RESUME OF BUSINESS TRANSACTED DURING THESECOND SESSION OF THE THIRTEENTH
KERALA LEGISLATIVE ASSEMBLY
The summons dated September 5, 2011 for the Second Session of theThirteenth Kerala Legislative Assembly was issued to the Members on September7, 2011. The session commenced at 8.30. a.m. on Monday, September 26, 2011and adjourned sine-die at 5.45 p.m. on Friday, November 4, 2011. Following thedemise of T. M. Jacob, Minister for Food, Civil Supplies and Registration, thebusiness scheduled for 31-10-2011 and 1-11-2011 was postponed. The House meton the following days viz., September 26, 27, 28, 29, 30 October 3, 4, 10, 11, 12,13, 14, 17, 18, 19, 20, 21, 24, 25, 27, 28, 31, November 2, 3, 4 (25 days ofsittings). The House transacted business for 128 hours and 56 minutes.
Obituary Reference
On September 26, 2011, the Speaker made references on the demise ofProf. M. P. Varghese former member Travancore -Cochin Legislative Assembly,K. K. Annan and Attingal N. Gopala Pillai, former members of Kerala LegislativeAssembly.
On November 2, 2011, the Speaker made references on the demise ofT. M. Jacob, member of the House and Minister for Food, Civil Supplies andRegistration. Shri Oommen Chandy, Chief Minister and Leaders of various partiesassociated themselves with the sentiments expressed by the Chair. As a mark ofrespect to the deceased, the members stood in silence for a while. The Houseadjourned on the day without transacting other business.
On November 3, 2011, the Speaker made references on the demise ofM. P. Gangadharan, former Minister, P. Abdul Majeed, former Member andT. Govindan, former member, Lok Sabha. As a mark of respect to the deceased,the members stood in silence for a while.

Condolence
On September 27, 2011, the Speaker made reference expressing condolenceof the House in the demise of four school children in an accident where a schoolvan overturned into Parvathi Puthanar river near Channamkara, Thiruvananthapuramon 26th September, 2011. As a mark of sorrow in the tragedy the Members stoodin silence for a while.

Correction of answer to unstarred question
On 27th September 2011 Minister for Forests, Sports & Cinema laid on thetable the corrected answer to unstarred question No. 823 dated 1-7-2010.
On 30th September 2011 Minister for Rural Development, Planning andCulture laid on the table the corrected answer to unstarred question No. 39 dated29-6-2010.
On 3rd November 2011 Minister for Transport and Devaswom laid on thetable the corrected answer to unstarred question No. 1520(a) dated 13-9-2007.
Adjournment Motion
During the Session 20 notices of Adjournment Motion were received, out ofwhich two were taken up for discussion the details of which are given below. Theremaining 18 notices were not admitted during the session.
On October 25, 2011, the Speaker informed the House that DR. T. M.Thomas Isaac and four other members had given notice for moving of anadjournment motion regarding the serious situation that had arisen consequent onthe reported non-willingness of the Government to conduct a comprehensiveinvestigation into the allegation of corruption in connection with the installation ofpollution control project in Travancore Titanium Company. As the Chief Ministerexpressed the readiness of the Government to discuss the matter the Speakerinformed that the motion be taken up for discussion at 12.30 p.m. and two hourstime be allotted for the same amidst the discussion on the motion forconsideration of the Kerala Appropriation (No. 2) Bill, 2011. DR. T. M. ThomasIsaac moved the adjournment motion at the allotted time and a discussion washeld. Shri Oommen Chandy, Chief Minister replied to the points raised in thediscussion. Then the motion was put to vote and declared lost.

On November 4, 2011, the Speaker informed the House that DR. T. M.Thomas Isaac and four other members have given notice for moving of anadjournment motion regarding the serious situation that has arisen consequent onthe frequent hike in the price of petrol by oil companies following the removal ofprice control of petrol by the Central Government leading to the steep increase inprice of food items. As the Chief Minister expressed the readiness of theGovernment to discuss the matter, the Speaker informed that the motion would betaken up for discussion at 2.30 p.m. and two hours time would be allotted for thesame. DR. T. M. Thomas Isaac moved the adjournment motion at the allotted timeand a discussion was held. Shri K. M. Mani, Minister for Finance, Law andHousing and Shri Oommen Chandy, Chief Minister replied to the points raised inthe discussion. The motion moved by DR. T.M. Thomas Isaac was put to vote anddeclared lost. Then the Chief Minister Shri Oommen Chandy moved thefollowing motion.

Motion for Suspension of rule
On October 18, 2011 the House adopted a motion moved by Shri OommenChandy, Chief Minister to suspend the Question Hour and Zero Hour underrule 313.
Statements under rule 300
On October 3, 2011 Shri Aryadan Muhammed, Minister for Power made astatement on the power crisis being faced by the state.
On November 4, 2011, Shri K. C. Joseph, Minister for Rural Development,Planning and Culture made a statement on the measures to be taken by theGovernment to revamp some important schemes relating to Rural DevelopmentDepartment.
Announcement by the Speaker
On Oct. 31, 2011, the Speaker informed that T. M. Jacob, Minister for Food,Civil Supplies and Registration had expired. He further announced that thebusiness of the House stand adjourned for the day and for the next day to enablethe members to pay homage to the deceased.
Ruling by the Speaker
On September 26, 2011, amidst the Question Hour the Speaker made a rulingthat the admissibly of Question is exclusively a matter of discretion of the Chairand raising question against the decision of the Chair and discussing the matteroutside shall deemed to be questioning the authority of the Chair, in reply to apoint of order raised by the opposition regarding the transfer of Starred Questionsto Unstarred list.
On September 29, 2011 the Speaker made a ruling regarding the necessityfor enhancing the number of Starred Questions coming on the floor of the Houseand regulating the number of supplementary questions.

On Oct. 12, 2011 the Speaker made a ruling that persons in the officialgallery should keep modesty in their behaviour while the House is in sitting.
On Oct. 17, 2011 The Speaker made a ruling against the aggressive attitudeshown by some opposition members in the House on October 14, 2011 due towhich a woman watch and ward staff got injured and hospitalised.
On October 18, 2011 the Speaker made a ruling that any Satyagraha for anindefinite period should be avoided inside the house.
On October 20, 2011 in reply to a demand by the Deputy leader ofOpposition the Speaker gave a ruling that as per the second proviso to Rule 295 ofthe Rules of Procedure and Conduct of Business in the Kerala LegislativeAssembly, the Report of Additional Chief Secretary on Kozhikode police firingneed not be laid on the Table of the House as the Chief Minister gave a gist ofthe report through this speech.
On November 4, 2011, the Speaker gave a ruling that questioning the rulingsof the Speaker and criticizing rulings outside the House is not a fair practice.

Financial Business
(1) Budget for 2011-2012:
13 days were allotted for the discussion on Demands for Grants in theBudget for the Financial Year 2011-2012, during the Second Session.
Out of 2261 cut motions received, 1086 were moved and disposed off. Therewere 496 occasions for speech including reply by the Ministers in connection withthe discussion and voting on Demands for Grants.
The Assembly devoted 50 hours and 42 minutes for transacting financialbusiness relating to the Budget for 2011-2012. The details are given inAppendix IX and X.
The Appropriation (No. 2) Bill, 2011, in respect of the Budget for the year2011-2012 was introduced by the Minister for Finance, Law and Housing,on 25-10-2011. The Bill was taken up for consideration and passed on the same day.
(2) Supplementary Demands for Grants:
On October 28th 2011, the Minister for Finance, Law & Housing laidbefore the House the Supplementary Demands for Grants for the 2010- 2011 andDemands for Excess Grants for the years 1993-94, 1995-96, 199697, 1997-1998,2002-03, 2003-2004, 2004-2005, 2005-2006, 2006-2007,2007-2008 and 2008-09.
The Discussion and voting on the Supplementary Demands For Grants andDemands for Excess Grants took place on 3rd November, 2011 and the Housedevoted 5 minutes for the transaction of the business.
The Kerala Appropriation (No. 14) Bill, 2011, in respect of theSupplementary Demands for Grants for the year 2011-12 and The KeralaAppropriation (No. 3 to No. 13) Bills, 2011 in respect of the Demands for ExcessGrants for the financial years 1993-94, 1995-96, 1996-97, 1997-1998, 2002-03,2003-04, 2004-05, 2005-06, 2006-07, 2007-08 and 2008-09 were introduced in theAssembly on 4-11-2011. The Bills were taken into consideration and passed on thesame day. The house devoted one hour and 30 minutes for the business.
Private Members’ Business
According to the calendar of sittings of the Second Session of the ThirteenthKerala Legislative Assembly, four days were set apart for transacting PrivateMembers’ Business viz. 30th September, 14th, 21st and 28th of October 2011. Ofthese days 30th September and 21st October, 2011 were set apart for transactingPrivate Members’ Bills, while 14th and 28th of October 2011 for PrivateMembers’ Resolutions respectively. During the Session, the House devoted1.28 hours in toto for Private Members’ Business.

(i) Private Members’ Bills
During the Session, the Business on Private Members Bills was transactedin two days, i.e., on the 30th of September and 21st of October 2011. On the 30thof September 2011, motions for leave to introduce 6 Bills and the discussion on3 pending bills were listed in the business. But the House was adjourned beforeconsidering the Private Members Business.
On the 21st of October, 2011, being the second day scheduled fortransacting Private Members’ Bills, motion for leave to introduce 10 Bills and thediscussion on 3 pending Bills were listed in the Business. Out of these, motionsfor leave to introduce all the Bills have come up before the House. But thediscussion on 3 pending Bills were not moved due to the lack of time.

(ii) Private Members’ Resolutions
During the Session, two days, i.e. on the 14th October and 28th October2011, were allotted for transacting Private Members’ Resolutions. On 14th October2011, three Resolutions came up before the House.
The first Resolution, given notice of by Shri Abdurahiman Randathani wasmoved in the House. The Resolution was passed by the House.
The Second Resolution, given notice of by Shri K. K. Narayanan was notmoved. The Third Resolution, given notice of by Shri Joseph Vazhakkan wasmoved in the House. After the reply by the Minister for Revenue, the Resolutionwas withdrawn by the Member.

SALIENT FEATURES OF THE BILLS
THE KERALA FINANCE BILL, 2011
The Bill seeks to amend the following enactments to give effect to thefinancial proposals of the Government of Kerala for the financial year 2011-2012as announced in paras 355 to 363 and 370 to 374 of the Revised Budget Speech2011-2012, namely:—
1. The Kerala Surcharge on Taxes Act, 1957 (11 of 1957)
2. The Kerala Money Lenders Act, 1958 (35 of 1958)
3. The Kerala Stamp Act, 1959 (17 of 1959)
4. The Kerala General Sales Tax Act, 1963 (15 of 1963)
5. The Kerala Tax on Luxuries Act, 1976 (32 of 1976)
6. Kerala Agricultural Income Tax Act, 1991( 15 of 1991)
7. The Kerala Value Added Tax Act, 2003 (30 of 2004)
8. The Kerala Finance Act, 2008 (21 of 2008).
The Bill proposes to impose a cess on the sale of luxury cars, the sale priceof which exceeds rupees 20 lakh, at the rate of two per cent on the tax amountand also to impose a cess at the rate of two per cent on the building tax forresidential building having a plinth area of 4000 sq.ft. and above.
THE KERALA FISCAL RESPONSIBILITY(AMENDMENT) BILL, 2011
The Government have decided to amend the Kerala Fiscal Responsibility Act,2003, passed by the Kerala Legislative Assembly, providing for the responsibilityof the Government to ensure prudence in fiscal management and fiscal stability byprogressive elimination of revenue deficit and sustainable debt management, witha view to reduce the revenue deficit and for building up an adequate revenuesurplus in accordance with the new road map of the Thirteenth FinanceCommission.
The Bill seeks to achieve the above objects.

The Bill is introduced in pursuance of Clause (1) of Article 204 of the
Constitution of India, to provide for the appropriation out of the Consolidated
Fund of the State of Kerala of the moneys required to meet the expenditure
charges on the consolidated Fund of the State and the grants made in advance by
the Legislative Assembly in respect of the estimated expenditure of the
Government of Kerala for the Financial Year 2011-2012.
THE KERALA APPROPRIATION (No. 3) BILL, 2011
The Bill is introduced in pursuance of Clause (1) of Article 204 of the
Constitution of India, read with Article 205 thereof, to provide for the
appropriation out of the Consolidated Fund of the State of Kerala of the moneys
to meet the amounts spent on certain services in excess of the amounts granted for
those services for the Financial Year 1993-1994.
THE KERALA APPROPRIATION (No. 4) BILL, 2011
The Bill is introduced in pursuance of Clause (1) of Article 204 of the
Constitution of India, read with Article 205 thereof, to provide for the
appropriation out of the Consolidated Fund of the State of Kerala of the moneys
to meet the amounts spent on certain services in excess of the amounts granted for
those services for the Financial Year 1995-1996.
THE KERALA APPROPRIATION (No. 5) BILL, 2011
The Bill is introduced in pursuance of Clause (1) of Article 204 of the
Constitution of India, read with Article 205 thereof, to provide for the
appropriation out of the Consolidated Fund of the State of Kerala of the moneys
to meet the amounts spent on certain services in excess of the amounts granted for
those services for the Financial Year 1996-1997.
