1. SERVICE OBJECTIVES

The Contractor will, subject to and in accordance with the terms of the Contract, operate the Household Waste Recycling Sites (“HWRS”) pursuant to the provisions of this Schedule 4 Part 5.

2. CONTRACTOR DETAILS

2.1 Transitional period sub-contractor and service arrangements

2.1.1 The Contractor will make arrangements with suitable sub-contractors for the transport, treatment (where appropriate) and disposal of all Household Waste deposited at each HWRS in the period from 15th May 2003 to the Completion of the relevant Transfer Stations in accordance with paragraph 2.2 of this Schedule 4 Part 5, in an appropriate manner determined by it. All sub-contractors utilised during the provision of this service will hold appropriate waste management licences and planning permissions.

2.1.2 The Contractor will deal with Household Waste in the manner detailed in the appendices to this Service Delivery Plan. The sub-contractors used by the Contractor will be reviewed on an ongoing basis. Depending on the location of the HWRS and the type of material, the sub-contractors used by the Contractor in accordance with paragraph 2.1 of this Schedule 4 Part 5 will be as follows:

2.2 Sub-contractor and service arrangements after transitional period

it to transfer Household Waste from HWRS proximate to those Transfer Stations, to such Transfer Stations before bulk up and disposing of/reprocessing of such Household Waste from such Transfer Stations in accordance with the Contract. The Contractor may direct Household Waste from a HWRS proximate Transfer Station in accordance with paragraph 2.2.1 of this Schedule 4 Part 5 to reduce haulage distances between HWRS and disposal / reprocessing sites and to increase payloads of Household Waste transferred for final disposal to Landfill Sites or for reprocessing at the MRF or elsewhere.

2.2.2 The Contractor will use various sub-contractors for disposal or reprocessing of Household Waste and where paragraphs 2.2.1 and 2.2.2 of this Schedule 4 Part 5 apply, the sub-contractors that it may use will be determined by the Contractor at such time.

3.3 Detailed operational narrative

3.3.1 An overview of the activities intended to be carried out at each HWRS is shown below.

3.3.2 General description of service

The service to be provided by the Contractor in respect of each HWRS pursuant to this Schedule 4 Part 5 may be summarised as:

(A) the management and supervision of the HWRS during the times

specified (see paragraph 3.1);

(B) the operation of recycling initiatives located at the HWRS and

identified in the appendix for each site;

(C) the promotion of segregation of Household Waste into categories of material types to enable re-use and recycling of those materials to take place, hence effecting diversion of Contract Waste from Landfill Sites;

(D) the receipt, handling and clearance of deposited waste at the HWRS by householders;

(E) the supervision of the deposit of Recyclable Materials brought to the HWRS by householders;

(F) the subsequent transportation and deposit of residual Household Waste to the nominated disposal facility identified in the appendix for each site, or such other disposal facility as the Contractor considers appropriate;

(G) the compliance with the Waste Management Licence (including Working Plan); and

(H) the compliance with the Planning Permission (including conditions attached).

3.3.3 Acceptance and control of Household Waste and Household Waste loading

The Contractor will, subject to and in accordance with the terms of the Contract:

(A) ensure that all persons and vehicles entering the HWRS are

directed in accordance with the Contractor’s Health and Safety policies and associated procedures as amended from time to time and assist the public as necessary and when requested to do so.

(B) ensure that site staff advise and give directions to the public but are not required to carry waste being deposited by them on their behalf.

(C) ensure the Household Waste is accepted free of charge and that trade waste is prohibited from being deposited at the HWRS.

(D) ensure clearly marked commercial vehicles carrying waste

associated with the trade or function of the markings are not be admitted to the site;

(E) ensure that site employees are aware of the types of waste acceptable to each site, according to the Waste Management Licence and the Councils’ policies, and the method of handling, storage, loading and disposal of each type of waste;

(F) ensure that any valuables or property reported lost by a member of the public will not become the property of the Contractor and the Contractor will provide all reasonable facilities for a search to recover such lost property;

(G) ensure that if reasonably requested by a member of the public, a search for valuables and lost property is undertaken;

(H) grant to householders access to the point of discharge, including areas for recycling and re-use;

(I) ensure that appropriate height barriers are in place at all times and are maintained in accordance with Schedule 15, Detailed Maintenance Plan;

(J) operate all vehicles and plant in accordance with Management System procedures, current Health and Safety requirements and European Union Regulations with particular reference to the loading of waste, drivers’ hours, over-loading, load security and overall vehicle condition;

(K) cover all Household Waste in containers or open vehicles with a suitable tarpaulin or net prior to it leaving the HWRS in order to prevent the loss of Household Waste during transportation; and

(L) provide and maintain appropriate administrative records as required by Schedule 21 Defined Audit Trail.

3.3.4 Types of Waste

Subject to the terms of the Contract:

(A) the Contractor will accept at each of the HWRS the type of waste listed in the relevant appendix to this Schedule 4 Part 5; and

(B) if the Contractor accepts unauthorised waste delivered with

authorised Household Waste to a HWRS whether knowingly or otherwise, the disposal of such unauthorised waste and all associated costs, including loading and haulage, will be the responsibility of the Contractor.

3.3.5 Inert Waste

The Contractor will so far as reasonably practicable:

(A) ensure that soil and hardcore deposited by householders is restricted to one car boot load per trip; and

(B) ensure that only those appearing to be private householders depositing Household Waste or inert are permitted to access the HWRS.

3.3.6 Trade waste may not knowingly be accepted for deposit at the HWRS by the Contractor.

3.3.7 The Contractor will ensure that each HWRS will have height restriction barriers set at a height of 1.75 metres (5’ 9”). The Contractor will not allow any vehicles, which cannot pass underneath the height restriction, to enter HWRS except certain vehicles that are authorised to enter the HWRS by the Councils or by the Contractor’s management. Private domestic users will be permitted to park outside sites and carry their waste into the site provided this does not cause an obstruction or is unsafe. The site operators will within the limits stated above give assistance to members of the public if asked and keep external areas clean.

3.3.8 The Contractor will so far as reasonable co-operate with, assist and support the Councils in the implementation of their policies relating to trade waste and with organisations such as the Environment Agency, the Benefits Fraud Investigation Service, the MOT Vehicle Inspectorate and the Police.

3.3.9 The Contractor will keep a list of all commercial vehicles that attempt to deposit waste at HWRS, and a list of those private domestic vehicles that are suspected by it of depositing trade waste. The Contractor will supply these lists monthly in a computer format as required by the Councils. Each record will list:

3.3.10 Gate Control Procedures

In addition to the measures described in paragraph 3.3.5 of this Schedule 4 Part 5, the Contractor in the following HWRS will operate a specific gate control procedure:

(A) Brighton HWRS;

(B) Eastbourne HWRS;

(C) Hastings HWRS; and

(D) Hove HWRS,

Details of the specific gate control procedures to be operated at each of these HWRS by the Contractor are outlined in the relevant appendices to this Schedule 4 Part 5. East Sussex County Council and Brighton & Hove City Council have specific policies and procedures relating to their own sites in respect of gate control and types or quantities of waste permitted to be deposited at the HWRS. Both Councils reserve the right to amend their own policies and procedures from time to time throughout the Contract period.

3.3.11 Removal of Household Waste

Subject to paragraph 3.3.3 of this Schedule 4 Part 5 and otherwise to the terms of the Contract, the Contractor will remove all Household Waste from each HWRS as soon as reasonably practicable and will ensure so far as reasonably practicable, that the HWRS remains available during opening hours. In particular, subject as aforesaid, the site will be emptied of Household Waste by the Contractor, so far as

reasonably practicable, prior to Public and Bank Holiday Weekends and residual waste will be removed from each HWRS by the Contractor on the working days immediately preceding Christmas and New Year as the case may be.

3.3.12 Transportation and Disposal of Waste

Each load of Household Waste transported in vehicles under the terms of this Contract will be validated by the Contractor using a controlled waste transfer note. The Contractor will hold a valid Registration of Carrier of Waste Certificate.

3.3.13 Waste Transport Vehicles and Containers

(A) The Contractor will maintain in a clean and roadworthy condition all road vehicles, containers and trailers used by it for the provision of the service in this Schedule 4 Part 5. Household Waste will be transported in enclosed containers or open vehicles covered by sheets or nets. All drivers and other operatives will be suitably trained by the Contractor and qualified for their tasks and made aware of the safe use of the vehicles in their charge in accordance with Management System Procedure SP.14 Household Waste Recycling Centre Procedures, “Training Awareness and Competence” as amended from time to time.

(B) The Contractor will provide vehicles that reduce the impact on the environment. Under normal circumstances, no vehicle more than 7 years old will be used by the Contractor except with the agreement of the Councils (such agreement not to be unreasonably withheld or delayed).

(C) All vehicles operated by the Contractor to transport Household Waste from any HWRS will be weighed on the disposal/delivery point weighbridge upon arrival and prior to departing from the disposal/recycling site unless agreed tare weights are stored, in which case only inward journeys will be weighed. Weighbridge tickets will be retained by the Contractor for up to 36 months for inspection by the Councils unless otherwise agreed between the parties.

3.3.14 Re-Use and materials recovery

(A) Materials for which the Councils currently provide a recycling facility at the existing HWRS are listed in the appendices to this Service Delivery Plan.

(B) The Contractor will supply the carrier with a Controlled Waste Transfer Note and a weighbridge ticket from the respective re-use or recycling organisation/company to the Councils for each load of re-used or recycled material.

(C) The Contractor will ensure that carriers employed in the service in this Schedule 4 Part 5 are Registered Carriers of Waste.

3.3.15 The Contractor will direct the public as appropriate to the recycling areas/containers at the HWRS and control the deposition of the materials to be set aside for recycling or re-use. The Contractor will keep containers for such materials and their surrounding area clean and tidy in accordance with Management System Procedure SP.14 Household Waste Recycling Centre Procedures “Container Servicing” and “Site Cleanliness” as amended from time to time.

3.3.16 At all HWRS, refrigerators and any other appliances that are known to the Contractor to contain chlorofluorocarbons (cfcs) will be stored separately by the Contractor for removal to a nominated reprocessor who will be responsible for removing CFCs in an environmentally acceptable manner. Items containing CFCs stored on site will be secured in accordance with Contractor procedures, and the Contractor will prohibit the cannibalising or removal of parts other than for reasons of safety. The Contractor, when requested, will inform the Councils of the number of appliances awaiting removal.

3.3.17 The Contractor may salvage Household Waste for re-use excluding items reported lost. Salvaged Household Waste will be removed from the HWRS on the day of salvage, unless the Contractor, in consultation with the Councils, wishes to operate a scrap or bric-a-brac store at one or more HWRS. The operation of any scrap store will conform to current legislation relating to the sale of goods, and the Contractor will supply the Councils with a list of goods that are prohibited from sale directly to the public. The Contractor will not allow the sale of electrical goods directly to the public at any of the HWRS. Any items salvaged will be stored in appropriate containers. The Contractor will submit appropriate records to the Councils of salvaged materials, which have been sold for re-use.

3.3.18 Disposal

(A) The Contractor will deliver residual Household Waste to the nominated disposal points. The Contractor may deliver such residual waste to an alternative disposal point other than that nominated in any Service Delivery Plan.

(B) The Contractor will keep records of all Household Waste despatched from the HWRS as required by Schedule 21 Defined Audit Trail. Such records will be available to the Councils at all reasonable times. These records will be retained by the Contractor for 36 months unless otherwise agreed between the parties.

(C) The Contractor will ensure that all Household Waste delivery vehicles are weighed in and out of the nominated disposal facility and computerised weight tickets are retained.

(D) In the event of a weighbridge/computer failure at a HWRS or disposal facility the Contractor will procure a hand-written ticket from the weighbridge operator in accordance with Management System Procedure GP.09 Weighbridge Procedure as amended from time to time.

3.3.19 Site Operators

(A) The Contractor will at all times employ or cause to be employed on each HWRS sufficient site operators, who are sufficiently trained and skilled, to carry out the duties as set out in this Schedule 4 Part 5 and the Waste Management Licence. The Contractor will train site operators in accordance with Management System Procedure SP.14 Household Waste Recycling Centre Procedures “Training Awareness and Competence” as amended from time to time.

(B) The Contractor will ensure that all site personnel employed by it will wear adequate personal protective equipment and display identification badges. Badges will carry a photograph and the name of the employee and identify his/her job title.

3.3.20 Courtesy to users of HWRS

The Contractor will ensure that all managers and staff engaged in activities on behalf of the Councils at the HWRS behave in a courteous manner in accordance with Management System Procedure SP.14

3.3.21 Complaints in respect of service provision

The Contractor will deal with all complaints received, from whatever source, in a prompt, courteous and efficient manner in accordance with the terms of Management System Procedure, GP.04 Control of Non Conformances and Complaints as amended from time to time. The Contractor will maintain a customer response helpline normally manned between 10am to 15.30pm. The helpline number will be prominently displayed at all HWRS. Outside the operational hours of the helpline, this service will divert to an answer machine which will receive prompt attention.

3.4 Emergency procedures/disaster recovery plan

3.4.1 The Contractor will be prepared and ready to take action in an emergency at the HWRS, particularly in the event of fire, accident to persons, vehicles or plant, the identification of hazardous waste and such similar events. The Contractor will prominently display the nearest means of communication to emergency services, together with contact points or telephone numbers on the HWRS and bring such information to the attention of all operatives. The authorised officer of the Contractor on the HWRS in question will be informed of any emergency as soon as reasonably practicable after the occurrence of the event at a HWRS and of the ensuing action that has been taken.

3.4.2 The Contractor will operate the HWRS in accordance with Management System Procedure SP.14 Household Waste Recycling Centre Procedures “Emergency Preparedness and Response” and GP.07 Emergency Plan Procedure as amended from time to time.

3.5 Backup arrangements

3.5.1 Should a HWRS become unavailable the Contractor will implement the site-specific contingency plan that will be formulated prior to the commencement of operations at the HWRS on 15 May 2003.

3.5.2 In accordance with the contingency plan mentioned in paragraph 3.5.1 of this Schedule 4 Part 5, the site staff will notify the Contractor and the public as soon as reasonably practicable. The Contractor will maintain a record of such notification and will notify the Councils and the Environment Agency as soon as reasonably practicable. Staff at

the HWRS will actively take part in redirecting the public to the nearest alternative site (set out in the table below). This information will be provided to the public verbally where possible, through notices at the site in question, via the Councils’ and Contractor’s web sites and the local press. Similar lines of communication will be used by the Contractor to keep the public informed of progress to resolve the problem and the date of site reopening.

3.6 Planned unavailability

Schedule 2, Works Programme or Schedule 15, Detailed Maintenance Plan (as applicable) will be developed to show when the Contractor requires to close any HWRS for maintenance, refurbishment or development. During this period the Contractor will be relieved from Unavailability Deductions. A protocol will be established for the communication of such planned closures and the reopening of the facility to both the Councils and the relevant WCAs (where applicable).

3.7 Procedures for handling special and clinical waste

3.7.1 The Contractor will provide its operatives with ongoing training on the handling and receipt of special waste. Members of the public wishing to deposit special waste at the HWRS will be advised by the Contractor that they may do so and such material will be contained in a Chem. Vault or Battery Store as appropriate and in accordance with the Waste Management Licence. The Contractor will keep a record of all such deliveries to the HWRS and submit to the Councils a monthly return of such records.

3.7.2 The Contractor will be responsible for the correct disposal of these items and will nominate the disposal site. Consignment notes for special wastes will be provided by the Contractor to the Environment Agency and to the Councils.

3.7.3 The Contractor will check that contractors employed to deal with special wastes are in possession of an appropriate Waste Management Licence and carriers will be checked to ensure that they are a Registered Carrier of Waste.

3.7.4 The Contractor will accept bonded asbestos at those HWRS that are authorised to accept bonded asbestos in accordance with the appendices to this Schedule 4 Part 5.

3.7.5 The Contractor will operate the HWRS in accordance with Management System Procedure SP.14 Household Waste Recycling Centre Procedures “Waste Handling” and GP.13 Handling of Special Waste as amended from time to time.

3.8 Health & safety

3.8.1 The Contractor and its staff will adopt safe working practices in accordance with Laws that apply to its activities under the Contract with a view to ensuring the safety of all site users and personnel.

3.8.2 The Contractor will be responsible for the suitable and safe use of the equipment used in the provision of the Service in this Schedule 4 Part 5 and no equipment will be used which is unsuitable, unsafe or liable to cause damage.

3.8.3 The Contractor will require its staff at all times while engaged in the provision of the Service in this Schedule 4 Part 5 to be properly and presentably dressed in suitable uniforms, work wear, protective and reflective clothing.

3.8.4 The provision of the Service in this Schedule 4 Part 5 will be carried out in accordance with Management System Procedure GP.06 Health and Safety and associated Contractor procedures as amended from time to time.

3.9 Resources available at each HWRS

3.9.1 The Contractor will ensure that within each HWRS, clear and clean signs are provided to direct the public to services offered by the HWRS to enhance the ‘user-friendly’ aspect of the sites and increase the recycling potential. Any signs or notices erected at the HWRS by the Contractor will be of a suitably durable material. The design of signs will be submitted to the Councils by the Contractor for comment prior to the signs being manufactured.

3.9.2 In addition, a sign will be provided by the Contractor at each HWRS stating that the facility is provided in partnership with the Council and displaying the following information:

(A) site name;

(B) name and address and telephone number of Contractor;

(C) Environment Agency office responsible for issuing the licence;

(D) site licence number;

(E) hours of operation; and

(F) emergency telephone number.

3.9.3 The Contractor will provide, erect, remove or re-locate all temporary signs that may be necessary for the safe and efficient running of a HWRS. All signs will be to the satisfaction of the Councils and no sign will be erected without the Councils’ prior agreement (not to be unreasonably withheld or delayed).

3.9.4 New directional signs will be provided in the locality of each HWRS by the Contractor where no adequate signs already exist. These signs will be designed in accordance with the Traffic Signs Manual and erected in accordance with the requirements of the Highway Authority.

3.9.5 Appropriate plant and equipment to enable the safe and efficient operation of the HWRS will be provided and maintained by the Contractor.

3.9.6 Each of the HWRS will be equipped to provide staff welfare and site management facilities by the Contractor.

3.10 Staffing

3.10.1 The Contractor will ensure that staffing levels on each HWRS are adequate to allow compliance with health and safety, legislative and performance requirements. For information, indicative staffing levels dedicated to each HWRS are set out in the table below (subject to change by the Contractor in its sole discretion):

3.10.2 Site operatives will be trained and certified by the Contractor to operate any plant on a HWRS.

3.10.3 Under normal circumstances a minimum of two operatives will be employed on each site during operational hours by the Contractor.

3.10.4 A Contract Manager and Administrator will be specifically responsible for the efficient management of the HWRS operation.

3.10.5 The Contractor will ensure that all operatives of HWRS will have undergone sufficient induction training and will at all times on the HWRS be required to dress in personal protective equipment.

3.11 Maintenance and inspections

3.11.1 The Contractor will maintain the HWRS buildings and all facilities used by it in accordance with Schedule 15, Detailed Maintenance Plan. Any material damage, excluding fair wear and tear, caused by the Contractor, by members of the public, or by persons unknown, whether during opening hours or out of hours, and whether accidental or malicious, will be reported to the Councils. The cost of replacement, reinstatement or repair will be borne by the Contractor.

3.11.2 The Contractor will be responsible for the maintenance and administration of all HWRS services distribution systems from the service authority’s stopcock, manhole, junction box, meter box or other terminal point.

3.11.3 The Contractor will remove on a daily basis waste and litter clearly identified as originating from the HWRS, and also illegally tipped waste within 5 metres of the entrance to the HWRS and the area of the highway adjacent to and in the vicinity of the HWRS as shown in the lease plans. The Contractor will daily remove litter clearly identified as originating from the HWRS from any land adjacent to the HWRS with the consent of the owner, and keep all paved areas of the HWRS swept clean of waste and litter.

3.12 Security arrangements

3.12.1 The Contractor will keep a site diary to record daily events on each HWRS that will include the following information as minimum:

HOUSEHOLD WASTE RECYCLING SITES

(A) details of visitors to the site (except site users);

(B) details of maintenance and breakdowns of any plant and machinery;

(C) details of inspections for vermin and/or insects, including control measures taken;

(D) accidents to any person visiting the site as well as damage to vehicle and infrastructure;

(E) notification of incidents reported to the Environment Agency;

(F) notification made to the Councils of site closures; and

(G) the site diary will be made available to the Councils when requested.

3.12.2 The Contractor will be responsible for the security of the HWRS including any property belonging to the Councils and the Contractor.

3.12.3 The Contractor will comply with the Councils security regulations, and its obligations under the Data Protection Act 1998 and the Computer Misuse Act 1990 in operating the HWRS.

3.12.4 The Contractor will provide cover 24 hours a day, every day of the year to respond to any emergency that may arise in connection with the HWRS. An emergency call out procedure will be provided by the Contractor prior to the commencement of site operations, maintained and updated in accordance with the requirements of the Environment Agency.

3.12.5 The Contractor will take all reasonable precautions to prevent unauthorised access to the HWRS.

3.13 Traffic management

3.13.1 The Contractor will arrange each HWRS, wherever reasonably practicable within the logistical limitations of the site area to enable one-way flow of traffic. Wherever possible the Contractor will segregate lorry movements from the public.

3.13.2 The Contractor will erect signs to establish a maximum speed limit of 10 miles per hour across all HWRS.

3.13.3 The Contractor will ensure that vehicles wishing to use the HWRS

may park in the areas provided and will take steps to ensure that, after unloading, they will follow the route directed to exit the HWRS.
