RECYCLING SERVICE DELIVERY PLAN

1. SERVICE OBJECTIVE

1.1 Service

Recycling of Recyclable Material is fundamental to the provision of the Service.

1.2 Recycling facility

The Contractor will, subject to and in accordance with the terms of the Contract, provide a recycling facility that accepts Recyclable Material from Kerbside Schemes, Bring Banks and Bring Schemes and deliver those materials to established reprocessing markets.

In so far as organic compostable kitchen waste EWCC Number 20 01 08 is collected by a WCA then subject to Clause 24 of the Contract the Contractor shall provide a recycling facility that accepts such Recyclable Material and the WCA shall deliver such Recyclable Material to the facility.

1.3 Recycling levels

The Contractor will, subject to and in accordance with the terms of the Contract, provide new waste reception, bulking and sorting infrastructure to meet the recycling levels required under the Contract.

1.4 Transfer of Recyclable Materials

Pursuant to clause 1.2 transfer of recyclable materials to reprocessors will be carried out in the Contractor’s dedicated vehicles or by its appointed sub-contractors.

1.5 Standard of performance

The Contractor will perform its obligations in relation to this Service Delivery Plan in accordance with Onyx Management System Procedure SP.05 as amended from time to time.

2. CONTRACTOR DETAILS

2.1 Transitional period sub-contractor and Service arrangements

2.1.1 In the period from the Execution Date to Completion of the MRF the Contractor will make arrangements for the transportation of Recyclable Materials deposited at its nominated disposal points in an appropriate manner determined by it and in accordance with the Contract.

Such Recyclable Materials shall be delivered in the following form:

2.2.1 The Contractor will select its MRF supplier when the input specification has been completed. The nature of this specification will be dependent upon the collection arrangements adopted by the WCAs.

2.2.2 Based on current technology for constructing an MRF, the Contractor may employ any of the following, but will not be obliged to use any of the following to provide and construct an MRF:

(A) Okay Engineering Valley Way, Market Harborough Leicestershire LE16 7PS

(B) Adcon MRF Equipment, Whinstanley Racecourse Road Pershore Worcestershire WR10 2DG

3. TRANSITIONAL SERVICE PROVISION ARRANGEMENTS

3.1 Interface arrangements with Waste Collection Authorities

3.1.1 B&HCC may at any time after the Execution Date until the Completion of the MRF inform the Contractor that it requires the Contractor to take delivery of Recyclable Materials and the Contractor will, subject to and in accordance with the terms of the Contract, take delivery of such Recyclable Materials at locations to be determined by it and notified by it to the Councils. The Councils shall give a minimum of six months notice of any change in collection and delivery arrangements.

3.1.2 Upon Completion of the proposed MRF, the transitional arrangements outlined in paragraphs 2.1, 3.1.1 and 3.2 of this Schedule 4 Part 3 will cease, with the exception of the depositing of recyclables from the West Hove scheme at Leighton Road Depot which will need to continue for vehicle capacity reasons so long as such limitations on the vehicle exist. All Recyclable Materials will then be directed to the proposed MRF.

3.1.3 The Contractor will have no obligation at any time to accept any Recyclable Materials for reprocessing from any of the following WCAs at any Household Waste Recycling Site, Transfer Station or MRF unless otherwise agreed with the individual WCA and the Councils:

(A) Wealden District Council;

(B) Rother District Council;

(C) Lewes District Council;

(D) Eastbourne Borough Council; and

(E) Hastings Borough Council.

3.2 Recycling arrangements

Brighton & Hove City Council

Paper Collection Sources (other than Bring Schemes) Kerbside Schemes

A quantity of paper is currently collected from a kerbside collection and taken by refuse collection vehicles to Leighton Road, Hove Transfer Facility on a daily basis by B&HCC.

B&HCC intends to implement two multi-material collection schemes in 2003/04 generating further quantities of paper. The first of these schemes is to commence in April 2003, the second in June 2003. This collection will be carried out in large sacks, some of which will then be left at a drop-off point for collection by B&HCC’s contractor. The designated delivery point for such material is Leighton Road Transfer Facility, Hove.

B&HCC will also be trialing the collection of paper in a limited number of underground banks serviced by a Hiab vehicle commencing in August 2003.

Bring Banks

Paper is also collected from bring sites across B&HCC’s Area and delivered to the Leighton Road, Hove site by a contractor on behalf of B&HCC.

B&HCC has 28 Front End Loader (FEL) paper containers within B&HCC’s Area, which are currently serviced by a contractor who transports the material directly to the re-processor.

Service Provision Kerbside Schemes

The Contractor shall provide a storage bay for the receipt of paper at Leighton Road Transfer Facility, Hove.

The Contractor or its appointed contractor shall also provide sufficient vehicles at appropriate intervals to service the delivery point and transport the material to a suitable re-processor.

The Contractor will provide a suitable transfer facility for paper collected from underground banks and provide sufficient vehicles at appropriate intervals to service the transfer facility and transport the material to a suitable re-processor.

Bring Banks B&HCC will make arrangements to service the FEL paper containers at appropriate intervals. This material will be transported directly to a suitable re-processor under arrangements made by the Contractor. All reasonable costs incurred in the transport of this material from the boundary of B&HCC’s Area to the transfer point are to be reimbursed by the Contractor.

Kerbside Schemes

Glass is generated from a kerbside collection, separated at source into green, clear and brown glass. B&HCC currently collects this and the material is taken to a Transfer Facility outside B&HCC’s Area before delivery to a re-processor.

B&HCC intends to implement two multi-material collection schemes in 2003/04 generating further quantities of glass. The first of these schemes is to commence in April 2003, the second in June 2003. This collection will be carried out in large sacks, some of which will then be left at a drop-off point for collection by B&HCC’s contractor. The designated delivery point for such material is Hollingdean Lane Depot.

B&HCC will also be trialing the collection of glass in a limited number of underground banks serviced by a Hiab vehicle commencing in August 2003.

Bring Banks Separated glass is also generated from bottle banks across B&HCC’s Area and collected by a contractor on behalf of B&HCC.

Service Provision Kerbside Schemes

Glass collected from kerbside collections will continue to be transported by B&HCC to a Transfer Facility outside B&HCC’s Area before delivery to a suitable re-processor. All reasonable costs incurred in the transport of this material from the boundary of B&HCC’s Area to the transfer point are to be reimbursed by the Contractor. The Contractor shall provide, maintain and service a storage bay for the receipt of mixed glass at Hollingdean Lane Depot under a temporary arrangement with Brighton and Hove City Council. The Contractor will also provide a storage area for sacks containing this material at Leighton Road and will transport these to Hollingdean Lane Depot.

The Contractor or its appointed contractor will also provide sufficient vehicles at appropriate intervals to service the delivery point and transport the material to a suitable re-processor.

The Contractor will provide a suitable transfer facility for glass collected from underground banks and provide sufficient vehicles at appropriate intervals to service the delivery point and transport the material to a suitable re-processor. Bring Banks Glass collected from bring banks will continue to be transported by B&HCC to a Transfer Facility outside B&HCC’s Area before delivery to a suitable re-processor. All reasonable costs incurred in the transport of this material from the boundary of B&HCC’s Area to the transfer point are to be reimbursed by the Contractor.

Cans, Aerosols and Foil Collection Sources (other than Bring Schemes)

Kerbside Schemes Cans, aerosols and foil are currently collected through a kerbside collection and taken to a Transfer Facility outside B&HCC’s Area prior to delivery to the re-processor.

This material will be taken to a Transfer Facility outside B&HCC’s Area before delivery to the re-processor. All reasonable costs incurred in the transport of this material from the border of B&HCC’s Area to the transfer point are to be reimbursed by the Contractor.

The Contractor shall provide, maintain and service a storage bay for the receipt of mixed plastics and cans at Hollingdean Lane Depot under a temporary arrangement with Brighton and Hove City Council. The Contractor will also provide a storage area for sacks containing this material at Leighton Road and will transport these to Hollingdean Lane Depot.

The Contractor or its appointed contractor shall also provide sufficient vehicles at appropriate intervals to service the delivery point and transport the materials to a suitable re-processor.

The Contractor will provide a suitable transfer facility for mixed plastics and cans from underground banks and provide sufficient vehicles at appropriate intervals to service the transfer facility and transport the material directly to a suitable re-processor.

Bring Banks

B&HCC will make arrangements to service the can banks at appropriate intervals. This material will be taken to a Transfer Facility outside B&HCC’s Area before delivery to the re-processor. Collection Sources (other than Bring Schemes) Kerbside Schemes

Cardboard is currently collected by a contractor on behalf of Brighton and Hove City Council from 10 Front End Loader sites and taken directly to the re-processors.

Service Provision

Kerbside Schemes The Contractor will provide a storage bay for the receipt of cardboard at the Leighton Road, Hove Transfer Facility.

The Contractor or its appointed contractor will also provide sufficient vehicles at appropriate intervals to service the delivery point and transport the material to a suitable re-processor.

Bring Banks

B&HCC will make arrangements to service the FEL cardboard containers at appropriate intervals. This material will be transported directly to a suitable market outlet under arrangements made by the Contractor. All reasonable costs incurred in the transport of this material from the boundary of B&HCC’s Area to the transfer point are to be reimbursed by the Contractor.

Textiles and Shoes Collection Sources (other than Bring Schemes) Kerbside Schemes

B&HCC intends to implement two multi-material collection schemes in 2003/04 generating a quantity of textiles and shoes. The first of these schemes is to commence in April 2003, the second in June 2003. This collection will be carried out in large sacks, some of which will then be left at a drop-off point for collection by B&HCC’s contractor. The designated delivery point for such material is Hollingdean Lane Depot.

Bring Banks Textiles and shoes from bring sites are currently serviced by various charities.

Bring Banks

The existing arrangement whereby the Bring Banks are serviced by charities will continue.

Plastic Bottles and Bags

Collection Sources (other than Bring Schemes) Kerbside Schemes

B&HCC intends to implement two multi-material collection schemes in 2003/04 generating a quantity of plastic bottles and bags. The first of these schemes is to commence in April 2003, the second in June 2003. This collection will be carried out in large sacks, some of which will then be left at a drop-off point for collection by B&HCC’s contractor. The designated delivery point for such material is Hollingdean Lane Depot.

B&HCC will also be trialing the collection of mixed plastics and cans in a limited number of underground banks serviced by a Hiab vehicle commencing in August 2003.

Service Provision Kerbside Schemes

The Contractor shall provide, maintain and service a storage bay for the receipt of mixed plastics and cans at Hollingdean Lane Depot under a temporary arrangement with Brighton and Hove City Council.

Service Provision Kerbside Schemes

The Contractor will provide containers at Leighton Road, Hove Transfer Facility and Hollingdean Lane Depot for the storage of non-lead acid household batteries.

The Contractor or its appointed contractor shall provide sufficient vehicles at appropriate intervals to service the delivery point and transport the material to a suitable re-processor.

Expansion of Kerbside Schemes

If by 1 October 2003 B&HCC gives notice to the Contractor that it will expand the Kerbside Scheme and deliver to the Contractor segregated Recyclable Material in accordance with Clause 2.1.1 the Contractor will provide a location within the existing Hollingdean Depot by 30 April 2004 and B & HCC shall deliver such Recyclable Material to that location. The Councils shall help facilitate the establishment of the location and provide the Contractor with such assistance as may be requested at the cost of the Contractor.

3.4 Receipt of Recyclable Materials at the MRF/Transfer Station

From Commissioning of the MRF/Transfer Station, the Contractor will, subject to and in accordance with the terms of the Contract, take delivery of Recyclable Materials from B&HCC at the MRF/Transfer Station and arrange for the haulage of these materials to suitable re-processors, subject to the following criteria:

(a) That the capacity of the MRF to process the materials being processed by it is not exceeded.

(b) That the total tonnage of material delivered to the MRF site does not exceed the stated site capacity.

(c) That the total tonnage of material delivered to transfer stations does not exceed the stated site capacity

In the event that the Councils wish to deliver quantities in excess of a) or b) above then the Council shall agree arrangements at the discretion of the Contractor subject to Clause 24 of the Contract.

The capacity of the transfer stations for the receipt of Recyclable Materials shall be:

(a) Northern Transfer Station 8,000 tpa

(b) Eastern Transfer Station 1,200 tpa

4. MRF DEVELOPMENT PLANS

4.1 Construction/location of MRF

The Contractor will, subject to and in accordance with the terms of the Contract construct an MRF. The Contractor's current preferred location for the MRF and associated Transfer Station is on the following site but it may choose any other site for development of the MRF: South side of Hollingdean Lane, Brighton. (Also known as the Abattoir site).

A site plan of the preferred location is attached in Appendix 1 of this Service Delivery Plan.

4.2 Scheduled operational date

The development of the MRF is subject to planning permission and land acquisition but is expected to be operational from April 2006.

4.3 Specification

4.3.1 The MRF to be constructed by the Contractor in accordance with the Contract will have a capacity to sort up to 18 tonnes per hour of mixed Recyclable Materials from source separation collections providing (on a two shift operation) an annual capacity of 70,000 tonnes per annum (with a maximum of 20,000 tonnes being glass). In addition to this the site shall be capable of accepting 80,000 tonnes per annum including the MRF capacity.

4.3.2 The Contractor will ensure that the MRF will be able to process mixed dry Recyclable Materials, including:

(a) paper and card items EWCC No. 20 01 01

(b) cans, aerosols and foil; and;

(c) plastic bottles.

4.4 MRF opening hours

4.4.1 The Contractor will, where appropriate, operate the MRF on a 2-shift system to enable the processing of the facility’s annual maximum input tonnage. The Contractor will commence operations on a single shift basis and then progressively move to a 2-shift system as the amount of input Recyclable Materials from WCAs progressively increases.

4.4.2 The Contractor will ensure that the MRF is open for the receipt of materials between the hours of 7 a.m. and 6p.m. subject to receipt of planning permission. The Contractor will make the MRF available for operations for 252 days of the year according to a standard Monday to Friday working week. The MRF shall also be open for deliveries on Saturdays following bank holidays with the exception of when Boxing Day falls on a Saturday subject to receipt of planning permission.

4.4.3 The Contractor will equip the MRF with operational, staff welfare, site management and visitor facilities. These will include but may not be limited to the following:

(a) MRF building;

(b) glass bulking bays;

(c) offices and education / conference room;

(d) operative mess room and amenity building;

(e) weighbridges;

(f) visitor and operative car parking; and

(g) workshop.

4.4.4 The Contractor will recruit an education/communications officer with responsibility for interface with the public and the media. This officer will be

4.6 Delivery of glass to the MRF

The MRF will only accept delivery of glass if delivered contained separately from other Recyclable Materials. The Contractor will only accept Recyclable Materials delivered from schemes that collect the Recyclable Materials separately from domestic refuse and other waste and in a format that satisfies a Materials Input Specification (Appendix 4 of this schedule).

4.7 MRF Capacity

The Contractor will design the MRF plant to allow some flexibility in its use of operational and human resources through a mixture of automated sorting and manual picking. The Contractor may therefore vary the following plant operational areas:

4.7.1 number of days per annum;

4.7.2 number of hours;

4.7.3 size of the workforce.

4.8 The MRF Process

The following is a description of the expected process flow of the MRF:

4.8.1 Stage 1 – arrangement for receipt of Recyclable Materials

(a) Delivery vehicles enter the site and pass over the Recyclable Materials ‘in’ weighbridge. Vehicles are directed into the Recyclable Materials reception area. The Recyclable Material is discharged into the appropriate area. The building will be designed to accommodate 2 days worth of Recyclable Material in the waste reception area. All Recyclable Material delivered must meet an input specification and all loads will be checked upon discharge.

(b) The sorting equipment is located in the adjacent area of the building.

4.8.2 Stage 2 – Recyclable Material loading and sorting

(a) A loading shovel manoeuvres Recyclable Material into a sunken-pit, which feeds an in-feed conveyor.

(b) The in-feed conveyor takes Recyclable Material onto an elevating conveyor where it is fed onto a cardboard screen. This segregates cardboard and other larger items (overs) from the remaining smaller items of paper/card and the containers (unders) fall through the screen.

(c) The overs (predominantly brown corrugated card) proceed along conveyors to a sorting cabin where a quality check is undertaken to remove contras from the card stream. Card runs off (negatively sorted) the sorting conveyor and into the relevant storage area below the sorting line.

(d) The unders (other paper/card and containers) items pass via a series of screens, which remove fines (small items of residue) according to size.

(e) The remaining Recyclable Materials then pass over a series of screens. The aim of these screens is to separate automatically the bulk of the newspapers and magazines from the remaining mixed paper & packaging grey / brown card and the containers. Through a combination of the screens, manual quality control checks and auto-sort technology, the majority of the Recyclable Material is negatively sorted into the targeted grades.

(f) The conveyor configuration is designed to ensure that the newspapers and magazines and mixed paper/card are delivered into the appropriate storage area.

(g) The containers left after the paper / card-screening process are then automatically diverted to an adjacent sorting line.

(h) A conveyor takes the containers (plastic bottles and ferrous & aluminium cans) past a magnetic separator that automatically removes steel food and drinks cans.

(i) The remaining Recyclable Material then passes through a bottle-perforator before the plastic bottles are automatically removed as a mixed grade. Remaining aluminium cans are removed by eddy current and subjected to a final manual quality check.

(j) All segregated Recyclable Materials are stored in bunkers adjacent to the sorting line.

4.8.3 Stage 3 – Recyclable Material storage and transfer management

The sorted Recyclable Materials, when there are sufficient quantities, are then sent to the appropriate reprocessor. In order to do this in a cost-effective manner and to meet reprocessors’ requirements, the Recyclable Materials are handled as follows:

(a) newspapers & magazines are loose-loaded into bulk haulage trailers using a 360° loading grab. The facility has the flexibility to add a baler to the plant in the event that it is either financially advantageous or operationally beneficial to bale the newspapers and magazines;

(b) cardboard and mixed papers are fed stored in bunkers before transfer to a dedicated paper and card baler;

(c) sorted plastic bottles, ferrous and aluminium cans are fed into dedicated balers situated below each material sort station;

(d) once baled, the relevant Recyclable Materials are then transferred by forklift to a covered storage area;

(e) residues from the sorting process are stored in a residue handling area and are then fed by conveyor to be automatically compacted into a Rolonoff container or removed by loose-loaded bulk container;

(f) a side of the building will be allocated solely for Recyclable Materials storage. Appropriate areas will be set aside to enable up to 3-day storage of sorted and processed Recyclable Materials.

4.8.4 Stage 4 - Process Residues

The Contractor will dispose of any residues from the MRF.

4.9 Emergency procedures/disaster recovery plan

The MRF will be operated by the Contractor with a set of emergency procedures that cover eventualities such as fire, pollution and specify contingency measures / operations that need to be undertaken. These procedures are governed by the Onyx Management System (MS) and will be put in place from the date of commissioning of the MRF.

4.10 Environmental clean-up / containment / notifications

4.10.1 In order to reduce the impact of any emergency at the MRF on the surrounding environment, the Contractor will carry out a series of activities to contain and clear up after any such incident at the MRF and then notify the appropriate

authorities of the actions as soon as reasonably practicable after the occurrence of the event.

4.10.2 In the event of an oil or diesel spillage, for example, the Contractor will seal drain covers in the MRF. An oil spill kit will be utilised by the Contractor, involving the use of oil absorbent granules and any residue from this process will be containerised for disposal and removed to an appropriately licensed disposal site. Both the Project Director and EA will be notified by the Contractor of any major incidents as soon as reasonably practicable and all material incidents will be recorded in accordance with the Onyx Management System.

4.10.3 The Contractor will operate the MRF in accordance with Management System Procedure SP.05 Materials Recovery, Facility Procedure ‘Emergency Preparedness and Response’ and GP.07 Emergency Plan Procedure.

4.11 Backup arrangements

The Contractor will hold stocks of strategic parts required for the MRF. In the event of the MRF not being operational and dependent upon the scale of the repair or maintenance operation required or scale of emergency, the Contractor will in so far as reasonably practicable:

4.11.1 report the situation to the Project Director and appropriate WCAs;

4.11.2 store unsorted Recyclable Material in the MRF building up to licensed storage capacity;

4.11.3 store Recyclable Material in a Transfer Station or delivery point as a holding measure;

4.11.4 divert Recyclable Material to other materials recovery facility operated by the Contractor in the region and inform the Councils of that decision;

4.11.5 divert Recyclable Material to other third party materials recovery facilities in the region and inform the Councils of that decision; or

4.11.6 export the Recyclable Material to overseas markets/ materials recovery facilities.

4.12 Planned unavailability

Schedule 2, Works Programme or Schedule 15, Detailed Maintenance Plan (as applicable) will be developed to show when the Contractor requires to close the site for maintenance or refurbishment. During this period the Contractor will be relieved from Unavailability Deductions. A protocol will be established for the

communication of such planned closures and the reopening of the facility to both the Councils and the relevant WCAs.

4.13 Arrangements for assisting WCAs or third party waste carriers to "catch up" after any period of unavailability of the MRF

If there is a period during which the MRF is unavailable, the Contractor will assist WCAs or third party waste carriers to continue to deliver Recyclable Materials, by implementing one of the following measures:

4.13.1 opening the MRF beyond normal operating hours or at increased throughput rates, subject to approval from the Council’s Planning Authority if required;

4.13.2 extending working hours to include weekday evenings and Saturdays;

4.13.3 undertake specific co-operation with individual WCAs to co-ordinate appropriate and required opening times; or

4.13.4 divert as a last resort option in cooperation with the relevant WCAs, Recyclable Material, for a temporary period, to an alternative delivery point to enable the Contractor to catch-up.

4.14 Procedures for handling unauthorised waste

4.14.1 The Contractor may accept non-Contract Waste at the MRF. Special procedures will apply in the case of unauthorised waste being delivered into the MRF.

4.14.2 In the event unauthorised waste is delivered to the MRF within Recyclable Materials, the materials will be identified by the Contractor and an appropriate response taken in accordance with the Onyx Management System following which the Councils will be notified as soon as reasonably practicable.

4.14.3 In the event that hazardous or special wastes are delivered to the MRF within Recyclable Materials, this will be handled by the Contractor in accordance with its operating procedures. All staff will be required to wear personal protective equipment (PPE) and quarantine the relevant material into appropriate containers or into an appropriate area of the MRF prior to disposal. The Contractor will use an audit of the WCA schedules to identify the appropriate area of properties that have generated the waste and the Councils will procure that the relevant WCA will undertake educational activities to prevent recurring production of hazardous waste.

4.14.4 If the audit process identifies the source of the hazardous or special waste as a HWRS, the Contractor will use its reasonable endeavours to prevent the incident recurring.

4.14.5 In the event that any waste type cannot be identified, a specialist operator will be called to the site by the Contractor to check the waste and to advise and / or undertake appropriate handling and disposal measures.

4.14.6 If any Hazardous Waste is identified, the material will be consigned for disposal at a suitable EA licensed site.

4.14.7 The Contractor will operate the MRF in accordance with Management System Procedure GP13 ‘Handling of Special Waste’.

4.15 Health and safety

4.15.1 The Contractor and its staff will adopt safe working practices in accordance with Laws that apply to its activities under the Contract with a view to ensuring the safety of all site users and personnel.

4.15.2 The Contractor will be responsible for the suitable and safe use of the equipment used in the provision of the MRF service and no equipment will be used which is unsuitable, unsafe or liable to cause damage.

4.15.3 The Contractor will require its staff at all times while engaged in the provision of the MRF service to be properly and presentably dressed in suitable uniforms, work wear, protective and reflective clothing.

4.15.4 The provision of the MRF service will be carried out by the Contractor in accordance with Management System Procedure GP.06 Health and Safety and associated Contractor procedures as amended from time to time. All visitors will be required to wear PPE in accordance with site rules.

4.16 Resources available at MRF

4.16.1 Materials and chemicals to be stored on site at the MRF by the Contractor will be subject to the appropriate COSHH risk assessment.

4.17 Signs

4.17.1 The Contractor will ensure that notice-boards are located at the main MRF / Transfer Station site access points for displaying the following information:

(a) site name;

(b) name and address and telephone number of Contractor;

4.17.2 The Contractor will ensure that other signs are located at appropriate places throughout the MRF to inform about such issues as speed limits, directions, traffic flow, health and safety and emergency procedures.

4.17.3 The Contractor will periodically review the suitability and location of existing signs and the need for replacements

4.18 Plant and equipment

The Contractor will install and operate the following sorting plant and mobile equipment within the MRF and amenity area provided always that the type and nature of such equipment may change at the Contractor's sole discretion:

4.19 Staffing

4.20 Maintenance and inspections

4.20.1 MRF plant and mobile equipment will be serviced and maintained by the Contractor at a frequency and schedule set by the relevant manufacturers but the Contractor will carry out any further preventative maintenance in addition that it considers necessary.

4.20.2 The Contractor will engage a full-time maintenance operative to ensure continuous and smooth running of the MRF.

4.20.3 All plant and equipment used by the Contractor at the start of the MRF operation will be new. The Contractor will ensure that the building and civil engineering works and mechanical and electrical elements of the sorting plant and balers will be designed to last 25 years. The Contractor will undertake all necessary on-going maintenance together with a scheduled replacement programme on all aspects of the MRF to enhance the longevity of the MRF.

4.20.4 The Contractor will ensure that the mobile equipment used at the MRF, i.e. loading shovels etc., will have a life expectancy of approximately 5 years and such equipment will also be subject to a maintenance and replacement programme.

4.21 Cleaning and cleanliness standards

4.21.1 Cleaning of the MRF will be undertaken by the Contractor to ensure the cleanliness of the two main areas of the office / amenity block and the MRF building and operations and to avoid the build-up of dust.

4.21.2 The Contractor will utilise an external contractor in addition to the cleaning activities that form part of the maintenance programme to carry out:

(a) daily cleansing of operative cabins etc;

(b) daily site cleansing;

(c) daily cleaning of mess room facilities, offices, education room etc;

(d) weekly cleaning of moving parts e.g. screens, balers;

(e) weekly washing of all mobile equipment; and

(f) annual deep cleanse of whole facility.

4.22 Environmental Protection

The Contractor will establish a programme consistent with its Management System to ensure that environmental protection and occupational health considerations are carried out to the necessary contractual and legislative requirements which will include:

4.22.1 residue handling;

4.22.2 lighting;

4.22.3 fuel tanks;

4.22.4 noise/litter;

4.22.5 pest control;

4.22.6 surface waters drainage;

4.22.7 dust control.

4.23 Security arrangements at the MRF

4.23.1 The Contractor will take all reasonable precautions to prevent unauthorised access to the MRF site.

4.23.2 The Contractor will ensure that during working hours all authorised visitors to the MRF will be required to ‘sign in’ at the weighbridge office.

4.23.3 The Contractor will install CCTV at suitable locations in the MRF to provide 24-hour surveillance of the MRF site.

4.23.4 Outside of working hours, the Contractor will supplement security of the MRF site by engaging an on site guard.

4.23.5 Control of vehicle and people movements at the MRF to ensure site security will be undertaken as follows:

(a) all external site visitors will be directed to sign in at the weighbridge or office / amenity block (as appropriate).

(b) temporary passes will be issued to all visitors;

(c) all site waste / Recyclable Material and output vehicles will be required to report to the appropriate weighbridge with details being taken, for example, driver’s name, vehicle registration number, nature of vehicle load etc; and

(d) identification cards will be required to be worn at all times by all site staff.

4.23.6 The Contractor will procure that supervisors, shift leaders and managers will have keys to the MRF.

4.23.7 The Contractor will establish procedures prior to Completion of the MRF to facilitate a timely and appropriate response to emergency situations. The contact details of the site / facility supervisor and manager will be distributed to the Councils, police and fire brigade by the Contractor. The appointed representative will then handle any request and co-ordinate the appropriate response from the Contractor.

4.23.8 An alarm will be installed in the office / amenity blocks of the MRF by the Contractor which will also cover the MRF building and other appropriate areas of the whole site. The alarm system will be managed from an external central control point, with an intercom to the site.

4.23.9 The Contractor will ensure that the perimeter of the MRF site will be secured by 2.4m high chain link fencing and walls or similar and all entrance and exit points will have double lockable gates.

4.23.10The MRF site manager will ensure that the condition of the perimeter fence and wall is checked on a daily basis. Repairs to all reported defects will be carried out by the Contractor where reasonably practicable within the following working day. In all cases, gates will be locked and secured at the end of each working day.

4.23.11The Contractor will ensure that internal and external lighting will adhere to current lighting standards for the various work areas on the MRF site, and as agreed with the local planning authority. In particular the lighting will be specified to take account of, and reduce the impact on the surrounding neighbourhood.

4.24 Traffic management

4.24.1 The Contractor will use its reasonable endeavours to separate MRF input and output vehicle movements from the visitor / staff traffic.

4.24.2 Upon entering the MRF site, the Contractor will ensure the operational vehicles pass over the weighbridges prior to driving to either the MRF or Transfer Station to deposit or collect waste or Recyclable Material and after this has been done, such vehicles will pass back over the weighbridge.

4.24.3 The Contractor will establish a speed limit of 10 miles per hour across the MRF.

RECYCLING SERVICE DELIVERY PLAN

Purpose of Specification The purpose of this input specification ("Input Specification") is to set a standard for the materials delivered to the Contractor which it will process through the MRF under the terms of the Contract. The Input Specification applies to the materials at the point of delivery ("delivery point").

1. Terms of Reference This Input Specification has been prepared pursuant to the requirements of the Contract 2. Recyclable Materials

This Input Specification, together with Appendix B, defines those collected partially segregated dry recyclables that the Contractor will or will not accept for processing through the MRF under the terms of the Contract.

Appendix “B” details those materials constituting collected partially segregated dry recyclables, how they should be presented, their required quality and a procedure for evaluating whether material delivered to the MRF conforms to this Input Specification.In Appendix B:

2.1 the "Commodity" column lists the broad commodity definitions as exampled 2.2 the "Range" column classifies the commodity in terms of specific materials 2.3 the "Targeted" column identifies materials to be targeted for collection and delivery to the Contractor for segregation 2.4 the "Contamination" column lists materials which constitute contamination and the

presence of which may give rise to load rejection. 2.5 the "Load Evaluation" column describes criteria under which loads will be evaluated

as complying with this Input Specification and therefore as acceptable for processing 2.6 the "Presentation" column describes the form in which incoming material has to be

delivered to enable the MRF to operate in accordance with the Service Delivery Plan relating to the MRF.

3. Failure to meet Input Specification- Load Rejection Procedure 3.1 Any loads failing to meet this Input Specification, after evaluation, shall be sent for

disposal by the Contractor at a Landfill Site or the Newhaven ERP 3.2 The Contractor shall be responsible for monitoring deliveries for compliance with this

Input Specification as outlined in the flow chart in Appendix “C”. Except in cases of urgency any loads considered by the Contractor to be potentially rejectable shall be put to one side, the Councils and (where appropriate) the relevant WCA informed and the load held for 24 hours or greater time if agreed between the Contractor, the Councils and (where appropriate) the relevant WCA to enable the Project Director and/or the WCA representative to inspect same. Where this is not possible the Contractor shall seek the agreement of the Councils to dispose of the load before doing so.

3.3 In all cases where a load is rejected by the Contractor without the Councils’

agreement because it fails to meet this Input Specification, the Contractor shall provide the Councils and the relevant WCA with evidence of the reasons why the Contractor considered the load had failed to meet this Input Specification. This shall include photographs, and where appropriate a sample of the waste, demonstrating failure.

3.4 The procedure to determine if a load complies with the Input Specification is contained in Appendix “C”. 4. Breach of Site Licence Conditions 4.1 Any load which breaches the relevant Waste Management Licence may be rejected in

accordance with the procedures contained in Appendix “C”. The contractor will inform the Project Director and the relevant WCA (if any) immediately, by fax or telephone.

4.2 The contaminated material will be treated in accordance with paragraph 3.1 above

within a time scale agreeable to the Environment Agency.

5. Input Specification Evaluation Procedures

Delivered materials will be evaluated using the criteria contained in Appendix “B” using the flow chart contained in Appendix “C”.

Materials for processing shall be presented as set down in appendix “B” and shall comply with the following specification:

5.1 Bulk Density 5.1.1 Materials should not be delivered in an over compacted condition. Where the

Contractor can show that materials are regularly delivered compacted to a level which prevents normal sorting methods being carried out, the Contractor may request a review of the method of collection with the WCA.

5.2 Contaminated Material 5.2.1 Each load of dry recyclables should contain less than 2% by weight of contamination

as detailed in Appendix “B” 5.3 Unwanted Material 5.3.1 The Councils shall use their reasonable endeavours to ensure that quantities of

unwanted materials are not such that they prejudice the ability of the Contractor to process materials.

6 Point of Responsibility 6.1 Once materials have been delivered to the delivery point and the delivery vehicle has

discharged its load, the materials may be subject to visual inspection by the Contractor as indicated in the load evaluation flow chart - Appendix “C”. Once the Contractor has accepted that this material is within the Input Specification, this material becomes the responsibility of the Contractor.

6.2 Loads will be deemed to have been accepted as being within this Input Specification

by the Contractor once the delivery vehicle has left the MRF unless the Contractor has

indicated otherwise on the delivery ticket given to the driver for that load, prior to the vehicle leaving the MRF.

7 Controlled Processing 7.1 Where the Contractor and the Councils fail to agree that a load does or does not

comply with this Input Specification the load shall be subject to further analysis, known as Controlled Processing, as referred to in Appendix C.

Controlled Processing shall involve the processing of an agreed sample (or whole load in the event of failure to agree a sample) to determine the weight of contamination and shall be undertaken by an independent third party agreed between the Parties. Where Controlled Processing determines that a load failed to meet this specification the costs of the Controlled Processing shall be borne by the Councils, otherwise the costs of the Controlled Processing shall be borne by the Contractor.

8. Presentation 8.1 Collected Dry Recyclables 8.1.1 The method of presentation for Partially Segregated Dry Recyclables is as follows: Delivered - Loose (not contained in bags/boxes etc.) 8.1.2 In the event that a WCA requires to deliver Recyclable Material to the MRF using a

new collection method and such new collection method incurs the Contractor in extra cost, the Contractor shall not accept such Recyclable Material unless the new collection method is approved by the Councils, in which case clause 24 shall apply.
