties interessees et, eventuellement, a !'approbation eta Ia ratification par les deux parties;

• I' acceptation de remettre sur Ia table des negociations toute proposition de changement resultant des consultations.

Ce n'est qu'une fois les points d'entente defmitivement etablis et approuves ou ratifies, qu'une entente sur !'execution d'un projet conjoint et le present Plan integre de gestion de Ia peche ont ete elabores.

Introduction

Le Plan integre de ge~tion de Ia peche est valable pendant cinq ans, a partir de Ia saison de peche de 1996 jusqu ·a Ia fm de mars 200 l. Etant donne que le T AC est ftxe annuellement et que le Plan de gestion s' etend sur une periode de cinq ans, aucun niveau d'exploitation annuel n'est mentionne dans le present document. Le TAC et tout autre renseignement a caractere annuel sont indiques dans le Plan de peche annuel du crabe des neiges de Ia zone 19 que l' on peut se procurer au pres du MPO.

Le Plan integre doit etre applique parallelement a une entente sur !'execution d'un projet conjoint conclue entre le MPO et le Area 19 Snow Crab Fisherman's Association. Cette entente, de Ia meme duree que le Planet dont certaines parties doivent etre renegociees chaque annee, defmit les roles et obligations de chacune des parties et leur contribution fmanciere a Ia gestion de cette peche.

I. VUE D'ENSEMBLE DE LA PECHE

L 'exploitation du crabe des neiges le long de Ia cote ouest du Cap-Breton, qui est actuellement une peche cotiere pratiquee au moyen de casiers appates, a commence au milieu des annees soixante, avec un groupe de senneurs danois, dont le port d'attache etait a Cheticamp, tandis que certains pecheurs du Quebec et du Nouveau­Brunswick venaient sporadiquement pecher dans Ia region. Devant !'augmentation de Ia valeur du crabe des neiges sur le marche, a Ia fm des annees soixante-dix, Ia peche a connu une expansion graduelle jusque dans toutes les pecheries situees le long de la cote ouest de l'ile du Cap-Breton. En 1978, le Ministere a declare zone cotiere exclusive un secteur appele « Le Gully>> (maintenant Ia zone 19 de peche du crabe). La peche du crabe des neiges de Ia zone 19 a ete Ia premiere au Canada a utiliser, comme outil de gestion, des quotas individuels (QI). A partir des six permis d'origine, Ia peche a pris de !'expansion avec le temps, par une reduction des quotas de bateau et une augmentation du nombre de permis cotiers. Ainsi, en 1984, les quotas de bateau ont ete reduits de 82 000 lb a 50 000 lb par bateau, ce qui a permis de hausser le nombre de permis de 27 a 61. Ces permis etaient delivres aux pecheurs cotiers authentiques (bonafide) deja existants, c.-a-d. les titulaires de permis de peche des especes principales, telles que le homard, le poisson de fond, etc. En 1992, le nombre de pecheurs titulaires de permis qui participaient a Ia peche etait passe a 74 (59 permis permanents et 15 temporaires). Comme le prix continuait de subir des hausses importantes, de fortes pressions continuaient de s'exercer pour qu'on augmente le nombre de participants. Par consequent, le MPO a mis sur pied un pro jet pilote en vue de proceder a un partage plus large de cette peche lucrative. Ce projet pilote devait etre applique en 1995. Les pecheurs de crabe titulaires de permis tout comme les pecheurs d'autres especes ont rejete cette idee et le MPO a exige qu'ils proposent un autre plan. Au printemps 1995, le Area 19 Snow Crab Fisherman's Association a propose un projet de partage incluant une reduction de leurs allocations individuelles de casiers de 20 a 18, et de leurs QIT de SO 000 lb a 43 000 lb. Seton le projet, une partie de cette reduction irait a Ia conservation tandis que le reste servirait a augmenter de 37 le nombre de nouveaux permis, chaque nouveau titulaire etant autorise a utiliser quatre casiers, et disposant d'un QIT d'environ 8 000 lb. En 1995, Ia proposition a ete mise en oeuvre par le MPO (moyennant quelques modifications pour tenir compte de Ia reduction du TAC) et 37 nouveaux participants se sont vu accorder des permis temporaires.

1.1 Participants Pour Ia zone de peche du crabe (ZPC) 19, il y a Ill permis de peche commerciale, et il est estime qu'un autre ISO pecheurs travaillent comme membres d'equipage dans ce secteur d'exploitation. Six des permis de peche commerciale sont detenus par des bandes autochtones. La liste administrative des participants de depart de cette peche ftgure en annexe VI. Etant donne que !'information peut changer parce que certains pecheurs viennent s'ajouter tandis que d'autres quittent Ia peche et qu'il y a des echanges de casiers ou de parts entre eux, I' information a jour figure dans le Plan annuel de peche du crabe des neiges de Ia zone 19 qu' on peut se procurer aux bureaux du MPO. Puisqu'il s'agit d'une peche cotiere, tousles bateaux mesurent 45 pieds ou moins. Trois

usines de transfonnation situees dans la ZPC 19 transfonnent le crabe en differents produits . Cependant, une quantite importante de crabe est expediee vers des usines siruees a l' exterieur de la province.

Historiquement. le principal debouche du crabe des neiges du sud du golfe etait le marche americain de Ia chair conge lee. Cependant. au cours des annees quatre-vingt, le marche japonais a pris une expansion considerable, au point oil les sections congelees et les produits en carapace representent maintenant environ 90 % de Ia valeur de Ia production du sud du golfe. Le Japon est de loin le marche le plus important (88 % de Ia valeur des exportations en 1995), sui vi par les Etats-Unis (II %). Entre 1993 et 1995, le marche japonais du crabe des neiges du sud du golfe etait tres favorable, a cause principalement de Ia diminution des debarquements du crabe opi/io de I' Alaska et de !'appreciation du yen japonais par rapport au dollar canadien. Tous ces facteurs ont contribue a I' obtention de prix eleves par les pecheurs en 1995.

1.5 Processus consu/tatif

La principale tribune de consultation sur les questions de gestion de Ia ZPC 19 a ete le groupe de travail sur le crabe des neiges de Ia zone 19. Ce comite consultatif etait compose de representants des pecheurs de crabe titulaires de permis, des transformateurs/acheteurs, du ministere des Peches de Ia Nouvelle-Ecosse (MPNE) et, contrairement a beaucoup de comites semblables, des pecheurs professionnels non titulaires de permis de peche du crabe. Le comite etait preside par le gestionnaire de secteur local du MPO et faisait des recommandations au directeur regional de Ia Gestion des peches, a Moncton, sur tous les aspects de Ia gestion de Ia peche du crabe des neiges dans Ia zone 19.

A Ia fm de 1995, le MPO a lance un projet pilote de partenariat avec les titulaires de permis de peche de Ia ZPC 19, afm de trouver une solution de gestion a long terme pour cette peche. Le processus consultatif propose pour en arriver a cette entente consistait a entreprendre des negociations officielles directement avec le Area 19 Snow Crab Fisherman's Association. Ces negociations ont ete menees par une equipe du MPO, dirigee par le gestionnaire de secteur et appuyee par des membres de Ia Direction de Ia gestion des peches et de Ia Direction des sciences. Le Area 19 Snow Crab Fisherman's Association etait representee par les six membres de son conseil d'adrninistration et son conseiller juridique. (II convient de noter que les bandes autochtones qui participent a Ia peche dans Ia ZPC 19 font aussi partie dele ;\rea 19 Snow Crab Fisherman's Association.) Ces negociations ont donne lieu a !'elaboration d'un document decrivant les principaux points d'entente auxquels en sont parvenus les parties au cours des negociations. Ces «points d'entente » ont ete communiques par le MPO aux autres parties interessees (pecheurs d'autres especes, provinces, etc.) qui ont eu Ia possibilite de faire des representations aupres du MPO au sujet de !'entente. Toutes les parties ont ete informees, cependant. que les changements aux points d'entente ne pouvaient etre faits qu'a Ia table des negociations du MPO et de !'association des pecheurs de crabe des neiges.

Le document contenant les «points d'entente »est devenu le fondement d'une entente sur !'execution d'un projet conjoint et a servi de principe directeur au present Plan integre pluriannuel de gestion de Ia peche. A moins d'indication contraire dans le Plan, le Comite conjoint de gestion, dont Ia liste des membres figure en annexe V, prend les decisions au sujet de !'application du Planet de !'entente sur !'execution d'un projet conjoint. Le Comite conjoint peut consulter d'autres groupes de l'industrie, des transformateurs ou des ministeres provinciaux des Peches, a n'importe que! moment. s'ille juge necessaire. Le ministre des Peches et des Oceans peut entreprendre des consultations independantes; toutefois, une consideration prioritaire sera accordee aux conditions etablies dans le Plan integre de gestion de Ia peche et !'entente sur !'execution d'un projet conjoint.

1. 6 Style de gestlon

La peche est adrninistree au moyen d'un total autorise de captures (TAC), etablissant Ia quantite de poissons qui peut etre exploitee, defmi a partir des informations foumies par les scientifiques et par l'industrie. Le TAC est habituellement fixe en fonction de !'exploitation d'une partie de Ia biomasse estimee exploitable commercialement (taux d'exploitation en pourcentage), de fa~on a optimiser le rendement, sans exposer les ressources au risque de surexploitation. Une fois le TAC etabli, les quotas individuels transferables (QIT) sont calcules a partir du pourcentage auquel a droit chaque titulaire de permis. En plus des limites des extrants mentionnees ci-dessus (TAC, QIT), plusieurs intrants sont reglementes: nombre de casiers, taille minimale, rejet des femelles, nombre de pecheurs, etc.

2. ETAT DU STOCK 2.1 Biolog~

Le crabe des neiges (Chionoecetes opilio) est un crustace (comme le homard et Ia crevette) au corps aplati et circulaire, ayant cinq paires de pattes similaires a celles d'une araignee. A mesure que le crabe grossit. il se debarrasse

periodiquement de sa carapace exterieure rigide au cours d'un processus appele mue. Ace stade, sa carapace reste moUe pendant uncertain temps; c'est pourquoi on l'appelle crabe a carapace molle (premier stade apres Ia mue) et crabe blanc (tousles stades suivant Ia rnue). Contrairement au homard, le crabe des neiges male ou femelle ne mue pas pendant toute sa vie. Les femelles arretent de muer lorsqu'elles acquierent un abdomen suffisamment grand pour porter leurs oeufs, soit a une taille generalement inferieure a 95 mm. Le male, pour sa part, arrete de muer lorsque les pinces de sa premiere paire de pattes sont relativement grandes; il arrive ainsi que certains males cessent de muer lorsque leur carapace mesure 40 mm d'envergure. Ce stade est alors appele mue terminale. Les crabes femelles pondent des oeufs qu'elles transportent sous leur abdomen pendant environ deux ans. Les oeufs eclosent a Ia fin du printemps ou au debut de l'ete et les petites larves passent douze a quinze semaines a deriver librement dans l'eau. A Ia ftn de cette periode, elles se fiXent au fond. II faut compter ensuite au moins huit a neuf ans avant que le crabe des neiges male atteigne Ia taille reglementaire. On considere que tousles crabes de !'ensemble du sud du golfe font partie d'un seul et unique stock.

2.2 Milieu On sait que le crabe des neiges pretere des temperatures qui se situent entre -1 oc et 3 °C, de sorte que I' expansion de Ia couche d'eau froide pourrait signifier qu'il y a eu une expansion de !'habitat favorable aux crabes adultes depuis les six demieres annees. Les temperatures de fond ont ete inhabituellement fro ides par rapport a Ia moyenne du sud du golfe en 1995 : dans 40 % de Ia superficie du sud du golfe, Ia temperature etait inferieure a 1 °C. De plus, 1995 est l'annee au cours de laquelle Ia superficie des eaux dont Ia temperature se situait sous zero a ete Ia plus importante depuis 25 ans. Au cours des six demieres annees, une grande partie des eaux du fond a ete regulierement fro ide. Cette situation pourrait favoriser l'accroissement de l'abondance du crabe.

2.3 Interactions entre les esp~ces Certaines especes de poissons de fond (morue et merluche) sont de grands predateurs connus du crabe. Cependant, on connal't malles quantites reelles de crabe consommees par les predateurs. Les repercussions veritables des predateurs sur les stocks de crabe demeurent incertaines.

2.4 Evaluation L' evaluation est basee sur une analyse des activites de peche et un releve de recherche au chalut. Les registres des pecheurs servent a decrire Ia repartition de !'effort de peche eta estimer l'abondance relative des crabes adultes. Le releve au chalut est entrepris immediatement apres Ia peche et fournit une estimation du nombre de males a large pince eta carapace molle de plus de 95 mm, qui feront partie de Ia biomasse exploitable de l'annee suivante, en tant que nouvelles recrues. Le releve foumit egalement une evaluation des crabes adultes non captures et de I' abondance des males et des femelles de taille inferieure, c.-a-d. les prerecrues.

2.5 Recherche Le releve et les techniques de cartographic utilises pour estimer Ia biomasse de crabe des neiges ont donne des resultats assez semblables au rendement de Ia peche tel que mesure au moyen des prises par united' effort (PUE) et se sont done reveles des outils valables pour l' evaluation du stock. Cependant, il faut y apporter certains changements afm d'en ameliorer Ia precision et d'attenuer les incertitudes de !'evaluation de Ia biomasse, surtout aux limites de Ia zone de releve.

Bien que Ia biomasse disponible et le recrutement au sein de Ia population exploitable pour Ia saison suivante puissent etre predits a partir de Ia biomasse des males a petite pince et des males a grande pince dont Ia carapace mesure plus de 95 mm de diametre, Ia prediction du recrutement pour plus d'une annee demeure assez aleatoire a cause des mecanismes complexes de croissance de l'espece. De plus, les facteurs qui influent sur les tendances cycliques du recrutement obtenues par le releve depuis 1988, sont encore inconnus. II faudrait faire une analyse en profondeur de Ia dynamique de Ia population et des etudes biologiques de l' ensemble du cycle de I' espece afin d'ameliorer Ia capacite de predire les changements a long terme du recrutement.

2.6 Perspectives pour 1996 a 2001 La peche depend du moment et de l'ampleur des poussees de recrutement. Le niveau actuellement eleve de Ia biomasse est attribuable au bon recrutement de plusieurs groupes de taille de petits crabes qui ont d'abord ete observes au cours du releve de 1988. Lorsque les jeunes recrues font leur apparition parmi les prises du releve au chalut, il faut compter environ cinq a six ans pour qu'elles fassent partie de Ia population exploitable commercialement. Une autre poussee de recrutement a ete observee en 1995. II est probable que l'abondance du stock diminuerajusqu'en 1998-1999. II faut done adopter une strategic de gestion assez souple pour tirer parti de ces

fluctuations d'abondance. L'etat du stock du crabe des neiges dans Ia ZPC 19 est presente dans le Rapport sur 1 'etat du stock de crabe des neiges du sud du golfe. Region des Maritimes, qui fait partie d'une serie de publications sur I' etat des stocks exploites dans le cadre des peches de I' Atlantique qu' on peut se procurer aux bureaux du MPO.

3. OBJECTIFS A LONG TERME DE LA PECHE

4. OBJECTIFS GENERAUX DE GESTION

4.1 Conservation/Viabilile • Promouvoir et assurer Ia conservation et Ia protection des stocks de crabe des neiges. • Recueillir les donnees precises et opportunes essentielles a !'evaluation de l'etat des stocks. • Optimiser !'utilisation de cette ressource limitee, tout en arrivant a Ia rentabilite eta Ia viabilite. • Promouvoir Ia mise au point et !'application de bonnes pratiques de peche afm de reduire les rejets en mer.

4.2 Considerations internationales II y a peu de considerations intemationales dans ce cas, puisque cette peche est pratiquee par une flottille canadienne dans des eaux canadiennes.

4.3 Considerations nationales a) Peche autochtone

Dans le cadre de Ia strategie generate du Ministere visant a accroitre Ia participation des Autochtones a Ia peche commerciale, trois permis temporaires de peche commerciale du crabe des neiges de Ia zone 19 ont ete accordes a des bandes autochtones en 1992. En 1996, ces permis deviennent des permis ordinaires de peche du crabe avec 18 casiers, et trois permis additionnels a quatre casiers sont accordes. Ces permis sont delivres en vertu du Reglement de pee he de I 'Atlantique de 1985, et les participants sont assujettis aux memes regJes que tous les autres participants a Ia peche dans Ia ZPC 19.

II semble y avoir certains mouvements de crabes entre Ia zone 19 et Ia zone F; il faudra done faire d'autres etudes afin de determiner Ia nature de ces migrations.

5. DIFFICULTES DE GESTION ACTUELLES

5.1 Difficulte: Protection des nouvelles recrues (crabes a carapace molle) Bien que Ia population de crabe avance en age, il importe de noter qu'il faut s'attendre, a mesure que les nouvelles recrues se joignent a Ia population exploitable, a une incidence accrue de crabes a carapace molle, particulierement si Ia biomasse commerciale est faible. Par consequent, I' industrie do it optimiser ses prises a court terme ou repartir les prises sur uncertain nombre d'annees, de fa~on a maximiser ses revenus, tout en tenant compte de Ia quantite et de Ia qualite du crabe disponible.

Demarche: Les crabes a carapace molle sont les futures recrues de Ia population exploitable et doivent etre proteges. Le recours aux observateurs en mer au niveau determine par le MPO est d'une importance cruciale pour surveiller Ia flottille, afm de mesurer l'ampleur du probleme et d'etablir un seuil d'interdiction de Ia peche lorsque le niveau de crabes a carapace molle depasse 20 % des prises.

5.1 Diff~eulte : Determiner Ia biomasse exploitable Au cours des annees passees, Ia Direction des sciences du MPO a mis au point une methode qui permet de determiner, a partir des releves au chalut, l'etat des stocks de crabe dans le sud du golfe du Saint-Laurent. Etant donne les restrictions budgetaires actuelles, cet outil ne pourra plus etre utilise par le MPO, ce qui ne lui laisse que Ies anciennes methodes moins fiables de determination de l'etat des stocks de crabe des neiges.

Demarche: Grace a Ia conclusion d'une entente sur I' execution d'un projet conjoint a long terme et au present Plan integre quinquennal de gestion de Ia peche, l'avenir des pecheurs leur apparait plus stable. lis ont done decide de fmancer cet important releve, puisqu' ils se rendent comptent qu' ils beneficieront directement des resultats.

5.3 Difflculte : Partage des ressources La peche du crabe des neiges dans Ia zone 19 est passee de quelques titulaires de permis au debut des annees soixante a 74 entreprises de peche cotiere a permis multiples, en 1992. Cette expansion est attribuable a un certain nombre de facteurs; cependant, le facteur determinant de cette progression constante a ete !'augmentation de Ia valeur du crabe des neiges sur le marche mondial. Tandis que Ia peche devenait plus lucrative, on a cherche des moyens de repartir cette richesse entre un plus grand nombre de pecheurs de Ia collectivite. Cette repartition s' est faite au hasard et de fa~ on non planifiee, de sorte qu' au fur et a mesure de I' evolution de Ia pee he dans Ia zone 19, les demandes d'elargissement du processus de partage ne cessaient d'affluer. Face a !'augmentation de ces demandes, les pecheurs de crabe ont demande au MPO de mettre un frein au processus ou tout moins de le limiter, afm de maintenir Ia stabilite a long terme de leur industrie.

Demarche: Afm de resoudre le probleme du partage et d'apporter une certaine stabilite a l'industrie de Ia peche du crabe des neiges de Ia zone 19, I' entente sur !'execution d'un projet conjoint et le present Plan integre de gestion de Ia peche etablissent un processus global de partage de Ia fa~on suivante: aux 74 permis existants s'ajoutent 37 nouveaux permis autorisant !'utilisation de quatre casiers chacun. Un regime de casiers individuels transferables, administre par l'industrie, permet le transfert de casiers/parts entre les Ill titulaires de permis mais, ce qui est plus important encore, des 74 titulaires d'origine aux 37 nouveaux titulaires de permis. Le regime comporte egalement un mecanisme de partage des ressources avec les nouveaux participants, dans le cas oil Ia valeur des ressources augmenterait au-dela des niveaux etablis. Enfm, le regime de QIT est etabli de fa.;on a empecher un titulaire de permis d'obtenir un autre permis (minimum de quatre casiers/parts par permis), afm de stabiliser a Ill le nombre de permis, avec addition possible de permis temporaires lorsque Ia hausse des valeurs le permet.

6. MESURES GENERALES DE GESTION POUR 1996 A 2001

6.1 Repartitions du quota Le total autorise des captures (TAC) est fixe chaque annee, en multipliant le taux d'exploitation, tel qu'etabli selon le paragraphe 6.3 ci-dessous, par Ia biomasse exploitable, estimee par Ia Direction des sciences du MPO dans le Rapport sur I' etat du stock. Le T AC sera reparti au moyen d'un systeme de casiers/parts transferables, chaque easier/part recevant Ill 480 (,0675 %) du TAC, suivant I' entente de partage decrite au paragraphe 6.6, ci-dessous.

Des renseignements precis au sujet de Ia biomasse exploitable, du taux d'exploitation et du TAC seront fournis dans le Plan annuel de peche du crabe des neiges de Ia zone 19.

6.2 Saisons de peche Les saisons de peche demeurent les saisons traditionnelles, soit de Ia mi-juillet a Ia mi-septembre, Ia date reelle d'ouverture restant a detenniner par l'industrie, en collaboration avec le MPO.

6.3 Taux d'exploitation L'industrie sera chargee de fixer le taux d'exploitation entre 40% et 50% de Ia biomasse exploitable. Le choix d'un taux d'exploitation inferieur ou superieur a cette echelle exige le consentement du MPO.

6.4 Controle Tous les debarquements doivent etre soumis au controle independant d'un tiers, effectue par une societe de controle a quai approuvee par le MPO.

6.5 Mesures de conservation Seton le protocole du MPO, si !'incidence des jeunes crabes non adultes (crabes a carapace moUe ou crabes blancs) captures en mer depasse 20 %, a tout moment de Ia saison au cours d'une des annees de !'entente, Ia peche sera interdite pendant le reste de cette annee. Le niveau requis de presence des observateurs pour appliquer cette mesure sera etabli par le Comite conjoint de gestion et sera indique dans le Plan annuel de peche du crabe des neiges de Ia zone 19.

6. 6 Entente de partage En 1996, Ill pennis seront delivres pour cette peche, c'est-a-dire les 59 pennis ordinaires de peche du crabe et les 15 penn is temporaires delivres en 1992, qui sont de venus des penn is ordinaires. Ces 7 4 penn is sont assortis de l'autorisation d'utiliser 18 casiers/parts chacun. De plus, 37 nouveaux pennis ordinaires a quatre casiers/parts seront delivres par tirage au sort. Les transferts pennanents de casiers/parts sont pennis. • Chaque easier/part aura un lien direct avec le T AC. • Le nombre total de casiers/parts est de I 480. • Uneasier correspond a une part. • Le nombre maximum de casiers/parts qu'un pecheur peut detenir est de 26; le minimum est de quatre. • Aucun pecheur titulaire d'un pennis de peche du crabe des neiges ne peut en obtenir un second; par

consequent, les quatre demieres parts detenues par un pecheur peuvent etre redelivrees a un pecheur membre du noyau ou a un nouvel arrivant qualifie qui ne detient pas encore de pennis de peche du crabe des neiges (suivant Ia Politiq,ue d'emission cies pennis pour Ia peche commercjale dans l'est du Canacia.

• Le nombre de titulaires de pennis est ftxe a 111, pas un de plus, pas un de moins. • Les pecheurs sont autorises a utiliser jusqu'a 26 casiers a partir d'un meme bateau; cependant, tousles

titulaires de pennis concemes doivent etre a bord pendant toutes les activites de peche. • Le Area 19 Snow Crab Fishennan's Association, en collaboration avec le MPO, administrera le transfert des

casiers/parts et infonnera le MPO de toutes les transactions, au moins deux semaines avant l'ouverture de Ia peche, chaque annee .

• 6. 7 Partage additlonnel

a) Mecanisme Ce processus detennine Ia methode de partage du surplus au cas ou le niveau du stock ou les prix augmenteraient Ia valeur de Ia peche a des niveaux anormalement eleves. • Pour appliquer ce mecanisme, on a ftxe un « seuil de declenchement »,base sur Ia valeur des debarquements

de Ia peche de 1995. • La valeur de l'annee de base est de 13 320 000 $. • Ce « seuil de declenchement » augmentera de 133 200 $ (1 %de Ia valeur de l'annee de base) en 1997 et

chaque annee subsequente de !'entente. Le tableau qui suit montre Ia valeur du « seuil de declenchement »a chaque annee (sous reserve d'un examen en 1999).

• Si cette valeur est moindre que les 90 % du seuil de declenchement de cette annee-1!\, Ia totalite du quota sera repartie entre les Ill titulaires de permis. Si Ia valeur prevue de Ia peche depasse les 90 %, il faut alors suivre les etapes suivantes :

Etape 1 : Attribuer 90% du seuil de declenchement de l'annee a Ia flottille existante. Etape 2 : Apres deux semaines de peche, confmner les prix en collaboration avec les pecheurs. Etape 3 : Attribuer le reste du quota necessaire pour atteindre le seuil de declenchement a Ia flottille

existante. Etape 4 : Partager tout quota additionnel, au-dela du seuil de declenchement de Ia fa~on suivante :

50% a Ia flottille existante et 50% en permis temporaires a des pecheurs membres du noyau qui pratiqueraient une peche a Ia fm de l' ete. La portion attribuee aux pecheurs membres du noyau est determinee a Ia discretion du Ministere.

Les permis de peche du crabe des neiges dans Ia ZPC 19 sont delivres a Ia discretion absolue du Ministre, conformement a !'article 7 de Ia Loi sur les peches. Les politiques qui regissent Ia delivrance de ces permis, incluant Ie renouvellement et le partage des permis, le remplacement des bateaux, l'immatriculation des bateaux et !'enregistrement des pecheurs, les !ignes directrices generales, etc., soot toutes decrites dans Ia Politique d'emjssjon cies perm is pour Ia peche commerciale dans I' est du Canada. qu' on peut se procurer dans tous les centres de delivrance des permis du MPO. La surveillance est assuree au moyen de vehicules, d'avions et de bateaux

Les agents des peches doivent aussi verifier le travail de Ia societe de controle a quai.

7.3 Patrouilleurs des peches Dans le golfe, il y a cinq zones pennanentes et deux zones de peche experimentale; !'experience passee montre que les pecheurs d'autres zones empietent dans des secteurs oil ils ne sont pas autorises a pecher. Les patrouilleurs servent principalement a surveiller les limites. lis foumissent egalement une plate-fonne a partir de laquelle les agents des peches peuvent verifier les exigences legales concernant les casiers, arraisonner des bateaux de peche et inspecter les prises, les registres, les engins, les pennis, les documents d'immatriculation, Ie numero d'immatriculation du bateau, etc.

7.4. Surveillance aerienne Les zones de peche sont patrouillees sporadiquement par des avions qui s' assurent que Ia peche est pratiquee par des bateaux autorises dans les zones d'eau libre.

La zone 19 n'a pas de« comite consultatif» qui lui soit propre. Cependant, pendant Ia duree du planet de !'entente sur !'execution d'un projet conjoint, et, a moins qu'il n'en soit autrement indique dans le Plan, le Comite conjoint de gestion, dont Ia liste des membres figure en annexe V, prend les decisions au sujet de !'application du Planet de !'entente sur !'execution d'un projet conjoint. Le Comite conjoint peut consulter d'autres groupes de l'industrie, des transformateurs ou des ministeres provinciaux des Peches, a n'importe que! moment, s' il le juge necessaire. ENTENTE SUR L'EXECUTION D'UN PROJET CONJOINT

Etablie en double exemplaire

ENTRE: SA MAJESTE LA REINE DU CHEF DU CANADA, representee par le ministre des Peches et des Oceans ( « le Ministre »)

ET: AREA 19 SNOW CRAB FISHERMAN'S ASSOCIATION, corps dliment constitue en vertu de Ia Societies Act de Nouvelle-Ecosse, dont le siege social est situe au easier postal477, Cheticamp (Nouvelle-Ecosse) («!'Association»).

CONSIDERANT QUE le Ministre et !'Association(« les parties>>) souhaitent entreprendre un projet conjoint visant a gerer efficacement Ia peche du crabe des neiges dans Ia zone 19, en Nouvelle-Ecosse, au moyen d'une relation de cooperation a long terme s'appuyant sur Ia confiance et le respect et sur des principes de preservation et de durabilite de l'environnement (« le projet » );

ET CONSIDERANT QUE Ia presente entente sur !'execution d'un projet conjoint peut constituer Ia base de plus amples pourparlers au sujet d'un contrat d'association, advenant !'entree en vigueur des modifications prevues a Ia Loi sur les peches;

EN CONSEQUENCE, compte tenu de ce qui precede et des engagements reciproques enonces ci-apres, les parties aux presentes sont con venues de ce qui suit :

I. LE PRQJET

1.1 Le projet est decrit a l'annexe A ci-jointe. Les responsabilites de chaque partie a l'egard du projet sont enoncees dans le Plan de travail annuel, annexe B ci-jointe, qui sera revise tous les ans, conformement a Ia clause 3.1.

2. LE COMITE DE GESTION

2.1 A !'entree en vigueur de Ia presente entente, les parties mettront sur pied un comite de gestion, charge de surveiller Ia gestion et !'administration du projet. Le comite de gestion sera constitue des personnes suivantes:

a) representants du Ministre : le gestionnaire du secteur du Golfe Nouvelle-Ecosse (copresident du comite); le chef, Conservation et Protection, Golfe Nouvelle-Ecosse; I' agent de gestion des ressources, Golfe Nouvelle-Ecosse; un representant des Sciences;

b) representants de !'Association: le President (copresident du comite); au plus six membres du Groupe de travail de !'Association.

2.2 Le comite de gestion invitera, pour lui preter main-forte, toute autre personne qu'il jugera utile.

2.3 Pendant Ia duree de Ia presente entente, le comite de gestion se reunira au moins une fois par periode allant du ler avril au 31 mars(« l'annee fmanciere >>).

3. FONCIIONS DU COMJTE DE GESIION

3.1 Les parties veilleront a ce que le comite de gestion :

a) dresse, tous les ans au 31 mars, un Plan de travail annuel pour l'annee fmanciere suivante, qui precise les activites a entreprendre et les responsabilites fmancieres et non fmancieres de chaque partie a l'egard du pro jet;

b) surveille l'etat d'avancement des travaux et le rendement des parties dans le cadre du Plan de travail annuel;

c) verifie les couts et Jes depenses de chaque partie relativement au projet.

4. OBLIGATIONS DU MJNISJRE

4.1 Le Ministre doit se servir des fonds qui lui sont verses par !'Association, comme il est precise dans Ia Partie II du Plan de travail annuel, et assumer ses responsabilites fmancieres et non fmancieres, enoncees dans Ia Partie I du Plan de travail annue1, pour mener les activites mentionnees dans les presentes.

4.2 Les responsabilites fmancieres et non fmancieres du Ministre a l'egard du projet s'elevent, pour l'annee fmanciere 1996-1997, a 96 700 $. II faut s'attendre a ce qu'elles soient de 1'ordre de 96 000 $ pour chaque annee financiere subsequente de Ia presente entente.

4.3 Une fois chaque plan de travail annuel accepte et signe par 1es parties, les responsabilites tinancieres et non fmancieres du Ministre qui y seront detaillees engageront le Ministre pour l'annee fmanciere en question.

4.4 Les fonds re~us par le Ministre devront etre comptabilises conformement aux reglements applicables du Conseil du Tresor. Tout solde non utilise des fonds verses au Ministre aux termes de !'entente sur !'execution d'un projet conjoint sera rembourse a !'Association, conformement au Reglement sur le remboursement de recettes.

5. OBLIGATIONS DE L'ASSOCIAIION

5.1 L'Association versera les fonds au Ministre, menera les activites et s'acquittera des responsabi1ites fmancieres et non financieres precisees dans Ia Partie II du Plan de travail annuel.

5.2 Les responsabilites financieres et non financieres de !'Association a l'egard du projet s'elevent, pour l'annee fmanciere 1996-1997, a 100 040 $. II faut s'attendre a ce qu'elles soient de l'ordre de 145 000 $ pour chaque annee financiere subsequente de Ia presente entente.

5.3 Une fois chaque plan de travail annuel accepte et signe par les parties, les responsabilites fmancieres et non fmancieres de !'Association qui y seront detaillees engageront !'Association pour l'annee fmanciere en question.

5.4 Dans les cinq (5) jours suivant !'acceptation et Ia signature de chaque plan de travail annuel par les deux parties, les fonds payables par I' Association au Ministre seront verses au Ministre. L'instrument de paiement sera etabli a 1'ordre du Receveur general du Canada.

6. vtRIFJCAIJON ET SURVEILLANCE

6.1 Le Ministre et !'Association conviennent de tenir des livres, des registres, des documents et autres elements probants ayant trait a tous les couts et depenses engages et utilises et aux fonds acquis en vertu de Ia presente entente dans une mesure et selon un niveau de detail tels qu'ils feront convenablement etat de tous Ies couts directs et indirects de Ia main-d'oeuvre, des materiaux, de l'equipement, des fournitures et des services. Chaque partie conservera les registres et documents pendant une periode de trois (3) ans suivant Ia resiliation de Ia presente entente pour quelque raison que ce so it. Les deux parties conviennent de mettre, sur demande, a Ia disposition de !'autre partie pour examen et verification tous les registres se rattachant au projet, sous reserve des dispositions de Ia Loi sur l'acces a /'information et de Ia Loi sur Ia protection des renseignements personnels.

l'une ou !'autre partie. Tout document devant etre publie par l'une ou I' autre des parties sera foumi a !'autre partie avant sa ditfusion publique.

8.2 Chaque partie conserve le droit de designer nornmement l'un quelconque de ses employes, qui aura participe a Ia redaction de projets, d'analyses ou de rapports, cornme coauteur de toute publication scientifique en resultant.

9. ENTREE EN VJGUEUB EI DuREE

9.1 La presente entente entre en vigueur a Ia date a laquelle elle est signee par les deux parties et, a !'exception de l'annexe B, demeure en vigueur jusqu'au 31 mars 200 I, a moins qu'elle ne soit resiliee plus tot, conformement a Ia clause 10.

10. RESILJATION

I 0.1 La presente entente peut etre resiliee en tout temps avec le consentement des deux parties.

10.2 Resiliation motivee:

a) L' Association peut resilier Ia presente entente par !'envoi d'un avis ecrit au Ministre:

i) si le Ministre n'en respecte pas les conditions ou ii) si le Plan integre de gestion de Ia peche du crabe des neiges de Ia zone 19 pour 1996-2001 est

modifie.

b) Le Ministre peut resilier Ia presente entente par !'envoi d'un avis ecrit a !'Association:

i) si !'Association n'en respecte pas les conditions, ii) si !'Association fait faillite, demande Ia protection de Ia loi sur les faillites ouest mis en cause

dans une procedure de faillite ou iii) si le Ministre est, a son avis, incapable de remplir ses obligations aux termes de Ia presente

entente.

II. CONSEQUENCES DE LA RESILIAIION

11.1 La resiliation de !'entente entrainera les consequences suivantes :

a) Le Ministre remettra a !'Association Ia portion inutilisee des fonds ~us de !'Association aux termes de Ia presente entente, deduction faite de toutes les sommes affectees au paiement des biens, des services et d'autres engagements que le Ministre est incapable d'annuler;

b) le Ministre communiquera a !'Association tous les rapports, analyses et donnees qui ont ete produits en execution de Ia presente entente.

12 INDEMNISAIION

12.1 Le Ministre doit indemniser !'Association et tous ses representants et employes de tous dommages-interets, pertes, depenses et collts de quelque nature que ce soit decoulant directement ou indirectement de Ia negligence du Ministre ou de ses employe(e)s ou de ses mandataires en vertu ou dans le cadre de Ia presente entente.

12.2 L'Association doit indemniser Sa Majeste, le Ministre et tous ses employe(e)s de tous dommages-interets, reclamations, poursuites, causes de poursuites, pertes, depenses et c01its de quelque nature que ce soit decoulant directement ou indirectement de !a negligence de !'Association, de ses employe(e)s ou de ses mandataires en vertu ou dans le cadre de !a presente entente.

13.1 Tout avis signifie aux termes de Ia presente entente doit etre envoye par ecrit a !'autre partie a l'une des actresses suivantes :

14. REGLEMENI DES DIFFtRENUS

14.1 Si survient un differend quanta !'interpretation de Ia presente entente ou de questions se rattachant a sa resiliation ou de I' execution des presentes, les parties chercheront de bonne foi a regler le differend par voie de negociation. Si Ia negociation echoue, les parties soumettront Ia question a un tiers acceptable de part et d'autre aux fins de mediation. Les couts de mediation seront repartis en parts egales entre les parties.

15 PAS DE RELATION MANDANT ET MANDATAIRE

15.1 Ni !'Association ni aucun de ses employes ou mandataires n'est un employe, un prepose ou un mandataire du Ministre ou de Sa Majeste et ne doit en donner !'impression. L'Association est seule responsable de tous les couts, reclamations, mises en demeure, pertes, creances, actions, dommages-interets, poursuites ou autres procedures engagees contre elle de quelque maniere que ce soit, par suite ou a cause de ses obligations en vertu de Ia presente entente.

16 CHAMDRE DES COMMUNES OU SENAT

16.1 Les membres de Ia Chambre des communes ou du Senat ne peuvent participer a Ia presente entente ni en tirer avantage.

17 FONCTIONNAIRES

17.1 Un titulaire actuel ou un ancien titulaire d'une charge publique qui ne se conforme pas aux dispositions applicables du Code regissant Ia conduite des titu/aires de charge pub/ique en ce qui concerne les conjlits

PLAN DE TRAVAIL ANNUEL

1996-1997

PARTIE I- LE MINISTRE

A. ACTMTES

APPLICATION DES REGLEMENIS ET GESTION

Affectation d'agents des picbes Affecter !'equivalent de deux (2) agents des peches (GT 03) a Ia zone 19 pendant 5 jours de travail a horaire nonnal par semaine pour une periode de 5 semaines, qui meneront les activites ordinaires d'application des reglements suivantes : verifications a quai/au rivage; arraisonnements; surveillance, observations et recherches par avion, bateau et vehicule.

Niveau de presence des observateun en mer Etablir et appliquer des nonnes pertinentes applicables aux observateurs en mer. Accrediter les observateurs selon des nonnes etablies. Coordonner le Programme des observateurs. Mettre a Ia disposition de !'Association tousles rapports et les analyses decoulant des activites des observateurs. Etablir le niveau approprie de presence des observateurs.

Niveau de presence des patrouilleurs et de Ia surveillance aerienne (avions et belicopteres) Coordonner et planifier les activites de surveillance des patrouilleurs et de surveillance aerienne dans Ia zone 19 et aux alentours, avec !'avis de l'industrie. Mettre a Ia disposition de Ia zone de peche 19 le patrouilleur Aquariel pendant au moins 15 jours de mer et au plus 20 jours de mer.

Etiquettes de easier Acheter des etiquettes et les distribuer aux pecheurs de Ia zone 19.

Registres de picbe/saisie de donnees Se charger de Ia saisie des donnees des registtes, de !'analyse des donnees et de Ia production de rapports. Acheter des registres et les distribuer aux pecheurs.

Gestion et administration Surveiller les quotas individuels et Ia peche en general. Delivrer des immatriculations, des enregistrements et des pennis pour les bateaux et pour les pecheurs. Coordonner les processus d'appel. Prendre conseil et participer au processus de cogestion. Administrer le processus des sanctions.

SCIENCES

Surveillance des picbes Surveiller le rendement et les caracteristiques des peches (p. ex. abondance de crabes a carapace molle panni les prises, niveau et repartition de !'effort de peche, quantites debarquees, PUE et autres). Valider les donnees sur Ia peche (prises, effort, repartition selon Ia taille, composition des prises et potentiel de capture par easier), a I' aide des donnees des annees precedentes.

Releve au chalut Faire le releve de 53 stations au total dans Ia zone de peche 19 et aux alentours.

Analyse statistique Estimer l'abondance de differentes categories de crabe. dont les males et les femelles a carapace molle, et produire des cartes de distribution densimetrique pour ces categories. Evaluer !'exactitude des estimations de Ia biomasse et les parametres des populations visees par les estimations. Mener des observations biologiques de base sur Ia croissance et Ia reproduction. Ameliorer les techniques de krigeage, en collaboration avec !'Ecole polytechnique de l'Universite de Montreal ( obtenir le nombre optimal de stations de releve, normaliser les histogrammes, rectifier les variogrammes et autres).

Analyse et communication de donnees Estimer Ia biomasse des differentes categories de crabe Ueunes femelles, primipares, multipares et non fecondees, jeunes males, physiologiquement matures, irnmatures et morphometriquement matures), afm de foumir des donnees de base a l'industrie en vue d'une projection des prises a court terme. Foumir une projection des prises a long terme d'apres les donnees quantitatives et qualitatives sur les jeunes crabes. Dresser des cartes indiquant les concentrations de crabes commercialement exploitables. Foumir une repartition spatio-temporelle des differentes categories et tailles de crabe pour expliquer Ia dynamique des populations de crabe. Ameliorer !'exactitude des estimations de Ia biomasse et des techniques d'echantillonnage. Mener des recherches biologiques speciales (p. ex. maladie de Ia carapace, anomalies biologiques, contenu de I' estomac, etat et qualite de Ia carapace et autres ).

Consultation de I' Association Mener des consultations opportunes aupres du Groupe de travail de !'Association. Distribuer des renseignements scientifiques (tableaux et previsions) et tenir des reunions avec les membres de !'Association. Entretenir des relations avec les membres de !'Association et inciter les pecheurs a faire part de leur experience de peche et d'autres connaissances sur les stocks de crabe. Permettre a un representant de !'Association d'observer et d'enregistrer sur bande magnetoscopique le releve au chalut et d'autres projets scientifiques sur le terrain entrepris dans Ia zone 19 et concernant le crabe des neiges. Dans Ia mesure du possible, former les p&heurs et les instruire sur Ia biologie du crabe des neiges, sur les techniques statistiques et sur les techniques de mesurage pour qu'ils puissent participer a Ia collecte des donnees et aux etudes visant a parfaire les connaissances sur le crabe et a assurer Ia prise de decisions de cogestion responsables. Prendre part aux seances d'information avec les membres de !'Association d'ici le ler mars 1997.

GESIION ET APPLICATION DES REGLEMENTS

Niveau de presence des observateurs Assurer un niveau de presence de 5 % des observateurs pendant Ia saison de peche. Ce pourcentage augmentera a l 0 % dans le cas et au moment d'une allocation supplementaire au cours de Ia saison. Les couts des observateurs seront acquittes au moyen d'un contrat passe directement avec I' association des observateurs.

Etiquettes de easier Aider a Ia distribution des etiquettes.

Registres de pecbe I saisie des donnees Se charger de Ia collecte des registres et les livrer au Ministre dans les 48 heures suivant les debarquements.

Gestion et administration Prendre conseil et participer au processus de cogestion.

SCIENCES

Releve au cbalut Affreter un navire pourvu du materiel et de l'appareillage convenables, qui so it approuve par le Ministre. Designer, de fa~on facultative, un representant de l'industrie qui participera au releve. lnciter les membres pecheurs a consigner des donnees exactes dans les registres, y compris le compte quotidien des prises, I' effort de peche, le temps de peche et I' emplacement des prises, et a fournir toutes les autres observations pertinentes concernant les stocks exploites, et leur expliquer I' importance de recueillir avec soin des donnees exactes. lnformer les membres pecheurs de ['importance de signaler au Ministre toute observation revelatrice concernant Ia biologie et ['exploitation du crabe des neiges. Encourager les pecheurs a communiquer au Ministre tous les renseignements ayant trait aux crabes a carapace tres vieille observes pendant Ia saison de peche. Appuyer un projet de retour des etiquettes, en encourageant les membres a y participer et a accorder leur soutien. Participer activement au processus d'etablissement des rapports sur l'etat du stock. Organiser des seances d'information en vue de Ia presentation de renseignements relatifs au projet par le Ministre.

ANNEXE VII Communique

Le 12 juillet 1996

LE MINISTRE MIFFLIN ANNONCE LE RECOURS A LA COGESTION POUR LE CRABE DES NEIGES

OTTAWA -- M. Fred Mifflin, ministre des Peches et des Oceans, a annonce aujourd'hui une strategie de cogestion pour le crabe des neiges de Ia zone 19, situee au nord-ouest de Ia cote de l'ile du Cap-Breton. L ·Association des pecheurs de crabe de Ia zone 19 a approuve Ia nouvelle entente, qui comprend un plan quinquennal de gestion integree pour cette peche ainsi qu'un accord fmancier.

«L'approche de Ia cogestion constitue le type de cooperation qui devrait exister entre le ministere des Peches et des Oceans (MPO) et I' industrie de Ia peche», a declare M. Miftlin. «Grace a cette entente, I' industrie pourra participer davantage aux decisions touchant Ia gestion de Ia peche, ce qui permettra d'augmenter les efforts de conservation et d'assurer une peche plus stable aux pecheurs eta leurs collectivites.»

Un plan quinquennal de gestion integree clairement defmi a ete adopte pour Ia gestion de Ia peche. Les pecheurs de crabe ont convenu de partager Ia ressource, ce qui a fait passer le nombre de participants de 74 a Ill. Les 3 7 nouveaux detenteurs de perm is seront choisis parmi les pecheurs admissibles du noyau de base de Ia zone 19 qui possedent des bateaux de moins de 45 pieds de longueur et qui n' ont jamais eu de fa~on reguliere de perm is de peche du crabe des neiges. L' entente de partage permettra aussi a des pecheurs temporaires de participer a Ia peche, les annees ou Ia valeur de Ia rckolte depassera le niveau declencheur etabli.

<de suis heureux que les pecheurs de crabe de Ia zone 19 aient offert de partager Ia ressource de fa~on permanente, meme si le niveau de Ia biomasse en 1996 etait inferieur a celui de I' an demier. Cela demontre Ia volonte des pecheurs de distribuer cette ressource productrice de richesse.»

Le Plan de gestion integree prevoit aussi l'etablissement d'un maximum de I 480 parts representees par les casiers. Chaque part representerait un easier et 0,07 % du quota annuel. Les detenteurs de permis actuels debuteront Ia peche en 1996 avec 18 parts et les nouveaux pecheurs avec quatre parts chacun. Le nouveau systeme permettra un transfert permanent de parts entre les participants, jusqu'a concurrence de 26 casiers et de I ,82 % du quota. Les pecheurs devront detenir au moins quatre parts afm de pouvoir participer a Ia peche.

Dans le cadre de !'entente, il incombera aux membres de l'industrie d'etablir, entre 40 et 50%, le niveau d'exploitation annuel de Ia biomasse recoltable estimative. Dans le cas d'un niveau d'exploitation inferieur ou superieur aces pourcentages, il faudra obtenir l'autorisation du Ministre. S'il y a lieu, le niveau d'exploitation sera modifie pour tenir compte des preoccupations en matiere de conservation.

«Cette approche de cogestion a ete rendue possible grace a Ia tres grande collaboration des representants de Ia flottille du crabe des neiges de Ia zone 19 et des fonctionnaires du Ministere», a indique M. Miffiin. «Elle constitue Ia base des prochaines discussions sur les ententes de partenariat. qui auront lieu apres !'adoption des modifications de Ia Lor sur les peches. »

En 1996, Ia peche du crabe des neiges dans Ia zone 19 commencera a Ia mi-juillet et le total autorise de captures (T AC) s' elevera a 1 113 tonnes.

L'accord fmancier de !'entente de cogestion, que signeront les representants du MPO et de l'industrie, fait etat d'une participation importante de l'industrie dans des domaines comme !'evaluation scientifique, les etiquettes de casiers, !'application des reglements, le controle a quai, les registres et !'entree de donnees.

Dans le Plan de gestion integree, on y enoncera clairement les sanctions, les plans d'application des reglements et les mesures de conservation, dont Ia surveillance sera assuree par le personnel du MPO afm de ne pas

compromettre les efforts de conservation. Par exemple, Ia peche sera fermee si le crabe a carapace moUe s'eleve a 20 % des prises.

«La conservation est notre priorite et no us pouvons modifier le Plan de gestion integree en tout temps pour qu'elle le demeure>>, a conclu M. Mifflin.
