Watson moved tho court to Instructtho Jury to return a verdict of notguilty. Judgo Gear took the matterunder advisement until 1:30 o'clock.
Watson contended that tho law wassuch, that burglary, constituting thabreaking Into a place with intent tocommit a felony, did not cover larceny.Defendants were charged with takingn few bottles of beer, evidently belowthe value of fifty dollars; this was nottelony, and yet they were Indicted forburglary which was defined ns break-ing Into a place "with Intent to com-
