Walsh: Before the Court are several discovery motions filed by the parties and one of their lawyers. Though there are numerous issues in dispute, one of the biggest sticking points is the language of the proposed protective order. Defendants want the order to require that, before someone is shown documents produced in discovery, he or she must sign an acknowledgment that they have read and understood the protective order governing this case. Plaintiffs are concerned that some witnesses may refuse to sign the acknowledgment and argue that there should be a provision for those witnesses that allows them to see the documents even if they refuse to sign the acknowledgment. The Court sides with Defendants here and has signed and entered their proposed protective order. Having issued the protective order, the Court assumes that many of the issues the parties have been fighting about are moot. In addition, the Court notes that the district judge has denied Plaintiffs motion for class certification. This, too, will likely have an impact on the parties

assessment of the scope of discovery going forward. As such, the Court orders counsel to meet and confer again between now and May 24, 2012. No later than May 25, 2012, each side is ordered to submit a two-page status report setting forth what, if any, disputes raised in their motions are still in issue. The Court will hold a hearing on May 30, 2012 at 11:00 a.m. to allow counsel to address those outstanding issues.
