Proposal: The applicant seeks Historic Resource Review approval for alterations to the 1922 "contributing" resource historically known as the Lloyd D. and Emma M. Painter House. The structure, built in the English Cottage Style, is located at the southwest corner of NE Siskiyou Street and NE 15th Avenue intersection in the northwest quadrant of the Irvington Historic District. Alterations include the following:

North Elevation (street facing- NE Siskiyou Street): • Installation of new stucco 88Q enclosure. • Installation of new wood basement egress window in the same location as existing

basement window on this elevation. • Installation of a new stucco wall including stucco columns, at the property line. • Removal of existing wood fence and gate to be replaced with a new iron gate and wood

fence, at grade and setback from the existing retaining wall. • Alterations to the existing retaining wall at the property line including reinforcement

and resurfacing with stucco. (See Modification request below) • Installation of a new fireplace/chimney structure. Note: This is exempt from Historic

Review per Portland Zoning Code 33.420.320.8.2. • Removal of existing wood stairs off of the concrete porch to be replaced with a new

concrete stairs. Note: This is exempt from Historic Review per Portland Zoning Code 33.420.320.8.2.

East Elevation (street facing- NE 15th Avenue): • Removal of existing glass block window to be replaced with wood double-hung window

in the same location. • Removal of existing main entrance circular stairs to be replaced with new rectilinear

concrete stairs and railing in the same location on the street facing fac;ade. • Installation of new period correct lighting sconces at the main entrance. • Installation of new wood door to access the area where the residence and garage meet. • Installation of a new stucco wall including stucco columns, at the property line. • Removal of existing metal garage door to be replaced with a wood carriage style door in

the same location on the elevation.

South Elevation: • Removal of existing wood stairs to be replaced with new concrete stairs and landing,

including powder coated steel guardrail. • Installation of new concrete stairs/egress to proposed basement accessory dwelling unit

(ADU) at the southeast corner of the structure including powder coated steel guardrail. • Installation of new wood French doors and wood double-hung window at ADU entry. • Extension of lower roof at the kitchen/ garage to the southeast corner of the residence.

West Elevation: • Removal of three existing windows on the second floor to be relocated and reused on the

same floor and elevation. • Removal of an existing window on the bay to be replaced with a wood door matching

other doors on the contributing resource. • Installation of new concrete stairs and patio similar to the north patio. • Removal of two existing windows on the ground floor to be moved on this elevation and

reused. • Installation of new ground floor area at the southwest corner of the residence. The

impacted window in this location will be reused on the west elevation of this structure. • Removal of existing steel garage man-door to be replaced with a wood door in

approximately the same location at the northwest corner of the garage. • Installation of a new wood basement egress window slightly south (due to the previously

mentioned new patio) of the current windows location on this elevation.

• Installation of a new wood basement egress window in the same location as existing basement window on this elevation. Note: This is exempt from Historic Review per Portland Zoning Code 33.420.320.B.4.

• Installation of a new skylight. Note: This is exempt from Historic Review per Portland Zoning Code 33.420.320.B.12.

• Installation of a concrete path, steps and landing. Note: This is exempt from Historic Review per Portland Zoning Code 33.420.320.8.2.

The applicant requests the following Modification: • 33.110.257 Retaining Walls- to make proposed alterations to the existing retaining wall

that exceeds the 4 foot height limit as measured from the wall's top to the bottom of the footing.

Historic resource review is required for exterior alterations to contributing structures such as this one in the Irvington Historic District.

Relevant Approval Criteria: In order to be approved, this proposal must comply with the approval criteria of Title 33. The relevant criteria are:

Zoning Code Section 33.700.080 states that Land Use Review applications are reviewed under the regulations in effect at the time the application was submitted, provided that the application is complete at the time of submittal, or complete within 180 days. This application was submitted on September 30, 2016 and determined to be complete on Thursday, March 16. 2017.

DECISION MAKING PROCESS The Bureau of Development Services will make a decision on this proposal. We will consider your comments, and

• Approve the proposal. • Approve the proposal with conditions, or • Deny the proposal.

The neighborhood association listed on the first page of this notice may take a position on this application. They may also schedule an open meeting prior to making their recommendation to the Bureau of Development Services. Please contact the person listed as the neighborhood contact to determine the time and date of this meeting.

ORS 227.178 states the City must issue a final decision on Land Use Review applications within 120-days of the application being deemed complete. The 120-day review period may be extended at the request of the applicant.

APPEAL PROCESS If you disagree with the Bureau of Development Services administrative decision, you can appeal the decision to the Landmarks Commission. This review body will hold a public hearing for the appeal. When the decision is mailed, the criteria used to make the decision and information on how to file an appeal will be included. If you do not send any comments, you

can still appeal the decision. There is a 14-day deadline to file an appeal beginning on the day the decision is mailed. The reason for the appeal must be specifically defined in order for the review body to respond to the appeal. If an appeal is filed, you will be notified of the time and location of the appeal hearing.

There is a fee charged for appeals. Recognized neighborhood associations may qualify for an appeal fee waiver.

APPEAL OF THE FINAL CITY DECISION Mter an appeal hearing, the review body decision may be appealed to the Oregon Land Use Board of Appeals (LUBA) at 775 Summer St NE, Suite 330, Salem, Oregon 97301-1283. The phone number for LUBA is 1-503-373-1265. Issues that may provide the basis for an appeal to LUBA must be raised prior to the comment deadline or prior to the conclusion of the hearing if a local appeal is requested. If you do not raise an issue with enough specificity to give the Bureau of Development Services an opportunity to respond to it, that may also preclude an appeal to LUBA on that issue.
