Attached is the name of a principal campaign committee that has failed to file 48-hournotices with the Commission for contributions of $1,000.00 or more received from the close ofbooks of the 12 Day Pre-General Report up to 48 hours before the November 4, 2008 GeneralElection in accordance with 2 U.S.C. § 434(a)(6) and 11 CFR. § 104.5(f). The committee, JebBradley for Congress Committee, represents a candidate who lost the General Election. Thecommittee is being referred for failing to file 48-hour notices for contributions totaling$74,400.00.

A 48-hour notice is required to report all contributions of a $1,000.00 or more, to anyauthorized committee of a candidate, including contributions from the candidate, loans from thecandidate and other non-bank sources and endorsements or guarantees of loans from banks, asperllCFR§104.5(f).

We have attached an information sheet which includes the contributor name, date ofreceipt and amount of the contributions for which a 48-hour notice was not filed.

Dear Mr. Leone:

The Federal Election Campaign Act of 1971, as amended, 2 U.S.C. § 431, et seq. ("theAct"), requires principal campaign committees of candidates for federal office to notify inwriting either the Secretary of the Senate or the Federal Election Commission ("FEC"), and theSecretary of State, as appropriate, of any contribution of $1,000 or more, received by anyauthorized committee of the candidate after the 20th day, but more than 48 hours before, anyelection. 2 U.S.C. 434(a)(6)(A). The Act further requires notification to be made within 48 hoursafter the receipt of the contribution and to include the name of the candidate and office sought,the date of receipt, the amount of the contribution, and the identification of the contributor. Id.These notification requirements are in addition to all other reporting requirements. 2 U.S.C. §434(a). The Act permits the FEC to impose civil money penalties for violations of the reportingrequirements of 2 U.S.C. § 434(a). 2 U.S.C. § 437g(a)(4). Our records indicate that Jeb Bradleyfor Congress Committee did not submit 48-Hour Notices for contributions of $1,000 or more,received between October 16, 2008 and November 1, 2008, totaling $74,400, as required by 2U.S.C. § 434(a)(6)(A). Attachment 1.

On May 12, 2009, the FEC found that there is Reason to Believe ("RTB") that JebBradley for Congress Committee and you as treasurer violated 2 U.S.C. § 434(a) by failing tofile the 48-Hour Notices. Based on the FEC's schedule of civil money penalties at 11 C.F.R. §111.44, the amount of your civil money penalty calculated at the RTB stage is $7,660. Pleasesee the attached copy of the Commission's administrative fine regulations at 11 C.F.R. §§111.30-111.46. Attachment 2. The Commission's website contains further information abouthow the administrative fine program works and how the fines are calculated.http://www.fcc.gov/affaf.shtml. 11 C.F.R. § 111.34. The amount of the civil money penalty is$110 for each non-filed notice plus 10 percent of the dollar amount of the contributions nottimely reported. The civil money penalty increases by 25 percent for each prior violation. Sendyour payment of $7,660 within forty (40) days of the finding, or by June 21,2009.

At this juncture, the following courses of action are available to you:

1. To Pay the Calculated Civil Money PenaltyIf you should decide to pay the calculated civil money penalty, send the enclosed

remittance form, along with your payment, to the FEC at the address on page 4. Upon receipt ofyour payment, the FEC will send you a final determination letter.

2. To Challenge the RTB Finding and/or Calculated Civil Money PenaltyIf you should decide to challenge the RTB finding and/or calculated civil money penalty,

you must submit a written response, including the AF# found at the top of page 1 under yourcommittee's identification number, to the FEC's Office of Administrative Review, 999 E Street,NW, Washington, DC 20463. Your response must be received within forty (40) days of theCommission's RTB finding, or June 21, 2009. 11 C.F.R. § 111.35(a). Your written responsemust include the reason(s) why you are challenging the RTB finding and/or calculated civilmoney penalty, and must include the factual basis supporting the reason(s) and supportingdocumentation. The FEC strongly encourages that documents be submitted in the form ofaffidavits or declarations. 11 C.F.R. § 111.36(c).

The FEC will only consider challenges that are based on at least one of three grounds:(1) a factual error in the RTB finding; (2) miscalculation of the calculated civil money penalty bythe FEC; or (3) your demonstrated use of best efforts to file in a timely manner when preventedfrom doing so by reasonably unforeseen circumstances that were beyond your control. 11 C.F.R.§ 111.35(b). In order for a challenge to be considered on the basis of best efforts, you must havefiled the required report no later than 24 hours after the end of these reasonably unforeseencircumstances. Id. Examples of circumstances that will be considered reasonably unforeseenand beyond your control include, but are not limited to, (1) a failure of Commission computers orCommission-provided software despite your seeking technical assistance from Commissionpersonnel and resources; (2) a widespread disruption of information transmissions over theInternet that is not caused by a failure of the Commission's or your computer systems or Internetservice provider; and (3) severe weather or other disaster-related incident. 11 C.F.R. §111.35(c). Examples of circumstances that will not be considered reasonably unforeseen andbeyond your control include, but are not limited to, (1) negligence; (2) delays caused by vendorsor contractors; (3) treasurer and staff illness, inexperience or unavailability; (4) committeecomputer, software, or Internet service provider failures; (5) failure to know filing dates; and (6)failure to use filing software properly. 11 C.F.R. § 111.35(d).

The "failure to raise an argument in a timely fashion during the administrative processshall be deemed a waiver" of your right to present such argument in a petition to the U.S. districtcourt under 2 U.S.C. § 437g. 11 C.F.R. § 111.38.

If you intend to be represented by counsel, please advise the Office of AdministrativeReview. You should provide, in writing, the name, address and telephone number of yourcounsel and authorize counsel to receive notifications and communications relating to thischallenge and imposition of the calculated civil money penalty.

3. If You Do Not Pay the Calculated Civil Money Penalty and Do Not Submit aWritten Response to the RTB FindingIf you do not pay the calculated civil money penalty and do not submit a written

response, the FEC will assume that the preceding factual allegations are true and make a finaldetermination that Jeb Bradley for Congress Committee and you as treasurer violated 2 U.S.C. §434(a) and assess a civil money penalty.

Unpaid civil money penalties assessed through the Administrative Fine regulations willbe subject to the Debt Collection Act of 1982 ("DCA"), as amended by the Debt CollectionImprovement Act of 1996, 31 U.S.C. § 3701 et seq. The FEC may take any and all appropriateaction authorized and required by the DCA, as amended, including transfer to the U.S.Department of the Treasury for collection. 11 C.F.R. § 111.45.

This matter was generated based on information ascertained by the FEC in the normalcourse of carrying out its supervisory responsibilities. 2 U.S.C. § 437g(a)(2). In regards to your notice dated May 22, 2009, please be advised that the Jeb Bradley for CongressCommittee is appealing the calculated civil money penalty imposed by the FEC for the followingreasons.

When our committee was originally formed, report filing software was purchased from an outsidevendor. During the following four election cycles that this software was used, problems with calculatingand filing the reports occurred on multiple occasions. It is important to note that every effort was madeon our part to ensure that all reporting was filed accurately and on a timely basis.

The Jeb Bradley for Congress Committee has terminated business relations with the software vendorand at this point, no new vendor has been retained. The 2008 general election was not a successfulelection for our candidate and although we reserve the right to keep the committee active, no planshave been made to file a Statement of Candidacy for the 2010 election.

In addition to the unsuccessful election, substantial debt remains on the books for our committee andwith a very limited amount of cash on hand (please refer to our most current report), there is noopportunity to settle that debt, past or present.

SUPPLEMENTAL FILING INFORMATION

PLEASE NOTE: The Commission provides reminders of upcoming filing dates as a courtesy to help committeescomply with the filing deadlines set forth in the Act and Commission regulations. Committee treasurers must complywith all applicable filing deadlines established by law, and the lack of prior notice does not constitute an excuse forfailing to comply with any filing deadline.

WHO MUST FILEPrincipal campaign committees of all 2008 general election congressional candidates3 (including unopposed candidatesand candidates whose names do not appear on the ballot) must file Pre- and Post-General Election Reports.4

Campaigns that raise or spend more than $5,000 for the 2008 election cycle (and thus trigger registration and reportingrequirements) must file quarterly reports throughout 2008, even if the candidate plans to retire, withdraws from therace prior to the primary election, loses the primary or drops out of the race prior to the general election. Before acommittee can stop filing with the FEC, it must file a termination report with the Commission. Committees mustcontinue to file reports until the Commission notifies them in writing that their termination report has been accepted.

METHODS OF FILING REPORTS

Electronic FilingReports filed electronically must be received and validated by the Commission by 11:59 p.m. Eastern Time on thefiling deadline. For additional information, call the Electronic Filing Office at (800) 424-9530 or (202) 694-1642 orvisit our website at www.fec.gov/elecfil/electron.shtml.

Under the Commission's mandatory electronic filing regulations, U.S. House committees that receive contributionsor make expenditures in excess of $50,000 in a calendar year, or that have reason to expect to do so, must file allreports and statements with the FEC electronically. Other U.S. House committees may voluntarily file electronically;however, any entity that files electronically, whether required to do so or not, must comply with the electronic filingrules. U.S. Senate committees that file with the Secretary of the Senate are not subject to the mandatory electronicfiling rules, but may file an unofficial copy of their reports with the Commission in order to speed disclosure.

Registered & Certified MailReports sent by Registered or Certified Mail must be postmarked on or before the mailing deadline to be consideredtimely filed. A committee sending its reports by Certified Mail should keep its certified mailing receipt with the U.S.Postal Service (USPS) postmark as proof of filing because the USPS does not keep complete records of items sent byCertified Mail. A committee sending its report by Registered Mail should keep its proof of mailing. Note that aCertificate of Mailing from the USPS is not sufficient to prove that a report is timely filed using Registered, Certifiedor Overnight Mail.

Overnight MailReports filed via overnight mail will be considered timely filed if the report is received by the delivery service on orbefore the mailing deadline. "Overnight mail" includes Priority or Express Mail having a delivery confirmation, oran overnight delivery service with which the report is scheduled for next business day delivery and is recorded in theservice's on-line tracking system.

'Generally, an individual becomes a candidate for Federal office (and thus triggers registration and reportingobligations) when his or her campaign exceeds $5,000 in either contributions received or expenditures made. If thecampaign has not exceeded the $5,000 threshold, it is not required to file reports. See 11 CFR 100.3(a).

COMPLIANCE

Treasurer Responsibility. Treasurers of political committees are responsible for both the timeliness and theaccuracy of all reports. They may be subject to monetary penalties if reports are inaccurate or are not filed on time.For additional information, see the Commission's Statement of Policy Regarding Treasurers Subject toEnforcement Proceedings on the web site at www.fec.gov/law/policy/2004/notice2004-20.pdf.

Administrative Fine Program. Under the Administrative Fine Program, political committees and their treasurerswho fail to file their reports on time may be subject to civil money penalties up to $16,000 (or more for repeat late-and non-filers).5 For additional information, visit the FEC website at www.fec.gov/af/af.shtml.

Report Format. In addition, political committees that file illegible reports or use non-FEC forms (except forFEC-approved, computer-generated forms) will be required to refile their reports.

Electronic Filers Must File Electronically. Electronic filers who instead file on paper, or who submit anelectronic report (either by direct transmission, 3.5" diskette or CD) that does not pass the validation program by11:59 p.m. Eastern Time on the filing deadline, will be considered non-filers and may be subject to enforcementactions (including administrative fines).

IMPORTANT FILING INFORMATION - PAPER FILERSIn response to the anthrax threat, the U.S. Postal Service is irradiating mail directed to many federal agencies,including the FEC and the Secretary of the Senate.6 This process has not only delayed mail delivery, it has alsodamaged and in some cases destroyed pieces of mail. As a result, committees that file reports with the FEC maywant to consider submitting their reports by some means other than U.S. mail. Alternative methods includeelectronic filing, overnight mail service, and hand delivery.

'Penalties for late- or non-filing of 48-hour notices are based on the amount of contributions not timely disclosed. On May 12, 2009, the Commission found reason to believe ("RTB") that the respondentsviolated 2 U.S.C. § 434(a) for failing to file 48-Hour Notices for 12 contributions totaling$74,400 associated with the 2008 General Election and made a preliminary determination thatthe civil money penalty was $7,660 based on the schedule of penalties at 11 C.F.R. § 111.44.They were notified by the Reports Analysis Division ("RAD") on May 22, 2009 of theCommission's RTB finding and civil money penalty.

Respondents* Response

On June 22, 2009, the Commission received the written response ("challenge") fromSaylee J. Merrow, assistant to the Treasurer, requesting that, due to the Committee's financialhardship, the Commission reconsider the calculation of the civil money penalty. She explainsthat the Committee purchased software from an outside vendor and has been using this softwaresince it was formed. During the time that the software was used, problems with calculating andfiling reports occurred on multiple occasions but they made every effort to ensure that allreporting was filed accurately and on a timely basis. At this point, the Committee has terminatedrelations with the software vendor and does not currently have a replacement vendor. Despite anunsuccessful election in 2008, substantial debt, and very limited cash on hand in the Committeeaccount, they plan to keep the Committee active.

The Federal Election Campaign Act ("Act") requires that the treasurer of a principalcampaign committee of a candidate must notify the Commission, in writing, of any contributionof $1,000 or more received after the 20th day but more than 48 hours before an election. Theprincipal campaign committee must notify the Commission within 48 hours of receipt of thecontribution. The 48-hour notification shall be in addition to all other reporting requirementsunder the Act. 2 U.S.C. § 434(a)(6)(A) and 11 C.F.R. § 104.5(f). The treasurer shall bepersonally responsible for the timely filing of reports. 11 C.F.R. § 104.14(d).

Based on a review of Commission records, there is no indication that 48-Hour Noticeswere filed for 12 contributions of $1,000 or more that were received between October 16 andNovember 1,2008.

In response to RAD's Request for Additional Information ("RFAI") dated January 8,2009, and the Analyst's April 16, 2009 phone call, the respondents filed a Miscellaneous TextSubmission ("MS-T") on April 22, 2009 listing the 12 contributions totaling $74,400 that wereinadvertently not filed during the reporting period. In it, Ms. Merrow states that the Notices

were inadvertently not filed and they were unable to file the missing Notices with the campaign'susual method of reporting (Hannibal Software) because an upgrade was not available to theCommittee which would bring their filing version inline with the FEC's current filing version.

In the challenge, they acknowledge recurring software issues. During the time period inwhich 48-Hour Notices were required, October 16 through November 1, the Committeeelectronically uploaded 5 Notices successfully on October 20,22,24,28 and 30 for contributionstotaling SI41,300 but then failed to file Notices for another contribution received on October 30and 11 on October 31. Regardless of the reason for their failure to file these Notices, a result of.software problems which their vendor had not resolved or because they inadvertently failed tofile them, it is the Treasurer's responsibility to ensure that they are filed on time.

Furthermore, delays caused by committee vendors or contractors, committee computer,software or Internet service provider failures and negligence are included at11 C.F.R. § 111.3S(d) as examples of circumstances that are not considered reasonablyunforeseen and beyond the respondents' control. The other issue raised in the challenge (theCommittee's ability to pay) also does not fall within the list of defenses at 11 C.F.R. § 111.35(b).Their challenge fails to meet any of the three valid excuses at 11 C.F.R § 111.35(b). These are:(i) the RTB finding is based on factual errors; and/or (ii) the improper calculation of the civilmoney penalty; and/or (iii) they used best efforts to file on time but were prevented from doingso by reasonably unforeseen circumstances that were beyond their control and they filed thereport no later than 24 hours after the end of these circumstances.

Therefore, the Reviewing Officer recommends that the Commission make a finaldetermination that the respondents violated 2 U.S.C. § 434(a) and assess a civil money penalty of$7,660.

OAR Recommendations

(1) Adopt the Reviewing Officer recommendation for AF# 2092 involving the Jeb Bradley forCongress Committee and Eugene F. Leone, Jr., as Treasurer, in making the finaldetermination;

(2) Make a final determination in AF# 2092 that the Jeb Bradley for Congress Committee andEugene F. Leone, Jr., as Treasurer, violated 2 U.S.C. § 434(a) and assess a civil moneypenalty of $7,660; and

(3) Send the appropriate letter.

We have received your response of July 27, 2009 relating to our request to have the civilpenalty of $7,660 due to failure of the 48 hour filing requirements abated.

I have been the Treasurer for Jeb Bradley for Congress through four election cycles. Duringthis period, we have filed all but one 48 hour notices on a timely basis along with all requiredquarterly reports. In the last election cycle, we admit to not filing one 48 hour notice on timehowever, these contributions were included in the post general report which was filed onDecember 4, 2008. Obviously we made a clerical error which was remedied with thesubsequent filing. We feel a penalty of $7,660 for a clerical error which has no consequenceswhatsoever is a bit harsh. As you are aware, the campaign is dormant with absolutely nomoney and an outstanding debt to the candidate of $390,000.

We respectfully request you reconsider your decision and abate the penalty. Over the fourelection cycles of eight years, I think you will find we have meticulously filed all required reportsand have only this one mishap which is basically irrelevant.

One additional comment is that subsequent to the last election cycle, when a software updatewas required in order to continue filing, our software vendor would not release it unless weprovided them with our entire data base, to which we refused. As a result, we have beenunable to electronically file since and have filed all reports manually which we know is not incompliance but our only option.

On May 12, 2009, the Commission found reason to believe ("RTB") that therespondents violated 2 U.S.C. § 434(a) for failure to file 48-Hour Notices for 12contributions totaling $74,400 associated with the 2008 General Election. As a result, onMay 12, 2009, the Commission also made a preliminary determination that the civilmoney penalty was $7,660 based on the schedule of penalties at 11 C.F.R. § 111.44.

One June 22, 2009, the Commission received their written response("challenge"). After reviewing the challenge, the Reviewing Officer's recommendation("ROR") dated July 23, 2009 was forwarded to the Commission, a copy was forwarded tothe respondents, and is hereby incorporated by reference. The Reviewing Officerrecommended that the Commission make a final determination that they violated2 U.S.C. § 434(a) and assess a $7,660 civil money penalty because they submitted noevidence that a factual error was made in the RTB finding, that the penalty wasmiscalculated at RTB or that they used best efforts to file on time.11 C.F.R. §111.35(b).

Within 10 days of transmittal of the recommendation, the respondents may file awritten response with the Commission Secretary which may not raise any arguments not

raised in the respondents' challenge or not directly responsive to the Reviewing Officer'srecommendation. 11 C.F.R. § 111.36(f). A response was received from the Treasurer onAugust 13,2009, and a copy is attached.

This response presents no new information about the two defenses raised in thechallenge and addressed in the ROR: the financial hardship the fine places on therespondents and recurring difficulty with their software vendor. They admit that they didnot file one Notice and corrected this clerical error by including the contributions on thesubsequent report, but contend it was "one mishap which is basically irrelevant." TheROR addressed this issue and determined that they failed to file two, not one, Notices -one for the contribution received October 30 and one for the 11 contributions receivedOctober 31 - and that the notices are required to be filed independent of the 30 Day Post-General Report filing requirement. 2 U.S.C. § 434(a)(6)(A) and 11 C.F.R. § 104.5(f).

The response presents one new issue: their history of meticulously filing allreports. Since the respondents did not raise this new issue in the challenge, and is notdirectly responsive to the ROR, it is not addressed by the Reviewing Officer in thismemorandum. 11 C.F.R. § 111.36(0

The Reviewing Officer, therefore, recommends that the Commission make a finaldetermination that the respondents violated 2 U.S.C. § 434(a) and assess a civil moneypenalty of $7,660.

OAR Recommendations

(1) Adopt the Reviewing Officer recommendation for AF# 2092 involving the JebBradley for Congress Committee and Eugene F. Leone, Jr., as Treasurer, in makingthe final determination;

The Reviewing Officer reviewed the Commission's RTB finding with its supportingdocumentation and the written response. Based on this review, the Reviewing Officerrecommended that the Commission make a final determination that the Jeb Bradley for CongressCommittee and you, as Treasurer, violated 2 U.S.C. § 434(a) and assess a civil money penalty inthe amount of $7,660 in accordance with 11 C.F.R. § 111.44. The basis for the ReviewingOfficer's recommendation was included in the Final Determination Report, a copy of which wassent to you on July 27, 2009.

On September 8, 2009, the Commission adopted the Reviewing Officer'srecommendation and made a final determination that the Jeb Bradley for Congress Committeeand you, as Treasurer, violated 2 U.S.C. § 434(a) and assessed a civil money penalty of $7,660.A copy of the final determination recommendation is attached.

If You Choose to Appeal the Final Determination and/or Civil Money PenaltyIf you choose to appeal the final determination, you should submit a written petition,

within 30 days of receipt of this letter, to the district court of the United States for the district inwhich the committee or treasurer reside, or transact business, requesting that the finaldetermination be modified or set aside.
