Re: Local Improvement Charge Bylaw #2013-46 Ogilvie Street Reconstruction Project

File# 4025-01 OSW

The City proposes a capital project in the Ogilvie Street area which includes new water lines and sanitary sewer upgrades, improved fire protection, improved water drainage and sanitary services, improved street lighting, new asphalt paved surfaces with bike lanes, concrete curb and gutter with sidewalk and landscaping. This reconstruction project includes a local improvement portion that will provide funding for the cost of surface work which is detailed in the attached bylaw. This Bylaw was given first reading at the Regular Council meeting held September 23, 2013.

The City's Engineering Department has already introduced the project through a letter and a meeting on September lOth, and further engagement is encouraged. This letter and ballot are your official written notice of the proposed work, in accordance with the Municipal Act

The estimated total cost of the reconstruction project is $3,800,000, of which $475,341 constitutes the Local Improvement Charge (LIC) portion for surface works. Costs for the LIC are set at 2013 urban standard rate in accordance with the City's LIC Policy (attached), and the details for this project are included on your ballot (also attached). The City pays for the remainder of the project through the available capital funds.

The work funded by the City includes the balance of the cost of surface works under the LIC, the costs of all water and sewer work in the roadway, and installation of recirculating water services on your property and into the wall of your building. Work inside the building and replacement of your private sewer service (optional) will be the responsibility of the property owner. We have enclosed a diagram to illustrate the cost responsibilities, and the Engineering department welcomes any questions you might have. We have also enclosed a preliminary design of the proposed surface improvements to provide an idea of the final result. Detailed design would be done by an engineering consultant and would be developed in consultation with property owners if the project proceeds as a result of this ballot.

The benefitting property owners have 30 days in which to submit a vote or a negative written response to the City as to whether the LIC Bylaw should be approved for the above-noted project Therefore according to the Municipal Act, the ballots must be returned to the City by no later than November 1, 2013.

If the majority of the benefitting property owners object to this local improvement in writing the project cannot proceed, therefore if you object to this LIC you must notify the City in writing.

A public hearing with respect to this LIC is scheduled for a Special Council Meeting on Monday, October 21,2013 to receive and consider any submissions property owners may have regarding the proposed project and LIC. The public hearing will be held in Council Chambers at City Hall, beginning at 5:30p.m.

LOCAL IMPROVEMENT CHARGE (LIC) VOTE BY PROPERTY OWNERS ON BYLAW 2013-46

OGILVIE STREET WEST- PROPOSED INFRASTRUCTURE RECONSTRUCTION PROJECT

Under the Municipal Act all benefitting property owners must be sent written notice of the proposed work. The information is as follows:

The estimated total cost of the capital project is $3,800,000 of which $475,341 constitutes the Local Improvement Charge (LIC) portion. Costs associated with the surface works portion of the project are set at a fixed cost for residential properties at $600.00 per linear metre of property frontage and non-residential properties at $1,195.00 per linear metre of frontage. These costs are in accordance with the City's LIC Policy, where residential properties pay only 1/3rd of the estimated average cost of construction of roads, and in which non-residential properties pay 2/3rds. The City pays for the remainder of the project's design and construction through the available capital funds.

Schedule "A" of the Bylaw lists the legal description and location of the benefitting properties along with the assessable costs for each. It is proposed that in the year following completion of the project, the property owner will have the option of paying the lump sum amount (Total Property Charge Column) OR of paying the annual property assessment for 15 years with the interest rate estimate @ 6.25% (Total Property Charge over 15 years with Interest @ 6.25% Column). The property owner may also come in at any time during the 15-year life of the bylaw and pay off the balance owing, or make lump sum payments each year in January.

A public hearing has been scheduled for a Special Council Meeting on Monday, October 21, 2013 so that Council may hear and consider all submissions with respect to the proposed Local Improvement Charge (LIC)

Property owners are asked to vote for acceptance or rejection of the above-mentioned project and LIC. If you object to the Local Improvement as proposed, please complete the appropriate section on this ballot and return it to the Manager, Financial Services using the attached return envelope by November 1, 2013.

If the majority of the benefitting property owners reject this local improvement, it cannot proceed. Please see the Municipal Act, Section 267-271 for further information.

WHEREAS section 267 of the Municipal Act (R.S.Y. 2002) provides that a municipality may undertake any local improvement it considers necessary for the benefit of all or part of a municipality; and

WHEREAS section 268 of the Municipal Act requires that a bylaw to provide for and authorize a local improvement will prescribe which parcels of land will benefit and how to determine the total cost or a portion of that cost that is to be levied against parcels of land that will benefit from a local improvement, and determine the levy to be charged against each parcel of land that will benefit over the probable life of the local improvement; and

WHEREAS section 268 of the Municipal Act provides that council may by bylaw levy the total cost or a proportion of the cost of a local improvement against the parcels of land that will benefit from the local improvement, and provide the means for assessment, collection, and payment of the cost; and

WHEREAS the actual cost of the said design and construction is estimated to be $3,800,000.00 of which $475,341.00 will be raised by way of a special frontage charge, and $3,324,659 will be contributed by the municipality at large; and

WHEREAS in order to construct and complete the project it will be necessary to borrow up to the sum of $475,341.00 on the credit of the City by issuing debentures as herein provided; and

WHEREAS the amount of taxable assessment as last determined and fixed by the Assessment Review Board for 2012 was $2,313,962,362.00; and

WHEREAS the amount of debenture debt of the City as at December 31, 2012 was $10,825,283, no part of which is in arrears; and

WHEREAS the estimated life of the project exceeds fifteen years; and

WHEREAS it is deemed necessary and expedient to undertake certain local improvement works, namely the construction of underground and surface works on a portion of Ogilvie Street between Fourth Avenue and the escarpment;

NOW THEREFORE the Council of the municipality of the City of Whitehorse, in open meeting assembled, hereby ENACTS AS FOLLOWS:

1. Pursuant to section 269 of the Municipal Act, notice is hereby given that the Council of the City of Whitehorse hereby authorizes a work of local improvement, being the construction of underground and surface works on the roadways abutting the properties as set out in Schedule 11A11 attached to and forming part of this bylaw.

(3) The property owner may pay off the balance owing at any point during the15-year life of the bylaw.

11. The frontage rate is determined as residential or non-residential in accordance with the property's assessment class. Should this assessment class change during the life of the bylaw, it is hereby authorized that the unit rate may also change as required.

12. Any existing local improvement charges for surface works abutting any properties set out in Schedule "A" are hereby rescinded.

13. The provisions of section 269 and 270 of the Municipal Act respecting the giving of notice and hearing of objections shall be followed prior to final passage of this bylaw.

14. A public hearing is scheduled to take place at a Special Council meeting on Monday, October 21, 2013 at which council will hear and consider any submissions respecting this proposed project and local improvement charges. The meeting will be held in Council Chambers at City Hall, beginning at 5:30 p.m.

15. The provisions of this bylaw shall come into full force and effect pending budget approval.
