Instruction to Tenderers for Tendering

1. Tender documents are available with Store Officer,Dapartment of Mines and Geology,Khanija Bhavan, Race Course Road, Bangalore-560001 after paying a fee of Rs. 5,000/- through DD drawn in favour of Director, Department of Mines and Geology.

2. The Tenderers shall submit certified and attested supporting documents only.

3. All bids should be submitted physically along with Tender document Fee, E.M.D. and Supporting Documents for Technical Bid. The tender document shall be dropped in the Tender Box placed with the Store Officer, Department of Mines and Geology, Khanija Bhavan, Race Course Road, Bangalore-560001. Also no fax, e-mail, letters will be entertained for the same. For any clarification the tenderer may contact Deputy Director (Plan and Monitoring), Department of Mines and Geology, Khanija Bhavan, Race Course Road, Bangalore-560001.

4. The Tenderer or person or persons duly authorised by a written power of attorney for signing the bid shall mandatorily sign all the pages of the tender document. Otherwise the tender is liable to for rejection.

5. The technical bids will be opened for scrutiny on 21/07/2014 at 11.00 AM. The commercial bids of only the technically qualified bidders will be opened on 22/07/2014 at 11 A.M. in the Chamber of the Chairman, Tender Committee in the Department of Mines and Geology, Khanija Bhavan, Bangalore.

6. All the supporting documents submitted along with the tender documents towards claiming the eligibility criteria shall be mandatorily produced in original during the opening of technical bid.

7. The Tenderers shall be present either by themselves or authorized representatives at the time and date and venue of opening the bid.

8. Termination:- The Department reserves the right to accept or reject the bid unconditionally without giving notice to the Tenderer. If the successful Tenderer after entering into the contract/MoU becomes bankrupt or otherwise insolvent, provided that such termination will not prejudice or effect any right of action or remedy which has accrued or will accrue thereafter to the department.

1.0 Notice of Invitation to Tenderer

Department of Mines and Geology, invites offers from reputed, financially sound and experienced Agencies/companies for Section survey of different ornamental stone leases located in the Government Lands and their lease boundary survey using DGPS in the state Karnataka

a) Completion period: maximum 2 months from the date of issue of

Work Order for all the quarry Leases, subject to ‘Force Majeure’.

b) The validity of the Bid shall be 180 days.

c) Bids complete in all respects will be received by Store Officer,

Department of Mines and Geology at the above address.

d) Tenderers have to submit their offer for entire work.

2.0 LOCATION AND DESCRIPTION OF THE SITE:

Department of Mines and Geology herein after referred as DMG, is a State Govt. organization looking after exploration, exploitation and administration of mineral resources in state of Karnataka. DMG has decided to carry out Section and Lease boundary survey of different ornamental stone Quarry Leases located in the Government Lands using State-of-the-Art Total Station & DGPS equipments in the State. The numbers of quarries to be surveyed are presented in the following Table. A total of 184 quarries in 15 districts are to be surveyed.

3.0 SCOPE OF WORK :

1 SCOPE OF WORK :

The successful Tenderer/Tenderers have to carry out Section and Lease boundary survey of 184 ornamental stone Quarry Leases survey leases across 15 districts over an extent of 1009.11 acres located in the Government Lands using Total station and DGPS. (DGPS survey as per the procedures given in IBM Circular no. N/110913-3-MP-CCOM-V-VII dtd. 6/4/2010 enclosed as Annexure VIII).

a) Quarry area boundary fixation shall be carried out using DGPS Survey. The boundaries should conform to the standard projection system followed by Survey of India. The Guidelines F.No.7/76/2009-MIV dt. 13th Oct. 2010, issued by Ministry of Mines, Govt. of India para 4(1)(c) (I) to (VII) is to be followed. Though the said Guidelines are meant for Mining Leases the same may be followed for Quarry Leases (Annexure IX). In case of Forest areas, the boundary pillar shall be fixed on ground with reference to permanent ground features in and around quarrying lease. The Tenderer shall prepare and submit the of Geo – referenced plan of the Lease using DGPS survey.

b) The topographic & other features of the granite quarries shall be carried out

using Total Station. c) The survey for picking up the original topography of the QL block shall be

carried out mandatorily at 1meter grid interval. d) The sections of the QL have to be generated in both Longitudinal section (LS)

and cross sections (CS). e) The survey shall cover the entire QL block and a minimum of 10m around the

QL block, even if it overlaps adjoining quarries or other structures. f) In the broken ground (i.e. quarried area) spot heights be taken at 1 to 5m

interval depending upon the dimension of the quarried blocks and the extent of the QL area. The main purpose is to obtain the 3 dimensions of the quarried area in a QL as precisely as possible.

g) The survey shall cover all kinds of land use patterns such as roads, tracks, office quarters, sheds, dumps, water bodies, vehicle yard, crusher unit if any and green belts irrespective of their dimension.

h) In addition to the survey, the job entails Geological mapping of the granite deposits. The map should show over burden, joint patterns and fracture systems including hairline fractures if possible, defects of mappable dimension such as black patches, moles, veins, dykes, soil covered ground etc. The main purpose of this exercise is to assess encroachments if any and fixing the boundary marks on ground.

i) Once the corner points of the lease area are identified and their latitude and longitude readings are obtained in UTM system, the lessee shall erect concrete corner pillars at his own expenses as per the Covenants of the lessee/lessees in item 2 under Part VII of the lease deed which states that “The lessee/lessees shall at his/their own expense erect and at all times maintain and keep in proper boundary marks and pillars according to the demarcation to be shown in the plan annexed to the lease. The pillars should be pyramid shaped with base of 1 meter and height of 2 meter and should be placed 1 meter above the ground and 1 meter below the ground with yellow and black painting in Zebra pattern. The Distance of a point from forward and backward pillar along with its latitude and longitudes should be marked on all the corner pillars. The lessees shall erect the pillars on the same day at their own expenses.

j) The successful Tenderer while conducting the survey shall be the party to the daily mahaar report along with the lessee and officers of the DMG and other departments such as Revenue and Forest Departments wherever necessary.

k) Final report shall be submitted in both hard and soft copies capable to be used in both Auto cad and GIS environment to utilize the data in the shape file format which can be imported by any GIS database for use in the web GIS application software developed by the DMG.

l) The unit cost of estimate for section survey should be quoted in per Acre, per point, per pillar and per Report format.

m) The Successful tenderer shall conduct a pilot survey of this project in any of the

granite quarry lease at a given point of time immediately after the issue of work order and the results of the survey should be demonstrated before DMG for further improvements of the results as suggested. There after the methodology would be freezed for remaining leases to be surveyed.

n) Applicant company shall posses atleast 4 sets DGPS and 4 sets of total station of their own: shall hire atlest 6 sets each DGPS and Total Stations of and sufficient number of technical and other personnel (see Annexure IV) for speedy and quality completion of the survey in a time bound manner.

DMG WILL PROVIDE :

a) Quarry Lease map showing the location of lease boundary points. b) Support from local district office of the DMG towards conducting the survey by

deputing Geologists and Engineers, (Revenue and Forest Surveyors wherever needed will also be deputed from concerned departments) for identification of the area and lease boundary points required for the survey and supervision of the survey work.

c) The daily mahajar reports should be drawn on the work carried out in the presence of the lessee and duly signed by the service provider, Government Officers, staff and the lessee.

4) GENERAL SCOPE OF SERVICES: The successful Tenderer shall start the work within the prescribed time schedule

(as mentioned in Sl No 1.0)

The successful Tenderer shall deploy his own manpower for the satisfactory

completion of the entire work

The successful Tenderer shall make his own arrangement for shifting all the

required accessories / facilities at his own cost during field work.

The successful Tenderer shall make his own arrangement for diesel, Lubricants, all

other consumables, power, Camping, lodging boarding Transportation Etc. Total contract shall be awarded on turnkey basis

There is no subletting of any job.

All circular / amendments / notification or any new circular / amendments issued or notified at any time by concerned competent authority / GOI shall be complied compulsory

5 ) P R O P O S A L E V A L U A T I O N

The Proposals will be ranked according to their combined technical (St) and

commercial (Sf) scores using the weights (T = the weight given to the Technical

Proposal = 70%; P = the weight given to the Financial Proposal = 30%; T + P =

100%) using the formula:

S = St x T% + Sf x P%

This evaluation procedure reflects the high importance attached to quality and

competence. Please note that the Client is not bound in any manner to select any

of the firms submitting proposals or to select the firm offering the lower price.

The firm achieving the highest combined technical and commercial score (S) will

get the highest rank, followed by others. The firm obtaining the highest number

of points will be invited for contract negotiations, with a view to clarify any

outstanding points, to finalize technical and financial arrangements and, in case

of successful negotiations, to sign a Contract Agreement. Bidders submitting

proposals should clearly understand that any or all parts of their proposals are

liable to be part of the negotiation procedure and that key personnel to be

employed on the assignment may be called for interview.

First, the evaluation of technical proposal will be done. The technical proposal

will be evaluated out of 100 (One hundred) marks. The bidder will have to score

at least 70 (Seventy) marks (St >= 70marks) to be declared as technically

qualified.

The Tenderer may conduct clarification meetings with each or any bidder to

discuss any matters, technical or otherwise. Further, the scope of the evaluation

committee also covers taking of any decision with regard to the Tender proposal,

execution/ implementation of the project including management period.

Proposals shall be evaluated as per the following steps.

A detailed evaluation of the proposals shall be carried out in order to determine

whether the bidders are competent enough and whether the bidder’s proposal

technically qualifies to the requirements set forth in the Tender proposal,.

The team should contain named resources of professionals who would be the key contributors in all areas of Project Execution & Management. Such as:

a) Project Manager (having more than 10 years of experience with minimum Educational Qualification of M.Sc. in Geology/Applied Geology or B.E in Mining) recognized by IBM as RQP - 1 employee

b) AutoCAD and GIS Expert (having more than 4 years of experience in AutoCAD, GIS, Remote Sensing, Image Processing, LiDAR, DGPS, Total Station, DGPS/GPS based Projects with minimum qualification of Masters Degree in Geology/Remote Sensing and GIS or B.E in Mining and working knowledge of Geology, Mining and quarrying – 3 employee

e) Professional Field surveyors with mine survey competency certificate issued by IBM capable of using Total Station and DGPS in mining applications (having more than 1 year of experience of using Total Station and DGPS)-At least 4 Nos (Tenderer has to submit certified copy of the certificates along with the technical bid) and Field Surveyors with minimum qualification of Diploma in mining/Civil Engineering with more than 2 year of experience of using Total Station and DGPS in mining applications - 5 employees

Bidder is required to submit documentary proof of either Purchase

Order / Agreement / Completion Certificates, detailing Scope of

Work, Timelines, etc. or relevant documents.

Detailed specification and timeline shall be attached in the Technical

Proposal

The bidder is required to fill in the Self-Assessment form for

Evaluation of Technical Criteria in the as part of the Technical

Proposal. The last section “Bidders Approach & Methodology” shall

not be considered in the self-assessment.

The technical marks of the bidder against each criterion would be totaled up, and

thereafter the total technical marks of all the bidders would be listed in

decreasing order. Any proposal achieving a Total Technical Score less than 70

(Seventy) Marks will be treated as “Not Technically Qualifying the

Requirements” and will not be considered further. The commercial bids of the

“Technically Qualified Bidder” shall only be opened. DMG reserves the right to

take the decisions of whose commercial bids are to be opened.

Technical Score of each of the qualified bidder shall be calculated based on the

total technical marks of each bidder. The highest evaluated Technical Bid (Tm)

will be given the maximum technical score (Tf) of 100 (one hundred) points. The

technical scores (Tf) of the other qualified bidder will be computed as per the

formula – Tf = 100 x T/Tm in which Tf is the technical score of qualified bidder,

Tm is the highest technical marks and T is the technical marks of qualified bidder

under consideration.

7) Evaluation of Commercial Proposal

The commercial proposals will be opened only for the bidders with score of 70

(Seventy) marks and above on the parameter defined above. The lowest

evaluated Commercial Bid (Fm) will be given the maximum commercial score

(Sf) of 100 (one hundred) points. The commercial scores (Sf) of the other

Commercial Proposals will be computed as per the formula – Sf = 100 x Fm/F, in

which Sf is the commercial score, Fm is the lowest commercial quote and F is the

commercial quote under consideration.

8) THE TENDER & THE OFFER: a) It is a two-bid system. The bids are required to be submitted

manually by the date and time prescribed in the tender notice as under:

Part – I Technical bid

- The Tenderer shall submit the tender document Fee of Rs. 5,000/- and EMD of 1,50,000/- in the form of DD drawn in favour of Director, Department of Mines and Geology, Bangalore from any nationalized Bank payable at Bangalore. Technical bid documents i.e. forms are to be submitted manually. The documents required to be submitted in support of forms as well as Tender document Fee and EMD in the desired form shall be placed in sealed cover super-scribed “TECHNICAL BID, Tender No. and Name of work” and should be submitted separately at DMG, Head Office, Bangalore.

Part – II Price-bid a) The Tenderer shall submit manually the tender document on or before

the stipulated time. The price bid shall be placed in sealed cover super-scribed “PRICE BID, Tender No. and Name of work” and should be submitted separately at DMG, Head Office, Bangalore.

b) If the Tender document Fee and EMD are not found in the sealed technical bid document cover or if the amount thereof is found short, the tender will not be considered for scrutiny and will be out rightly rejected.

c) The Department reserves the right to reject any or all the tenders or split the work between more than one Tenderer without assigning any reason thereof.

9) OPENING OF TENDERS :

a. The Tenders will be opened after verification of receipt of payment

towards Tender document Fee and EMD in the presence of Tenderers

or his authorized representatives. b. On verification of the supporting documents, technical qualification of

the Tenderers will be assessed. The successful Tenderers will be communicated the date and time of opening of price bids by fax or telephone or email or SMS. However, all the Tenderers or their representatives will be invited while opening the price bids.

10) EARNEST MONEY DEPOSIT :

(a) A non-interest bearing Earnest Money Deposit of Rs.1,50,000/-

shall be paid along with the tender, enclosed with TECHNICAL BID documents in sealed cover superscribed “TECHNICAL BID COVER”, in the form of DD drawn in favour of Director, Department of Mines and Geology, Bangalore payable at Bangalore from any Nationalized banks only.

(b) Any pending dues against invoice or any other deposit lying with the Corporation will not be adjusted against Earnest Money Deposit Any tender submitted without Earnest Money shall be summarily rejected and no claim shall be entertained on such rejected tenders.

(c) The unsuccessful Tenderers will be refunded the EMD amount after

the finalization of tender process through Price bid.

(d) The EMD of the successful Tenderers shall be refunded after the

successful execution of the contract agreement.

(e) If the party does not accept the LOI/WO issued by DMG then EMD

amount paid by the Tenderer will be forfeited.

11) SECURITY DEPOSIT :

The successful Tenderer shall have to deposit Security Deposit at 10% of the order value (excluding EMD) within a fortnight after receipt of the order in the following manner;

1. DD in favour of Director, Department of Mines and Geology, Bangalore, payable at Bangalore from any nationalized Bangalore or scheduled banks (not being a cooperative Bank), or

2. Bank Guarantee, issued by a Nationalized Bank or IDBI, ICICI, Axis, HDFC banks only in India valid for a period of not less than 3 (three) months beyond the proposed validity of bid.

If the successful Tenderer does not pay Security Deposit or does not carry out the job assigned as per our order or does not fulfill any of the terms & conditions of this tender, Earnest Money Deposit / Security deposit paid by such Tenderer shall be liable to be forfeited. EMD and Security Deposit paid will be refunded within 90 days after the satisfactory execution of the order. Earnest Money / Security Deposit will not bear any interest

12) RATES:

a) The Tenderer has to carry out all the works for all the areas and will

quote item wise lumpsum rates in INR, for preparation of section survey work using Total Station and DGPS survey work of different Ornamental Stone Leases areas located in the Government lands of Karnataka in price bid. No escalation will be considered on any part of the work.

b) All duties, taxes, other levies ( including service tax if applicable)

payable by the Tenderer under the work, or for any other cause as applicable on the last date of submission of tender, shall be included in the rates, prices and total Bid price submitted by the Tenderer.

However such duties, taxes, levies etc. which is notified after the last date of submission of tender and/or any increase over the rate existing on the last date of submission of tender shall be reimbursed by the company on production of documentary evidence in support of payment actually made to the concerned authorities.

c) The Department reserves the right to accept or overlook or rejecting any lower rates offered by the Tenderer without assigning any reason thereof. The evaluation of offers will be made on the basis of the lowest offer, Technical skill, available software, Experience and financial position of the Tenderer.

d) The Tenderer is required to quote the rate strictly as per the terms

and conditions mentioned in the tender documents. The conditional tender will not be entertained and will be rejected. The rate quoted should be inclusive of all taxes.

13) ACCEPTANCE OF GENERAL TERMS AND CONDITIONS:

The Tenderer should unconditionally accept all the terms and conditions of the contract by signing on each page of the technical bid document of the tender including the annexures.

14) ACCEPTANCE OF LETTER of INTENT/WORK ORDER :

If the successful Tenderer does not accept the Letter of Intent or work order issued by DMG within two weeks of its receipt, the EMD paid by him will be forfeited.

15) CONTRACT AGREEMENT:

The successful Tenderer will have to enter into an agreement within 15 (fifteen) days of the receipt of LOI/WO with DMG on appropriate Stamp Paper (to be provided by the Contractor) in token of acceptance of the terms and conditions of the contract. In case of failure, the contract is liable to be terminated and the Security deposit and EMD may be forfeited.

16) COMMENCEMENT OF WORK:

The successful Tenderer will have to start the work within 15 (fifteen) days of the date of receipt of the Letter of Intent. In case of failure to commence the work within 15 days of the date of receipt of the LOI, the contract may be terminated, and EMD and SD forfeited by DMG.

17) DURATION AND QUANTITY OF WORK

(a) The period of the contract will be of two months starting with the

date of commencement of the work.(The actual rainy days will not be considered).

(b) However DMG reserves the right to increase or decrease the

quantum of the work with advance intimation to the contractor.

18) LOCAL FACILITIES / LOCAL CONDITIONS

DMG do not undertake or agree to provide any facilities to the Consultant at the work site. The Contractor has to make his own independent arrangements for Transportation, lodging, boarding, Tools, machinery, equipment, etc. and the manpower required to execute the contract shall be arranged by the Contractor only.

19) REPORTS :-

All the draft survey reports as per scope of work mentioned at Sl No. 3 shall be submitted in duplicate. DMG after scrutiny and approval of the draft report, will return it back to the Tenderer and thereafter Tenderer has to submit final five copies of the survey report along with sketches/maps in cadastral scale & Sections to DMG.

After the submission of the Final Report and, within 90 days thereafter, if DMG/IBM/MoM/MOEF or any other competent authority will raise any

query/ rectification or modification, the Tenderer will have to submit compliances as per the comments communicated by the DMG.

The consultant shall get the Total Station/DGPS survey report approved by Competent Authority within one week of the completion of survey.

The Tenderer shall have to submit 5 copies of the approved report (Drawing and text) along with a Soft copies (in CD/DVD form ) capable to be used in both Auto cad and GIS environment to utilize the data in the dxf and shape file format which can be successfully imported for use in the web GIS application software developed by the DMG.

If required, Tenderers have to make power point presentation to DMG before submission of final Section survey and Boundary demarcation report.

20) MODE OF PAYMENT:

Contractor/Tenderer shall submit full & final bill for entire work or RA bills for part of the work.

If required DMG will release 50% of payment of submitted RA bill after submission of draft survey report of individual lease area. The duly signed (consultant and DMG Geologist/Surveyor/Revenue Surveyor) Joint measurement sheet along with daily mahazar report indicating number of pillars, surveyed should be enclosed along with RA bill.

The Running Account bills, submitted at DMG Office will be processed, after considering following deductions.

a) TDS as per provision of Income Tax Act, and other Taxes (and sub-

charges) applicable in force from time to time

b) Recovery towards security deposit if any.

c) If any amount becomes payable by DMG as a result of any claim or application in terms of the provisions or non compliance of provision of any Acts and the Rules and Regulations, By-laws or the orders made there under, applicable from time to time, such amounts shall be recoverable from the contractor for which DMG will not be responsible for any compensation.

21) STATUTORY OBLIGATIONS:

a. Successful Tenderer shall ensure payment of minimum wages to your workmen as per the provisions of the Minimum Wages Act, 1948 and all other relevant Acts, Rules, Regulations, as may be applicable to you from time to time.

b. Successful Tenderer You shall also comply with all the statutory obligations with regard to employment of personnel /workmen their safety, health and strictly enforce various provisions of Municipal Laws, Local Laws, Payment of Bonus Act, 1965, Employees Provident Fund and Miscellaneous Provisions Act, 1952, Payment of Gratuity Act, 1972, Workmen Compensation Act, 1923, Employees State Insurance Act, 1948, Contract Labour (Regulation & Abolition Act, 1970, Employment Exchange (compulsory notification of vacancies) Act, 1959, Equal Remuneration Act, 1976, Fatal Accidents Act, 1855, Mines Act, 1952 and other Labour Legislations as applicable to you.

22) PENALTY If the successful Tenderer fails to start the work within 15 days of receipt of Letter of Intent/Work Order, then DMG can forfeit the EMD and shall be free to have the work executed through any other party at DMG’s discretion and at the risk and cost of the successful Tenderer.

DMG will impose penalty @ of 0.5% of the total contract value of the work per week of delay or part thereof subject to a ceiling of 10% of the total contract value of the work.

23) BLACK-LISTED TENDERER:

The Tenderer or its directors or partners should not have been black listed by any Government Organization, or any litigation be pending against any of them. The Tenderer will submit declaration to this effect along with the technical bid. If at any time such declaration is found false, the bid will be rejected or if the contract work is already awarded, it will be terminated forthwith without payment of any compensation and the EMD/SD will be forfeited.

24) NON FULFILMENT OF TERMS & CONDITION AND TERMINATION OF THE CONTRACT.

If the successful Tenderer fails to carry out the work as per terms and conditions of the contract to the satisfaction of DMG, DMG shall be entitled to terminate the contract and forfeit the security deposit paid by the successful Tenderer. This however, shall not absolve the successful

Tenderer from his obligation to fulfill the contract. In such event, DMG shall have the right to complete and / or to get the work completed at the cost & risk of the Successful Tenderer.

Likewise, if the successful Tenderer does not fulfill the terms and conditions of the contract and does not carry out the work up to the satisfaction of DMG, the DMG has the right to forthwith terminate the contract at its sole discretion, without assigning any reason. Under such events, DMG shall be entitled to forfeit the security deposit and EMD paid by the Contractor and DMG shall have a right to complete the work and/or to get the work completed at the risk and cost of the Successful Tenderer.

If required, for any reason, DMG reserves right to cancel, terminate, amend and / or alter the contract and / or bifurcate and / or reduce the contract work at any time without giving any notice to the Contractor without incurring any responsibility.

25) GENERAL CONDITONS

a. The successful Tenderer has to ensure supervision of the work

through duly qualified and competent persons and also has to make sure that a responsible Person is full time available on work site to whom DMG can issue the instruction and who can fulfill such instructions.

b. The successful Tenderer shall not change the constitution of the company/ firm during the currency of the contract.

c. For any dispute arising out of this Work Order or interpretation of

any terms thereof, the decision of DMG, shall be final and binding upon the successful Tenderer.

d. In case of any Central/State Government directives regarding execution of work related thereto, the same shall have to be strictly adhered to and shall be binding upon the successful Tenderer, for which DMG will not be responsible for any compensation.

26) DISPUTES & JURISDICTION

Matter relating to any dispute or difference arising out of this tender and subsequent contract award based on the bid shall be subject to the exclusive jurisdiction of Bangalore court only.

27) FORCE MAJEURE Force majeure is here in defined as natural phenomena such as floods,

cyclone, earthquakes and epidemics, declaration of war, accidents etc. In such conditions of force majeure both the parties can claim force majeure. But they are obliged to inform the either party within 7 days in writing of the date of commencing and again ending of the force majeure. Under the circumstances of force majeure, the contract terms of quantum of work and period shall be extended by period equivalent to the loss of time due to force majeure.

The decision regarding the occurrence of force majeure to be

considered shall be taken jointly by Successful Tenderer and DMG.

Period of such time loss due to force majeure will be considered for reducing the monthly target for calculating the liquidated damages for the respective month in which such force major has occurred.
