Sir,  Thank you for your time. You will be notified of the results of this complaint investigation when it is complete.   Cpt. Karns   ‐‐‐‐‐Original Message‐‐‐‐‐ From: "Mark Dixon" <md20033@yahoo.com> Cc: Harry Grizzle <Harry.Grizzle@pinalcountyaz.gov> To: Jeffrey Karns <Jeffrey.Karns@pinalcountyaz.gov> Cc: Paul Babeu <Paul.Babeu@pinalcountyaz.gov> Cc: Steve Henry <Steve.Henry@pinalcountyaz.gov>  Sent: 4/21/2012 5:39:55 AM Subject: RE: request for phone records from Mark Dixon  Deputy Karns,  Yes at this point communicating via email would probably be best.  As you can see I do document pretty much everything anyway.  As for your request I have some issues and questions.  1)  Since your original request was for 520‐876‐0365 that must be the number John Ellsworth claims he called me on, is this correct?  2)  It appears that this number, a Quest landline, was found for me as it is readily available on the internet as my number.  I will conclude that due to the investigative experience of John Ellsworth he knows that Quest does not keep detailed call logs on incoming and outgoing calls.  Therefore if this number was an active number at the time of his supposed phone call, it would come down to my word against the word of John Ellsworth.  3)  In the civil case which was dismissed in federal court this matter was fully addressed with Marc Appel, council for the Sheriff's Office.  In those discussions and documentation no one could or would indicate when John Ellsworth called me. Thru review of my phone records, which were included in discovery, All that anyone would confirm is that the supposed call did not occur on 520‐705‐2945, my only phone number.  It was also confirmed that the supposed conversation occurred before December 1, 2009.  4)  Deputy County Attorney and Marc Appel both have the phone records for 520‐705‐2945 for the entire period in question except the date of December 3, 2009 thru December 25, 2009.  The only way you will get the records of December 3, 2009 thru December 25, 2009 is thru a subpoena,  Those records include calls from and to individuals both within and outside the Pinal County system including the Sheriffs department.  I have no faith in the whistle blower act and will not release those records as it is my responsibility to protect those who have tried to help me.

 Dixon: 4‐18‐2012 3:01pm              "Do you want them digitally or on paper"     Karns: 4‐18‐2012 3:02pm               "If you can email them that is preferred"      Dixon: 4‐18‐2012 3:03pm              "and what dates do you want included"     Dixon:  4‐18‐2012 3:04pm             "I can what dates to include"     Karns: 4‐18‐2012 4:13pm               "Please shelve my request for a day or so.  There is a date clarification I need to get first.  I will re‐contact you.  Sorry for any confusion."     Dixon: 4‐18‐2012  4:50pm             "No problem I could send you 1000 pages but you only need 1 to 10 let me know"     Karns:  4‐19‐2012 2:05pm              "Sir, if you are able to provide phone records for the period of 1 November 2009 through 25 December 2009, for phone number 520‐876‐0365, I would appreciate it.  Email copy is fine. Thank you in advance.       Deputy Karns, I will assume by this that John Ellsworth is claiming to have talked to me between November 1, 2009 and December 25, 2009.  We already know that he claimed to speak to me on the phone per disclosure thru PCSO, in the statement he spoke to Carol Dixon first then had a subsequent conversation with myself.     Well let's cut to the chase here, John Ellsworth is a liar.  As I told you when we spoke the only phones  I have at my are Verizon cell phones. Verizon has a detailed call log for each number including all incoming and outgoing calls.  I never received any call from John Ellsworth prior to the dates above, during the dates above or after the dates above on any of my Verizon lines.     In so far as 520‐876‐0365 that was my home number for many years thru Quest. That number was transferred to the residence I sharred with Carol Dixon/Johnson when we were married.  When I moved back into my home on Pasadena in June 2009 Quest would not allow me to transfer that number back to this

address, therefore that number was disconnected June of 2009.  There is no possible way John Ellsworth talked to me on that number and I will say again he never talked to me on any other number.     I will further point out that according to sources at the Superior Court this is not the first time John Ellsworth has spokenout of turn and lied regarding testimony in order to assist another officer, although apparently some of those records are sealed they are available.     I hope this response adequately answers all of your questions.     Sincerely,  Mark Dixon
