Whereas, the Hon'ble High Court of J&K passed the following order on 29.12.2010 in SWP No. 2938/2010 titled Talib Hussain and others VIS State and others: - "Mr Basotra, learned Additional Advocate General, who appeared for the respondents submitted that the State respondents may not be averse to consider the petitioners' representations for passing appropriate orders thereon, under rules. In view of the statements made by the learned counsel for the parties, this writ petition does not survive for further consideration. It is accordingly disposed of issuing a direction to the Director General of Police J&K Jammu to consider the petitioners' representations for passing appropriate orders thereon, as warranted under rules, within a period of twelve weeks ".

1. Whereas, some employees of the Police Transport WorkshoplPioneer Platoon had approached the Hon'ble High Court of J&K through themedium of SWP NO.2938/2010 titled Talib Hussain and others VIS State andothers and SWP NO.1620/2002 titled Mohd. Sultan and others Vs. State andothers, praying therein for conferment of skilled/semi-skilled status byplacement in the relevant pay scales in terms of the provisions of SRO-149dated 07.04.1973 on the analogy of similarly situated cases; and

2. Whereas, the Hon'ble High Court of J&K passed the followingorder on 29.12.2010 in SWP No. 2938/2010 titled Talib Hussain and othersVIS State and others: -

3. Whereas, the Hon'ble High Court of J&K passed the followingorder on 21.07.2011 in SWP No. 1620/2002 titled Mohd. Sultan and others Vs.State and others: - r---

"Learned counsel for the petitioner stated at the bar that th'smatter is covered by the judgement delivered at Jammu ~yCoordinate Bench of this Court in SWP No. 131512002 whi hstands complied with and prayed that the respondents .edirected to consider the case of the petitioners in light of the sa]djudgement. Learned counsel also produced Photostat copy of t esaidjudgement, made part of the file.

J have gone through the judgement and the relief sought in t1epresent writ petition and J am of the considered view that thiswrit petition is covered by the said judgement. Accordingly, t1erespondents are directed to consider the case of the petitionersin terms of the said judgement and make a decision within thrjemonths from the date the copy of this order along copy of t1ejudgement (supra) is served upon them ".

Whereas, pursuant to the orders passed ~S.WP Nos. 518/2000titled Mohammad Ishaq & anothers Vs State, 196/2000 titled Shri Raj shKumar & others Vs State & others, 258112002 titled Mohammad Shafiq &others Vs State and anothers, 1315/2002 titled Mohinder Lal & oth9rs,respectively and with the prior concurrence of the Finance Departmfntconveyed vide U.O. No.Al97(93)-1045 dated 08.11.2006, vide Governms ntOrder NO.Home-471 (P) of 2006 dated 29.11.2006, sanction was accorded tothe placement of 18 petitioners of J & K Police Transport Workshop (PT\\fS)in the relevant pay scales on the analogy of Shri Uttam Chand (SWP No.60A90COA (W) No.20 of 1996); and

5. Whereas, the matter was examined in consultation with the FinaJceDepartment in light of the Court orders passed in SWP Nos 1620/2002 and2938/2010 referred to in Para 3 and i? above respectively. The FinadceDepartment vide their U_O. No.Al97(93)-49 dated 09.04.2013 advised asunder: -

6. Whereas, pursuant to aforesaid orders of the Hon'ble High Co~rt,referred to in paras 2 and 3 above and with the agreement of the Fina~ceDepartment conveyed vide U.O. No.A/97(93)-49 dated 09.04.2013, v~eGovernment Order NO.Home-462 (P) of 2013 dated 24.10.2013, 1~3employees of the Police Transport Workshop/Pioneer Platoon were confe~edthe skilled status in the relevant pay scales in terms of the provisions of SRp-149 dated 07.04.1973 notionally from the date of their initial appointment ardmonetarily from the date of issuance of the order; and

7. Whereas, the petitioners in the writ petition SWP No.2938/20~0titled Talib Hussain and others V/S State and others and those in SWPNO.1620/2002 titled Mohd. Sultan and others Vs. State and others have filbdContempt Petition (SW) No.546/2013 alleging non-implementation ofGovernment Order NO.Home-462 (P) of2013 dated 24)i~·~013; and

8. Whereas, the matter was examined in consultation with the POlifeHeadquarters and a proposal in this regard submitted to the FinanceDepartment vide U.O.Home/550/PB-IV/2001 dated 07.10.2015 to ensfeimplementation of Government Order NO.Home-462 (P) of 2013 datId24.l0.2013 in totality; and

9. Whereas, the Finance Department vide their U.O. No.Al97(93)-1048 dated 31.12.2015 have conveyed as under: -

"Returned. Agreement conveyed to the Department vidyNO'Al97(93)-49 dated 09.04.2013 itself implies that FD ha~included the employees of PTWS(Pioneer Platoon of HorneDepartment in schedule 'c' of J&K Civil Services (Revise4Pay) Rules, 1973 for classification' as skilled and semi-skilledworkers. IOnce the confirmation of skilled/semi-skilled status is granteq

: .•..-..in favour of workers by the Competent Authority, the posts heldby them are deemed to have been upgraded/ revised to thdrevised pay scales as applicable td such class of workers irlterms of schedule 'c' of J&K Ciyil Services (Revised Pay)Rules, 1973, and thus up-gradation/creation of posts afresh inskilled/semi-skilled pay scales is notl required." i

Now, therefore, keeping in view the agreement of the FinanceDepartment conveyed vide their U.Os. No.Al97(93)-49 dated 09.04.2013 apdNo.Al97(93)-1048 dated 31.12.2015 and in continuation of Government Or1erNO.Home-462 (P) of2013 dated 24.10.2013, it is hereby ordered that the p0i:tsheld by the 123 employees (whose names are given in the Annexure-' A' tothis order) and have been conferred the benefit of skilled status in terms ofSRO 149 dated 07.04.1973 vide above said Government Order, shall Eedeemed to have been up-graded/revised to the Pay Scale as applicable to sJchclass of workers in terms of Schedule 'c' of the J&K Civil Service (Rev sePay) Rules, 1973.

This order is issued subject to the outcomeof any writ petition s)pending consideration before any competent court of law.
