Greetings & happy summertime to everyone! This is one of my most favorite months of the entire year – July always seems to crank up the patriotism to its highest levels as we celebrate our nation’s birthday. Each year, as the sun begins to set on the 4th & the distant sounds of booming firecrackers & bottle rockets get louder, I start to feel a lump in my throat begin, in anticipation of the spectacular light shows that will be filling the evening skies. It doesn’t matter whether I’m attending a fireworks display somewhere or just hanging out with friends watching the skies above the rooftops in my neighborhood…fireworks on the 4th gets me choked up & brings tears to my eyes every year. As the fireworks illuminate the skies, it reminds me of some of the words in the Star Spangled Banner….”And the rockets red glare, the bombs bursting in air….” I have never seen any wartime personally nor have I ever been in harm’s way abroad, but for the many brave men & women who have, I salute all of you, who are still here with us today & especially to those who have gone before us. I pray everyday that our country remains indivisible, with liberty & justice for ALL. It may sound really corny to some people, but I’ll never be ashamed to say that I truly am Proud to be an American. I attribute most of my sentimental value of this special month to my military service – what an incredible honor it was to wear the uniform of one of our nation’s armed services. After proudly serving 13 years on active duty in the U.S. Navy, I have grown a deeper love & appreciation for our country & what we stand for. You didn’t have to have served in the military to pick out who are the “true” Americans…you all know who you are. You’re the ones who buy American made products. You’re the business owner who hires American citizens & not illegal immigrants. You’re the ones who call your bank or other business’s CEO’s to complain about having to press 1 for English. You are the biker who wears an American Flag on your vest or flies an American Flag from your bike. You are the single mother who is working full time & going to school part time to be better educated so you don’t have to go on welfare. The list goes on & on. The true Americans…you all know who you are – I salute you too!

Have a great month out there friends. We wish you all peace, love & happiness in your lives. Keep the wind in your face, stay cool & be safe on all your roads!

See you next month!

Jul 4th Gloucester Red Cross – Gloucester, VA Independence Day is a day when we should extend ourselves to help our fellow man. It is no secret that the American Red Cross practices this on a daily basis. The Red Cross is there for us in our time of need without question. But there comes a time when we should be there to help the American Red Cross. It is not common knowledge that the Gloucester Chapter of the American Red Cross is easily one of the neediest chapters in the state of Virginia. While most chapters have numerous sources of income, the Gloucester chapter relies on its community for charity. Due to economical issues, the Gloucester is on the verge of closing its doors. The citizens of Gloucester have benefitted greatly from the goodwill of the Gloucester Red Cross. I am organizing a fund raiser event to help bring much needed revenue and awareness to keep the doors open. The event will be a motorcycle poker run on July 4. The event will begin at the Gloucester Wal Mart and will extend into the country roads of Mathews, Kilmarnock, Saluda, Tappahannock and will end at the gorgeous Beaver Dam Park located on Fary’s Mill Rd in Gloucester. The cost of the event will be $20 per bike and $5 for an extra hand. The cost will include the food and beverages at the end of the ride. Registration will begin at 8:30 at the Gloucester Wal Mart and the last bike should leave out at 10:30. Come enjoy a beautiful country ride and help support a much deserved cause. For more information, you can contact me at [email protected] or (804)815-0558

Bikers are an incredibly patriotic crowd. I often see the U.S. flag gracing the rear of motorcycles as

we ride around… bringing a lump to my throat at the display of such pride. For those thinking about adding flags to your bike, consider this… there is a protocol for displaying this patriotic symbol. While it’s

not specifically addressed in the U.S Code, as it is when dealing with an automobile, you can read between the lines to determine how the flag should be flown on the back of your ride.

When the United States flag is flown alone on your motorcycle, flag etiquette calls for it to be either centered on the

bike or mounted to its “marching right”; its own right as the vehicle is moving forward (which would be the right side of the motorcycle to the rider’s perspective when sitting astride).

If the U.S. flag is displayed on your bike with another flag of any type, it should be positioned to its “marching right;” that is, to the rider’s right sitting on the motorcycle. When the U.S. flag is on your bike with other non-national flags (POW/MIA, service banners, fraternal flags, etc.), the U.S. flag is placed at the center and at the highest point of the group. According to the United States Flag Code, NO flag should ever be larger or displayed higher than the U.S. flag. If the U.S. flag is displayed on your bike with those of any other nation, the flags should be approximately equal in size and flown from separate staffs of the same height, with the U.S. flag to the marching right and other countries’ flags arranged to the left in alphabetical order in English. International usage forbids the display of the flag of one nation above that of another nation in time of peace. The order of precedence for flags generally is nations first, states (host state first, then others in the order of admission) districts and territories (Washington DC, Puerto Rico, etc.), military (in order of establishment: Army, Marine Corps, Navy, Coast Guard, Air Force), then any others.

Also noteworthy, when the American flag is painted on the side of a motorcycle or other vehicle, the custom is that the stars face toward the front of the vehicle, regardless of which side the flag is on (giving the impression that the flag is flying in the wind as the vehicle moves forward). The flag of the United States of America represents a living country and is itself considered a living thing. Proper display reflects pride in country and respect for your motorcycle!

Taking this one step further, there are also proper procedures for disposing of U.S. flags when they are old, torn, worn, or dirty. The flag, when it is in such condition that it is no longer a fitting emblem for display, should be destroyed in a dignified way, preferably by burning.

Most American Legion Posts regularly conduct a dignified flag burning ceremony, often on Flag Day, June 14th. Many Cub Scout Packs, Boy Scout Troops, and Girl Scout Troops retire flags regularly as well. Contact your local American Legion Hall or Scout Troop to inquire about the availability of this service.

Dear Readers – I run this once a year in hopes that someone, anyone, who is not familiar with the motor-cycle community, will pick up a copy of this magazine out of curiosity - we are all curious creatures who are usually intrigued with finding out about the unknown. Maybe after reading this, it will help them realize that bikers are not always who they have been stereo-typed to be. Maybe they will gain a better awareness & respect for the riders that are travelling on the same roads that they do. Maybe, just maybe…it may save a life. ~ Kelly ~

JUST A BIKER I saw you hug your purse closer to you in the grocery store line. But you didn’t see me put an extra $10.00 in the collection plate last Sunday.

I saw you pull your child closer when we passed each other on the sidewalk. But you didn’t see me playing Santa at the local Mall.

I saw you change your mind about going into the restaurant when you saw my bike parked out front. But you didn’t see me attending a meeting to raise more money for the hurricane relief.

I saw you roll up your window and shake your head when I rode by. But you didn’t see me riding behind you when you flicked your cigarette butt out the car window.

I saw you frown at me when I smiled at your children. But you didn’t see me, when I took time off from work to run toys to the homeless.

I saw you stare at my long hair. But you didn’t see me and my friends cut ten inches off for Locks of Love.

I saw you roll your eyes at our Leather jackets and gloves. But you didn’t see me and my brothers donate our old ones to those that had none.

I saw you look in fright at my tattoos. But you didn’t see me cry as my children were born or have their name written over and in my heart.

I saw you change lanes while rushing off to go somewhere. But you didn’t see me going home to be with my family.

I saw you, complain about how loud and noisy our bikes can be. But you didn’t see me when you were changing the CD and drifted into my lane.

I saw you yelling at your kids in the car. But you didn’t see me pat my child’s hands knowing she was safe behind me.

I saw you reading the newspaper or map as you drove down the road. But you didn’t see me squeeze my wife’s leg when she told me to take the next turn.

I saw you race down the road in the rain. But you didn’t see me get soaked to the skin so my son could have the car to go on his date.

I saw you run the yellow light just to save a few minutes of time. But you didn’t see me trying to turn right.

I saw you cut me off because you needed to be in the lane I was in. But you didn’t see me leave the road.

I saw you, waiting impatiently for my friends to pass. But you didn’t see me. I wasn’t there.

I saw you go home to your family. But you didn’t see me. Because I died that day you cut me off.

I was just a biker. A person with friends and a family. But you didn’t see me.

In Memory ofSome knew Bobby Mantlo during his years in the Virginia National

Guard and managing Club 149. Some knew him from LaChrome Motorcycle Shop and Easyriders/American Classic. Those of us who knew him well, knew him as the best friend anyone could have. Bobby never met a stranger. If you were in his presence, you felt you were a part of him.. He never had a harsh word to say about anyone. He’d calm you down if you were angry and make you smile if you were down. For those of you who can remember back that far, he reminded you of a contented Gabby Hayes. Bobby had been married for 42 years and had three sons, two of whom survived him, and six grandchildren.

Bobby loved motorcycling. Even after his many injuries from an ac-cident on September 2, 2007, he couldn’t wait to get back on the road to feel the wind rushing through his signature beard and feel the free-dom of being on two wheels. He was a true biker. Despite his seventy years, Bobby rode with his friends every chance he got. Along with some of those friends, he was on his way to Tail of the Dragon–a ride that was on his “bucket list.” He never fulfilled that wish..

On Sunday, June 7, 2009, a careless, reckless driver came speeding around a curve on the wrong side of the road, hitting three of eight motorcycles. Approaching the vehicle after the crash, I saw beer cans everywhere and the vehicle reeked of alcohol. In a matter of seconds, two motorcyclists had been injured and Robert Wayne “Bobby” Mantlo had been taken from us. Bobby, you will be sorely missed!Janet Acampora

Three Headlights

There are 3 headlights missing from our group tonight

Two we will get back and one we won’t No matter how much we wish we might

His light will always be bright In our hearts and minds

But the world is dimmer without him in it He’s gone ahead on the road alone I’m sure he’ll be there to greet us

and guide us home When our own rides come to an end

With heavy hearts and saddened eyes We say goodbye to our dear friend

RIP Bobby Mantlo 06/07/09

SENIOR DRESS CODE

Many of us ‘Old Folks’ (those over 50, WAY over 50, or hovering near 50) are quite confused about how we should present ourselves. We are unsure about the kind of image we are projecting and whether or not we are correct as we try to conform to current fashions. Despite what you may have seen on the streets, the following combinations DO NOT go together And should be avoided:

1. A nose ring and bifocals 2. Spiked hair and bald spots 3.. A pierced tongue and dentures 4. Mini skirts and support hose 5. Ankle bracelets and corn pads 6. Speedo’s and cellulite 7. A belly button ring and a gall bladder surgery scar 8. Unbuttoned disco shirts and a heart monitor 9. Midriff shirts and a midriff bulge 10. Bikinis and liver spots 11. Short shorts and varicose veins 12. Inline skates and a walker 13. Thongs and Depends

And at some point, you have to give up the Daisy Dukes.

2009 Indian Chief MotorcycleAmerica’s First Motorcycle Is Back

Press Release by Indian Motorcycle CompanyKings Mountain, NC—Founded in 1901, the legendary In-

dian brand remains America’s first motorcycle and is highly revered. Chairman Stephen Julius and President Steve Heese have orchestrated the re-launch of Indian. Under General Manager Chris Bernauer, an eleven-year veteran of Harley-Davidson, the Indian Motorcycle team has main-tained a sharp focus on product development, design and engineering excellence.

“We’re very excited about the new Indian Chief which are, in every way, both true to the legacy of the Indian brand and representative of the highest level of engineering expertise” according to Mr. Bernauer. “Indian aficionados everywhere will be pleased with these superior motorcycles which ef-fectively blend timeless Indian design with contemporary motorcycle performance.”

For the past few years, Indian Motorcycle’s engineer-ing staff, led by VP of Engineering Nick Glaja, have logged thousands of hours developing, evaluating and refining each and every engineering detail. Rigorous testing con-tinues until each component has proven its durability and performance. There will be no rush to market. Mr. Glaja, also a motorcycling industry veteran, was Principal Engi-neer of Powertrain Technology at Harley-Davidson before joining Indian.

Mr. Glaja says “Our goal was quite simple: to focus on the premium nature of this brand and build the finest Indian motorcycle ever. We took a ‘clean sheet’ approach to the engineering of this world class American legend to ensure a solid engineering platform. Benchmarks were set high and we believe our customers will be very happy.”

At the heart of the process has been an unrelenting em-phasis on quality and craftsmanship. No details have been overlooked or considered too minor to be discussed and evaluated. The final assembly of each Indian Chief takes place at Kings Mountain by a team of technicians known for the passionate pursuit of their craft.

An overriding sense of reverence pervades Indian head-quarters. There is an enormous sense of pride in being a part of the rebirth of Indian Motorcycle and that feeling translates into an attention to detail and genuine care for each and every component. Assembly is both loving and methodical, with obvious care taken to produce the finest

Indian motorcycles the world has ever seen. The new Indian Chief motorcycles are rightfully positioned

as premium products and will be produced in limited num-bers, with the focus on outstanding quality, performance and exclusivity. Limited production will ensure the highest level of quality is maintained and owners will be certain to enjoy the enduring value of an extraordinary new Indian Chief as well as true appreciation of ownership exclusivity.

The new Indian motorcycles are designed and engineered to be powerful works of art. The 2009 Indian Chief features a redesigned 105 cubic inch PowerPlus V-Twin powertrain with electronic closed loop sequential port fuel injection. A new charging system provides increased capacity for the EFI.

Engine cylinders are Nikasil plated, eliminating the need for cast-iron liners. A new crankshaft eliminates “scissoring”. The exhaust system is a new design with integrated 3-way catalytic converter and heated oxygen sensors. All body parts are e-coated and the frame and swingarm are e-coat-ed and powder coated for enhanced corrosion protection.

A six-speed transmission delivers power through the belt drive to 16-inch wheels out back. Stopping is achieved via Brembo 4-piston calipers, with 11.5” dual rotors up front. Standard 5.5-gallon tank helps extend cruising range. Seats are all-leather and built to exacting specifications. But specs don’t even begin to tell the story of what it’s like to ride an Indian. It’s simply awe-inspiring.

For 2009, Indian will offer four Chief models: Chief Stan-dard, Chief Deluxe, Chief Roadmaster and Chief Vintage. As befits these limited-edition masterworks, base prices will range from $30,999 for the Standard to $31,999 for the Deluxe and $33,999 for the Roadmaster to $35,499 for the Chief Vintage. Primary differences between models are in levels of trim, seating configurations, fender design, paint combinations, and included accessories.

The exciting reality for all motorcycle enthusiasts is that the 2009 Indian Chiefs are so much more than the sum of their parts. Each model is an integrated whole, the result of superior engineering and a reflection of achievement well beyond incremental improvement. The 2009 Indian Chiefs are all-new and a dramatic extension of the Indian Motorcy-cle legacy, certain to take their place in motorcycle history.

A duded-up city rider only walks into a seedy tavern near Lick River, TN. He had lost his wallet out of his new “accessories bag”, but was really hungry. He sits at the bar and notices a grizzled old biker with his arms folded, staring blankly at a full bowl of chili. After fifteen minutes of just sitting there staring at it, the newbie rider bravely asks the old biker, ‘If you aren’t going to eat that, mind if I do?’ The old veteran of a thousand rides slowly turns his head toward the young pup and says, ‘Nah, you go ahead.’ Eagerly, the guy wearing the shiny new leather fashions reaches over and slides the bowl into his place and starts spooning it in with delight. He gets nearly down to the bottom of the bowl and notices a dead mouse in the chili. The sight was very shocking and he immediately barfed up the chili back into the bowl. The old biker quietly says, ‘Yep, that’s as far as I got, too.’

Last night, my friend and I were sitting in the living room and I said to her, “I never want to live in a vegetative state, dependent on some machine and fluids from a bottle. If that ever happens, just pull the plug.” She got up, unplugged the computer, and threw out my wine. She’s such a bitch.

A lone crusty, bad ass biker rode into Las Vegas one day after a week of riding. He immediately went to the closest biker bar he could find. “I’m lookin’ for the meanest, toughest and roughest hooker in all of Vegas,” he said to the bartender. “We got her” replied the bartender. “She’s upstairs in the second room on the right.” The biker handed the bartender a cool hundred to pay for the hooker and two beers. He grabbed the bottles, stomped up the stairs, kicked the door open on the second door on the right and yelled, “I’m lookin’ for the meanest, roughest and toughest hooker in all of Vegas.” The woman inside the room looked at the bad ass biker and said, “You found her!” Then she stripped naked, bent over and grabbed her ankles. “How do you know I want that position first?” asked the biker. “I don’t,” replied the hooker, “but I thought you might wanna’ open those beers before we get started.”

The body builder takes off his shirt and the blonde says, ‘What a great chest you have!’ He takes off his pants and the blonde says, ‘What massive calves you have! ’The body builder tells her, ‘That’s 100 lbs. of dynamite, baby.’ He removes his underwear and the blonde goes running away, screaming. The body builder gets dressed and chases after her. He catches up to her and asks why she ran away screaming. The blonde replies, ‘I was afraid to be around all that dynamite after I saw how short the fuse was!’

A fellow walks into a bar, notices a very large jar on the counter, and sees that it’s filled to the brim with $10 bills. He guesses there must be more than ten thousand dollars in it.He approaches the bartender and asks, ‘What’s with the money in the jar?’‘Well......you pay $10 and if you pass three tests, you get all the money and the keys to a brand new Lexus.’The man certainly isn’t going to pass this up. And so he asks, ‘What are the three tests?’ ‘You must pay first..... Those are the rules,’ says the bartender. So, after thinking it over a while, the man gives the bartender the $10 and the bartender drops it into the jar. ‘Okay,’ the bartender says, ‘Here’s what you need to do: First - You have to drink a whole quart of tequila, in a minute or less, and you can’t make a face while doing it.Second - There’s a pit bull chained in the back with a bad tooth. You have to remove that tooth with your bare hands.Third - There’s a 90-year old lady upstairs who has never had sex....You have to take care of that problem!’The man is stunned. ‘I know I paid my $10, but I’m not an idiot! I won’t do it! You’d have to be nuts to drink a quart of tequila, and then do all those other things... ’Your call,’ says the bartender..... ‘But, your money stays where it is...’ As time goes on, and the man has a few more drinks, he finally says, ‘Where’s the damn tequila?’ He grabs the bottle with both hands and drinks it as fast as he can. Tears stream down both cheeks... but he doesn’t make a face, and he did it in fifty-eight seconds! Next, he staggers out the back door, where he sees the pit bull chained to a pole. Soon the people inside the bar hear growling, biting, and screaming sounds... then nothing but silence! Just when they think that the man surely must be dead, he staggers back into the bar, with his shirt ripped open and there are scratches and he’s bleeding all over his body. He says, ‘Now where’s that old woman with the bad tooth?’

The other day, my Accounting Dept. friends and I went to this “Ladies Night Club. One of the girls wanted to impress us, so she pulls out a $10 bill. The male stripper came over to us, and my friend licked the $10 and put it on his butt cheek. Not to be outdone, another friend pulls out a $20 bill. She calls the guy back over, licks the $20 bill and puts it on his other butt cheek. Still attempting to impress the rest of us, my other friend pulls out a $50 bill. She calls the guy back over again, licks the $50 bill and again puts it on one of his butt cheeks. Now the attention is focused on me. What could I do to top that? I got out my wallet, thought for a minute... and then the financial genius in me took over. I got out my ATM card, swiped it down the crack of his ass, grabbed the $80 bucks and went home.

Rallyin' The Valley 5Shenandoah Harley-Davidson, Staunton, VABy Marlene Steele

Shenandoah Harley-Davidson hosted another hot Harley Event June 6 & 7. An estimated 2000 people joined Biker Bob and his staff to celebrate Rallyin’ The Valley 5. Mother Nature offered 2 days of warm, pleasant temperatures and sunshine as the parking lots filled quickly both days.

Biker Bob was on his best behavior and provided his guests with all the amenities. Vendors offered cold bev-erages, delicious snacks and food from cotton candy to smoked chicken Fine crafts along with custom products and services like LED lighting and custom artwork by Letterfly were available both days.

Saturday was pure partying with 4 bands playing through the day. The opening performance by Occum’s Razor was hot and a real crowd pleaser. This 4 member band from Waynesboro, VA provided “razor rock n roll” and got the crowd pumped up for the rest of the performers like Nathan Neff and Keith Bryant and Ironhorse.

One highlight was Shenandoah Harley-Davidson’s 2009 National Anthem performer, 12 year old Emily Henline from Staunton, VA. This small, blonde lady can belt out the National Anthem acapala. Emily was warmly welcomed and got a roaring applaud at the end of her stellar performance.

As the sun went down Saturday, the crowd was still raring to rock into the night. As Hillbilly Casino took the stage, the moon rose to greet this rockabilly band from Tennessee. Front man, Nic Roulette strutted and belted out tunes from Johnny Cash, Elvis Presley to Motorhead and The Stray Cats. This 4 piece band is a sure crowd pleaser and great guys to party with.

Shenandoah Harley-Davidson proudly welcomed Bike and Rider Show Point Series 2009 organizers Boston and Stephanie on Sunday. The bike show brought in enthusiasts and riders from all over Virginia and beyond to participate. As the sun beamed, 90 bikes were displayed and judged.

To keep Sunday lively, the day started with an upbeat, jamming performance by the 8-piece R&B/Funk & Rock sounds of Everyday People, followed by another local favor-ite group, The Rogan Brothers Band

Brothers. Josh and Eric Rogan, along with their band, rounded out the day, belting out tunes with their “outlaw country” style.

As an excited crowd gathered, a pallet of neatly pack-aged awards was bought to the stage. The big moment had arrived. As Boston and Biker Bob proudly announced their “goin’ green” effort, the crowd applauded the beautiful best of show award. The “goin” green” bike awards were all crafted by pieces of 103 year old wood and parts of motor-cycles. 65 awards were handed out, the “Best Of Show” go-ing to Bill Ski of Rixeyville, VA, for his custom touring bike.

…If you joined Biker Bob and the Staff at Shenandoah Harley-Davidson, thank you for making this event a huge success. If you didn’t…don’t miss next year!

Parking lots fill quickly as Rallyin’ The Valley 5 begins on a beautiful, summer, Saturday afternoon.

News BytesMISSOURI HELMET FREEDOM STILL ON HOLDLegislation to partially repeal the “Show Me” state’s 42-year old mandatory helmet law has been sitting on Governor Jay Nixon’s desk since May 29, awaiting his approval or veto. Senate Bill 202, a bill to allow motorcyclists 21 and older to ride without helmets except on the interstate highway system, passed both the House and Senate and will become law in Nixon doesn’t veto the measure. In addition to the helmet provisions, SB 202 introduced by Senator Kurt Schaefer (R-Columbia) would also prohibit insurance companies from reducing claims from injured motorcycle riders on the grounds that a motorcycle is a hazardous vehicle, even if the rider is fault-free. Nixon has received about 1,000 e-mails and let-ters on the motorcycle legislation -- more than on any other legislative issue, said a spokesman for the governor’s office. Those urging the governor to sign the legislation outnumbered those urging a veto by about 7-to-1, according to analysis of the messages by The Associated Press. Mark Chapman, chairman of the Freedom of Road Riders of Missouri, said that motorcyclists should be allowed to decide for themselves when conditions warrant wearing a helmet. “It should be my choice as an adult,” Chapman said. “It’s not like I’m a 10 year old trying to kill myself.” Those who urged him to sign the bill -- some of whom said they regularly wear helmets -- mentioned personal freedom and suggested that not requiring helmets could spur tourism. FORR-MO is appealing to riders nation-wide to contact his office and urge Gov. Nixon to sign the bill into law or allow it to automatically become law without his signature. You can call Missouri Governor Jay Nixon at (573) 751-3222, e-mail him through www.governor.mo.gov or write to P.O. Box 720, Jefferson City, MO 65102. OMAHA POLICE TO ENFORCE HELMET COMPLIANCE If you’ve ever wondered where some of your state and federal motorcycle safety funds are being spent, the Nebraska Office of Highway Safety has awarded a grant to fund extra police officers on the streets to ensure motorcyclists are compliant with Nebraska state laws regarding motorcycle helmets. The Omaha Police Department received $25,000 in grant funding to begin operations to enforce motorcycle helmet compliance throughout the entire city from May 27 through September 30, 2009. Nebraska state law specifies that protective helmets that meet the United States Department of Transportation’s Federal Motor Vehicle Safety Standard #218 are required for all operators and passengers of a motorcycle or moped. Citing safety concerns, officers will be citing operators who are in vio-lation of this law and confiscating their non-compliant helmets. In the meantime, Vermont State Police are advising motorcy-clists that a new state law goes into effect on July 1st requir-ing that all helmets be DOT approved, similar to a measure enacted recently in North Carolina. SMOG, OR SMOKE & MIRRORS?In spite of already having the lowest motorcycle emissions standards in the country, and despite verbal promises from the legislative sponsor in response to key Senate opposition, a bill to enact Smog Checks for motorcycles has passed the California State Senate and may be heard in the Assembly

as early as June 29th. ABATE of California is seeking nation-wide assistance to quash this bill once and for all. “Our out of state brothers and sisters may be our most effective resource in fighting the motorcycle smog bill,” wrote ABATE Executive Director Tim Tennimon in a request to NCOM to help rally op-position to Senate Bill 435. “SB 435 has been passed to the Assembly as a SMOG CHECK BILL on the verbal promise to amend but has not yet been fulfilled. It would appear that it may go so far as to include all 3 (smog check, noise, and cata-lytic converter with random pull over inspection thrown in for good measure),” explains Tennimon. Sponsor of the measure, Santa Monica Senator Fran Pavley, agreed to remove the controversial biennial emissions testing when the bill passed the Senate, but no such action has yet been taken. ABATE Lobbyist Jim Lombardo reports that “I personally spoke with the committee staff and they have not been officially notified that SB 435 is to be amended or turned into a 2-year bill, and even if it had, Pavley could ask for it to be reset for a hear-ing…the stakes are too high to be caught with our pants down: LET’S KILL SB 435 -- IT IS STILL A SMOG CHECK BILL!!!” Therefore, ABATE of CA is asking all out of state motorcyclists to contact the Chairman of the Assembly Transportation Com-mittee, Mike Eng at phone (916) 319-2049, fax 916-319-2149, or e-mail [email protected], and also Gov-ernor Arnold Schwarzenegger at phone (916) 445-2841, fax 916-558-3160, or e-mail at gov.ca.gov, and let them know that if you are going to be at risk of being singled out and pulled over for exhaust system inspections when you visit California then you will choose another location to spend your vacation dollars, and urge their NO vote on SB 435. “Unfortunately many laws of this type start in California and spread to other states,” warns Tennimon, so “the place to stop it is here and now, then hopefully you won’t have to deal with anything like this in your state.” AIM ATTORNEY SUES NY POLICE FOR ILLEGAL CHECK-POINTS Proner & Proner, Attorneys at law, has filed a Fed-eral class action lawsuit in the Federal Court for the Northern District of New York against the New York State Police as well as New York State and county authorities to stop them from conducting motorcycle-only roadblocks near popular motor-cycle events. Last year the New York State Police and county sheriffs stopped every motorcycle en route to twelve different events for “safety checks.” With the riding season starting, the New York State Police expect to conduct up to fifteen motorcycle-only roadblocks throughout the state this year. One of the events targeted was Americade, the largest motorcycle event in the Northeast. Police set up two checkpoints during the Lake George-based rally in June that netted 84 tickets for unapproved helmets, 19 for modified exhausts and 32 other vehicle and traffic violations. New York A.I.M. (Aid to Injured Motorcyclists) Attorney Mitchell Proner, an active motorcyclist and personal injury attorney, is initiating the lawsuit on behalf of all motorcyclists. ABATE of New York supports the legal action. Proner said that the New York State Police “uses the pretense of safety inspections to delay and harass motorcy-clists without any reasonable belief that any laws are being broken.” Although courts have upheld DWI checkpoints as

THUNDER ROADS MAGAZINE 36

Page 39: Thunder Roads Virginia Magazine - July '09

News Bytesgenerally permissible, “These motorcycle roadblock stops are lengthy and do not address any legitimate safety concerns,” according to Proner. MYRTLE BEACH HELMET LAW LAWSUIT UPDATEFollowing is an update from Matt Danielson of Tom McGrath’s Motorcycle Law Group regarding the lawsuit filed against the helmet law enacted by the city council of Myrtle Beach, SC. “Forty-nine of the motorcyclists who took part in the Myrtle Beach Freedom Ride and who were ticketed for violations have had their cases stayed yesterday. A.I.M. Attorney Tom McGrath filed motions to have the cases dismissed due to lack of jurisdiction. The original city ordinance mandated that the violations, which are civil in nature, be heard by a special tribu-nal created by the city. However, since that time the tribunals have been found to be unconstitutional (or at least suggested to be by the Chief Justice of the Supreme Court of South Carolina). The city moved the cases to municipal court. How-ever, the State Code of South Carolina specifically states that the municipal courts do not have jurisdiction over civil matters. Since the city served the 49 defendants via mail after the Chief Justice’s ruling, they were forced to admit that the infractions were civil in nature since you can’t serve a criminal complaint by mail. That put the City of Myrtle Beach in a box since State Code says the municipal courts do not have jurisdiction over civil matters. The court decided to stay the trials of these mat-ters while deciding how to rule. The court has stated that none of the defendants need to appear on the scheduled dates. We expect a ruling soon. In the meantime, motions have been filed in the South Carolina Supreme Court to declare the ordinances void. More information will be forthcoming as it is made available.” PENNSYLVANIA SENATOR WANTS TO GIVE YOU $4,500 TO BUY A NEW MOTORCYCLE U.S. Senator Bob Casey (D-PA), a longtime advocate for the Harley-Davidson Motor Co., has introduced legislation that would provide up to $4,500 for motorcycle buyers who trade in an older, gas guzzling car or truck. Harley has its largest assembly plant in York, Pa., where it employs more than 2,000 people. Recently, the company said it might close its York operations due to the downturn in the economy and falling motorcycle sales. Senator Casey wants his proposal attached to the “cash for clunkers” bill passed recently in the U.S. House of Representatives. It authorizes the program for one year, for a total cost of $4 bil-lion. To be eligible, a trade-in car must get less than 18 miles per gallon, and the new vehicle must get at least 22 mpg. The voucher would be worth $4,500 if the gas mileage of the new car is at least 10 mpg higher than the old vehicle. Casey said his legislation would help spur economic recovery and protect manufacturing jobs in Pennsylvania, Wisconsin and other states where motorcycles and bike parts are manufactured and assembled. New motorcycle sales in the United States fell 8% in 2007 and 10% in 2008. The proposal “is positive from our perspective,” said Harley spokeswoman Rebecca Bortner, adding that swapping an old car for a bike would be an easy upgrade in fuel efficiency.

BILL MAY BAN BIKER BARSRevving up for a fight, motorcycle clubs in Virginia say they are being unfairly targeted by the state’s ABC Board for what they wear. Motorcyclists who recently rallied at a Richmond Public Safety meeting say they are trying to appeal to Richmond City Council members to repeal a new State law. In 2008, the General Assembly passed HB 1117 Alcohol Beverage Control; a bill saying that bars and restaurants could be stripped of their liquor license by allowing groups into their establishments who wear certain gang affiliations or colors. Although aimed at criminal street gangs, motorcyclists say they are victims of this new law and that their First Amendment rights are being violated.

BIKERNET.COM CREATES WORKING GROUP FOR MO-TORCYCLE RIGHTS Longtime bikers rights activist Keith R. Ball and the staff of Bikernet.com are working with the motor-cycle aftermarket to provide a direct link between legislative efforts, motorcycle rights groups, and the custom motorcycle aftermarket industry. “It’s been a goal of mine for 15 years to get the business side to help our freedom fighters,” said Ball. If successful, Keith hopes to encourage SEMA (the Specialty Equipment Market Association), the largest hot rod aftermarket organization in the United States, to work with us to deliver additional resources to the motorcycle rights community, since we all face similar battles. “The Motorcycle Aftermarket Work-ing Group is made up of many leaders and business owners, but we want to reach out directly to state motorcycle rights groups for their input,” said Ball, adding that they are already working closely with the National Coalition of Motorcyclists (NCOM) and the Motorcycle Riders Foundation (MRF). “What can we do to help keep motorcycling free?” The group is currently working on an agenda, so contact Keith Ball directly with any comments or suggestions at [email protected] or (310) 830-0630. FEDS QUESTION BIKERSThe Federal Highway Administration’s Motorcyclist Advisory Council is asking riders across the country to help state and federal highway administrators and State Motorcycle Safety Administrators (SMSA) to “better understand and plan for the needs of motorcycle riders.” Motorcycle riders are requested to complete a Motorcycle Road Issues Survey by logging onto http://tinyurl.com/ovzduo before August 1st and answering on-line survey questions that are separated into 3 distinct settings typically experienced by the majority of riders: Urban Areas (city/suburban/frequent intersections/pedestrians); Rural Areas (fewer intersections/higher speed); and Limited Access Areas (freeway/highway/toll road/minimal intersections). POINTMAN PERSPECTIVE: FREEDOM There are few things more inspiring than “ Old Glory” flying in the breeze. I still get chills when I hear the Star Spangled Banner or America the Beautiful being played. They stand for freedom, freedom that is unknown in most of the world today. The dictionary defines freedom as (1) the condition of being free (2) political independence (3) possession of civil rights (4) unrestricted use or access. As we celebrate Independence Day we need to ask ourselves “ What does freedom mean to me?” “ Why should I be concerned ?, I have freedoms” True, you have freedoms now, but they are slowly eroding. It is very much like putting a frog in a pot of water. As you turn up the heat the frog adjusts to the rising temperature until it dies without putting up a struggle. So it is with our freedoms. They are slowly being taken away and we are absorbed in our own little pot of water until it will be too late. Everything our founding fathers fought for will be gone. Everything our military fought and died for over the past 400 years all over world will be for nothing because we are sitting in our little pots of water oblivious to heat that is being turned up all around us. This is the apathy I spoke about last time. I implore each one of you to become active. Let your voice be heard. Gather together, there is strength in numbers. Let Freedom Ring! Do not settle for the morsels you are being thrown. Demand integrity, accountability, action from our elected officials. Let them know they work for you, not against you. If they do not listen, vote them out and put someone in that will listen. Each of us has to be involved in the process or we slowly be absorbed by the monster we have created. However, there is hope for all of us. No matter what happens we have eternal hope in Jesus Christ. 2 Corinthians 3:17 says “ Now the Lord is the Spirit, and where the Spirit of the Lord is, there is freedom.” We can rejoice because the freedom Christ gives us cannot be taken away by anyone or anything. John 8:31-32 says, To the Jews who had believed in Him, Jesus said “ If you hold to my teaching, you are really my disciples. Then you will know the truth and the truth will set you free.” Do you know the freedom that only comes through a personal relationship with the creator of the universe? Do you want to experience the peace that only Christ can give? If so, repent of your sins, ask Jesus to forgive you and come into your heart as savior and Lord of your life. As your mind and heart are transformed by His Word and Spirit, you will experience the love, peace, grace, and freedom that transcends anything this world has to offer. “ For whom the Son sets free is free indeed.” May the road rise up to meet you
