DATE: July 18, 2019 RECOMMENDATION THAT the Committee of the Whole recommend to Council that the Wasaga Beach Farmers Market receive approval to accept a vendor to sell alcohol at the Market; AND FURTHER that Council direct the Clerk to provide a letter of endorsement for the Alcohol, Gaming Commission Ontario (AGCO). BACKGROUND The original agreement with the Wasaga Beach Farmers Market was executed on June 15, 2016 when the Town passed By-law No. 2016-114 authorizing the execution of an agreement between the Town of Wasaga Beach and the Wasaga Beach Farmers Market for a land use lease at 130 Main Street, in the Main Street parking lot, to operate a seasonal Farmers Market. Termination of the lease agreement takes place at the end of the 2019 season, with an option to renew for two additional years, if both parties agree. APPENDIX A On February 21, 2017, the lease agreement was amended under By-law 2017-18 and the Town permitted the Market to utilize Town lands known as the Spruce Street parking lot. APPENDIX B On June 25, 2019, Council authorized the Mayor and Clerk to amend the lease agreement between the Town of Wasaga Beach and the Wasaga Beach Farmers Market for a land use lease at the Oakwood Community Centre parking lot to operate a seasonal Farmers Market. APPENDIX C The current agreement provides space at the Oakwood Community Centre parking lot located at 1724 Mosley Street on Tuesdays from 2:00 pm to 9:00 pm, including set-up, take-down and clean-up. The Market is permitted to operate from the Tuesday following Victoria Day weekend until the Tuesday before Thanksgiving weekend in October.

The new location at Oakwood Community Centre lot has already proven to be a successful venue for the vendors. Since opening day on June 11, 2019, vendors have been reporting increased sales as high as 47% for the same time period in 2018. The Wasaga Beach Farmers Market is a non-profit entity that operates solely on funds raised through vendor fees. These fees cover the operating expenses including insurance, marketing and special events. In addition, occasional fundraising provides support for community initiatives. In 2018, the Market provided $500 for the Wasaga Beach Ministerial Foodbank and $1000 for Collingwood General Marine Hospital. A collaboration with Skydive Wasaga Beach and Georgian College raised over $2000 to provide wigs for children facing illness that results in hair loss. Local community volunteer, Marlene Parkins operates the Market along with a volunteer board including residents Anthony Butcher and Laura Lee Gombee. The board works closely with an advisory committee comprised of market vendors. Ms. Parkins, representing the Farmers Market, works as a community volunteer for the events unit and recruits and manages vendors for Town events including Egg-stravaganza, Hootenanny and Snowman Mania. The vendor fees collected at these events are split between the Town and local charities through the Farmers Market. On opening day on June 11, 2019, a cheque was presented to Collingwood General Marine Hospital for $1,000.00 from these funds.

DISCUSSION

The Farmers Market board has refreshed the market with a new brand and tagline “Wasaga Beach Farmers Market – Where Community Comes Together” bringing local vendors, artisans and boutique businesses into the mix. Featuring more artisans allows the promotion of local makers offering products that include woodwork, skin-care products and unique hand-made jewellery. There continues to be an emphasis on food products, produce and baked goods in vendor selection. The Farmers Market board has looked at other examples of markets featuring beer and alcohol sales including the Stayner “Music, Market and Park-It” event happening on Thursday evenings during farmer market season. This market includes a beer garden, music and a classic car show and is a popular and well attended event, attracting people throughout the region. “Jazz and More in the Park” occurs every Tuesday until September 3rd from 7:00 pm to 9:00 pm and the Farmers Market board feels the addition of a “craft beer and spirits” component will attract more consumers and enhance their experience. The existing vendors have been consulted and have no objection to the addition of the proposed craft beer and spirits component. Staff, along with the organizer have met with Chris Roos, Director of Recreation, Events and Facilities who has reviewed the proposal and has no objections providing the Town’s Municipal Alcohol Policy (MAP) and the licensing policy of the AGCO are followed. He has reviewed the site plan to ensure

that no additional impingement of parking occurs and that the green space behind the lot is utilized. Mr. Roos has requested that all MAP paperwork be formally filed with Darlene Pool, Administrative Assistant responsible for booking facilities to ensure that the AGCO regulations have been met. Kevin Lalonde, Director of Public Works has reviewed the site plan and has determined that additional town staff will not be available to assist with set-up and tear down of fencing and barricades. Market staff will be required to provide the fencing and will be responsible for site delineation. Public Works will provide additional garbage and recycling receptacles when needed. CONCLUSION

Staff feels that the Market has great potential beyond economic and business benefits. Market days are becoming time to meet with friends as suggested by the new tagline “Where Community Comes Together”. The addition of a craft beer and spirit component will provide seating to linger while supporting small business and enjoying the beauty of Oakwood Woods Park. This new component will support Council’s tenth priority of “Building pride in the community through effective communication, events and initiatives”.

A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE TOWN OF WASAGA BEACH AND THE WASAGA BEACH FARMERS MARKET ORGANIZING COMMITTEE FOR A LAND USE LEASE

AT 130 MAIN STREET, MAIN STREET PARKING LOT TO OPERATE A SEASONAL FARMERS MARKET

WHEREAS pursuant to section 9 of the Municipal Act, 2001 S.O. 2001, chapter 25 a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act;

AND WHEREAS pursuant to section 8. (1) of the Municipal Act, 2001 S.O. 2001, chapter 25 the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate to enhance the municipality’s ability to respond to municipal issues;

AND WHEREAS the Council of the Corporation of the Town of Wasaga Beach deems it advisable and expedient to enter into an agreement with THE WASAGA BEACH FARMERS MARKET ORGANIZING COMMITTEE to utilize Town lands, known as 130 Main Street, Main Street Parking Lot for the operation of a seasonal farmers market;

NOW THEREFORE this Council of the Corporation of the Town of Wasaga Beach HEREBY ENACTS as follows:

1. THAT the Mayor and Clerk are hereby authorized to execute a LeaseAgreement with THE WASAGA BEACH FARMERS MARKETORGANIZING COMMITTEE to utilize Town lands, known as 130 MainStreet, Main Street Parking Lot for the operation of a seasonal farmersmarket.

2. THAT the Lease Agreement, Schedule “A”, is attached hereto and formingpart of this By-law.

3. THAT the Mayor’s and the Clerk’s authority and direction to execute theabove noted Agreements and Documents extends to any renewalagreements or administrative amendments to the Agreements andDocuments.

2. That the Mayor and Clerk are hereby authorized to execute the said Agreement onbehalf of the Corporation and to affix the Corporate Seal thereto.

3. That the Mayor's and the Clerk's authority and direction to execute the above notedAgreements and Documents extends to any renewal agreements or administrativeamendments to the Agreements and Documents.

AND WHEREAS the Operator wishes to operate the Wasaga Beach Farmers Market out of this area;

NOW THEREFORE this Amendment to the Agreement witnesses that the parties agree here to as follows:

Delete Item (a) under Town's Responsibilities which states the following :

The Town agrees to provide the space at the 130 Main Street Parking Lot as indicated on Appendix "A" to this Agreement for use as a Farmers Market between the hours of 7:00 a.m. and 2:00 p.m. Saturday only, including set-up, take-down and clean-up, from the Victoria Day weekend in May until the Thanksgiving weekend in October .

Replace Item (a) under Town's Responsibilities with the following :

The Town agrees to provide the space at the Spruce Street Parking Lot as indicated in Appendix "A" of the attached Agreement for use as a Farmers Market between the hours of 3:00 pm to 9:00 pm Tuesday only, including set-up, take-down and clean-up, from the Tuesday after Victoria Day weekend in May until the Tuesday after Labour Day weekend in September; and

The Town, at its discretion, reserves the right to adjust the area allocated in the Spruce Street Parking Lot based on the amount of space regularly required by the Main Street Farmers Market.

Delete: Appendix A - 130 Main Street Parking Lot from the Agreement.

Replace: Appendix A - 130 Main Street Parking Lot with Appendix A - Spruce Street Parking Lot attached hereto.
