I DtFKIVE PRISONER S Watson Moves Court To Instruct Jury For Not .Guilty. NEW LAW POINT RAISED IN BURGLARY COMPL INT SOLDIERS INDICTED FOR FELONY ALLEGED TO DE ONLY GUIL- TY OF MISDEMEA- NOR. Another question of law, following numerous rcceut constitutional and technical contentions In Judgo Gear's criminal court, was this morning brought up by Attorney 12. M. Watson, representing three Camp McKlnley sol- diers, Fischer, Buckley uud Kerny, charged with burglarizing Moody's Walklkl saloon. Watson moved tho court to Instruct tho Jury to return a verdict of not guilty. Judgo Gear took the matter under advisement until 1:30 o'clock. Watson contended that tho law was such, that burglary, constituting tha breaking Into a place with intent to commit a felony, did not cover larceny. Defendants were charged with taking n few bottles of beer, evidently below the value of fifty dollars; this was not telony, and yet they were Indicted for burglary which was defined ns break- ing Into a place "with Intent to com- mit a felony." The Attorney General stated that he had asked the Governor for the Id- lers and that Mr. Dole had stated that the communications In question hud been returned to Chief Justice Frear, to whom they belonged. ' "I cannot very well ask the Chief Justice for bis private correspond- ence," Mr. Andrews remarked to the court nt the time of the termination of the case. Another question of law, followingnumerous rcceut constitutional andtechnical contentions In Judgo Gear'scriminal court, was this morningbrought up by Attorney 12. M. Watson, representing three Camp McKlnley sol-diers, Fischer, Buckley uud Kerny, charged with burglarizing Moody'sWalklkl saloon.

Watson moved tho court to Instructtho Jury to return a verdict of notguilty. Judgo Gear took the matterunder advisement until 1:30 o'clock.

Watson contended that tho law wassuch, that burglary, constituting thabreaking Into a place with intent tocommit a felony, did not cover larceny.Defendants were charged with takingn few bottles of beer, evidently belowthe value of fifty dollars; this was nottelony, and yet they were Indicted forburglary which was defined ns break-ing Into a place "with Intent to com-

Gear stated that nil let tern had bceuwith the Governor when that gentle-man had lequcstcd the threo circuitjudges to- confer with him on the mat-ter. The Attorney General stated thathe had asked the Governor for the Id-

"I cannot very well ask the ChiefJustice for bis private correspond-ence," Mr. Andrews remarked to thecourt nt the time of the terminationof the case. Judgo Gear allowed thonolle pro&pqui to be entered, regrettingtho unavailability of the correspond-ence.

Chief Juttlce Frear, when asked tillrooming If he would permit the muchtalkeil-o- f correspondence to. be pub-lished, replied.

COST NOTHIMJF IT FAILS,

Any honest person who suffers fromRheumatism Is welcome to this offer.

I am a specialist In Hheumatlsm, andhave treatc.t moro cases than any oth-er physician, I think. For 10 years Imade 2,000 experiments with differentdrugs, testing all known remedieswhile searching tho world for some-thing hotter. Nine years ago I found acostly chemical In Germany which, with my previous discoveries, gives mea certain cure.

I don't rrean that It can turn bonyJoints Into flesh again; but It can curetho disease at any stago, completelyrnd forever. I have done It fully 100,.000 times.

I know this so well that t will fur.rlsh my remedy oc trial. Slmplrwrite me a nostal for mv tmnit nnRheumatism, and I will mall vmi nncrder on your druggist for six bottlesur. snoop's Rheumatic Curo. Take Itfor a month at my risk. If It succeeds.tho cost is only 15.50. If It falls, I willray tho druggist myself- -. and yourmere word shall decide It.

I mean that exactly. If you say thelcsults are not what I claim. I don't ex-pect n penny from you.

I hnvo no samples. Any mere sara-Ti- e

that can affect chronic Rheuma-tism must bo drugged to tho vergo ofdanger. I use no such drugs, and It Isfolly to tako them. You must get thedisease out of tho blood.

My remedy docs that even In themost dlftlcult, obstinate cases. It hascured tho oldest cases that I ever met.And In all my experience in all my2,000 tests I never found another rem-edy that would cure one chronic casein ten.

Write me and I will send you the or-der. Try my remedy for a month, jisIt can't harm you, anyway. ItJt fallsIt Is free.

titles this conclusion. Tho consent ofthe peoplo Is irresistibly Inferred fromthe fact that no civilized communitycould possibly dcslro to abrogate anexisting government, when the alter-native presented would be to ptacethemselves In a state, of anarchy, be-yond the protection of all laws, and re-

duce them to the unhappy necessity ofsubmitting to the dominion of thestrongest' ".Evils That Follow.

The evils that would follow In casethe decision of our Circuit Judge Islaw, are easily seen. A misdemeanantcharged with malicious Injury, for Instance, for which he might be fined$10 00 must be before Hiptrlct Magi.trate. He has not even thepoor privilege of pleading guilty, butmust bo sent to the Circuit Court to beindicted If he does not consent to beheld for the grand Jury his case Isheard. Tills Involves a ugular trial.Ho must procure, a lawjcr, and It thoMaglstrato finds there Is probablecause, he Is held over for the grandJury. He Is then released on ball, Ifho can procure ball, for which he mustgive a bond. This bond requires u dol-

lar revenue stamp If he can t procureball he must remain In Jail, lu casethe grand Jury should find a true billngnliist him, his case cotrld not. In allprobability, come on for hcariug with-in six months of the hearing in thedistrict couit Ho Is then brought upami arraigned lu the circuit court.niiT.it7 hit juuai ii,.WU I'lUJIiU u !iiwcriui represenc mm, auu is put upon Illstrial. If he Is found guilt), the costsof court would probably amount to 37,which ho would have to pay or workout. I have assumed that tho trialwould come off within six months otthe first hearing iu the district court, but in all probability It would bo nearer threo years If all misdemeanantsure to he Indicted. A man 4htis charged, although he might have been willingto plead guilty In the district court, isobliged to submit to tho senseless ceremony which I havo set forth, the onlydifference being that he pleads guiltyto ttio Indictment when arraigned Intho circuit court. Instead of procuringa lawvcr and atandlng trial. In case aman should desire to resist or to defendhimself from what he considers to boan unjust charge, ho would havo to re-

In speaking on Labor Day otthe annual fair of the New YorkState Agricultural Association, itIs natural to keep especially In

mind the two bodies who com- -

pose the majority of our peopleand upon whose welfare depends

i-- the welfare of the entire State. If! circumstances are such that

thrift, energy, industry and fore- -

thought enable the farmer, the til- -

ler of the soil, on the one hand, and the wageworker, on the other, -

to keep themselves, their wives,: and their children In reasonable

comfort, then the State Is welloff, and we can be assured thatthe other classes In the communi- -

ty will likewise prosper. On theother hand, If there is in the longrun a lack of prosperity amongthe two classes named, then allother prosperity Is sure to bemore seeming than real. Presl- -
