1. INTRODUCTION This Works Delivery Plan identifies work to be carried out in the construction of the Replacement HWRSs and the improvement and refurbishment works to be carried out at the Original HWRSs, in each case in accordance with the Contract. The functioning of the Household Waste Recycling Sites is described in the Service Delivery Plan relevant to the Household Waste Recycling Sites contained in Schedule 4. Modification works at the Original HWRSs and the development of the Replacement HWRSs shall be carried out in accordance with the timetable set out in the Project Plan. Minor and development works will be carried out by experienced Sub-Contractors. Control of the development of the works will be in accordance with the Contractor's management system procedure SP.16 Development Control (as set out in the Quality Manuals, and as amended from time to time), with a contract being placed on the construction Sub-Contractor. The construction contract will (where appropriate) follow a model form structure such as the Institution of Civil Engineers Minor Works (adapted) or Seventh Edition ICE Conditions of Contract (adapted) or similar, as considered appropriate by the Contractor. An engineer will be appointed by the Contractor with powers to administer on the Contractor's behalf such construction contract. The engineer may be a suitably qualified employee of the Contractor or a consultant instructed for the purpose. The improvement and refurbishment works in respect of the Original HWRSs will be let to experienced Sub-Contractors under such contractual arrangements as the Contractor considers appropriate taking into account the nature of the works to be undertaken. Prior to the transfer of the Original HWRSs to the Contractor, surveys will be carried out on each Site under and in accordance with Schedule 14.

2. CROWBOROUGH HWRS AND REPLACEMENT HWRSs Crowborough HWRS East Sussex County Council (ESCC) shall carry out the Works on the Crowborough Household Waste Recycling Site to be located on Plots 13-15 Farningham Road, Crowborough in accordance with Clause 91 of the Contract. Replacement HWRS The Contractor will take overall responsibility for the management of the construction of the Replacement HWRSs at the locations identified below. The methodology described in the Introduction in relation to Replacement HWRSs will be supplemented by the site-specific workscopes presented below. The Project Plan shows the envisaged timescales for the development of the works relating to the Replacement HWRSs. Subject to the provisions of Schedule 14, reference should be made to the Project Plan for start and completion dates for the activities related to each Replacement HWRSs. Pebsham and Uckfield Area Household Waste Recycling Sites The Replacement HWRSs are to be located in Pebsham and Uckfield areas within the zones indicated on the map (Drwg WD1100/2/Rev.B) contained in Appendix 2. Design drawings and a supporting statement will be prepared for each Replacement HWRS. The supporting statement will describe the function of the relevant Replacement HWRS, demonstrate how the proposed development meets relevant planning policies, and describe the major environmental impacts such as visual impact, vehicle movements and any other major influences created by the functioning of such Replacement HWRS. The Replacement HWRS shall have as a quality benchmark the design and civil engineering specification for the Replacement Crowborough HWRS. The benchmark shall apply in relation to the quality of civil engineering works and materials but not to any plant or equipment. The nature of the chosen Site and the design features may differ from those of the Crowborough HWRS at Farningham Road, Crowborough. The drawings and supporting statement will accompany a Planning Application to the Planning Authority of ESCC for construction of the relevant Replacement HWRS. A copy of the drawings and supporting statement will be submitted to ESCC for comment prior to the Planning Application being submitted. For each Replacement HWRS, on grant of the Planning Permission, the Contractor will apply to the Environment Agency for a Waste Management Licence to operate the relevant Replacement HWRS.

Design and Construction Contracting Subject to the grant of the relevant Planning Permissions and to the provisions of Schedule 14, the Contractor shall construct the Replacement HWRSs in accordance with this Works Delivery Plan. The planning drawings prepared for each Replacement HWRS will be used as the basis of a technical specification describing the physical layout of the Site and defining any specific requirements regarding material properties or functioning of installations. The specification will be forwarded to the Councils for comment before being included within the construction contract. A tender package will be issued to prospective construction contractors comprising the technical specification and conditions of contract. Following evaluation of tender submissions received, a contract will be entered into with the selected contractor. Depending on the proposed layout of the Site, a model form contract such as ICE Minor Works (adapted), ICE Seventh Edition Conditions of Contract (adapted), or similar will be used, as considered appropriate by the Contractor. A Planning Supervisor will be appointed prior to issuing a tender for the Works relating to the relevant Replacement HWRS with responsibility for producing the health and safety plan in compliance with CDM Regulations. The Contractor shall appoint an engineer, which shall be either an employee of the Contractor or a professional consultant, who will adopt the powers under the relevant construction contract. Construction management proposals will be developed for the construction phase of the Works based on the benchmark of the document entitled “Project Quality Plan-Construction Phase” for the Newhaven ERP tailored accordingly to suit the nature of the proposed HWRS.

3. ORIGINAL HWRSs The works to be carried out on the Original HWRSs will be confined to minor works and refurbishment of the existing fabric. Summaries of the improvements and refurbishment works to be carried out on each of the existing sites of the Original HWRSs are detailed in the Appendix 1 attached to this Works Delivery Plan. All minor works shall be carried out by qualified Sub-Contractors and shall comply fully with all Legislation relevant to the Original HWRSs. A schedule of works for each Original HWRS will be prepared based on the work identified to be necessary by the surveys carried out in accordance with Schedule 14. Such schedule of works for any one Original HWRS will be provided to the Councils for comment before any building or refurbishment works are instructed for that Original HWRS. The Contractor intends to appoint a suitably qualified and experienced Sub-Contractor under arrangements suitable to the nature and scope of those works. Should such works merit, a model form contract such as the ICE Minor Works contract (adapted) will be issued to the chosen Sub-Contractor for the completion of the works contained in the schedule of works. Until such time as a standard of work is agreed between the Parties, the quality of works can be benchmarked against works carried out at the Original HWRSs at Heathfield or Farningham Road, Crowborough. An employee of the Contractor or a professional consultant will act as engineer to administer the works being carried out in relation to the Original HWRS. Prior to appointment of the relevant construction Sub-Contractor a Planning Supervisor will be appointed to fulfil the relevant obligations of the CDM Regulations. During the course of refurbishment it will be necessary to carry out such works whilst the Original HWRSs are in operation. During such periods the construction area will be clearly delineated and care will be taken to ensure that the public do not access construction areas. If necessary, contingency arrangements will put in place. If closure of an Original HWRS is required, notice will be given to the Councils at least eight weeks prior to such closure taking place and any appropriate contingency arrangements agreed no later than four weeks prior to commencement of the relevant works. The public will be informed of programmed works, restricted areas and contingency arrangements through poster and leaflet notices at the relevant Original HWRS, via the relevant Council and the local press. Similar lines of communication will be used to keep the public informed of progress and the date of site reopening if applicable. The Contractor will use reasonable endeavours to minimise disruption to the relevant Original HWRS during refurbishment and improvement works. The safety of all persons in close proximity to the Site shall be of the highest priority at all times. Health and Safety shall be managed in accordance with the Contractor's management system procedure SP.16 Development Control “Health and Safety” (as set out in the Quality Manuals and as amended from time to time). As part of the

Health & Safety programme for the works, risk assessments will be carried out on each Original HWRS prior to the commencement of the works for that Original HWRS.
