This is a two stage bidding system. Vendors are required to submit two

bids as follows in the enclosed three envelopes.

1. Techno-commercial – Unpriced bid.

2. Price Bid.

3. EMD Envelope – should carry EMD in form of Demand Draft

favouring principal, SCET.

4. All the above three envelopes should be enclosed in the big envelope

of Tender Documents.

Notes : -

1. Only LENOVO, Hp and DELL brand should be offered.

2. Authorized dealers should enclose valid dealership certificate not

more than one year old in the techno- commercial bid.

3. Bidders should enclose list of customers.

4. Bidders should enclose copies of orders Rs. 1 lac or more. Bidders

should detail the service setup in Surat.

Special Terms Of Tender

1 This tender is under two stage bidding system. Vendors should submit their bids in three

separate envelopes.

a) EMD Envelope – Should carry EMD in form of Demand Draft favouring Principal, SCET.

b) Techno- commercial Un-priced Bid.

Technical and commercial bid – No prices to be indicated.

It should clearly specify models you have offered along with comprehensive technical details

means all details about configuration/make/features etc.

c) Price Bid.

Prices for the items offered.

It should include model number specified in Techno commercial offer along with price

offered, in tender document supplied to you only. Other higher configuration model price will

be treated as additional quote and it must be having mention in technical details in techno

commercial offer.

2 Tender will be issued against application on the firm’s letterhead stating the details of

business. Along with tender fees in form of demand Draft/Banker’s cheque favoring

Principal, SCET

3 Completed tenders will be received at this office on or before 18/04/2017 (5:00 p m ) along

with EMD of Rs. 30000/- payable by Bank Guarantee, Fixed Deposit or Demand Draft in the

name of the Principal, SCET.

4 You can also suggest higher configuration other than specified in tender along with technical

details as said earlier.

5 Filled tender must be typed/ written in indelible ink and should be free from corrections and

erasures.

6 Manufacturers name/ Model / Brand name of computer systems offered must be clearly

mentioned. Necessary literature / pamphlet on the material should be invariably furnished.

7 Price quoted shall be for free delivery to college site/stores.

8 Packing & Forwarding Charges, applicable taxes, duties, warranty period shall be indicated

clearly. (You have to fill the attached form # 1 and duly signed & stamped by authority )

9 Filled tender and all future correspondence must indicate the tender No. & Date.

10 Filled tender must be valid for at least 90 days from the date of opening.

11 Filled tender received after 18/04/2017 (5.00 p.m.) will not be accepted.

12 SCET reserves the right to accept or reject the tender wholly or partly without assigning any

reason thereof. SCET also reserves the right to adjust the tendered quantity according to its

actual requirement at the time of placement of order.

GENERAL TERMS OF TENDER

1 Filled tender must be typed/written in indelible ink and should be free from corrections and erasures.

2 Prices quoted must be valid for 60 days from the date of opening of tender No revision in the price

quoted will be allowed after the opening of tender.

3 Out station tenders must be quoted for goods delivered F.O.R Surat.

4 Manufacturers name/Brand name of material offered must be clearly mentioned. Necessary

literature/Pamphlet on the material offered should be invariably furnished.

5 Offers received after the specified date and time may be refused.

6 SCET reserves the right to accept or reject the filled tender wholly or partly without assigning any

reason thereof. SCET also reserves the right to adjust the tendered quantity according to its actual

requirement at the time of placement of order.

7 DEFINITION: Purchaser shall mean Sarvajanik College of Engg. & Tech. Seller shall mean the person

firm or corporation to whom this purchase order is issued. Order shall mean this purchase order and all

its attachments and exhibits. Goods and/or Materials shall mean the article material, machinery,

equipment supplies, drawing, data and other property and all services including design, delivery

installation, inspections testing and commissioning specified or required to complete the order. SCET

means Sarvajanik College of Engg. & Tech.

8 ACCEPTANCE OF ORDER: This order of expressively conditioned on Seller's acceptance of all

terms and Conditions thereof. The seller shall sign and return acceptance copy of the order within 7

days of the receipt of the Purchasers Order by him.

9 DEVIATIONS: The order shall be subject to these General terms and conditions and any

additional/specific conditions referred to in the order and no deviation shall be made from the

requirements of the Order or from the General Terms and Conditions unless such deviation be

approved in writing by the purchaser.

10 ASSIGNMENT AND SUBLETTING: Except with the prior permission of the Purchaser, the Seller

shall not assign the order or any part thereof or any money due hereunder to any other

manufacturer/vendor.

11 DELAY OR NON-DELIVERY: Time is the essence of the Purchase Order and completion dates

agreed to are binding on Seller. In the event the Seller is not able to execute the order within the limit

specified in the order. Purchaser will have a right either to cancel the order without prejudice to any or

right to make purchase from an alternate source at the cost of the Seller or to impose the penalty for

late delivery @ 1/2% of the Purchase Order value for every week or part thereof subject to a maximum

of 5% of the purchase order value.

12 FORCE MAJEURE: Force majeure shall mean and be limited to the following. any war or hostilities

(b) any riot-or civil commotion, (c) any earthquake, flood, tempest, lightning or other natural physical

disaster impossibility of the use of Railway, Port, Airport, Shipping service or other means of

transport. (d) any strike or lock out (only those exceeding 10 continuous days in duration) affecting

the performance of the Seller's/Purchaser's obligations.

13 TERMS OF PAYMENT: Unless otherwise specified in the purchase order, the terms of payment will

be 30 days of receipt and acceptance of the material at the site office.

14 MODE OF DISPATCH: Unless otherwise specified in the purchase order the material shall be

dispatched by Rail/Road and the dispatch documents along with a copy of the invoice will be mailed

directly to the Purchaser.

15 INSPECTION AND EXPEDITING: If the Purchase Order specifically requires purchaser's inspection,

the supplier shall advise the purchaser in writing at least 15 days in advance of the date when the

materials will be ready for inspection.

16 PATENT RIGHTS: The seller shall fully indemnify the purchaser its customers and users against any

action, claim or demand, cost of expenses arising from or incurred by reason of any infringement or

alleged infringement of letters. Patent trade mark or name copy right or any other protected rights in

respect of any material supplied. All royalties and the like payments shall be paid directly by the seller.

17 SPECIFICATION: All materials or equipments shall be supplied strictly in accordance with the

specification, drawing data sheets other attachments and conditions stated in order. No deviation from

such specification or alterations of these conditions shall be made without the Purchaser's agreement in

writing, which must be obtained before materials, is placed on manufacture or any work commenced.

18 TAXES DUTIES ETC.: Unless otherwise specified in the Purchase Order all taxes, duties and octroi

will be borne by the Seller.

19 TRANSIT RISK INSURANCE: The transit risk Insurance from the Seller's Workshop or place upto

the time of delivery to the Purchaser's site or office, shall be covered by the Seller at his own cost,

unless otherwise specified in the purchase order.

20 GOVERNING LAW JURISDICTION : All actions at law out of or suits arising out of or in connection

with this order of the subject matter thereof and whether as to construction or otherwise shall be

instituted in a court of competent jurisdiction in Surat.

21 CORRESPONDENCE: All correspondence concerning the Order shall state order number and item

number and shall be submitted in duplicate addressed to the SCET.

22 DOCUMENTATION: Document shall be submitted as called in the order.

23 ORIGIN AND TEST CERTIFICATE: The Seller will supply copies of Test Certificate for materials

and equipments called for in the order such certificates shall clearly state the purchase order number

item and equipment number etc.

24 FIXED PRICE: Unless otherwise stated in the order, all prices shall be fixed for the duration of the

Order and shall not be subject to escalations of any description notwithstanding any change in the cost

of raw materials and/or labour which may be take place while the order is being carried out. Even

though it might be necessary for the order for any reason whatsoever to take longer than the delivery

periods indicated in the Order.

25 PACKING & DESPATCH: All packing, boxing, carting and protection shall confirm to the

specifications or requirements of the Order. The Seller shall be held liable for the damage or breakage

to the goods to defective insufficient Packing Marking as specifically advised in the Order or Dispatch

instruction shall be done by Seller in indelible paint and in such manner to ensure that the same is

clearly visible.

26 DESPATCH/DELIVERY All goods shall be dispatched by Rail/Road/Air on freight

TOPAY/FREIGHT PAID and the Railway Receipt/Lorry Receipt/Air Consignment Note shall be

posted to the following address

27 CHALLAN: Distribution Shall be as follows: Copies shall be posted on the day of dispatch to the

Sarvajanik College of Engg. & Tech. for the attention of the Principal as per address given in above

clause 20.

28 INVOICE Three copies of each invoice made out in the name of Sarvajanik College Office for the

attention of Accounts Office immediately after dispatch has been made. The invoice shall show clearly

whether they cover part order or balance order or complete order and shall include the item number as

well as the Order number. Net price shall be shown in the invoice. Cash Discount shall be described as

such each invoice shall show any progress payments which have been previously submitted by the

seller.

29 COMMUNICATION: All correspondence relating to the Purchase Orders will be mailed as under.

30 ARBITRATION: a) If at any time any question, dispute or difference shall arise between the parties

under the contract or in connection with the contract, either party shall as soon as reasonably

practicable, give to the other party notice in-writing of the existence of such question, dispute or

difference specifying its nature and the point at issue and the same shall be referred to arbitration in

accordance with the provision of the Indian Arbitration Act 1940. The award of such arbitration shall

be final and binding on the parties hereto.

b) Performance of the contract shall continue during arbitration.

c) The value of all the proceedings of the arbitration shall be Surat or as decided by the

Management of SCET. at its sole discretion.
