SECTION 1: The recitals set forth are herein adopted as part of this Ordinance.

SECTION 2: The Village will accept written bids for the purchase of all or part of the Subject Property until 4:00 p.m., Thursday, January 17, 2019 at the Village of Lakewood Village Hall, c/o Chief Administrative Officer, 2500 Lake Avenue, Village of Lakewood, Illinois, 60014. Such bids will be opened atthe January 22, 2019 Board of Trustees meeting at Red Tail Golf Club, 7900 RedTail Drive, Lakewood, Illinois 60014. The Village reserves the right to reject any or all bids for the Subject Property by a majority vote of the Village's corporate authorities then holding office and to accept any bid determined by the Village's corporate authorities to be in the best interest of the Village by a vote of three-fourths of the corporate authorities then holding office.

SECTION 3: The Village Attorney is directed to publish public notice at the first opportunity following its passage in a newspaper published in McHenry County, there being no newspaper published in the Village itself, in accordance with 65 ILCS 5/11-76-2.

SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.

SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.

SECTION 6: This Ordinance shall be in full force and effect upon its passage and approval.

Re: Motion authorizing Chief Administrative Officer to execute 36 month

contract with Comcast for expanded services

Currently the Police Department and Village Hall are using Call One for their telephone service and RedTail is using Comcast. Comcast has the internet service for all (3)

locations. Comcast is proposing that by consolidating the telephone and internet services at Village Hall, the Police Department, and RedTail Golf Club under one contract we can expand our level of service at discounted pricing.

Analysis

The new contract will provide:

1) All locations will now have voicemail-to-email (visual voice) service for each user. Currently there is no voicemail service for the police department.

2) New telephone system (no charge) for all locations. RedTail will have (1) wireless telephone as part of their (5) phone lines, allowing ability to answer while at different locations inside or outside the clubhouse. The telephone system at Redtail is over 15 years old.

3) Internet speed upgrade: Village Hall currently 50mg going to 150mg RedTail currently 25mg going to 150mg

4) Redundancy between Village Hall and RedTail, if either location has power issues the telephones can be automatically answered at the other location.

Additionally, the Village currently utilizes a service to maintain our phone system. In 2017 and 2018 the Village was charged $903.75 for this service. By switching to Comcast we will not be charged for phone maintenance or updates or setting up new users.

Finally, if approved Staff will be selling the existing phone system which will improve our bottom line on this proposal.

Recommendation

At this time, Staff respectfully requests and recommends a motion to authorize our Chief Administrative Officer to execute at 36 month contract with Comcast.

This Comcast Business Service Order Agreement sets forth the terms and conditions under which Comcast Cable Communications Management, LLC and its operating affiliates ("Comcast") will provide the Services to Customer. This Comcast Business Service Order Agreement consists of this document ("SOA"), the standard Comcast Business Terms and Conditions ('1"erms and Conditions"), and any jointly executed amendments ("Amendments") entered under the Agreement. In the event of inconsistency among these documents, precedence will be as follows: (1) Amendments, (2) Terms and Conditions, and (3) this SOA. This Agreement shall commence and become a legally binding agreement upon Custome(s execution of the SOA. The Agreement shall terminate as set forth in the Terms and Conditions (http://business.comcast.com/terms-conditions/index.aspx). All capitalized terms not defined in this SOA shall reflect the definitions given to them in the Terms and Conditions. Use of the Services is also subject to the then current High-Speed Internet for Business Acceptable Use Policy located at http://business.comcast.com/terrns-conditions/ndex.aspx (or any successor URL), and the then current High-Speed Internet for Business Privacy Policy located at http://business.comcast.com/terms-conditions/index.aspx (or any successor URL), both of which Comcast may update from time to time.

2. Comcast Business Voice, Internet, TV, Comcast Business SecurityEdge and Comcast Business SmartOffice™ Services ("Service") carry a 30 day• money back guarantee-. If, within the first 30 days following Service installation, Customer is not completely satisfied, Customer may cancel Service and Comcast will issue a refund for the monthly recurring fee paid for the first 30 days of service, excluding installation charges, fees, taxes and voice usage charges, however, Customer will be charged any remaining payments owed for non-refundable fees (including installation) and other charges. In order to be eligible for the refund, Customer must cancel Service within 30 days alter installation and return any Comcast-provided equipment in good working order. In no event shall the refund exceed $500.00.

3. To complete a Voice order, Customer must execute a Comcast Letter or Authorization ("LOA") and submit it to Comcast, or Comcast's third party order entry integrator, as directed by Comcast.

4. New telephone numbers are subject to change prior to the install. Customers should not print their new number on stationery or cards until alter the install is complete.

5. Modifications: All modifications to the Agreement, if any, must be captured in a written Amendment, executed by an authorized Comcast Senior Vice President and the Customer. All other attempts to modify the Agreement shall be void and non-binding on Comcast. Customer by signing below, agrees and accepts the Terms and Conditions of this Agreement.

6. IF CUSTOMER IS SUBSCRIBING TO COMCAST'S BUSINESS DIGITAL VOICE SERVICE, CUSTOMER, BY SIGNING BELOW, ACKNOWLEDGES RECEIPT AND UNDERSTANDING OF THE FOLLOWING 911 NOTICE:

911 NOTICE Comcast Business Digital Voice service ("Voice Service") may have the 911 limitations specified below:

In order for 911 calls to be properly directed to emergency services using Voice Service, Comcast must have the correct service address for the telephone number used by the Company. If the Voice Service or any Voice Service device is moved to a different location without Company providing an updated service address, 911 calls may be directed to the wrong emergency authority, may transmit the wrong address, and/or Voice Service (including 911) may fail altogether. Customer's use of a telephone number not associated with its geographic location may also increase these risks.

• The Voice Service uses electrical power in the Company's premises. If there is an electrical power outage, 911 calling may be interrupted if a battery back-up is not installed in the voice modem, fails, or is exhausted.

• Calls using the Voice Service, including calls to 911, may not be completed if there is a problem with network facilities, including network congestion, network/equipment/power failure, a broadband connection failure, or another technical problem.

• Customer should call Comcast at 1-888-824-8104 if it has any questions or needs to update a service address in the 911 system. Delays in updating the service address may also impact 911.

• BY SIGNING BELOW, CUSTOMER ACKNOWLEDGES THAT IT HAS READ AND UNDERSTANDS THE FOREGOING 911 NOTICE AND THE 911 LIMITATIONS OF THE VOICE SERVICE.

If, within the first 30 days following Service installation, Customer is not completely satisfied, Customer may cancel Service and Comcast will issue a refund for the monthly recurring fee paid for the first 30 days of service, excluding installation charges, fees, taxes and voice usage charges, however, Customer will be charged any remaining payments owed for non-refundable fees (including installation) and other charges. In order to be eligible for the refund, Customer must cancel Service within 30 days after installation and return any Comcast-provided equipment in good working order. In no event shall the refund exceed $500.00.

4. New telephone numbers are subject to change prior to the install. Customers should not print their new number on stationery or cards until after the install is complete.

5. Modifications: All modifications to the Agreement, if any, must be captured in a written Amendment, executed by an authorized Comcast Senior Vice President and the Customer. All other attempts to modify the Agreement shall be void and non-binding on Comcast. Customer by signing below, agrees and accepts the Terms and Conditions of this Agreement.

In order for 911 calls to be properly directed to emergency seivices using Voice Seivice, Comcast must have the correct seivice address for the telephone number used by the Company. If the Voice Seivice or any Voice Seivice device is moved to a different location without Company providing an updated service address, 911 calls may be directed to the wrong emergency authority, may transmit the wrong address, and/or Voice Seivice (including 911) may fail altogether. Customer's use of a telephone number not associated with its geographic location may also increase these risks.

• The Voice Service uses electrical power in the Company's premises. If there is an electrical power outage, 911 calling may be interrupted if a battery back-up is not installed in the voice modem, fails, or is exhausted.

• Calls using the Voice Service, including calls to 911, may not be completed if there is a problem with network facilities, including network congestion, network/equipment/power failure, a broadband connection failure, or another technical problem.

Pursuant to Ordinance No. 2010-06, AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION WATERWORKS AND SEWERAGE REFUNDING BONDS (ALTERNATE REVENUE SOURCE), SERIES 2010B, OF THE VILLAGE OF LAKEWOOD, MC HENRY COUNTY, ILLINOIS, PROVIDING THEIR DETAILS OF SUCH BONDS AND FOR AN ALTERNATE REVENUE SOURCE AND THE LEVY OF DIRECT ANNUAL TAXES SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON SUCH BONDS, AND RELATED MATTERS, passed and approved March 23, 2010, by the President and Board of Trustees of the Village of Lakewood, McHenry County, Illinois (the "Issuer") (with respect to which undefined terms herein shall have the meanings therein, the "Bond Ordinance"), the undersigned, as Village President and Treasurer of the Village of Lakewood, Illinois, hereby certify to the McHenry County Clerk that it is appropriate to reduce by abatement the tax levy for 2018 (to be received in 2019) as provided in Section 13 of the Bond Ordinance (filed on March 23, 2010, with such County Clerk), as follows:

The County Clerk is hereby directed to abate taxes as set forth above and to ascertain the rate percent required to produce the aggregate tax herein above provided to be levied in 2018 (for 2019 tax year), as shown above to be levied, and to extend the same for collection on the tax books in com1ection with other taxes levied in such year, in and by the Issuer for general corporate purposes of the Issuer, and in such year levied and collected in like mam1er as taxes for general corporate purposes for such year is levied and collected and, when collected, such taxes shall be used solely for the purpose of paying the principal of and interest on the Bonds herein described as the same become due and payable. The tax levy shall be abated as parenthetically shown above. Otherwise Ordinance No. 2010-04 shall be given effect according to its terms, and we certify the compliance with such Ordinance preliminary to filing this Abatement Certificate.

If any paragraph, sentence or provision of the Ordinance shall be adjusted by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.

This Ordinance shall take effect from and after its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.

An Ordinance Authorizing the Abatement of Taxes on Certain Property Annexed to the Village of Lakewood Pursuant to 35 /LCS 200118-184

WHEREAS, 35 ILCS 200/18-184, Abatement; Annexation Agreement, authorizes municipalities, upon a majority vote of its governing authority, to order the county clerk to abate any portion of its taxes on any property that is the subject of an annexation agreement; and

WHEREAS, on June 6, 2010, the President and Board of Trustees of the Village of Lakewood ("Village") passed ordinances authorizing execution of several annexation agreements ("Agreements"); and

WHEREAS, pursuant to the Agreements, the Village agreed to adopt an ordinance, pursuant to 35 I LCS 200/18-184, ordering the McHenry County Clerk to abate the Village portion of taxes on the properties that were the subject of the Agreements.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lakewood, McHenry County, Illinois, as follows:
