Sierra Vista City Council Meeting Minutes October 24, 2019

Mayor Mueller called the October 24, 2019 Regular Meeting to order at 5:00 p.m., City Hall Council Chambers, 1011 N. Coronado Drive, Sierra Vista, Arizona. Pledge of Allegiance – Council Member Umphrey led the Pledge of Allegiance. Item 1 Acceptance of the Agenda Council Member Benning moved that the Agenda for the Regular City Council Meeting of October 24, 2019 be approved as written. Mayor Pro Tem Gray seconded the motion. The motion passed by a unanimous vote of Mayor Mueller, Mayor Pro Tem Gray, Council Members Benning, Calhoun, Pacheco, Umphrey and Wolfe. Awards and Presentations The Mayor and Council presented a Proclamation declaring October as Fire Prevention Month to Fire Chief Jones. Fire Chief Jones stated, “Not every hero wears a cape, plan and practice your escape.” He added that in a residential fire it takes about one or two minutes for the average family to get out of a home and that is when the smoke detectors go off. The Fire Department wants individuals to plan and practice an escape plan out of their home, choose a safe place to meet and test their smoke detectors because those items will assist if ever, they have a home fire.

Mayor Mueller added that everyone should be checking the batteries in their smoke detectors. City Manager’s Report: Mr. Potucek announced the next regularly scheduled Council Work Session is scheduled for November 12, 2019 at 3:00 p.m. in the Council Chambers and the next regularly scheduled Council Meeting is scheduled for November 14, 2019 at 5:00 p.m. also in Council Chambers. He reminded everyone that there will not be a Council Work Session nor Council Meeting the week of November 25, 2019 due to the Thanksgiving Holiday. He reported that the that the Community Development Block Grant-funded old Public Works’ yard demolition will begin on October 25, 2019. The Airport Heli-Pad Erosion Repairs Project bids will be opened on October 30, 2019 at noon. The Avenida Escuela Extension Improvements Project bids, bridge over the wash to connect the Walmart area with the Domingo Paiz Project, will be opened on October 25, 2019. Item 2 Resolution 2019-075, Approval of the Modifications to Refuse Services and Fee Schedule - Tabled Item Mayor Mueller asked for a motion to take from the table Item 2, Resolution 2019-075. There was no response. Public Hearings Item 3 Ordinance 2019-006, Request for Rezoning for 700 N. Carmichael Avenue from NC to SFR-8 Mayor Pro Tem Gray moved that Ordinance 2019-006, a request for rezoning for 700 N. Carmichael Avenue from NC to SFR-8, be approved. Council Member Benning seconded the motion. Mr. Pregler stated that this is a rezoning request at 700 North Carmichael Avenue located at the northwest corner of North Carmichael and West Tacoma Street with Len Robert’s Park located directly east of the property. The rezoning is requested to go from Neighborhood Convenience, which allows for low impact commercial development, i.e., small retail, small restaurant, to a Single Family Residential Eight that allows for single family residential dwellings. Lot sizes must be at least a minimum of 8,000 square feet and in this case the lot is approximately 8,100 square feet; therefore, meeting the lot size requirement for the zoning district. The applicant is proposing to repurpose an existing commercial building for a residential use for a home. The rezoning would be consistent with the surrounding zoning and land use as the property is surrounded by residential on the north, west and south with Carmichael School and Len Robert’s Park to the east. In looking at the ability to serve, North Carmichael Avenue and Tacoma Street are designated as local residential streets. North Carmichael has an average daily trip rate of over 1,500 vehicles and Tacoma Street has an average daily trip rate of 888 vehicles per day. The typical single-family residence generates 10 average daily trips in a typical day; therefore, there will be no significant vehicle impacts on the roadways. Staff also looked at whether the rezoning would be compatible with the surrounding area and it is. If this property were to be developed as commercial development, there would be numerous constraints, i.e., meeting setback requirements, buffers, parking and there would also be a negative impact that the commercial

would have on the adjacent residences. The highest and best use and most compatible use would be the residential zoning. Lastly, staff looked at consistency with the General Plan that designates a land use designation as Medium City Residential for the property. The Single-Family Residential is classified as a Medium Density Residential Land Use. The applicant held a neighborhood meeting on September 21, 2019 where eight members of the public were in attendance. There was one concern about the home becoming a halfway house/group home, but the applicant has indicated that this would not be the case. It will remain as a residential use. The Planning and Zoning Commission considered this request on October 15, 2019 and unanimously approved the rezoning request. There were no members of the public in attendance. Staff did notify all property owners within 500 feet of the property and to date there has not been any public comments. Mr. Pregler noted that the applicants, Jennifer and John Wisniewski are in attendance. Council Member Umphrey stated that she would be abstaining from voting on the rezoning because the rezoning is in her neighborhood. The motion passed by a unanimous vote of Mayor Mueller, Mayor Pro Tem Gray, Council Members Benning, Calhoun, Pacheco and Wolfe. Council Member Umphrey abstained. Item 4 Resolution 2019-085, Declaring a 30-day Public Record Proposed Development Code Amendments-Accessory Dwelling Units, Section 151.02.004-Definitions, Section 151.06.010-Accessory Dwelling Units and Section 151.22.006-Matrix of Use Permissions by Zoning District Council Member Umphrey moved that Resolution 2019-085, proposed Development Code amendments to Accessory Dwelling Units, Section 151.02.004 - Definitions, Section 151.06.010 - Accessory Dwelling Units and Section 151.22.006 - Matrix of Use Permissions by Zoning District and to declaring a 30-day public record, be approved. Council Member Wolfe seconded the motion. Mr. McLachlan stated that the essential proposal before Council would make accessory dwelling units, whether they are detached or integrated into the main house as an addition, a permitted use across all residential zoning districts subject to certain use restrictions and design developments. This is relatively common in the neighborhoods built in the early part of the last century located along the back alleys in major cities. They are relatively rare in single use suburban type settings like Sierra Vista. Those that are built are less conspicuous often sited on larger lots tucked behind landscaping, fencing and walls. Due to the newer urbanism movement, they gained momentum in the early 1990s and accessory dwelling units were reintroduced as key traditional neighborhood designs. At the same time, they were talked about in smart grid handbooks as a low impact form of infill development. They also showed up in affordable housing strategies, particularly in large metro areas. They are touted to allow seniors to age in place and avoid entering long term care facilities. They can also be an investment opportunity and source of extra income for homeowners who want to give up a portion of their house or yard for an accessory dwelling unit.

Mr. McLachlan stated that he interprets the City’s General Plan Vista 2030, which espouses promoting quality of affordable rental housing by encouraging new regulations and incentives to permit accessory dwellings, to mean making the permitting process easier for this type of use. Staff understands that the tightening supply of affordable housing in the community is going to require more than accessory dwelling uses to address this as one prong of a larger strategy. He further stated that he spoke with a Planning and Zoning Commissioner, who felt strongly about retaining the Conditional Use Process. The Commissioner was not aware of the goal in the General Plan and agrees that the work needs to be guided by the voter-approved General Plan and is now ok with the administrative permit procedure being put in place; however, he does believe that the ordinance should prohibit separate addresses and water/utility meters. In his view, any visual evidence such as two mailboxes on a property will erode the single-family character of the district as two addresses signify multi-family. The Department proposed this restriction in an earlier version of the draft, but it was deleted because it seemed like over regulation, not thinking that the Planning and Zoning Commission recommendation was going to hang in the balance. Staff has no objection if the Council wants to restore this provision, which would be adding a Number Eight under Subsection G, Development Standards, stating that a separate address, water or utility meters shall not be provided. Mr. McLachlan stated that after the Council Work Session, he spoke to the City Attorney, who confirmed that if Council votes to amend the resolution to add the provision and include it in the 30-day review record, Council would not need to extend the public comments period. If Council chooses to add it later, it would be considered a substantial amendment by virtue of the ordinance becoming more restrictive. Staff maintains its recommendation that the administrative permitting process stay intact with the proposal. This is consistent with prior City Council Strategic Plan guidance of removing unnecessary red tape and regulatory burdens on applicants. The proposed use restrictions design a location requirement that is adequate to ensure the neighborhood character is maintained. Notification would be provided to adjacent owners, no less than 30 days from a building permit being issued providing that the application information on the standards and the procedure for providing comments back to the City. The requested action is to approve Resolution 2019-085, declaring a 30-day public record on the proposed text amendments following staff’s recommendation. If the Council wishes to add a provision stating a separate address, water or utility meters shall not be provided, then Council would need to provide that in a motion. Council Member Wolfe asked if Council is voting on the resolution stating that it would be up to the parcel owner, when they put in the accessory dwelling, whether they want a separate address. Mr. McLachlan stated that she is correct in that is staff’s recommendation. Council Member Calhoun asked for clarification with regards to driveways. Mr. McLachlan stated that driveways were mentioned in the original version that was rescinded. The focus in the Planning and Zoning Commission’s recommendation was placed on multiple addresses and utility meters on a single-family site. The accessory dwellings are going to share access with the main house and there are driveway separation requirements that would need to be followed. They would need enough width to have a second driveway and not all lots are going to meet that standard. This would be case by case whether they could do a semi-circular or second driveway. Council Member Calhoun stated that it seems to her that an extra driveway would take away from maintaining the single-family appearance of the neighborhood. Mr. McLachlan stated that these are ideal situations on yards with alley access and the City has neighborhoods that have

those. These are built for family members, who may not have their own personal automobile and may be elderly or visiting guests. Not all cases will need additional parking on the property.

Council Member Pacheco asked if the Council is voting on opening the public comment for 30 days without the provision of separate addresses. Mayor Pro Tem Gray stated that this is for the staff’s recommendation that allows for a separate street address.

The motion passed by a unanimous vote of Mayor Mueller, Mayor Pro Tem Gray, Council Members Benning, Calhoun, Pacheco, Umphrey and Wolfe.

New Business

Item 5 Approval of the City Council Regular Meeting Minutes of October 10, 2019

Council Member Benning moved that the City Council Regular Meeting Minutes of October 10, 2019, be approved as written. Mayor Pro Tem Gray seconded the motion. The motion passed by a unanimous vote of Mayor Mueller, Mayor Pro Tem Gray, Council Members Benning, Calhoun, Pacheco, Umphrey and Wolfe.

Item 6 Resolution 2019-086, Approval of an Intergovernmental Agreement between the City of Sierra Vista and Cochise County for the establishment of a 700 MHz Simulcast Repeater at 100 North Avenue

Council Member Wolfe moved that Resolution 2019-086, an Intergovernmental Agreement between the City of Sierra Vista and Cochise County for the establishment of a 700 MHz Simulcast Repeater at 100 North Avenue, be approved. Mayor Pro Tem Gray seconded the motion.

Commander Hiser stated that this intergovernmental agreement is an enhancement to the Regional Public Safety Communications System. The addition of a 700 MHz Simulcast Repeater has been needed as the City turned over to a 700 MHz trunking system for public safety communications in 2017 as their primary channel. However, it was noticed that there were some pockets on the West End of town where the City was not getting the reception and being able to communicate that was causing officers to have to transition back to the older VHF frequency. This causes operational issues, both in Dispatch at SEACOM and out on the field.

In working closely with the Cochise County Sherriff’s Office, Commander Tom Alinen determined that the best course of action to fix this and also strengthen the 700 MHz System was to add a 700 MHz Simulcast Repeater to the tower located at 100 North Avenue, owned by the City. Essentially, Commander Alinen sought and successfully received funding through an Operations Stone Garden Grant to completely fund this project in the amount of $617,000.

The purpose of the intergovernmental agreement is to formalize the agreement with Cochise County to allow them to purchase and install the 700 MHz Simulcast Repeater on the City-owned tower at 100 North Avenue. This will also allow them continued access to the property for maintenance, a site visit about every two months. The Police Department feels that this is going to be a good addition to the ability to serve the community as police officers, public safety officials and in moving one step further toward a strong public safety communications network because they want to eventually expand out to have statewide communications.

Council Member Wolfe asked about the cost to the City. Commander Hiser stated that there will be no cost to the City.

Council Member Pacheco thanked the County Sheriff’s Office and the Sierra Vista Police Department for their work on the grant for the upgrade to the radio equipment that is much needed.

Council Member Benning stated that he will be recusing himself due to a potential conflict of interest as he is employed by Cochise County.

The motion passed by a unanimous vote of Mayor Mueller, Mayor Pro Tem Gray, Council Members Calhoun, Pacheco, Umphrey and Wolfe. Council Member Benning abstained.

Call to the Public

Zina Justiniano spoke about a gasification system, an option to avoid a change in refuse fees and turn trash into cash. She added that this gasification system can process 20 tons of garbage per day. Each ton of garbage that is processed will change one ton of garbage into one barrel, 55 gallons of synthetic diesel. She added that she has spoken to the County’s Waste Manager, who stated that the County produces more than that but that it might be enough for the City of Sierra Vista. If the City does not want to handle this, it may be possible for the County to do it at a smaller level and prioritize garbage, i.e., medical waste, biohazardous waste so that they can get the 20 ton daily limit at seven days a week and also take stuff out of the landfill. She further stated that at $2.50 a gallon for diesel, it would take approximately 272 days to pay off the $750,000 system and it would not require a bond. Funds could be transferred from the fuel cost to the other cost. This system takes 12 to 18 months to come in and it mans a crew of nine people per shift.

Amy Carter stated that she serves as an Associate Member on the Environmental Affairs Commission and the Commission on Disability Issues. She further stated that she is concerned with the proposed changes to the commissions and requested for an article, editorial, various forms of social media be put into place so that the citizens may know about the history of how the Council came to its determination. Lastly, she stated that environmental issues and sustainability issues will go by the wayside if the commissions are dissolved. Paper recycling has been lost and since Malaysia is no longer taking plastic, things will have to changed.

Mayor Mueller announced that at the urging of Council, the Council Work Session of November 12, 2019 will provide for comments by the commissioners before the Council starts its deliberation.

Liz Thomey spoke about the volunteer income tax assistance program that does volunteer tax preparations for low-income families at the Good Will and Work Force Development sites. She reported that last year the organization did 442 returns, bringing back approximately $575,000 in refunds of which $540,000 stayed within the local community. ARP is the biggest income tax assistance program for seniors and SECAP, through its employees, also provides income tax assistance. She added that only six percent of those who are eligible for the free tax services take advantage of it and the average income of the families that they serve is less than $25,000. Lastly, she requested that the City take a more active involvement in helping to get the word out about the program.

Comments and Requests of the Council Council Member Umphrey thanked the three individuals who spoke to the Call to the Public on informative topics. Council Member Benning thanked Corporal Scott Borgstadt of the Sierra Vista Police Department for his work on a grant for new vin etching machine. He added that a lot of people do not know that windows are the number one item that are sold from vehicles when stolen. Vin etching every window helps to prevent cars from being stolen. Last year there were 19,000 cars that were stolen in the State of Arizona. He further stated that he likes the phrase, “not every hero wears a cape.” And noted that this hero could be a teacher, Police Chief or the Fire Chief. Lastly, he thanked Fire Chief Jones, encouraged people to practice their escape plans and thanked the public that came out to the Council Meeting to speak to Council. Council Member Wolfe shared that the Fire Department will come out and help replace the batteries in the smoke detectors, especially if they are in places that cannot be reached. She also shared that she had a tremendous act of kindness bestowed upon her by an individual with the Texas Roadhouse, who presented her with rolls and butter. She thanked that individual publicly and reminded everyone to be kind. In closing, she stated that Halloween is forthcoming and little ones are going to be out; therefore, she encouraged people to drive slower and to be sure to be safe. She further stated that there are older kids out there as well that are still little in some ways who should be given candy. Lastly, she suggested mandating costumes for Halloween at City Hall. Council Member Pacheco mentioned that November 2, 2019 is Young Eagles Day at the Sierra Vista Airport and encouraged families to take their kids out for a free airplane ride by a local pilot to witness the City from the sky. She also mentioned that October 24, 2019 is Wear Purple Day in recognition of Domestic Violence Awareness Day and although, the Council had a proclamation and comments about Domestic Violence Awareness Month at the last Council Meeting, she feels that the importance of this issue and the fact that the Council Meeting happens to fall on this day bears speaking on it again. Council Member Pacheco reported that while one in four women and one and seven men in the United States are going to experience intimate partner violence in their lifetime. In Arizona that statistic is one in three women, which is higher than in the nation. She added that last week the Council heard from a group called the Fatality Review Board that is in the community that reviews fatalities related to domestic violence that occur in the City. Amongst other tasks they identify areas where agencies, who may have interacted with the case, could have improved their response to situations and hopefully prevent future incidents/fatalities. Lastly, she noted that Commander Hiser spoke at last year’s Domestic Violence Vigil. He stated that the Sierra Vista Police Department alone responds to an average of three calls every day related to domestic violence in the City. These tend to be more volatile situations and more dangerous for the City’s officers. This group really advocates for domestic violence awareness, who do well in providing education to the community as this issue is so pervasive and prevalent in the community that it can’t be left to the agencies to do it alone. In closing, Council Member Pacheco encouraged everyone to take a stand, speak out and support survivors to end domestic violence in the community. Council Member Calhoun echoed Council Member Pacheco’s comments and noted that a way to be there for people can be through a smile or hand out, which can make a difference so that

they know that someone is there and cares. She thanked Zina Justiniano, Amy Carter and Liz Thomey for speaking to Council and noted that the Council cares about these issues in the community. Council will do what they can to assist with those issues brought before them. She then reported on her attendance at the Census 2020 Meeting and noted that the City is involved in putting together a team to help educate the community and raise awareness on the importance of the Census. Lastly, she stated that in Arizona there are 57,000 part time jobs available with Census 2020. Mayor Mueller noted the importance of the Census for the Complete Count Committee, which will be active going forward. Mayor Pro Tem Gray announced the upcoming Trunk or Treat Halloween Event at Veteran’s Memorial Park from 5:00 p.m. until 8:00 p.m. where Council Member Benning will be judging the costume contest at 6:00 p.m. Mayor Mueller thanked everyone for celebrating the National Cities and Towns Week, announced that the hospital is sponsoring a kick ball tournament called the Pumpkin Punt on Saturday, October 26, 2019 from 9:00 a.m. until 11:00 a.m., the Historical Society’s event at the Ethel Berger Center at 1:00 p.m. at the Museum to help explain the history of the 100th anniversary of the Fry Cemetery and the Buffalo Soldiers Association’s event on Saturday, October 26, 2019 at 5:30 p.m. at the Thunder Mountain Activity Center on Fort Huachuca. He also announced upcoming Veterans’ Day celebrations on November 11, 2019. Lastly, he cautioned the public to watch out for the children on Halloween Night and encouraged attendance at the events at Veterans’ Memorial Park and at Len Robert’s Park. Adjournment Mayor Mueller adjourned the October 24, 2019 meeting of the Sierra Vista City Council at 5:49 p.m.

On October 14, 2019, the West End Commission unanimously voted to recommend the reappointment of Father Gregory P. Adolf, Michele Cotton, Joe C. Ford, and the appointment of Michele Mccollum to the West End Commission, with said terms to commence on January 1, 2020 and expire on December 31, 2021.

BACKGROUND:

The West End Commission has four members with terms expiring at the end of this year. Rosie Mackey is completing her third consecutive two-year term on the West End Commission and is not eligible for reappointment to the West End Commission for one year. She has indicated her interest in continuing her service as an Associate Member. Current members Father Gregory P. Adolf, Michele Cotton, and Joe C. Ford are eligible and interested in being reappointed for another two-year term. The City Clerk has received one additional application from Michele McCollum who wishes to serve on the West End Commission.

Background:

Staff is proposing adjustments to refuse services and associated fees to meet the financial needs of the Refuse Enterprise Fund. Currently, the revenues generated by the residential dumpster rental program, special pick-ups, and compost programs and services are not sufficient to offset the costs of providing the services. Changes are being proposed to “Table A – Sanitation Charges” in order to improve the financial sustainability of the programs and the Refuse Enterprise Fund overall.

In addition, some redundant services are being eliminated. For example, the City is currently offering 2.5, 3, 4, 6, and 8 cubic yard dumpsters. Reducing the number of size options isn’t expected to have a significant impact on customers but will simplify billing and inventory management for the City.

RESOLUTION 2019-075

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SIERRA VISTA, COCHISE COUNTY, ARIZONA; REAFFIRMING SETTLED POLICY; ESTABLISHING REFUSE CHARGES; AND AUTHORIZING AND DIRECTING THE CITY MANAGER, CITY CLERK, CITY ATTORNEY OR THEIR DULY AUTHORIZED OFFICERS AND AGENTS TO TAKE ALL STEPS NECESSARY TO CARRY OUT THE PURPOSES AND INTENT OF THIS RESOLUTION.

WHEREAS, the City of Sierra Vista has determined that the refuse services provided by the City should be operated as an enterprise of the City; and

WHEREAS, refuse services must be fully and independently funded by the users of the services; and

WHEREAS, the capital and operational costs to provide services continues to increase; and

WHEREAS, staff has calculated the charges and fees which are needed to improve cost recovery within the Refuse Enterprise Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SIERRA VISTA, ARIZONA, AS FOLLOWS:

SECTION 1

That the settled policy of the City Council, of adjusting refuse charges and fees to generate the revenue required to meet the financial needs of the Refuse Enterprise Fund be, and hereby is, reaffirmed.

SECTION 2

That charges shall be assessed and collected in accordance with “Table A – Sanitation Charges.”

SECTION 3

That the City Manager, City Clerk, City Attorney, or their duly authorized officers and agents are hereby authorized and directed to take all steps necessary to carry out the purposes and intent of this Resolution.

Message Body:Since the blue bin recycle service in Sierra Vista ended, there has been a green bin trash pickup twice a week(Tuesday and Friday) on my street. I think one trash pickup a week as we had for years will suffice and savemoney.. It would help if the City had a campaign to encourage the public to think about the accumulation of trash intheir residence and try to reduce it in light of the detriment it is to our community, the environment, and the planet.

APPLICANT: City of Sierra Vista 30-DAY PUBLIC COMMENT PERIOD The Mayor and City Council approved a 30-day public comment period for the proposed text amendments on October 10, 2019, with Resolution 2019-083. The Council stated at the meeting that they had concerns relating to the code amendments for Development Code Section 151.06.004, Home Based Business. During the initial discussions with Council, staff indicated that the purpose of the amendments was to reduce the secondary effects of residential auto repair such as the parking of numerous vehicles on the property. The Council generally cited three objections related to the code amendments. First, that the amendments were over regulatory because property maintenance codes sufficiently addressed the parking of vehicles on residential properties. Second, that the allowable number of vehicles

to be sold on the property, which was limited to no more than one vehicle was arbitrary. Third, that enforcement was discretionary and subjective. After considering Council's concerns, staff is recommending that the proposed amendments to the Home Based Business section of the Development Code be removed from Council consideration and that there be no changes to the section. Staff is proposing to address potential secondary effects of Home Based Businesses through the administrative application process. The application will request that the applicant provide the scope of the business and how they will ensure that the residential character of the neighborhood will not be impacted. This will place the responsibility of proof on the applicant and allow staff to make a more informed decision on the impacts on the business. This application process will not require additional regulatory standards or processes and will be reviewed within the existing application process. The City has not received any additional public comments during the 30-day public comment period. The attached Ordinance reflects the removal of the Home Based Business code amendments and only includes the amendments to Section 151.04.004, Dumping or Disposal of Rubbish and Article 151.10, Sign Regulations, which will be the only amendments considered. BACKGROUND: The Planning & Zoning Commission, in working with Staff on its Annual Work Program prioritized the processing of Development Code amendments. The two amendments discussed in this memo were ranked as the highest priority because many of them are considered minor revisions and as such does not require lengthy research and analysis. The two Development Code amendments relate to the following Sections and Articles: 1) Section 151.04.004, Dumping or Disposal of Rubbish 2) Article 151.10, Sign Regulations The Planning and Zoning Commission held a work session on the proposed amendments on September 3, 2019. The Commission unanimously approved the amendments 5-0 at their September 17, 2019 meeting. There were no additional comments regarding these amendments. ANALYSIS Article 151.04, Supplementary District Regulations. Removal of obsolete and duplicative language. Specifically, Section 151.04.004, Dumping or Disposal of Rubbish, which prohibits the dumping and disposal of debris, garbage, industrial wastes, etc., is already addressed in the Building and Property Maintenance Codes. Therefore, the amendment is to remove this entire Section. Article 151.10, Sign Regulations Current language in this Article requires that the sign panels inserted within a multi-tenant or shopping center free-standing sign be a minimum of nine square feet. The original intent of this

requirement was to make the panels and lettering large enough to be easily seen by drivers, thus decreasing the amount of time that the driver is not focused on the roadway. The maximum sign face of a multi-tenant or shopping center sign is 75 square feet. The concern is that the minimum panel size requirement potentially limits the number of panels that can be inserted into the sign, ultimately prohibiting some businesses in the building or shopping center from advertising on the sign. The proposed amendment would eliminate the minimum panel size requirement, thus allowing additional sign panel flexibility.

requirement shall apply to any sign required to obtain a sign permit.

commercial or industrial zoning districts shall be 32 square feet for each side of the sign.

2. Height and Clearance

a. The maximum height shall not exceed 15 feet on properties fronting State Route

90, State Route 92, and Fry Boulevard east of Coronado Drive.

b. The maximum height shall not exceed 10 feet when located in all other locations not described in subsection a above.

a. Freestanding signs for a single business in commercial or industrial zoning

districts shall be limited to one multi-faced freestanding sign identifying the business, designating the principal goods or products, and facilities or services available on the premises. One additional freestanding sign may be erected on a single street frontage of 450-599 linear feet, two additional signs for 600-749 linear feet, or three additional signs for 750 linear feet or greater. For a lot sharing more than one street frontage, each street frontage will be calculated separately.

b. There shall be at least 100 linear feet separating each sign.

c. The property owner can choose to construct fewer signs than allowed in order to

increase sign height. Each allowed sign omitted may add 2 feet in height to another sign.

5. Sign Illumination

a. Internally illuminated signs shall not have white backgrounds. This requirement

shall apply to any sign required to obtain a sign permit.

b. Signs may have external illumination provided the lights are fully shielded and the fixtures are aimed directly at the sign.

c. Vacant sign faces shall have a completely dark or opaque background.

6. Pole Cover. For all new pole sign structures, the sign structure must be equipped

with pole covers or architectural embellishments that hide or conceal all structural components or braces (such as pipes, angles, irons, cables, internal back framing, bracing, etc.). Exceptions can be made if the uncovered poles are part of the overall site architecture.

7. Landscaping. All new sign structures associated with a site plan shall be

constructed within a landscaped area or island. B. Wall Signs for a Single Business in Commercial or Industrial Zoning Districts

1. Area. The total area for wall signs for a single business in commercial or

3. Maximum Square Footage for Multiple Frontages. On buildings that have more than one building frontage, each frontage can be used to calculate the overall signage square footage.

4. Transferability of Wall Signage. Wall signs for a single business in commercial or

industrial zoning districts can be transferred, in whole or in part, to any building wall provided the aggregate area does not exceed the total allowed signage area.

5. Awning or Canopy Signs. The gross surface area of an awning or canopy sign

shall not exceed 50 percent of the gross surface area of the largest face of the awning or canopy to which the sign is affixed. The total area of an awning or canopy sign shall be included as part of the total wall signage.

C. Freestanding Signs for a Multi-Tenant Building in Commercial or Industrial Zoning Districts

1. Area. The total sign area of a freestanding sign for a multi-tenant building in

commercial or industrial zoning districts shall be 75 square feet of which at least 15 percent shall be dedicated to the building identification. Changeable directory panels identifying the tenants in the building can be used provided each panel is a minimum of 9 square feet. The sign shall use materials that blend architecturally with the building.

2. Height and Clearance. Signs shall not extend above the roofline or the top of a

parapet wall.

3. Transferability of Wall Signage. All signs for tenants in multi-tenant buildings within a center, park, or commercial or industrial subdivision may not be transferred. Signs must be placed on the building in which the business or use is located.

4. Awning or Canopy Signs. The gross surface area of an awning or canopy sign

shall not exceed 50 percent of the gross surface area of the largest face of the awning or canopy to which the sign is affixed. The total area of an awning or canopy sign shall be included as part of the total wall signage.

G. Directional Signs

1. Area. The total sign area shall not exceed 3 square feet.

Section 151.10.009 Height Reduction of Legal Nonconforming Freestanding Signs

The following process is provided as an incentive to reduce the height of (currently classified) legal nonconforming freestanding signs.

(For a definition of legal nonconforming signs and non-legal nonconforming signs, please see Section 151.24.002.E of the Development Code.)

A. Incentives to Reduce the Height of Legal Nonconforming Freestanding Signs

1. The incentive to reduce the height of currently classified legal nonconforming

freestanding signs is to allow wall signage to be 2 square feet per linear foot of building frontage or 2 square feet per each 5 linear feet of lot frontage. Other than the allowances for total sign area, all other wall signage requirements are applicable. In order to receive this increase in total sign area, the following changes must be made:

a. All legal nonconforming freestanding signs on a site must be reduced to a

maximum of 10 feet high.

b. Freestanding signs must have pole covers attached to the bottom of the sign unless the uncovered poles are part of the overall site architecture.

Section 151.10.010 Non-Legal Nonconforming Freestanding Signs

Current signs that are classified as non-legal nonconforming freestanding signs, as defined in Section 151.24.002.E, must be brought into conformance or removed from

the premises. However as an alternative to removing the sign, the total sign area can remain at its current size provided the height of the sign is reduced to a maximum of 10 feet high when measured from the adjoining street pavement. Other sign regulations (other than size and height) apply.

Section 151.10.011 Special Use Permits

A Special Use Permit is used to request variations to this Article so that there can be increases in and a cohesive theme between all signage that are placed at a center, park, or associated subdivision. To obtain a Special Use Permit, the applicant must demonstrate the need for the additional signage and identify the architectural elements. Since the City will be making an exception to its code, it will be looking to the applicant to make the sign and building architectural elements as aesthetically pleasing as possible.

A Special Use Permit can be obtained for (1) new and existing residential or commercial subdivisions or (2) new and existing shopping centers or industrial parks. Special Use Permits cannot be used for a single business on a single lot. The Special Use Permit process cannot be used to exceed the standards for the electronic or digital display portion of signs. The process for a Special Use Permit requires the Permit to be recommended by the Commission and approved by the Council. The meeting notifications are given to the community through a published notice and posting on the property 15 days before the hearing. Any appeals of the Commission or Council decision will go to the Hearing Officer under the provisions of Article

151.30, Appeals and Variances.

A. Comprehensive Sign Plan. To receive a comprehensive sign plan special use permit, the applicant must address (1) the need for additional signage and (2) how the signs will architecturally blend with the buildings. Additional information to be included in the application will be the size, location, height, lighting, construction materials, and orientation of all proposed signs in addition to any other information deemed necessary by the City. The sign areas and densities requested must conform to the intent of this Article.

B. Special Sign District. As an exception to the subdivision, center, or park special use permit limitations, the owners of 60 percent or more of the street frontage, in linear feet, on both sides of the street in any defined area, may petition the City for the formation of a special sign district for the purpose of creating an integrated special sign theme in the area.

Section 151.10.012 Street Address in Signs

When street addresses are placed on any freestanding signs in commercial or industrial zoning districts, the numbers shall be at least 6 inches high and clearly legible from the street. Section 151.10.013 Removal of Certain Signs

On or after the effective date of this code, any signs that no longer advertise a legitimate business or product sold at the location, shall be removed by the owner, agent, or person having the beneficial use of the building or property on which the signs are located. The signs shall be removed within ten days after receiving written notification from the City. If the signs are not removed within the time specified in the letter, the Director of Community Development is authorized to remove the signs at the expense of the owner of the building or property on which the signs are located.

Authorizing the City of Sierra Vista on behalf of the Upper San Pedro Partnership to submit a Web Portal Grant Application through a WaterSMART Applied Science Grant with the Department of Interior, Bureau of Reclamation (BOR)

Recommendation: The City Manager recommends approval. The Assistant City Manager recommends approval. Background: The Sierra Vista Subwatershed groundwater-basin is the sole source of water for the communities throughout the Upper San Pedro Basin, as well as, Fort Huachuca. The mission of the Upper San Pedro Partnership (USPP) is to “ensure an adequate long-term groundwater supply is available to meet the reasonable needs of both the area’s residents and property owners (current and future) and the San Pedro Riparian National Conservation Area (SPRNCA)”. The City of Sierra Vista, acting as fiscal agent and on behalf of the USPP, submitted a proposal for a Web-based Hydrological Information Portal (WHIP) for Upper San Pedro Basin data to the U.S. Bureau of Reclamation (BOR) WaterSMART Applied Science grant program. The Web-based Hydrologic Information Portal-Upper San Pedro Basin (WHIP) is an interactive web-and geo-based tool with three main functions:

1. provide readily accessible, geospatially accessed, hydrologic information synthesized from raw hydrologic data sets to water managers, decision-makers, and the public

2. provide data visualization tools to view single data sets, side-by-side dataset comparisons, data overlays, and basic statistical analyses

3. ensure ready and timely availability of data via a report-out template The goal of WHIP is to improve groundwater management by providing water decision-makers with understandable and useful hydrologic information that is fully and easily accessible.

RESOLUTION 2019-091

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SIERRA VISTA, COCHISE COUNTY, ARIZONA; AUTHORIZING THE CITY OF SIERRA VISTA ON BEHALF OF THE UPPER SAN PEDRO PARTNERSHIP TO SUBMIT A WEB PORTAL GRANT APPLICATION THROUGH A WATERSMART APPLIED SCIENCE GRANT WITH THE DEPARTMENT OF THE INTERIOR, BUREAU OF RECLAMATION (BOR); AND AUTHORIZING AND DIRECTING THE CITY MANAGER, CITY CLERK, CITY ATTORNEY OR THEIR DULY AUTHORIZED OFFICERS AND AGENTS TO TAKE ALL STEPS NECESSARY TO CARRY OUT THE PURPOSES AND INTENT OF THIS RESOLUTION. WHEREAS, the Department of the Interior, Bureau of Reclamation has been

authorized to provide funding to develop hydrologic information and water management tools and improve modeling and forecasting capabilities under the authority of Section 9509 (Research Agreement Authority) of the Science and Engineering to Comprehensively Understand and Responsibly Enhance (SECURE) Water Act, Subtitle F of Title IX of the Omnibus Public Land Management Act of 2009, Public Law (P.L.) 111-11 (42 United States Code (U.S.C.) 10364), as amended with a funding opportunity number BOR-DO-19-F012; and

WHEREAS, grants or cooperative agreements for Federal financial assistance will impose certain obligations upon the City of Sierra Vista and may require City of Sierra Vista and other USPP members to provide the non-Federal share of the web-portal project supported with Federal financial assistance; and

WHEREAS, the City of Sierra Vista is legally authorized under Federal, state, or local law to apply for and receive Federal assistance; and

WHEREAS, the City of Sierra Vista is required to comply with certain federal regulations, certifications and assurances to the Bureau of Reclamation.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OR SIERRA VISTA, ARIZONA, AS FOLLOWS: SECTION 1 That the City Manager or his/her designee is authorized to execute and file an application for Federal assistance on behalf of the Upper San Pedro Partnership. SECTION 2 That the City Manager or designee is authorized to execute and file with the Bureau of Reclamation the certifications and assurances and other documents the Bureau of Reclamation requires before awarding a Federal assistance grant or cooperative agreement. SECTION 3 That the City Manager or designee is authorized to execute the grant and cooperative agreements with the Bureau of Reclamation on behalf of the City of Sierra Vista and the Upper San Pedro Partnership. SECTION 4 That the City Manager or designee is authorized to draw payments against available grant funding using the ECHO web system or other Bureau of Reclamation automated application used to request payments from grant awards. SECTION 5

The City Manager, City Clerk, City Attorney, or their duly authorized officers and agents are hereby authorized and directed to take all steps necessary to carry out the purposes and intent of this Resolution.
