1. STUDYING   ANGLO-­‐

AMERICAN   LAW   IN   RE-­‐

GENSBURG    

 Legal   education   traditionally  focuses   on   the   national   law   sys-­‐tem.   However,   in   the   modern  globalized   world,   the   traditional  home-­‐centred  approach  does  not  fit  the  needs  of  legal  thinking  any  more.   Lawyers   must   face   the  challenges   of   multi-­‐   and   trans-­‐national  legal  transactions  and  proceedings.   Thus,   legal   educa-­‐tion  has   to   take   into  account   the  growing   importance   of   foreign  legal  systems.      Due  to  the  political  and  economic  influence   of   the   United   States   of  America,   working   knowledge   of  Anglo-­‐American   Law   has   be-­‐come  an  essential  part  of  judicial  skills.   Not   only   the   work   in  transnational   law   firms   and   in-­‐ternational   organisations,   but  also   the   day-­‐to-­‐day   legal   service  of   lawyers   requires   at   least   a  basic   knowledge   of   Anglo-­‐American  Law.    In   addition,   the   active   participa-­‐tion  of   lawyers   in   the  process  of  harmonisation   of   European  Law   requires   at   least   a   funda-­‐mental  understanding  of  the  case  

law-­‐based   methods   of   the   Eng-­‐lish  legal  system.      For  the  sixth  time,  the  Faculty  of  Law   at   Regensburg   University  offers   a   unique   summer   pro-­‐gramme   for   lawyers   and   law  students   interested   in   Anglo-­‐American  Law.      The   courses   are   designed   not  only   to   prepare   those   who   in-­‐tend   to   participate   in   a   LL.M.  programme  in  the  UK  or  U.S.  but  also  to  give  an  insight  into  Anglo-­‐American  Law  for  anyone  whose  work   is   or  will   be   related   to   the  Anglo-­‐American  legal  system.    The   lectures   will   focus   on   an  introduction   to   Civil,   Constitu-­‐tional  and  Criminal  Law  and  will  be   taught   by   well-­‐known   law  professors   from   Oxford   and   Ed-­‐inburgh  University  as  well  as  U.S.  judges  and  lawyers.      Participants   will   profit   from  small  courses  (max.  40  students)  in  one  of  the  most  historic  places  in   Bavaria.   The   case   studies   in  the   afternoons   will   provide   a  comparative  approach  on  specif-­‐ic   topics   of   law.   They   will   be  taught   in   cooperation   between  the   guest   lecturers   and   profes-­‐sors   and   lecturers   from   the   Re-­‐gensburg  Faculty  of  Law.  In  joint

lectures   they   will   present   im-­‐portant   cases   and   their   legal  solutions   both   in   Anglo-­‐American  and  in  German  law.    This   comparative   approach  enhances   the   understanding   of  how  Anglo-­‐American  Law  works  “in   real   life“   as   well   as   the   stu-­‐dents’   abilities   to   work   in   an  intercultural  context.    In   addition   to   the   lectures,   a  presentation   of   LL.M.-­‐studies  abroad   and   of   a   U.S.   criminal  trial  will  be  provided.      Regensburg,   proud   of   its   Celtic  and  Roman  origin  and  the  centu-­‐ry-­‐long   location   of   the   well-­‐known   Perpetual   Imperial   Diet  (“Immerwährender   Reichstag”)  of   the   Holy   Roman   Empire,   has  not   only   been   declared   a   world  

heritage   site,   but   is   also   famous  for   its   cultural   attractions,   its  beer   gardens   and   its   role   as   an  ambassador   between   East   and  West.      German   and   foreign   students  are  strongly  encouraged  to  apply  for  this  summer  programme.  The  University   of   Regensburg   will  carefully   select   the   participants  to   guarantee   excellent   condi-­‐tions.  of  studying.      All   courses   will   be   held   in   Eng-­‐lish.  Knowledge  of  German  is  not  a   requirement.  At   the  end  of   the  programme,   students   will   re-­‐ceive   a   certificate   of   participa-­‐tion.

3. THE  CURRICULUM

The  Regensburg   Summer   School  addresses   law   students,   gradu-­‐ates   and   lawyers   from   countries  whose   legal   systems   are   not  based   on   Anglo-­‐American   legal  culture.   The   Regensburg   Sum-­‐mer   School   is   not   a   language  course   but   will   present   the  methodology   and   the   central  aspects   of   Anglo-­‐American   Law.  As   all   courses   will   be   held   in  English   a   solid   understanding   of  the  English   language   is   an   indis-­‐pensable   condition   for   the   suc-­‐cess   of   your   participation.   Ad-­‐vanced   knowledge   of   the   native  legal   system   will   enhance   the  understanding   of   Anglo-­‐American  Law.  

Although   the   Summer   School   is  open   for   lawyers   at   all   stages   of  their   career,   the   courses   are   an  ideal  preparation  for  those  who  are  planning  a  master  or  doctor-­‐al   programme   in   the   Anglo-­‐American   law  system  or  want   to  prepare   themselves   for   an   in-­‐ternship   or   assignment   in   an  international   law  firm  or  organi-­‐zation.   The   fact   all   lectures   will  be   given   by   speakers  who   come  from  world-­‐leading   faculties  and  

institutions  will  guarantee  a  high  standard  of  quality.  

While   the  Summer  School   focus-­‐es   on   the   general   structure   of  law   and   legal   methods,   detailed  study  of  substantive  law  will  not  be   neglected.   The   main   courses  you   will   attend   in   the   morning  are:  Civil   Law   (in   particular   the  law   of   contracts   and   tort   law),  Constitutional   Law   and   Crimi-­‐nal  Law.    

In  the  afternoon  you  will  partici-­‐pate   in   interactive   case   studies  which   focus   on   the   practice   of  legal   reasoning.   Moreover,   Ger-­‐man   lecturers   will   attend   the  case   studies   in   order   to   make  comparative   references   to   Ger-­‐man  law.    

Upon   successful   completion   of  the   programme,   each   student  will  receive  a  Certificate  of  Par-­‐ticipation.   Law   students   from  the  University  of  Regensburg  will  have  the  opportunity  to  write  an  English  paper  which  replaces  the  obligatory   first   seminar   paper.

8. INSURANCE  Health  Insurance  

Neither   Regensburg   University  nor   the   programme   is   liable   for  accidents   that   occur   on   the  way  to   and   from  Regensburg  Univer-­‐sity  or  for  illness  that  occur  dur-­‐ing  the  programme.  Therefore,   you   will   need   to   be  covered  by  a  Germany-­‐approved  provider   of   health   insurance  during   your   stay.   For   partici-­‐pants   from   countries   of   the   Eu-­‐ropean   Union   and   those   whose  health   insurance   is   valid   in   Ger-­‐many,   it   is   recommended   that  your   EHIC   (European   Health  Insurance  Card)  be  brought  with  you.    

Further   information   can   be   ob-­‐tained   from   your   home   health  insurance  company.      

Accident  Insurance  

Neither   Regensburg   University  nor   the   programme   is   liable   for  accidents   that   occur   on   the  way  to   and   from  Regensburg  Univer-­‐sity   or   for   accidents   that   occur  while   on   a   programme   excur-­‐sion.  Participation  in  the  excursions  is  at   one’s   own   risk.   Thus,   we  strongly   recommend   having  private   insurance   against   acci-­‐dents   if   you   do   not   have   it   al-­‐ready.  

 

9. APPLICATION  In  the  interest  of  maintaining  the  programme’s   high   standard,   the  number   of   participants   will   be  limited  to  40.        

Prerequisites   for   participation  are   a   minimum   of   one   year   of  legal   training  at  a  university  and  a   good   command   of  written   and  spoken   English.   Knowledge   of  German  is  not  a  prerequisite.

10.  SOCIAL  LIFE  AND  ATTRACTIONS  Regensburg  –  Italy’s  most  north-­‐ern   city   was   inscribed   to   the  UNESCO   World   Heritage   list   in  2006.  Ancient   cultural   traditions  meet   the   fascinating   life   of   a  university   town.   Today,   150,000  people   live   here,   among   them  about  22,000  students.    The  Gothic  St.  Peter’s  Cathedral  with  its  105-­‐meter  towers  is  one  of  Regensburg’s  most  impressing  monuments.  On  Sunday  you  have  the  chance  to   listen  to  the  world  famous   “Domspatzen”   (Regens-­‐burg  Cathedral’s  boys’  choir).      Another   unique   masterpiece   of  architecture  is  the  Stone  Bridge.  Built  between  1135  and  1146,   it  attests   to   the   medieval   im-­‐portance   of   Regensburg   as   a  trading   centre   and   important  transition   point   on   continental  trade  routes.        Another   famous  attraction   is   the  palace   and   cloister   of   St.  Emmeram.   Although   the   Prin-­‐cess  of  Thurn  and  Taxis  still  lives  there,   some   representative  rooms   are   open   to   visitors:   the  ballroom,   the   marble   staircase,  the  chapel  and  the  conservatory.      If   you   want   to   learn   something  about   Regensburg’s   history,   you  

should  visit  one  of  the  museums  -­‐   the   Historical   Museum,   “docu-­‐ment   Neupfarrplatz”,   the   Cathe-­‐dral   Treasury   Museum,   the  Stonebridge  Tower-­‐Museum,   the  Danube   Navigation   Museum   or  the  Imperial  Diet  Museum.    The  numerous  cafés,  bars,  disco-­‐theques  and  beer  gardens  invite  you  to  stay  a  while.  Especially  on  balmy   summer   evenings,   the  “Bismarckplatz”   attracts   stu-­‐dents   to   enjoy   themselves   on   a  nice  summer    evening.  Otherwise  you  can  spend  leisurely  hours  on  the  banks  of   the  Danube.  Young  people   and   families   enjoy   a  barbeque   on   the   so   called  “Jahninseln”   –   in   the   centre   of  the   city,   right   underneath   the  famous   Stone   Bridge.   At   this  place   you   have   a   splendid   view  of   the   panorama   of   Regensburg  and   the   famous   “Historische  Wurstküche”   (ancient   sausage  kitchen),   which   is   also   worth   a  visit.      If  you  are  interested  in  an  excur-­‐sion,   you   should   take   part   in   a  “Strudelrundfahrt”   on   the  Dan-­‐ube.   The   whirlpools   of   water   in  the   rapids   created   by   the   Stone  Bridge  are  called  “Strudel”.    The   Walhalla   nearby   Do-­‐naustauf   and   the   Befrei-­‐

ungshalle   at   Kelheim   (Hall   of  Liberation)  as  well  as  the  Bavari-­‐an   forest   are   further   tourist   at-­‐tractions  around  Regensburg.    As   Regensburg   is   located   in   the  centre   of   Bavaria,   day   trips   to  Munich   or   Nuremberg,  Neuschwanstein,   one   of   the  beautiful   Bavarian   lakes   like
