FUNfitness Volunteers Screen at Winter Games, Celebrates 10 Years

For the past 10 years, Texas physical therapy professionals and students have provided free screenings to Special olympics Athletes during State competi-tions and 2012 was no different. on Feb 10-11, volunteers from across Texas met at the Highland mall in Austin, TX where Athletes gathered at Athlete Village after their competitions. individual Athletes, as well as entire teams, took advantage of the free screenings by Funfitness and Fit Feet, both components of the Healthy Athletes® program. nearly 100 Athletes were screened by Funfitness volunteers during the two day event.

During the 20th Annual Winter games, nearly 2000 SoTX Athletes competed in volleyball, bowling, power lifting, and figure skating with competitions located all across the Austin area. in addition, special events such as opening Ceremo-nies, Victory Dance, Closing Ceremonies and demonstrations rounded out an-other awesome experience for athletes, coaches and families in attendance.

The Funfitness program was developed in collaboration with the American Phys-ical Therapy Association (APTA) for Spe-cial olympics (Soi) Healthy Athletes®.

The goals of Funfitness are to:

• assess needs in flexibility, strength, balance, and aerobic fitness; • teach exercises to help athletes im-prove identified areas of need;• educate participants, families and coaches about the importance of flex-ibility, strength, balance, and aerobic conditioning in overall fitness;• provide a hands-on opportunity for participants to learn how the physical therapist can help them with fitness.

How will these changes affect our Chap-ter? APTA is proposing changes to each component’s structure in an attempt to prevent reduplicating efforts of APTA so that the Chapter can focus on issues and needs specific to their state. This will be a gradual process if this structure is ac-cepted by the House of Delegates. Stay tuned. more to come.

APTA is also developing an alternate pay-ment method which is not based on CPT coding in order to improve reimburse-ment.

A preliminary report from the Task Force on rC3 was given by boD mem-ber Dianne Jewell. A written report will be given to the APTA boD at their April meeting and then will be given to the

delegates of the HoD for discussion prior to the June HoD.

And now, what change is happening in Texas?

eric Wilson has resigned as co chair of the government Affairs Committee. er-ic‘s leadership led us to our first hearing for direct patient access last year. Thank you eric for all of your hard work! Conse-quently TPTA will be seeking out candi-dates for the co chair and members for the gAC. eric proposed new structure to this committee last year to improve the efficiency of the committee and spread out the work of this committee to better accomplish our legislative goals. We are 10 months out from legislative session and there is a great deal of work to be done prior to January 2013.

It is essential that fundraising for the PAC fund continue as this helps us with legislative ef-forts.

Jerre van den bent has stepped down from co-chair of the membership com-mittee. Jerre and karina kunder have been instrumental in increasing mem-bership in Texas and increasing student involvement in the Association. Thank you Jerre for all of your hard work! Thank you karina for continuing to lead this committee.

TPTA is investigating ways to use technol-ogy to improve communication with the members and allow members to attend meetings without actually physically be-ing there.

in July, our three year strategic planning meeting will occur and we will plan the direction of the TPTA for the next three years. member participation is encour-aged as this is the opportunity to help decide the direction of TPTA for the next

This position has historically been handled by one Chair and committee members. We have already begun working to se-cure a bill sponsor for Patient Access to PT. last session, rep. Craig eiland car-ried our bill, and we hope that he will again. We hope to have multiple spon-sors, and possibly even multiple co-au-thors. An interim study is still not out of the question, and we will continue to push for this.

in addition to Patient Access, TPTA has identified other areas of concentration including adding PT to concussion leg-islation, copay legislation, adding PT to the Healing Arts Act regarding the Doc-

tor title, and nondiscrimination reim-bursement. We feel strongly about our progress for Patient Access in the last session, and hope that the 83rd Texas legislative Session is the one that we can say passed Patient Access to physi-cal therapy.

Section 15.50(a) of the Texas business and Commerce Code (the “Act”) governs the enforceability of non-compete agreements. under the Act, a non-compete agreement is enforceable if it is ancillary to or part of an otherwise enforceable agreement at the time the agreement is made. This means that to be enforceable, a non-compete agreement must be incorporated into, or referenced in another contemporaneously executed agreement between the Practice and the staff member. in other words, a court may conclude that a stand-alone noncompete agreement that is neither incorporated within nor tied to another agree-ment is unenforceable.

Additionally, to be enforceable, non-compete agreements must also be reasonable in time, scope, and geography. The statute does not specify what scope, distance, or length of time is reasonable. rather, parties must rely on case law to determine what restrictions are reasonable. The case law balances the interests of legitimately protecting the business interests of the employer versus unnecessarily preventing an individual from working in his or her trade or profession.

non-compete agreements often include ancillary provisions to provide additional protection to the Practice. Two such provi-sions commonly included are non-solicitation provisions and non-disclosure provisions. A well-crafted non-solicitation provi-sion can help reduce the risk of departing staff members from trying to lure away co-workers to join them in their new venture. likewise, a non-disclosure provision can help protect the Practice’s business operations by creating a contractual obligation of confidentiality under which the staff member may not share with others any of the confidential business operations he or she learned while on staff at the Practice. Practices should take special care to identify the information that it deems confidential so the non-compete agreement can be tailored accordingly to cover the appropriate information. An often overlooked item

that should be designated as confidential is the actual non-compete agreement.

There are a myriad of issues Practices must consider in order to protect their clients and confidential information when staff members depart. A well-crafted non-compete agree-ment can mitigate many of these risks. un-fortunately, it is often the case that the non-compete agreement, while well intentioned, is drafted in violation of applicable law and thus, unenforceable.

mary Thompson, professor in the School of Physical Therapy received the American Physical Therapy Association, Section on geriatrics’ Joan mills Award on February 10, 2012, in Chicago, il. According to the Section website, “this award was estab-lished in 1980 in honor of the Section on geriatrics’ first President, Joan m. mills. As the Section’s first president, Joan mills had the vision, determination, and dedica-tion to unite physical therapists caring for geriatric patients in their commitment to excellence in the delivery of physical therapy to older adults. Her years of leadership and participation have led to the growth and development of the Section and of new leaders in continuing to promote the mission of the Section. The intent of this award is to recognize a member who has followed in Joan mills’ footsteps, generously con-tributing his/her time, talents, and efforts to the development of the Section.” This is the highest award in this Section.

Jerre helped expand our membership committee into a true statewide committee of over 30 people. Whether he was referred to as the Dutch arm-twister, mentor, or handsome young fellow, he definitely made an impression in our hearts and profession. Jerre is stepping down as TPTA membership Co-Chair. This leaves a need for another membership Co-Chair to partner with myself. Jerre will still serve on our committee on a consultative basis, but we are looking for another passionate professional to continue moving our committee forward. We are still looking for membership committee volunteers. We need to retain first-year students and graduating students in the APTA. Physical therapist professionals and students assess:

• flexibility of the hamstring, calf, shoulder rotator, and hip flexor muscles;• functional strength of the abdominal and upper and lower extremity muscles; balance (single leg stance and functional reach); and • aerobic fitness (Step test or Wheel test).

The screening also provides instruction to participants about how to stretch, strengthen and improve balance and fitness. Physical therapist assistants and physical therapist/physical therapist assistant students assist in various aspects of the event.

Healthy Athletes currently offers health screenings in six areas other than Funfitness: Fit Feet (podiatry), Health Promotion (better health and well-being), Healthy Hear-ing (audiology), medFest (sports physical exam), opening eyes (vision) and Special Smiles (dentistry).

officially launched in 1997, Healthy Athletes organizes its events in a welcoming, fun environment. its screenings educate athletes on healthy lifestyle choices and identify problems that may need additional follow-up.

At more than 1.2 million free health screenings in more than 100 coun-tries, the Special olympics Healthy Athletes program, including Funfit-ness, has offered health services and information to athletes in dire need. in the process, Special olym-pics has become the largest global public health organization dedicated to serving people with intellectual disabilities. Despite a mistaken belief that people with intellectual disabili-ties receive the same or better health care than others, they typically re-

ceive sub-standard care, or virtually no health care at all. Healthy Athletes has the world’s largest database of health data for people with intellectual disabilities. Through Healthy Ath-letes, more than 100,000 health care professionals have been trained to treat people with intellectual disabilities. These health care professionals provide improved care to millions.

PANhANDlE DISTRICT:The Panhandle District had a wonderful meeting February 7. Joan Potter-bru-net, DPT, PT gave a great presentation on gait Assessments to start off our year of programming which will focus on gait. We had a good turn out with PTs, PTAs, and students from several of the local facilities.

CAPITAl AREA DISTRICT:The CAD march business meeting and CCu was held at Scott and White round rock on January 17, 2012. The topic provided by brian W Carr, PT, DPT, ATC, lAT was Si Assessment. The meeting was very well attended. Paul Hoover from Scott and White provided a great meal and reception for the meet and greet session. The CAD executive com-mittee would like to thank Scott and White for their generosity.

on January 20-22 the CAD and ACC PTA program hosted the APTA lAmP 2 con-ference which was also well received with over 20 leaders and new profes-sionals in the field in attendance.

The next CAD meeting will be on march 20 at ACC. The topic is introduction to Prosthetics “The First Steps into a new Horizon” sponsored by Prosthetic Sci-ence San Antonio.

The event allows people to walk amid 50 booths presenting information about a variety of health topics. other highlights include a large Zumba class and climbing tower for the kids. Also an, Amtryke ride will allow recepients to show off their skills and ride with several other riders. 2012 should also see the South Plains District connecting by webinar to other district meetings and CCu events acroos the state.

Leap to the Next LevelThe Sixth Annual Sports Medicine Symposium of the Americas will feature an all-star team of sports medicine physicians, pro-athlete physical therapists and expert athletic trainers. In Memoriam - Dale (Scooter) Phillipsit is with great sadness that TPTA announces the passing of Dale (Scooter) Phillips, a member from the midwest District. Dale leighroy (Scooter) Phillips, Jr. of Abilene, Texas was born march 3, 1963, in midwest City, oklahoma and passed from this life on February 20, 2012. Scooter and his office manager were enroute to norman, ok on monday when his plane went down.Scooter owned and operated rebound Sports and Physical Therapy for over seventeen years and also opened Steps 2 Strides, a provider of rehabilitation services for special needs children. Steps 2 Strides has two locations, one in Abilene and the other in Denison, TX. He also served on the board of Directors of enterprise investments, inc., and old Surety life insurance Company, both in oklahoma City, ok. Scooter loved life and lived it to the fullest. He enjoyed his work, sports, flying his airplane, and spending time with his family. Scooter is survived by two children, brendan, 16, and grace Ann, 13, and their mother, linda, all of Abilene, Texas.

Condolences to Scott humpal, Family and FriendsThe TPTA would like to express its deepest condolences to Scott Humpal, his family and the staff members of Humpal Physical Therapy. The Humpal’s plane went down during a heavy snowstorm on their way to a family vacation in Colorado. Scott lost his wife, gaby Humpal and pilot, Hans Vandervlugt in the crash.
