HMRC have declared that they arestill working to uncover any unpaid taxaccumulated from second home propertysales.

This is not the first warning issued fromHMRC, as they endeavour to reiterate themessage thatall individualswhohavesoldpropertieswhichhaveservedassecondorholidayhomesin theUKandabroadhavenot yet declared their Capital Gains Tax(CGT)willbepenalised.

Themain aimof the campaign focuses onexposing those who have sold a propertywhichdoesnotservepredominantpurposeas being a main home, and have gainedprofit exceeding the annual CGT limit of£10,600.Thisunpaid‘gained’taxiswhatHMRCisaimingtorecover.

So far, HMRC have been quite tolerant ofthose holding undisclosed taxes. Howeverwiththeclosingdateforpeopletovoluntarilyturn in theirprofitsdrawingnear, theyhaverecentlyresortedtosendingguiltyindividualspenalty letters. In light of this, it has beensuggestedthatthosewhodocomeforwardoftheirownaccordwillseealesserpenaltyfortheirunrevealedexpenses.

The cut off date for individuals to releaseinformationabout suchgains frompropertysalesstillstandsasbeingAugust9th2013,with a further 4 weeks then being offeredto such persons to actually pay back thebenefitstheyhadoriginally‘reaped’.

ItisthoughtthatasHMRCproposetocarryoutsuchthroughchecks,uncoveringrecordsfrom many years previous, that this in turn

maybegintorevealmanynormalindividualswho are honestly oblivious to the situationnowpresentedtothem.

There are fears that there may be peopleout there,targetedfortaxrepayments,whoaregenuinelyunawareoftheconsequencesawaiting them due to selling their secondhome.

Stephen Barratt, private client tax directorat James Cowper has suggested that allindividuals alike, whether they are awareornotawareoftheconsequencestheyfacemust: “seek professional advice becauseit is important that those preparing thecalculations fully understand the complexrules and so ensure that the tax, andthereforeanypenaltyand interest,arekepttoaminimum”.source: arla.co.uk

Chancellor George Osborne delivers Budget Speech –Housing Key Points

Withrecordlowinterestrates,itappearsthatpropertysales in the UK have peaked at their highest in 2.5years.

These figures recently recorded are thought to bea happy consequence of the introduction of thegovernment’s funding for lending scheme (FLS),whichwaslaunchedwiththeprioritisingaimofencouragingbanks to give out more property purchase loans byprovidingthemwithcheapmoney.

TheFLSappearstobeworking,followingrecentreportsthatUKpropertysalesarenowattheirhighest.

However, this increase in purchasing property has innowaybeen influencedbyanydecrease inpropertyprices. In fact,Nationwide recently reported that theaveragepriceofpropertyhadactuallyroseby0.2%inFebruary,andinadditiontothis,madeFebruarythe5thmonthinarowtoseenodecreasesatallinthepriceofproperty.

Instead, it has been alternatively suggested that theincreaseinpropertypurchaseshasfundamentallyarisenbecause of the recent ready availability of mortgagefinanceschemes,includingtheGovernment’sFLS.

However,even though ithasbeenreported that thereseemstobeaboostinconsumerspurchasingproperty,thepropertysalesmarket isstill runningwelldownonitspre-crisisnorm.

‘Threadneedle Street’ (who launched the FLS lastAugust)concludedthattheybelievethefiguresreportedrecently, are simply a result of the availability of FLSmakingfinanceformortgageseasier toobtain,whichhas in turn resulted inasteady incline in thepropertysalesmarkets’purchasefigures.

Home-buyer boost as property sales reach highest levelsin 2.5 years

CommentingontheBudget,andtheannouncementstherein,NAEAManagingDirectorMarkHaywardsaid:“Any news about attempts being made to improve the property market can only be a good thing”

• Theintroductionofanewhousingscheme,HelptoBuy,withtwokeyelements,whichwillprovide£3.5billionofcapitalspending.

• Thefirstpartisanequityloanof20%ofahome’svaluewhichwillbeofferedtopeoplelookingtomoveupthehousingladder.Thiswillonlyavailabletobuyersofanewlybuilthomeandthehomecannotbeworthmorethan£600,000pounds.

• £130billionofguaranteesforlenderswhooffermortgagestopeoplewithadepositofbetween5%and20%onhomeswithavalueofupto£600,000,fromthestartof2014.

• DoublingtheexistingAffordableHomesGuaranteeprogramme,tosupport£15,000moreaffordablehomesby2015.

• ExtendingtheBuildtoRentfundto£1billiontosupportthedevelopmentofnewhomes.

• ExtendRighttoBuy.

• Publish“significantlyreduced”planningguidancebySummer2013,inlinewithLordTaylor’srecommendations.
