    PRELIMINARYShort title, exten t 1a nd c ommen ceme nt

    (1) These ru les m ay be called the U ttar Pradesh Right of Children toFree an d C om pulsory Education R ules, 2011.(2 ) T hey sh all ex ten d _~ oh e w hole of U tta r Pra desh .(3) They shall com e in to force at once and shall rem ain in force subjectto th e co nd itio n th at a deq ua te fu nd s w ill co ntin ua lly m ad e a va ila ble

    b y th e C en tr al G ov ernmen t.Definitions 2 (1) In these ru les, un less the context otherw ise requ ires, -

    a) "A ct" means the R ight of Children to Free and CompulsoryEduc ati on Ac t, 2009;b) "anganw adi" m eans an A nganw adi C entre estab lished under theIn teg ra ted C hild D ev elo pm en t S erv ices S ch em e o f th e M in is tryof W om en a nd C hild D evelopm en t of th e G overn men t of In dia ;c) "appoin ted date" means the date of commencem ent of the A ct

    PART IIRIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION

    Sp ec ia l T ra in ing(section-4) 3(1) Th e S ch ool M an agem en t C ommittee/local au th ority sh all w ith in th earea of ju risdiction thereof, identify never enrolled or school dropoutch ildren ab ove th e age of 6 years, get th em adm itted in a class appropriateto th eir age in th eir n eigh bou rh ood sch ool, assess th eir learn in g level an da cc ord in gly o rg an iz e s pe cia l tra in in g fo r th em a s re qu ire d in th e fo llowin gmanner, n ame ly :-

    a) the special train ing shall be based on specially designed, ageappropriate learn in g m aterial, approved b y th e S tate C ou ncil forEduca ti on a l Res ea rc h a nd T ra in ing;

    b ) it shall be provided in classes held on the prem ises of the sch ool,o r th ro ug h c la ss es o rg an iz ed in s afe re sid en tia l fa c ilities;

    c) it shall be provided by teachers working in the school, or byp ers on s s pe cia lly a pp oin te d fo r th e p urp os e;d) the duration of special train ing shall be for a m inimum period of

    three months which may be extended, based on periodicalassessment of learning progress, for a maximum period note xc ee din g tw o y ea rs .

    (2) The child shall, u pon induction into the age appropriate class, afterspecial train ing, continue to receive special attention by the teacher toenable him /her to successfully in tegrate w ith the rest of the class,

    HUTlES OF' THE STATE-GOVERNMENT AND LOCAL AUTHORITY

    Areas or limits ofneigh bourhood(section-6)

    4 (1) The area or lim it of neighbourhood with in which a school has to beesta bl ish ed b y the C omm ittee au th orized b y th e S ta te G overn m en t. sh allb e a s u nd er-

    a) in respect of ch ildren in classes I-V , a school shall be estab lished inh ab ita tion w hich h as n o sch ool w ith in a dista nce of 1.0 Km. and hasp op ula tio n o f a t lea st 300;

    b) in respect of ch iIdren in classes V 1 -V III, a school sha II beestab lished in hab ita tion w hich has no school w ith in a distance of3 .0 k m. a nd h as popu lation of a t lea st 80 0.

    Explanation: For the purposes of th is ru le the expression "Committee au thorized by the S ta teG overn men t" sh all m ea n th e C ommittee esta bl ised u nder section -I 0 or section - J O A , as the case mayb e, of th e U tta r P radesh B asic E du ca tion A ct, 1972 . I

    (2 ) For ch ildren from su ch a rea s w here it is n ot possib le to provide sch oolw ith in th e ra diu s o f n eig hb ou rh oo d s pecified u nd er su b-ru le (I), th e S ta teGovernment shall make adequate arrangements, such as freetra nsp orta tio n, resid en tia l fa cilities etc. in rela xa tio n o f th e p ro visio nss pec ifie d u nd er s ub -ru le (I ).

    (3) The local au thority i.e. G ram Panchayat/Nagar Nigam /NagarP alik a/N aga r P an ch ay at a s th e ca se m ay b e s ha ll id en tify a n eig hb ou rh oo dsch ool w here ch ildren can b e a dm itted a nd m ak e su ch in form ation pu blicfo r e ac h h abi ta ti on w ith in i ts ju ri sd ic ti on .

    (4) In respect of ch ildren w ith disab ility, which prevent them froma ccess in g th e s ch oo l, th e lo ca l a uth ority w ith th e p rio r a pp ro va l o f th e Z ilaSh iksha A dhikari, shall endeavour to make appropria te and safetransportation arrangem ents for them to attend school and com pletee lemen ta ry educa tion .(5 ) T he loca l a uthority sh all en su re th at access of ch ildren to th e sch ool isn ot h in dered o n a cco un t o f so cia l a nd cu ltu ra l fa cto rs.

    Duties of StateGovernment andlocal authority

    5 (1) A ch ild a tten din g a sch ool of the S ta te G overnm en t or loca l au th orityreferred to in sub-clause (i) of clause (n) of section 2 of the .A ct a ch ilda tten din g a sch oo l referred to in s ub -cla use (ii) of clause (n) of section 2of the A ct in pursuance of c lause (b) of sub-section (I) of section 1 2 ofthe A ct and a child attending a school referred to in sub-clause (iii) and(iv) of clause (n) of section 2"ofthe A ct in pursuance of clause (c) of sub-

    section (I) o f s ec ti on 12 of the Act shall be cntii led to free textb ook s ea chyear and uniform once in each year: ,

    'Provided that a child with disabil ity shall a Iso be provided free speciallearn in g, su pport m aterial a nd equ ipm en ts,

    Explanation: In respect of the child admitted in pursuance of clause (b ) o f s ub -s ec tio n (I) of sect ion 12and a child admitted in pursuance of clause (c) of sub-section (I) of section 12, the responsibility orpr 0\ ' id ing th e free c n titlern cn t shall be of the school re ferrcd to i1 1 S U b-e Iause (i i) 0f c Iau se (n) of sect ion2 and of sub-clauses (iii) and (iv) of clause (n) of section 2. respectively.

    (2 ) For the purposes of determining and establishing neighbourhoodschools, the local authority (Gram Pauchayat.Nagar Nigalll.'~~J.garPalika/Nagar Panchayat, as the case may be) shall undertake schoolmapping, and identify all children, including children in remote areas,children with disability, children belonging to disadvantaged group,children belonging to weaker section and children referred to i n section 4,la test b y 31 ,IMarch, and every year.(3) The local authority shall be responsible to ensure that no child issubjected to caste, class, religious or gender abuse or discrimination in theschool.(4) The local authority shall ensure that a child belonging to a weakersection a nd a child belonging to disadvantaged group is not segregated ordiscriminated against in the classroom, during mid day meals, in the playgrounds, in the use of common drinking water and toilet facilities, and inthe clean in g of toi lets or classroom s.

    Maintenance ofrecords of childrenby l oc al a u thor ity(section.9 ( d )

    6 (1) The local authority (Gram Panchayat/Nagar Nigam/NagarPalika/Nagar Panchayat, as the case may be) shall maintain a record of allchildren, in its jurisdiction, through a survey, from their birth till theyatta in 14 years of age.

    (2 ) A unique identity number shall be allotted to each child by the ZilaShiksha Adhikari to ensure and monitor enrolment, attendance, learningachievement and completion of elementary education of every child.

    (3 ) The record, referred to in sub-rule (I), shall be a) updated annually;b) maintained transparently, in the public domain, and used for the

    purposes of ensuring and monitoring admission, attendance andcom pletion of elementary edueat ion by every child res id ing with inits jurisdiction,

    ('*) The record, re f erred to in sub-ru le (I) sha II, in res peel of every ch i Id.be maintained on the prescribed form at in clu din g th e follow in g detail.-

    a) name, sex, date of birth, pla ce of birth;b) parents' or gu ard ia ns ' n am e, a ddres s. o ccu pa tio n;c) pre-primary school/aganwadi centre where the child attends (up to

    th e age of 6 years);d) elementary school where child is admitted:e) present address of th e child:f) class in which the ch ild is studying;

    g) for ch ildren between age of 6~ 14 years, if education isdiscon tinued in the territorial jurisdiction of the local authority.th e ca use of su ch discon tin uan ce;

    h) whether the child belongs to the weaker section within themean ing of clause (e) of section 2 of th e A ct;

    i) whether the child- belongs to a disadvan taged group within them ean in g of clause (d) o f s ec ti on 2 of the A ct;

    j) details of ch ildren requ iring special facilities or residentia lfacilities on account of migration and sparse population. ageappropriate ad mission and d isa b i I ity,

    (5) The local au thority shall ensure that the names of all ch ildren enrolledin the schools under its ju risdiction are publicly displayed in each school.(6 ) The Zila S hik sh a A dh ik ari sh all ensure th at the in form ation referredto in s ub -ru le (4) is displayed an d u pdated on th e district website.

    PART IVRESPONSIBILITIES OF SCHOOLS AND TEACHERS

    Admission of 7ch ildren belongingto weaker sectionand disadvantagedgroup(section-12 (1) (e))

    (1) The schools referred to in sub-clauses (iii) and (iv) of clause (n) ofsection 2 shall ensure that children admitted in pursuance of clause (c) tosection 12 (I) shall not be segregated from the other ch ildren in theclassrooms nor shall their classes be held at places and tim ings differentfrom the classes held for the other children .

    Admission of 8children andreimbursement ofper-childexpenditure by theState Governmentsection-12 (1) (b)and (c) and section-12 (2)

    (2) The schools referred to in sub-clauses (iii) and (iv) of clause (n) ofsection 2 shall ensure. that children adm itted in pursuance of clause (c) tosection 12 (I) shall not be discriminated from the rest of the eh i klren inany m anner pertain ing to entitlem ents and facilities such as textbooks.Iibrary and In formati on , Com m un ication and Techno logy (IC'I) fa c iIit ies,ex tra -cu rricu la r a ctiv ities a nd s po rts .(3 ) The areas or lim its of neighbourhood specified in rule 4 (I) s ha ll a pp lyto admissions made in pursuance of clause (c) to section 12 (I):

    Provided that the school may, for the purposes of filling up therequisite percentage of seats for children referred to i n clause (c) tosection 12 (I), extend these limits with the prior approval of the StateGovernm ent.(4 ) The local authority (Gram Panchayat/Nagar Nigam/NagarPalikalNagar Panchayat, as the case may b e) shall m ain tain a name-wiselist and record of all ch ildren belonging to weaker section anddisadvantaged group, studying in private and specified category schoolsu nde r it s j ur is dic ti on ,(1) The process of adm ission of children referred to in clauses (b) and (c)

    of section 12 (I) shall be totally transparent. The detail of suchchildren applying for admission shall be maintained by the schoolregularly, which shall include the name, address, sex. caste, date ofbirth of the child and the name, address, occupation and monthlyincome of father/mother/guardian, detail of whether child belongs toweaker section or disadvantaged group. Such information shall b emade public through website. Out of the total applicants, all thechildren who applied for admission , but not admitted for whatsoeverreason, shall be informed in writing with the reason thereof: It shallalso be binding for the school to follow the process of admissionprescribed by the State Government from time to time.

    (2) The total annual recurring expenditure incurred by the S tateGovernment, from its own funds, and funds provided by th e C en tra lGovernment and by any other authorty on elementary education in respectof all schools established, owned or controlled by it or by the localauthority, divided by the total number of children enrolled in all suchschools as on 3 0 ~ hSeptem ber, shall be the per-child expenditure incurredby th e S tate G overn men t.

    Explanation- For the purpose of determining the per-child expenditure, the expenditure incurred by theS tate Government or local authority on schools referred to in sub-clause (ii) of clause (n) of section 2and the children enrolled in such schools shall not be included.

    (3 ) Every school referred to in sub-clause (iv) of clause (n) of section 2shall maintain a separate bank account in respect of the amount receivedby if as reim bursement under sub-section (2) of section 12.

    (4) Every school referred to in sub-rule (3) seeking reim bursem ent shallprovide th e list of ch ildren . with their unique identity number and detai Isof item -wise expen ditu re incurred by the school w ith all requisite detailsalong with eviden ce on the form prescrib ed by th e D irector of E du cation(Bas ic ) by 31 sl October 0f every yea r:

    Provided that where such schools are already under ob ligation toprovide free education to a specified number of children on account of ithaving received any land, bu ilding equipm ent or oth er faeil i ti es e it he r freeof cost or at a concessional rate. such schools shall not be entitled forreim bu rsem ent to the exten t of su ch obligation.(5 ) The lila S h ik sh a A d h ik ari after necessary verification will transferth e amount of reimbursement due in the accoun t referred to in sub-ru le (3)and shall make the in formation public th rough website.(6) If at any stage, the school is found having sought and receivedreimbursement on the basis of concealment of facts or wrong claim . it willhave to deposit twice the amount so received. in th e G overnmen texchequer with action for withdrawal of recognition of the school andproceeding under the relevant sections of Indian penal code. and theamount shall be recoverab le by the Collector as arrears of land revenue.

    Documents as ageproof 9 Wherever a birth certificate under the Births, Deaths and MarriagesC ertification A ct, 1886 is not availab le, anyone of the followingdocuments shall be deemed to be proof of age of the ch ild for thepu rposes of adm ission in schools-sedion-14)

    a) hospita l or Auxiliary Nurse and M idwife (ANM) register record;b ) anganwadi record;c) village register of birth and death;d) declaration th rough an affidavit of the age of the child by the

    p are nt. o r g ua rd ia n.Extended period for 10admission in school

    (1) Extended period of admission shall be th ree months from the date ofcommencement of the academic year of a school i.e. 3 0 th September afterthe comm encem en t of the session .(section- J 5)(2) Where a child is admitted in a school after the extended period, he orshe shall be eligib le to complete studies w ith the help of special tra in ing,as determ ined by the head of the school.

    (section-IS)

    1 1 (I) Every school, other than a school established, owned or controlled by theC en tral G overnmen t, S ta te G overnmen t or loca l a uth ority, esta blish ed b eforethe commencement of the Act shall make a self declaration in Form-I to theconcerned lila Shiksha Adhikari, who shall be the au thorized officer,

    regarding its compliance or otherwise with the norms and standardsspecified in the Schedule and fu l fillmcnl (If th e followin g con dition s,namely

    a) the school is run by a society registered under the SocietiesRegistration A ct, 1860 (21 of 1860) or a public trust constitutedunder any law for the time being il l force:

    b) the school is not run for profit to all)' individual, group orassociation of individuals or any other persons;

    c) the school conforms to the values enshrined in the Constitution:d) the school building or structures or the grounds are used only for

    the purposes of ed ucat ion and sk ill deve lopmeru:e) the school is open to inspection by any officer authorized by the

    S tate G overnmen t or loca l au th ority;f) the school furnishes such reports and information as m ay be required

    by the lila Shiksha Adhikari/ Director of Education or any otherauthorized officer from time to time and complies with suchinstructions of the State Government/ local authority as may beissued to secure the continued fulfillment of the condition ofrecognition or the removal of deficiencies in working of the school.

    (2) Every self declaration received in Form-I shall be placed by the lilaShiksha Adhikari in public domain through website within fifteen days ofi ts rece ip t .(3 ) The lila Shiksha Adhikari shall conduct on-site inspection of suchschools which claim in Form-I to fulfill the norms, standards and theconditions mentioned in sub-rule (I) within three months of the receipt ofth e s el f d ec la ra ti on .(4) A f ter the inspection referred to in sub-rule (3 ) is carried out, theinspection report shall be placed by the lila Shiksha Adhikari in publicdomain and schools found to be conforming to the norms, standards andthe conditions shall be granted recognition by the lila Shiksha Adhikariin Form-Il, within a period of 60 days from the date of inspection.(5) The I ist of schools wh ich do not conform to the norms, standards andcon dition s m en tion ed in su b-ru le (1) shall be prepared and made public bythe lila Shiksha Adhikari through a notification mentioning thedeficiencies and shall be displayed on website. Such schools may requestthe lila Shiksha Adhikari for an on-site inspection for grant orrecognition anytime within the next two years ..(6) Schools, which do not conform to the norms, standards and conditionsmentioned in sub-rule (1) even after three years from the commencem entof the A ct, shall cease to function,

    Withdrawalof recognition toschoolsection-IS (3)

    (7) Every sch ool, oth er than a sch ool estab lish ed, ow ned or con trolled b yth e C en tra l G overnmen t, S ta te G overnmen t or loca l a u th orn y. esta bl ish edafter th e commen cem en t of th e A ct sh all con form to th e n orm s. stan dardsand conditions mentioned in sub-rule (I) in order to qualify forrecognition.(8) Every lila S hik sh a A dh ik ari sh all m ain tain a register of recogn izedschools and allot a num ber to every such school.

    12 (I) Where the Zila Shiksha Adhikari on his own motion. or on anyrepresentation received from any person, has reason to believe. to berecorded in wr i t ing, that a school recogn ized u nder ru le II. has v iolatedone or more of the conditions for grunt of recognition or has failed tofulfill the norms and standards specified in the Schedule, he shall act inth e f ollowi ng manner :-

    a) issue a notice to the school specifying the violations of thecon dition of gra nt of recogn ition an d seek . i ts expla nation w ith ino ne mon th ;

    b) in case the explanation is not found to be satisfactory or noexplan ation is received w ith in th e stipu la ted tim e period, th e lilaShiksha A dhikari shall cause an inspection of the school, to beconducted by a Committee of three members comprising ofGov ernme nt re pre sen ta tiv es a nd o ne e du ca tio nist. T he Comm itte eshall make due inquiry and submit its report, along with itsrecommendations for continuation of recognition or itswithdrawal, with in a period of 20 days of such inspection to the2 ila S hik sh a A dhik ari. Th e C ommittee referred to ab ove sh all b econ stitu ted b y th e D istrict M agistra te an d th e D istrict M agistratesh all h ave pow er to ch an ge th e m em bers of th e C ommittee.

    (2) Th e Z ila S hiksh a A dh ik ari, on th e b asis of th e recommen dations of th eC ommittee shall send letter w ith in 10 days seeking explanation from thecon cern ed sch ool an d give 3 0 days tim e for su bm ittin g the explan ation an da fter du e examin ation ofth e expla na tion received or in case th e expla na tionis not received then on the basis of records/documents. send hisrecommen da tion s to th e S ta te E du cation D epartm en t w ith in a period of on emonth thereaf ter:

    Provided that the District M agistrate shall have the authority to getthe recommendation of the Committee to be re-exam ined before itssu bm is sio n to th e S ta te E du ca tio n D ep artm en t.(3) The State Education Department, shall. on the basis of there commenda tio ns re ferred to in s ub -ru le (2), tak e decision w ithin 3 0 daysof the receipt of the recommendations and convey it to the Zila ShikshaAdhikari .

    ( - J ) The lila Shiksha A dhikari shall, on the basis o r t he dec is ion o r th eState Education Department pass a speaking order canceling there cogn itio n g ra nte d to th e sch ool within 07 days from th e receipt of th edecision. The order of de-recognition shall be operative from theimmediately succeeding academic year and shall specify th en eighb ou rh ood sch ools to w hich th e ch ildren of th e de-recogn ized sch oolssh all b e admitted,(5 ) T he order m ade u nder su b-ru le H) shall be conveyed to th e respectivelocal authority and shall be placed in the public domain through displayon webs it e.

    PART VSCHOOL IHANAGEMENT COMMITTEE

    Composition and 13functions of theSchool ManagementCommittee(s ectio n-2 1 )

    (1) A School M anagement Committee shall be con stitu ted in everyschool, other than an unaided school, within its jurisdiction andreco ns titu ted w ith in ev ery two yea rs .(2) The S chool M anagem ent Committee shall consist of 15 members o uto f wh ic h 1 1 sh all b e from am on gst raren ls or gu ardian s of ch ildren :

    Provided that 50 percent of members of such Committee shall bewomen.(3 ) The remaining 04 members of the School Management Committeeshall be from am ongst the follow ing persons, nam ely :-

    a) one member from amongst the elected members of the localau th ority, to b e decided b y th e local au th ority;

    b) one member from amongst A uxiliary Nurse and M idwife (A NM ),to be decided by the teachers of the school;

    c) one Lekhpal, to be nom inated by the D istrict M agistrate;d) one member shall be the head teacher or in the absence of head

    teacher the senior most teacher of the school, who shall be the ex-offic io member-secretary.

    (4) The guard ian members of the School Management Corum itee s ha llinclude the parent/guardian of one child each belonging to the S cheduledC astes, th e S ch edu led T rib es, oth er b ackward classes an d w eak er section .(5) The selection of guardian members of the School ManagementCommittee shall be m ade through general consensus in the open m eeting:

    Provided that the Committee shall include paren t/guardian ofm in im um on e ch ild from ea ch cla ss o fth e s ch ool.(6) T o m an age its a ffa irs, th e S chool M an agem en t C ommittee sh all electa C ha irp ers on a nd V ice -C ha irp ers on from amon gs t th e p are nt memb ers .(7) T he S ch ool M ana gem en t C ommittee sh all m eet at least on ce a m on thand the m inutes and decision of the m eetings shall b e properly recordeda nd m ade a va ila ble to th e p ub lic.(8 ) T he S ch oo l M an agem en t C omm ittee sh all, m on itor th e working of th esch ool; prepare an d recommen d S ch ool D evelopm en t Plan ; m on itor th eu tiliza tion of the grants received from the S ta te Government or localauthority or other source. and in addition . perform the follow ingfunctions, for which it m ay constitu te sm aller work ing groups fromamong st i ts membe rs :-

    (3 ) The School Developm ent Plan , shall contain the following details-a) estimates of class-wise enrolment for each year;b) requirement, over the three year period, of the number of

    additional teachers, including head teachers, subject teachers andpart-tim e instructors, separately for classes I to V a nd c la ss es VIto V III, calculated, as per specified norm s;

    c) physical requirem ent of additional infrastructure and equipm entsetc. over the three years period, as per specified norms;

    b) monitor the regular attendance, learn ing ab ility and progress ofevery ch ild in school thereof. share students' perform ance withpa ren ts on a regu la r b as is;

    c) cooperate in managing the affa irs of School ManagementC ommittee, w hen requ ired;

    d) help the local authority for admission of all children in school, asre qu i re d, w ith in th e ju ris di c tio n 0f lo ca l a uth ori ty ;

    e) shall main tain a file conta in ing the pupil cumulative record forevery ch ild to check child's understanding of know ledge and hisor h er ab ility to apply th e sam e an d for con tin uous evaluation, andon th e b asis of w hich sh all aw ard the com pletion certificate.

    (2) In addition to the duties m entioned in sub-rule (1) and the functionsspecified in clauses (a) to (e) of sub-section (1) of section 24. a teachersh all p erform th e follow in g du ties as sig ned to h im or h er.-

    PART VIICURRICULUM AND COMPLETION OF ELEMENTARY EDUCATION

    PART VIIIPROTECTION OF RIGHT OF CHILDREN24 (1) TiJi such time as the State Government sets up the S tate Commission

    for Protection of Child Rights, i t shall constitu te an in terim authorityknown as the Righ t to Education Protection A uthority (REPA ).(2) The Righ t to Education Protection Authority (REPA ) shall consist ofthe following, namely :-

    a) a Chairperson who is a person of h igh academ ic repu te or hasbeen a H igh Court Judge or has done outstanding work forpromoting the rights of c h ildren ; and .

    b ) two members, of whom at least one shall be a woman, from thefollow ing areas, from amongst persons of em inence, ab ility,integrity, standin g an d experien ce in -(i) education;(ii) ch ild h ea lth ca re a nd ch ild developm en t;(iii) juven ile justice or care of neglected or marginalized

    ch ildren or ch ildren w ith disa bility;[iv) elim ination of child labour or work ing w ith children indistress;(v) child psychology or sociology; or(vi) educational or adm inistrative management.

    (3 ) The National Commission for Protection of Child Rights Rules, 2006shall, so far as perta ins to the terms and conditions, mutatis mutandisapply to the Righ t to Education Protection A uthority (REPA }.

    t) Secretary Basic Education shall be the convener member of theCouncil and the Director of Education (Basic), the Director ofEducation (Secondary), the Director, State Council ofEducational Research and Training, the Director of Mid DayMeal Authority and the State Project Director, Uttar PradeshEducation For All Project Board shall be ex-officio members ofthe Council;Provided that fifty percent of members, other than ex-officiomembers, shall be from amongst women.

    (4) The Council may especially invite representatives of other relatedMinistriesiDepartments as requ ired.

    (5) The Department of Basic Education shall provide logistic support formeetings of the Council and its other functions.

    (6) The State Advisory Council shall advise the S te Government foreffective compliance of the provisions of the Act.

The grant for recognition is not extendable and docs not in any way imply any

    obligation to recognize/affiliate beyond Class VIlL2. The School shall abide by the provisions of Right of Children to Free and Compulsory

    Education Act, 2009 (Annexure J) and the Uttar Pradesh Right of Children to Free andCompulsory Education Rules, 2 0 1 1 (Annexure II).

    3. The School shall admit in class I, to the extent of ------% of the strength of that class,children belonging to weaker section and disadvantaged group in the neighbourhoodand provide free and compulsory elementary education till its completion. Provided,further that in case of pre primary classes also, this norm shall be followed.

    4. For the children referred to in paragraph 3, the School, if covered under section 12(2)of the Act, shall be reimbursed accordingly. To receive such reimbursements schoolshall provide a separate bank account

    5. The Society/School shall not collect any capitation fee and subject the child or his orher parents or guardians to any screening procedure.

    6. The School shall not deny admission(a) to any child for lack of age proof;(b) on the ground of religion, caste or race, place of birth or any of them,

    7. The School shall ensure that,-(i) no child admitted shall be held back in any class or expelled from scbool till the

    completion of elementary education in a school;(ii) no child shall be SUbjected to physical punishment or mental harassment;

    (iii) no child is required to pass any hoard examination till the completion ofelemen ta ry educa tion ;

    (i\) every child completing elementary education shall he .awarded a certificate asl a i d down under Rule 23:

    8. The School shall follow the syllabus on the basis of curriculum laid down hy theapprop ri ate a u th or ity .

    10. No unrecognized classes shall run w ith in the prem ises of the school or outside in thesam e name of school.

    11. The School is run bv a societv rezistered under the Societies Registra tion A ct, 1860 (21of 1860) or a public' trust constituted under any law for the time being in force,

    13 . The accounts should be audited and certified by a Chartered A ccountan t and properaccounts sta tements should be prepared as per ru les. A copy each of the S ta tements ofA ccounts should be sen t to the Zila Sh iksha A dhikari every year.
