OLD BUSINESS Southern Tier Central Regional Planning & Development Board-will is receiving a new contract

from them. In 2015 the Town had a plus balance of $1,869 which will roll over into 2016.

On motion of Supervisor Tucker seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Tucker, Fitzsimmons, Card, Scott, Michaloski) NAYS 0-RESOLVED to approve the proposal from Christley’s Flooring at $3,104.39.

NYS OSHA-Supervisor Tucker had received a registered letter from NYS concerning the violations that had occurred at the Highway garage. Included was a notice of penalties in the

amounts of $7,344 owed for specific infractions and a $1,164 for violations of the NYS Labor Law. Supervisor Tucker discovered that the violations have been taken care of. At a later date Supervisor Tucker will meet with NYS to negotiate cost of penalties.

NEW BUSINESS Resolution #15-2016

Insurance Administrator-on motion of Councilwoman Card seconded by Councilwoman Fitzsimmons the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Card, Tucker, Fitzsimmons, Michaloski) ABSTAINED 1-(Scott) RESOLVED to appoint Supervisor Tucker as administrator of the health insurance policy currently at Sprague’s Insurance.

At 6 pm Supervisor Tucker called the Public Hearing Meeting to order with the pledge to the flag.

Public Hearing for proposed Local Law No. 1 of 2016-title of law is “To Change Grievance Day”. Intent of law is to hold Grievance Day on the first Tuesday after the fourth Tuesday in the month of May.

On motion of Councilman Scott seconded by Councilwoman Card the following resolution ADOPTED VOICE VOTE-AYES 5 (Tucker, Card, Fitzsimmons, Michaloski, Scott) NAYS 0-RESOLVED to close the Public Hearing at 6:06 pm, with no public comment heard.

Regular Meeting-Alan Lewis and another rep from Rural Metro Ambulance were here to discuss contract renewals. Two plans were proposed: a four-year contract with a (2%) rate increase each year for the first three years and a (3%) increase for year four. The other was a 5-year contract with a (1%) increase for the first year and a (2%) increase for the duration.

Caton Fire District 1 2016 Budget-Tax Collector Avonne Dickerson contacted the Steuben County Finance Department as to the amount of tax dollars to be collected for the Fire District. The Fire District had expected to receive $164,903.00 from the Town of Caton in collected taxes, but mistakenly, the amount the Fire District actually requested in their final budget was $147,803.00.

Steuben County update/Carol Ferratella- News letter from Steuben County. Town Clerk will have Don H put on the website.

Town Officials Reports-for January 2016:

Library-sent a paid receipt to the Town for end of previous contract.

Highway Superintendent David Card-report viewed, filed and discussed.

Code Officer/Building Inspector Don Miller-no report filed.

Town Constable Mike Smith-report viewed and filed. Councilman Scott would like Mike to put his mileage on his report. Light bar from old constable car has been sold.

Dog Control Officer Bruce Akins-report reviewed and filed. Bruce and the Board discussed purchase of a net, a pole and also, a shirt and hat with the Town of Caton name on it for DCO identification.

Town Court Justice Terri Divens-Bruffey-no report filed.

Assessor Katherine Deal-no report filed.

Supervisor Lynn Tucker-no financial report as the books have not been closed for 2015.

Carpets for offices have been ordered. Joanne Randall has resigned from the bookkeeper position and an ad has been run for a part-time bookkeeper position. Payroll Clerk Don Haussener has been filling the vacant position and working with CPA Carol Golden on getting the 2015 books closed to complete the 2015 AUD Report.

NEW BUSINESS Resolution #24 of 2016

Southern Tier Central Regional Planning & Development Board annual contract presented and discussed. On motion of Councilwoman Fitzsimmons seconded by Supervisor Tucker the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Tucker, Card, Fitzsimmons, Michaloski, Scott) NAYS 0- RESOLVED to approve the 2016 contract in the amount of $4,460.00 with STRCRPDB, and further to have Consultant Chelsea Robertson to furnish the Board with a year-end report of how many hours used for definitive services.

Supervisor/Bookkeeper appointment-after Board and Attorney discussion and on motion of Councilwoman Card seconded by Councilwoman Fitzsimmons the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Tucker, Card, Fitzsimmons, Michaloski) NAYS 1 (Scott)-RESOLVED that the Town Board of the Town of Caton gives the Town of Caton Supervisor the authority to appoint his own bookkeeper.

Resignations-on motion of Supervisor Tucker seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Tucker, Card, Fitzsimmons, Michaloski, Scott) NAYS 0- RESOLVED to accept the resignations of Joanne Randall as Bookkeeper and Carol Matusick as Court Clerk.

Caton Community Days-received notification from Debbie VanEtten (coordinator) concerning the NYSDOT Highway Work Permit for Caton Days. This includes a permit form that needs to be completed to be able to close State Route 225 for that day and will also entail speaking with Sprague Insurance to make sure everything is legal.

Building Permit Fees-Supervisor Tucker previously discussed current fees with Code Officer Miller. After Town Board discussion and on motion of Supervisor Tucker seconded by Councilman Michaloski the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Tucker, Card, Fitzsimmons, Michaloski, Scott) NAYS 0-RESOLVED to approve the following permit fee increases and additions:

Renewal of building permit-$20 Separate garage permit-$20 + $5/100 sq. feet Swimming pool-$25 fee for an in ground pool Swimming pool-$15 fee for an above ground pool Septic inspections-$30 Penalty for building without a permit-$100 penalty + cost of permit

Resolution #28 of 2016

Dog Control Fees-after Town Board discussion and on motion of Supervisor Tucker seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Tucker, Card, Fitzsimmons, Michaloski, Scott) NAYS 0-RESOLVED to approve the following increases to Dog Control Impoundment Fees:

Impoundment fee first offense-$35 + $7/day Impoundment fee second offense-$50 + $7/day Impoundment fee third or more offense-$75 + $7/day

Town Board also conversed about the $3 fee and the $1 fee (unaltered & altered respectively) attached to each dog license that the Town collects and forwards to NYS Ag & Market for the Animal Population Control Program (APCP) as provided in Section 117-a of the NYS Ag & Markets Law, Article 7.

Visitors Agrees with taking the APCP fees and using it for something more local. Pleased with what is happening with the Caton Highway Department. Travel trailers used as homes and concern over sewage disposal. Cost of ambulance contract. Dog control officer needing contractual money to cover expenses for doing the job. Utilizing the County Purchasing Department for purchase of Town Hall items. Caton Community Days is selling tickets as a Fundraiser Event from 03/01/2016-03/31/2016.

Supervisor Tucker closed the meeting at 8:10 pm.

Outstanding payables-Supervisor Tucker discussed (5) outstanding payments from last month’s abstract. One of the checks written was for the Caton Fire District in the amount of $147,803. After discussion and on motion of Supervisor Tucker seconded by Councilwoman Card the following RESOLUTION ADOPTED ROLL CALL VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0- RESOLVED to approve a stop-payment on check # 9849, dated 02/12/2016, in the amount of $147,803 payable to Caton Fire District # 1, and to rewrite and issue a second check payable to Caton Fire District # 1 in the amount of $147,803.

Steuben County Update-Carol Ferratella stated that the illegal drug use in Steuben County is on the rise and that from January 1, of 2016 through this week there have been seven drug related deaths. Currently there are two full time investigators working diligently on this problem. Steuben County Sheriff’s Department has supplied the following information for the public to inform law agencies of individuals that are abusing drugs or alcohol. See the following:

Resolution # 32-2016 On motion of Councilman Michaloski seconded by Councilman Scott the following RESOLUTION ADOPTED ROLL CALL VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0-RESOLVED to approve contractual expenses incurred by Bruce Akins for dog control in the Town of Caton, not to exceed the amount of money in the Dog Control contractual account A3510, which also pays his monthly salary.

Town Court Justice Terri Divens-Bruffey-report viewed and filed. Previously there was a Justice Court grant awarded in 2011 to obtain a bench. Justice Divens-Bruffey would like to put in a request to reallocate these funds so the Court may receive items such as a DMV abstract program, a larger fire proof safe, book shelves and a break-a-way bar for the back door.

Further, on Monday, March 21st, Justice Divens-Bruffey is requesting to hire a Deputy Sheriff to attend court proceedings for that evening, as Constable Smith will not be available.

Resolution # 33-2016 On motion of Supervisor Tucker seconded by Councilwoman Card the following RESOLUTION ADOPTED ROLL CALL VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0-RESOLVED to approve the hiring of a Deputy Sheriff for 03/21/2016 per Justice Divens-Bruffey request if there is not one that may volunteer their time, to be paid for out of Justice contractual fund.

Resolution # 35-2016 After Board discussion and on motion of Councilwoman Card seconded by Councilwoman Fitzsimmons the following RESOLUTION ADOPTED ROLL CALL VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0-RESOLVED to approve the quote from Access Computing at a total of $1,313, to be paid for out of Office Equipment Capital Reserve Fund, subject to a permissive referendum.

Resolution # 36-2016 On motion of Councilwoman Card seconded by Councilwoman Fitzsimmons the following RESOLUTION ADOPTED VOICE VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0-RESOLVED to withdraw the previous motion (Resolution # 34-2016) made by Councilwoman Card to purchase two computers from Access Computing at a cost of $1,313.

NYS Labor Fines-Supervisor Tucker discussed with the Board the penalties applied by NYS Labor Board against the fines that have been charged due to infractions at the highway building. Supervisor Tucker appealed the amounts and got them reduced to the following: $6,564.00.

Resolution # 37-2016 After discussion and on motion of Councilman Michaloski seconded by Councilman Scott the following RESOLUTION ADOPTED ROLL CALL VOTE AYES 4-(Tucker, Scott, Card, Michaloski) NAYS 0-ABSTAINED-1 (Fitzsimmons) RESOLVED to approve $6,564.00 payment to NYS Department of Labor, to be paid for from Contingent Fund, A1990.4 and to be sent by certified mail.

Replacement carpet is in and will be installed soon. The control box in the 1993 boiler in the janitor room was replaced. May need to put in a new

furnace before winter season next year. Sprague Insurance-Supervisor Tucker will be meeting with a rep from Sprague’s Insurance to

discuss the Town’s policies.

Caton Community Days-Co-chairperson Debbie VanEtten presented a proposed contract to the Board for payment of the $2,500.00 2016 budgeted amount for the Community Day event. Town Board discussed differences in opinions concerning the method the payment is issued. Supervisor Tucker will speak with Attorney Maio about contracts with Community Days and the Senior Program.

Resolution # 38-2016 Noise Ordinance variance-Community Days Committee has asked the Town Board to bypass the Noise Ordinance for Saturday, May 7th, 2016, from 7 am to 4:30 pm. On motion of Supervisor Tucker seconded by Councilman Scott the following RESOLUTION ADOPTED VOICE VOTE AYES 5-(Tucker, Scott, Card, Michaloski, Fitzsimmons)NAYS-0 to approve a noise variance for Community Days activities as presented by Co-chair Debbie VanEtten.

Old Business NYS Unified Court System-on motion of Supervisor Tucker seconded by Councilman Scott the

following RESOLUTION ADOPTED VOICE VOTE AYES 5-(Tucker, Fitzsimmons, Scott, Card, Michaloski) NAYS 0-RESOLVED to consent to the Temporary Assignment of our Justice, to preside in other towns in the Seventh Judicial District as needs arise and to approve Temporary Assignment of Justices from other towns within the Seventh Judicial District to preside in our Justice Court as needs arise for year 2016.

Local Law # 1 of 2016-Town Clerk received verification from NYS that as of February 11, 2015 the law has been accepted, filed and is legal.

Comprehensive Planning Update Committee-Supervisor Tucker has been asked by Chair Jan Glover to appoint resident Kate Hughes to this committee. Jamie Johnson and Michael Royce have opted out. Supervisor Tucker stated that alternates or anyone else that is interested may apply.

Bookkeeping position-Don Haussener has stepped up and is doing the bookkeeping and is willing to continue. 2015 books are closed. Supervisor Tucker will appoint Don as bookkeeper at the next Town Board meeting.

Supervisor Tucker brought the Regular Monthly Town Board Meeting to order with the pledge to the flag.

Opening Announcement prepared and read by Supervisor Tucker Following is a general synopsis of Supervisor Tucker’s statement: “Town Board meetings need to be conducted in an orderly fashion. The guests are allowed to observe the meeting. If throughout the meeting any guest is called upon for any information that the board is acting on, that person is the only one that we will hear from and not several people at once. We are not opening it up for discussion at that point. And if the board finds we need discussion only then will we do it and in a well-ordered manner.”

Assessor Katherine Deal Katherine discussed the recent revaluation of property with Town Board and also mentioned the new STAR legislation that will only affect persons who have purchased a new residence after March 2, 2015. A short question and answer session followed.

Sprague Insurance rep John Kuehn John discussed the 2016 renewal insurance policy for town vehicles, town barn and town hall with the Board. The amount due has decreased by $244.99. John also discussed the Cyber Product insurance that would protect computer data.

Money Transfer Supervisor Tucker stated that the OSHA fines have been paid.

County Update Supervisor Tucker received a call from Bryce Foster, Deputy Commissioner of Steuben County Department of Public Works, concerning a small triangular shaped parcel located on the County’s side of the creek behind the County sheds on the Marsh Road, which belongs to the Town of Caton. The County is interested in purchasing this piece of land to expand their building at this location.

Legislator Ferratella Stated that for year 2016 the County road projects for Caton are:

Tannery Creek Road (Cty. Rte. 120)-5.5 miles crack sealing. Whiskey Creek Road (Cty. Rte. 34)-3 miles chip sealed.

Drug tip hotline is now moved to the front page of the County’s website.

Legislator VanEtten Mentioned that the County is also interested in purchasing a small piece of Ed Loysch’s

land on the Deyo Road, which borders the Town land on the Marsh Road.

River Road (Cty. Rte. 73 in Lindley)-complete road from one end to the other will be redone.

NYS has also passed the $15 Minimum Wage Act, and they do have a separate rate for municipalities.

This money was never spent by Court officials and NYS Court Administration either wants the money returned or spent. Apparently, the money was put into the Town’s General Fund.

Resolution # 43 of 2016

On motion of Supervisor Tucker seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Scott, Michaloski, Fitzsimmons, Tucker)-NAYS 0 RESOLVED to approve putting out a bid for mowing of the park, cemeteries and town hall, to be publically opened and read at the May 11, 2016 Town Board Meeting.

CPA Carol Golden completed and filed the 2015 AUD Report. Supervisor Tucker provided Town Board members a copy. Notice of completion will be advertised in the Corning Leader as required by law.

Supervisor Tucker had received recent minutes from the Comprehensive Planning Committee and would like to receive minutes from other Boards in the Town.

Supervisor Tucker handed out information to Town Board members and the Highway Superintendent from NYS pertaining to credit card use in a municipality.

Supervisor recently met with Chelsea Robertson from STCRPDB and Attorney Maio. To save on cost of consulting, Supervisor Tucker advised that if anyone else besides him or the Chairperson of the other Boards contact the Attorney or Chelsea for advice or opinions, that individual will be responsible for payment of that transaction and not the Town of Caton.

Other business Community Days-Chair Debbie VanEtten presented Supervisor Tucker with an invoice for

items that will be required to be paid for from the $2,500 that the Town of Caton has budgeted for Caton Community Days. Supervisor Tucker assured Ms. VanEtten that checks not to exceed $2,500 will be written for these presented (or other) bills and will be available on May 7, 2016.

Attorney Maio prepared a tentative contract for the Town Board and Caton Days Committee for review.

Community Days went fine, method of paying vendors was good and Town Clerk received a copy of Community Days contract from Supervisor.

Supervisor and Highway Superintendent completed Shared Services Contracts with Steuben County and NYS DOT.

National Fuel Gas-owes the Town $1,951.46 for reviewing town roads when the pipeline was going through.

Southern Tier Central Regional Planning & Development Board-Supervisor received a correspondence from Planner Chelsea Robertson pertaining to the Comprehensive Update Committee survey that will be mailed out to residents.

We currently have a fund balance of $4,572 which may be used for Planning and ZBA Boards and the Comprehensive Update Committee.

Old Business

Page property @ Birch Creek and County Rte. 32-the Pages’ are asking $3,000 for this lot that is less than an acre. If purchased, the Town would need to have the lot surveyed. Steuben County is still willing to help the Town with this juncture.

In consideration for helping the Town revamp the connection of Birch Creek and County Rte. 32, the County would like to acquire from the Town, at no dollar cost, approximately one acre of the estimated 16-acres in the Town gravel pit which borders the County property.

The Board requested Superintendent Card speak to SCDPW to receive a complete cost of what updating the intersection might be.

New Business

Proposed truck purchase- Supervisor Tucker and Superintendent Card have discussed at length purchase of a new single axel truck through the Onondaga bid, which is called a “piggy-back” bid and is similar to a NYS bid. The truck they are interested is an International Harvester with all the necessary accessories included.

Resolution # 66-2016 WHEREAS,

The Town Board of the Town of Caton has previously authorized the purchase of a new 2017 highway truck in the amount of $163,676.24, and is now awaiting delivery of this truck; the Town Board now desires to amend the 2016 Highway Budget to provide the financing source and budget authorization necessary to pay for the truck once delivered.

WHEREAS, The Town has confirmed the establishment of its Highway Equipment Reserve in accordance with the General Municipal Law Section 6-c on April 30, 2014, the Town Board now desires to appropriate the full amount of this purchase from resources

Approximate amount remaining after truck purchase will be $299,776.00.

OTHER BUSINESS o Resident Robert Lord drafted a proposed working agreement between the Town of

Caton and the Caton Area Senior Citizens group. Proposal to be forwarded to Attorney Maio for review.

o Councilman Scott presented information from NYSDTF concerning the Real Property Tax Law on the topic of Solar Energy Systems and two letters with legal opinions from the County of Steuben Law Department that also pertain to Solar Exemption Under Real Property Tax Law section 487and 487-a. This information will also be forwarded to Attorney Maio for review.

o Supervisor and Town Clerk received notice from the Office of the NYS Comptroller stating that NYS has not received Town’s Standard Work Day and Reporting Resolution and Affidavit of Posting that was previously requested in 2014. Required information pertains to employees in the retirement system that are in a term of office or appointment that began on or after August 12, 2009. Data must be provided to NYS by 08/31/16.

o Supervisor Lynn Tucker stated that he officially appoints Don Haussener as his Bookkeeper.

o During the next few weeks some of the offices will not be open due to scheduled summer vacations.

Old Business o Page property-Attorney Maio stated that in order for the Town to purchase public

property the Board needs to pass a resolution subject to a permissive referendum.

o Internal audits-all caught up.

o Comprehensive Committee updates-still working on questions for the survey. Councilman Michaloski would like the Town Board to make a resolution to approve a FOIL request for an EMS report from Steuben County just to see if residents are satisfied with their service. Supervisor Tucker suggested that the Committee go to the Caton Fire District meetings to receive this information.

o Park Updates-old trash cans have been replaced. Ed Rose would like the Board’s approval to purchase mulch to complete the landscaping.

Resolution # 71 of 2016 o This year the Summer Park Program will run from August 8 to August 26, 2016.

Appointee Alex Hepburn is unable to work this year. On motion of Supervisor Tucker seconded by Councilmember Michaloski the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 3 (Fitzsimmons, Michaloski, Tucker) NAYS 0-RESOLVED to offer the vacant assistant position to Michaela Tobey.

o Security cameras have arrived and will be installed in the Town Hall soon.

o New truck has been ordered and is scheduled to arrive in September.

New Business o Community Days-Attorney Maio presented an updated contract for the event.

o Senior Citizens Group-Attorney Maio to double-check if there really is a need to draft a contract with this group in order for them to receive tax dollars. Otherwise, the contract will be drafted about the same as the Community Days Contract.

o Solar Panel issue-Attorney Maio has met with Steuben County RPTS director, Steuben County Attorney and attended a seminar concerning this issue. Bottom line is solar panels are assessable if the Assessor believes it increases the value of the property. However, as long as it meets the criteria in Section 487 of RPT Law, an exemption will be issued unless the taxing agency has opted out of the exemption. Currently, Steuben County and the School District have opted out because the law shows no differentiation between solar panels erected in a home or solar installed for a large business.

MEETING OPENED to the PUBLIC comments consisted of the following: Handrail for pavilion #2 at the Caton Park.

Money donated by residents for a permanent memorial in the Caton Park for Bob Richards.

Capital Reserve Building Fund money can be used for a new highway building.

Senior Citizens group paying the church for electric/heat costs and use of the building.

Front door to Town Hall is looking pretty shabby and needs to be painted.

Supervisor Tucker is requesting that when the Committee gets the mailing ready to go out to residents that the Town Board and possibly the Planning and ZBA review and approve before any mailings go out.

Senior Citizens Contract-contract is complete and just needs to be signed by the President of the senior group and the Town Supervisor.

NEW BUSINESS

Standard Work Day for Elected and Appointed Officials-NYS Retirement system says the Town of Caton elected and appointed officials need to keep a 3-month track of their hours to complete the required standard work day for employees.

Town Hall building-Councilmember Fitzsimmons would like the Board to look into getting the building painted.

Property next to Town Hall-Councilmember Card would like the Building Inspector to work on getting the owner to clean up the property.

Caton Highway Department negative accounts are due to work that needed to be done. thanks for purchasing a new loader for the Highway Department.

Legislator Carol Ferratella Steuben County is still working on creating the Data Collection position to assist Assessors’

throughout the County with sales collection information. Also, working with CCC to encourage internships from the College as there are many retiring

assessors. Wendy Flaitz, Director of RPTS at the County is retiring at the end of October, 2016.

On Thursday, October 20, 2016, at 11:00 am, the Board of Caton Fire Commissioners will meet at 34 W Market Street in Corning for the purpose of reviewing site plans for the proposed new fire station.

Supervisor Tucker and a few Caton Fire Commissioners met at the Town Hall today with Comp Alliance rep Roman Rotko. Mr. Rotko discussed NYS Comp Alliance training requirements and housekeeping items that the Town Hall, Highway Department and the Fire District need to complete.

Whereas, the Town of Caton has received a Federal Grant in the amount of $250 for Police/Constable equipment, and

Library Hannah Little from the Southeast Steuben County Library, gave a presentation on library services that are available to residents in our Town.

The Library just completed their 2-year plan that includes reaching out to some of the outlying communities in our area that may have a difficult time getting to the Library and they are collecting information to find out what is most relevant to these Towns. The Town Clerk has handouts pertaining to several of the items that the Library offers to residents.

Steuben County Update, Carol Ferratella 2017 calendars and toner and ink products are available at the County at a substantial savings if interested. Also, the 2017 County Budget tax rate is going down and the Public Hearing for the budget is November 28th, 6 pm at the Steuben County Offices’ Building.

STCRPDB 2017 Contract On motion of Councilmember Card seconded by Councilmember Fitzsimmons the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Card, Scott, Tucker) NAYS 0-RESOLVED to accept and sign the proposed 2017 Contract with Southern Tier Central Regional Planning and Development Board in the amount of $4,594.

Supervisor Tucker suggested that the Town purchase and place LED caution blinker signs at the intersection of Birch Creek Road and County Route 32 vs. raising the road and purchasing land from the Page family as discussed with Steuben County and Town of Caton now for several months. Signs would be powered by solar and cost is around $1,500-$1,700, to be paid for out of CHIPS money. The Town would need to discuss with Steuben County DPW before moving ahead. > added on 12/14/2016: Councilman Scott would like the road fixed, changed over there on Birch Creek.

Comprehensive Planning Update Committee

Town Board has been given a copy of the Committee’s survey to review, although this copy has not been officially approved by the Committee.

Caton Park Supervisor Tucker to purchase a railing and install at pavilion # 2. Also, still considering what to purchase with money donated to park memorial for Bob Richards.

NEW BUSINESS Caton Community Days Committee

Supervisor Tucker received notice from the committee that they had met with Sprague Insurance Co. and due to increased liability constraints that may have implications with the Town and the committee’s personal lives the committee has made a decision to discontinue organizing the annual Community Days. However, the committee will continue with the scholarship awards for the community graduates. Supervisor Tucker to speak with the Caton Fire Department to see if they would be interested in taking over the lead.

Old Voting Machines Resolution #2016-102

On motion of Councilmember Fitzsimmons seconded by Councilmember Card the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Card, Scott, Tucker) NAYS 0- RESOLVED to declare the unused polling machines as surplus equipment.

Code Enforcement

Councilmember Card inquired if Code Enforcement has done anything to remedy the deplorable condition of the property at 11149 Hendy Hollow Road, next to the Town Hall. Attorney Maio stated that the Town Constable may also write a violation notice against this property. Councilmember Card would like a citation written before next month’s meeting.

Supervisor Tucker stated that this is Don Miller’s last year as Building Inspector/Code Enforcement. Town will post notice for hire on the website.

MEETING OPENED TO THE PUBLIC Local restaurant losing business due to condition of property at 11149 Hendy Hollow Road. All back taxes have to be paid on a property before it can be subdivided legally. Any plans on milling roads.

Supervisor Tucker adjourned the meeting at 7:20 pm.
