Medicare Definitions

• Waste: Practices that, directly or indirectly, result in unnecessary costs to the Medicare Program, such as overusing services. This is not caused by criminally negligent actions and the misuse of resources.

• Abuse: Practices that, directly or indirectly, result in unnecessary costs to the Medicare. Any activity that does not meet professionally recognized standards or provide patients with medically necessary services. This is illegal.

– Billing for unnecessary services (not medically necessary)

– Overcharging for services or supplies

– Misusing billing codes to increase reimbursement

Medicare Definitions

• Fraud: Occurs when someone knowingly deceives Medicare to receive payment when they should not, or to receive higher payment that they should. This is illegal.

– Bill Medicare for services you never performed

– Bill Medicare for services that are different from the ones you performed (usually more expensive!)

– Continue to bill Medicare for rented medical equipment after beneficiaries have returned it

– Offer or perform services that beneficiaries do not need in order to charge Medicare for more services

– Telling beneficiary Medicare will pay for something and it will not

– Using someone else’s Medicare number or card

What is Targeted Probe and Educate (TPE)?

• Medical review practice for the Medicare Administrative Contractors (MAC) for Parts A and B.

• Change Request 10294.

• This started in October 2017.

• The goal is increased accuracy in claims submitted in very specific areas by using data analysis to identify select providers and providing education.

• The MACs are looking for high claim error rates OR unusual billing practices and items and services that have high national error rates and are a financial risk to Medicare.

Dear Medicare Provider or Supplier:

In order to fulfill our contractual obligation with the Center for Medicare & Medicaid Services (CMS), Wisconsin Physician Services Government Health Administrators (WPS GHA) your Jurisdiction 8 Medicare Administrative Contractor (MAC), performs reviews in accordance with the CMS instruction. The TPE review process includes three rounds of a prepayment probe review with education. You may be released from further review after any round if your documentation shows the required improvement. If there are continued high denials after three rounds, WPS GHA will refer the provider/supplier to CMS additional action, which may include 100% prepay review, extrapolation, referral to a Recovery Auditor, etc. Note, discontinuation of review may occur at any time if appropriate improvement is achieved during the review process.

Please do not send any documentation at this time. The claims processing system will notify you of the Additional Documentation Request (ADR) for each claim selected for review. The ADR will include a list of suggested documentation needed to support the service on review. Please ensure the process for routing ADRs to the person(s) responsible for submission is timely and effective. Inform your staff responsible for receiving the ADR letters and submitting the required documentation of this review. Authorization for the collection of this information included in Federal Law at SSA 1833 (e) and in Federal Regulation at 42 CFR 424.5(a)(6).

So You Got Picked for TPE…

Education will be provided both intra-probe and post-probe. As a provider, you will be able to ask questions during these 1:1 educational opportunities. Upon completion of the claim sample, the nurse reviewer will contact you to schedule a 1:1 educational session regarding any errors noted during the claim review. Medical Review will also provide you written notification at the end of the review to include your results. This letter will include the number of claims reviewed, the number of claims allowed in full, the number of claims denied in full or in part and limited education on the results.

In addition, we remind you that our regulation at 42 CFR §424.535 authorizes us to revoke Medicare billing privileges under certain conditions. In particular, we note that per 42 CFR §424.535(a)(8)(ii), CMS has the authority to revoke a currently enrolled provider or supplier’s Medicare billing privileges if CMS determines that the provider or supplier has a pattern or practice of submitting claims that fail to meet Medicare requirements.

What’s the Good News?

• Most providers never get picked for TPE.

• Even if you do get picked, most providers see improvement in the accuracy of their claims.

• Once your error rate is less than 20% you will be removed from TPE for that topic.

• If compliant with improvement, you cannot be reviewed on that topic for one year.

• You can be reviewed for other problems within that year.

• CPT defines 99214 as requiring 2 of 3 elements. The claim does have a comprehensive history and exam which more than exceeds the requirements for 99214.

• BUT… the complexity of the decision making is low complexity at best.

– Defined as limited number of diagnoses or management options, limited amount and/or complexity of data to be reviewed, low risk of complications and/or morbidity or mortality and low complexity of type of decision making.

You Did the Work, What’s the Problem?

• Medical necessity of a service is the overarching criterion for payment in addition to the individual requirements of a CPT code. It would not be medically necessary or appropriate to bill a higher level of evaluation and management service when a lower level of service is warranted. The volume of documentation should not be the primary influence upon which a specific level of service is billed. Documentation should support the level of service reported. The service should be documented during, or as soon as practicable after it is provided in order to maintain an accurate medical record.

Summary

• Think of the MACs as a consultant who reviews your claims for accuracy and then provides education to decrease errors in submitted claims.

• We are trying to educate the provider to decrease the improper payment rate.

• This is not part of the appeal process. Providers can appeal any denials after the TPE review process has been completed.
