We have TWO activities for you this month – one to get you MP involved, another for your MEP:

As expected; the EU Parliamentary vote on Anti-Tampering, Compulsory ABS, etc under proposed changes to Type-

Approval, has been POSTPONED to 3rd July 2012, leaving time for more lobbying and for a summer motorcycle

street party as the date for the next round of EU Hands-off Biking protests has been set for 24th June 2012...

Negotiations on the Type Approval Regulation are on-going between the Council of Ministers (the National

Governments), the EU Commission and the EU Parliament, but it would appear (from various sources including our

own DfT) that there is some distance between the various views, so a common position may still be some time

coming.

It is remarkable how MEPs have been waking up to MAGs campaign, so thanks for all your efforts. This sympathetic

ear of MEPs and their staff is cross-party and MEP dependant, which demonstrates that a rational argument, clearly

put, does bring results and opens the door to face to face meetings which further build our case.

This Friday 30th March saw Giles Chichester MEP answering questions in Exeter at Bridge Motorcycles 7.30pm and

Paddy has further meetings booked with MEPs of all political persuasions. We have more time now that the vote has

been moved to July, so please take advantage of it. If you want help organising a Riders Are Voters public meeting

with one of your MEPs, please get in touch, (but please make sure the subject header in your email is relevant).

You may remember MAG member Jon Strong's case that the European Ombudsman has upheld against the EU

Commission (please ask to see it if you haven't already http://www.ombudsman.europa.eu/shortcuts/contacts.faces

and ask for details of Case reference 0875/2011/JF). Steven Baker MP has formally written to the Roads Minister,

Mike Penning, asking that the British Government consider taking the EU Commission to Court for its contravention

of the Treaty of the EU.

In essence, there is no evidence for what has been proposed about Anti-Tampering, or many other parts of this

Regulation. The EU Commission acknowledge this and have not done any necessary research to establish if there is a

problem with riders modifying bikes, or even how many do it. Rather like IMCO voting before they have all the info,

the Commission really shouldn't have even proposed this legislation without it!

I have heard from the Department for Transport that they were overwhelmed with the letters you sent to Secretary

of State Justine Greening - over 300 in two days! - so huge thanks for that. They are aware of the situation, have

acknowledged the campaign and have decided to deal directly with MAG Central office on the issue, as they

investigate the legal aspects and so that they don't have to reply to you all individually!

But now we need your MP to write as well, on your behalf, so please contact them (www.ridersarevoters.org if you

aren't sure who they are) and ask them to write to the Minister in support of Steven Baker's letter.

It is very important that you include your address with post code this time because it is now a local issue. Adding a

personal twist to your letter is important, and actually doing one on paper is even better, but the basis of what you

might like to write is included below. Of course if you already know your MP you may want to pop round to the

constituency office and talk to them or their staff. Your MP may ask you to sign a form which will enable them to act

directly on your behalf on this issue.

As a constituent and someone who works in the motorcycle industry/ is a motorcycle instructor/ owns a bike

shop/ commutes everyday to beat congestion and minimise their carbon footprint, I would like to draw your

attention to a proposed European Regulation COM(2010)542 which, if enacted could severely curtail my business/

personal mobility/ freedom of choice/ wealth. The EU Commission, although consolidating existing legislation, has

added new, restrictive clauses, such as article 18 (which aims to stop personal motorcycle modifications) without

any evidential base.

The European Ombudsman has found that the Commission has a case to answer (0875/2011/JF) and now Steven

Baker MP (High Wycombe) has written to Mike Penning MP the Minister for Roads, calling on him to consider

taking the EU Commission to the European Court of Justice.

I urge you, as my representative, to write to the Minister in support of Steven Baker's letter of 12th March. As the

proposed regulation stands it is in contravention of the Treaty of the European Union Article 5 para 5 and fails to

comply with the principle of proportionality. There is no proof that there is a link between motorcycle modification

and safety, nor has there been any research undertaken to assess the size of the so-called problem.

2. Contact the UK Government now….

The other thing that you can do in light of Steve Baker's recent request to the UK Gov, is to write to Justine Greening the Secretary of State for Transport [email protected] and say something like this:

Dear Secretary of State

The European Ombudsman (case number 0875/2011/JF) has found that the EU Commission has a case to answer for maladministration and issues of proportionality, as defined by the Treaty of the European Union (Article 5 para 4), regarding its proposed Regulation COM(2010)542 final.

Issues within the Regulation raising concern in regards of proportionality include Anti-tampering, mandatory Anti-lock Braking Systems (ABS) and Automatic Headlights On (AHO).

The Regulation is currently timetabled to go before Plenary session on 19th April 2012 without evidence to support some of the proposals contained within. I fear that the case before the Ombudsman will not be resolved prior to that Parliamentary vote.

I am therefore writing to ask that you call on the European Commission to drop those articles relevant to the Ombudsman's investigation, especially article 18 of its proposed regulation, until these issues can be resolved.

I further ask that you support the call from Steven Baker MP (High Wycombe) demanding the European Court of Justice makes a ruling on this fundamental breach of the Treaty of the European Union.

Useless impact assessment reinforces ABS proponents (29 Feb)

The EU parliamentary committee in charge of the motorcycle type approval regulation rejected the findings of an impact assessment it had ordered previously due to flawed data assessment. Contradicting the Committee's vote the analysis concluded that mandating ABS for scooters and motorcycles with an engine displacement below 125cc was not cost-effective.

In the course of the decision making process of the EU regulation "on the approval and market surveillance of two- or three-wheeled vehicles and quadricycles", the Committee for Internal Market and Consumer Protection (IMCO) of the European Parliament decided to expand mandatory Anti-lock Braking Systems (ABS) to new scooters and motorcycles from 51cc to 125cc (A1 category vehicles). The European Commission had originally proposed the option to install either ABS or Combined Braking Systems (CBS) for this category of vehicles.

IMCO further agreed to commission a study to assess the potential effects of the most drastic changes resulting from its vote. Next to the extending of ABS provisions the impact assessment, carried out by the British consultancy London Economics, aimed at shedding light on the cost-benefit of modifying On Board Diagnostics requirements and changing the timetable for emission standards for the application of the provisions.

Good results based on deficient analysis

FEMA and its member associations as well as the Association of Motorcycle Manufacturers in Europe (ACEM) oppose mandatory ABS for the A1 category based on the reason that for this group of vehicles CBS performs equally in terms of safety but is less costly then ABS. With an average price of 2.800€ A1 motorcycles and scooters used to be an affordable means of transport for commuters from all social levels as well as the entry category for young riders. Having to add the estimated average of 500€ per unit due to the installation of ABS would result in an average price increase of 16% for these vehicles.

Now the results of the impact assessment have indicated that for all the three IMCO decisions assessed, ABS for A1, On Board Diagnostics and the amended timetable for emission limits, the costs outweighed the benefits. Especially for mandatory ABS the costs seemed disproportionately high.

Unfortunately, the consultants of London Economics did not seem to have invested special efforts into quantifying the costs and benefits of these measures. Especially with regard to ABS, the most controversial issue, instead of thoroughly investigating all costs from production to adaptation and installation and not least maintenance, London Economics simply relied on the figure given by ACEM: 500€.

FIA, the umbrella organisation of car drivers' clubs, immediately stated ABS FOR MOTORCYCLES: FIA DISAPPOINTED WITH FLAWED COST-BENEFIT ANALYSIS. And on Tuesday, 28 February, due to apparent shortcomings, the vast majority of the members of IMCO agreed to not take the results of the impact assessment into account at all. Therefore IMCO is going to stick to its call for mandating ABS for all powered two wheelers exceeding 51cc.

How not to spend money and how to calculate costs

FEMA is seriously wondering about the amount of taxpayers money spent for an impact assessment, whose preparation had taken over two months, which at the end is not being taken into account by anybody. As ACEM points out the stated figure of 500€ is not based on pure guesswork but could have been analysed thoroughly and convincingly:

"ACEM wishes to underline the following manufacturers' costs per ABS system fitted/per individual vehicle: - Manufacturers' costs for additional hardware sourcing (e.g. pump, phonic wheel, CPU, wheel sensors, additional hoses, electric wiring, etc) start at 200€ for a basic ABS system. More complex systems can reach more than double, up to 500€. Smaller motorcycles, equipped with drum brakes, will even require changing the wheels, further increasing the costs. - Manufacturers' costs for application (e.g. adjustment of the function to the specific motorcycle model) will vary,

depending on the complexity of the system and on the foreseen number of vehicle units sold over the model's commercial lifetime. This cost can be estimated on average at 30€ per vehicle. In case of below-average-volumes production, all costs will be much higher.

Total costs to install ABS for manufacturers' start therefore at 230€ per vehicle for the most basic systems, with large variations depending on volumes. These translate currently into consumer costs from 400€ to 1000€, with an average around 500€.

Whilst ACEM can agree that economies of scale and competition will to some extent contribute to reducing these costs, the magnitude of this future expected reduction should remain realistic. Motorcycle average production is much lower than car average production and is insufficient to trigger the economies of scale announced by some stakeholders. CBS systems also have varying degrees of complexity, but on average their costs can be estimated to be approximately 50% of those for ABS."

Parliament vs Council

It becomes apparent that the majority of member states are not willing to support mandatory ABS for A1 vehicles therefore Council is expected to oppose the measure. Currently IMCO Rapporteur Wim van de Camp is trying to find a compromise between Council and EU Parliament and irrespective of the success of these so called trilogue discussions (the third party being the Commission who acts as advisor) there is still a chance that the Plenary of the EU Parliament finally votes against ABS despite the recommendation of IMCO.

And if not the legislative process is likely to go into second reading which would slow down implementation dates considerably. The more ambitious timetables IMCO was bringing forward could then become obsolete again. Finally nobody would benefit since manufacturers had to bear an extensive period of uncertainty which usually tends to hamper innovation.

From July Motorcyclists as well as drivers must carry breathalysers in France From 1 July this year all road users (except mopeds), using French Roads, need to carry a breathalyser kit, Even though the start date is 1 July 2012, it won’t actually be enforced until the 1 November 2012, giving road users time to prepare for the change.

Single-use breathalyser kits will satisfy the requirement. The legal limit in France is 50 mg per 100 ml of blood, lower than in the UK (the UK limit is 80mg). They cost between £1 and £2 and they will be available at ferry and tunnel terminals for crossings to France.

Drivers/riders are being advised all road users to carry at least two breathalysers at all times, so that if one is used you still have one to produce for the police if you are stopped.

AROUND THE COUNTRY

London

After much lobbying and in light of the recent Transport for London decision to permanently open red route bus lanes

to motorbikes, Westminster City Council have today announced that they shall follow suit.

Councillor Lee Rowley said: "Our long term objective is to solve the congestion problems in London by creating a safe,

clean and vibrant environment in which all road users can benefit from Westminster's streets.

"With the use of scooters rising by over 11% in 2011, it is important that the council takes action to help two-wheeled

road users get around the capital safely."

MAG have been working very closely with Westminster Council for months on this issue, the realisation that motor-

cycles can play a significant part in traffic congestion reduction and in the reduction of emissions swayed the balance.

Since the mid 1990's, MAG has been working with Councils around the country to achieve access to bus lanes for

safety, environmental and convenience reasons. Councils as diverse as Bristol, Bedford and Swindon have seen the

sense and approved the idea.

Bikes do not cause congestion and it is terrific that a flagship council such as Westminster is prepared to begin

consultation on 6th March for 3 weeks having acknowledged the safety and environmental arguments. Much credit

must go to MAG's Dr Leon Mannings for his work on this.

East Yorkshire MAG Victory for Humber Bridge.

East Yorkshire MAG have had a victory in getting the toll removed from the Humber Bridge. From April the 1st 2012

motorcycles will be able to cross the bridge without charge. The bridge was opened by HM the Queen in July 1981 and has charged for all vehicles from its opening, the motorcycle charge today is £1.30 per crossing. East Yorkshire MAG have always objected to motorcycles being charged a toll since its opening, but over the last ten years the group has stepped up its campaign by holding meetings with the Humber Bridge Board, holding numerous letter writing campaigns and finally resorting to mass slow pay demonstrations attracting hundreds of motorcyclists from as far as afield Scotland. The campaign has had a two stances, one because of the delays to other road users as the motorcyclist struggles to hold a bike and search for change to give to the toll collector, but our main objection to the toll is that whist charging motorcycles the bridge is seen not to be promoting a more economical mode of transport that will undoubtedly encourage motorists to use two wheels and this will reduce congestion and emissions in the regions adjacent to the bridge.

BATH - Moped and motorbike thefts - protect your property

Bath police are urging moped and motorbike riders to take extra precautions to protect their property, following a series of thefts in the South West of the city. There have been more than 30 such thefts reported of motor vehicles since December last year in the Twerton, Southdown and Oldfield Park areas. Three motorbikes were tampered with in Oldfield Park yesterday (Tuesday March 20) but the thieves failed to drive them away. The mopeds and motorcycles are stolen from driveways and front gardens or from roads in front of their owner's property, although there have been cases where motorbikes have been stolen from back gardens. Cars have also been stolen. The thefts take place overnight, on all nights of the week, with the vehicles hot-wired and started by having their ignition damaged. Most have been recovered in the area, sometimes close to where they were stolen. A small number have been set on fire. Many have been found in Rosewarn Park or the Linear Path. Police believe a gang of young men are responsible for the thefts. They are appealing for anyone who can identify them or who has any information to contact them on 101, or via Crimestoppers on 0800 555 111. People are also urged to take greater security measures to prevent their motorbike or car from being stolen. • Always lock your vehicle or fit a heavy chain and padlock • Park in well-lit areas • Fit an alarm or immobiliser. • Use a good quality ground anchor. • Cover your machine.

Motorcycle testing

Baker moved the questioning onto the subject of motorcycle tests.

Penning made a commitment to moving the tests back onto the roads rather than the surface which is currently used. He admitted that this would make the test centres redundant but was confident that the reforms would produce a clear policy for motorcycle testing.

Hilling brought up the issue of fitness to drive.

In response Penning told the committee that he was not planning to change the current eye test but that they were looking at changing the rules in relation to those with diabetes and other illnesses. He assured the committee that they were working closely with the representative departments to ensure the results would be beneficial to those affected.

Penning promised to write to the committee and keep them updated of any developments on this issue.

15 Mar - Mr Holloway: To ask the Secretary of State for Transport what recent progress she has made on

implementing the third European driving licence directive motorcycle test; how each major feature of the test will

improve safety; and if she will make a statement.

Mike Penning: Implementation of the third European driving licence directive will not affect the form or content of the motorcycling test. It contains new provisions which will affect how motorcyclists progress to ride larger and more powerful machines. The most significant changes are:

a new medium-sized motorcycling licence category (A2) to be introduced for riders aged 19 or over.

a new common category (AM) across Europe for mopeds, which will replace the current domestic category P licence. The practical test for mopeds will also remain unchanged.

an increase in the minimum age for motorcyclists gaining direct access to the most powerful motorbikes from 21 years to 24 years.

new arrangements for younger motorcyclists wishing to progress in stages to ride larger and more powerful machines (currently, unlimited access to all motorcycles is gained automatically after two years' experience on less powerful machines).

We anticipate that the implementing legislation will shortly be laid before Parliament. We are on track to meet our obligations for full implementation by January 2013.

Uncorrected Commons Committee Evidence - [Extract]

Steve Baker: I turn to a subject close to both our hearts, I am sure, which is the motorcycle test. When will the Committee receive a response to our March 2010 report on the new European test?

Mike Penning: I have to declare an interest. I have been a biker for 40 years and continue to be a biker today.

We will be able to respond in the near future-as soon as we possibly can. A review is going on into the motorcycle test as we speak. We want to get the test back on to the road rather than on an artificial surface that you are not going to experience in your actual driving experiences. We will get it to the Committee as soon as we can. I want it to be as strong and robust as possible because, as I said earlier, although we are doing better, we still have a serious issue to do with killed and seriously injured motorcyclists. That is partly because there is a complete change in two-wheeled vehicles out there today, compared to when I first started; the prevalence of low cc vehicles such as scooters and mopeds is really high now compared to what it was a while ago.

Q374 Steve Baker: With the test going back on to the road, does it mean that the DSA has spent money on test centres that will now be redundant, or do you have some plan for them?

Mike Penning: They will be redundant. We intend to downsize the estate as fast as we possibly can. You may be aware that we are also running a pilot on taking testing to the community rather than saying that the community has to keep coming to us like some Soviet system. The only way that you can get a test in this country is if the DSA gives you a pass certificate. We are piloting six at the moment, and we are about to flow out another 20 in areas where either the test centre was closed or where there is a demand. We are making an awful lot of people go to other areas to have their test. That is for cars, but we will look to run that out for motorcycles as well. Do I have lots of tarmac for the off-road part of the test that is not going to be required? Yes, I do. We would not have done it that way if we had been in Government.

Q375 Steve Baker: If I recall correctly, the new test is due any time soon. Would you explain what the last few remaining obstacles are to getting the test in place?

Mike Penning: The wonderful health and safety is there. The risk assessment has to be right, and there are certain manoeuvres that it was deemed could not be done on the road as part of the test, which is why they created the off-road part. We are now bringing out the pilots, and the Transport Research Laboratory has already tested our ideas and we are okay on that. I passionately believe that if you are going to be taught to drive a motorbike safely, and to pass a test safely, you should be tested on the roads where you have your driving experience. At the moment we have a two-tier system, as you are aware. You can drive for up to two and a half hours to get to a test centre, which is the furthest that we have, fail the test off-road and then be allowed to drive for two and a half hours back home. That is a ludicrous situation, and we are going to resolve that.

Q376 Steve Baker: In resolving it, are you confident that you will soon have a completely clear and straightforward policy on the motorcycle test?

Mike Penning: Yes. I am absolutely adamant that we will. It is very important.

Q377 Chair: When will that be?

Mike Penning: I have a meeting in about two weeks, where we will announce the pilots. As to where we roll this out, we have to work very closely with the unions involved, to make sure that our employees are safe when they are doing this, but all the evidence shows that we can roll it out. Once we have done the pilots, we will have the evidence base; we can then phase away from the existing system into the new one, which I hope will be finished in this Parliament.

Q378 Chair: When will this Committee get a formal reply?

Mike Penning: Literally as soon as I can. I see no reason why we should not be able to give a formal reply before the recess. If I cannot, I shall write to explain why not.

2012 Riders Are Voters Lobby Day a Success A combined effort by MAG, BMF and MCIA (whose press release is reproduced below): Motorcycling Takes Its Case To Parliament The UK’s main motorcycle organisations have declared Motorcycle Lobby Day a great success. The Rider are Voters (RAV) badged event on March 7th brought together the key motorcycle organisations in a day of activities aimed at MPs and Ministers and was organised to highlight key issues where the motorcycle world is calling for direct and positive action by the Government. Nearly 50 riders and businesses attended a lobby meeting in one of Parliament’s committee rooms. Attendees also held individual meetings with their MPs. The meeting, which was hosted by Steve Baker MP, was followed by an Associate Parliamentary Motorcycle Group reception which was attended by over 20 MPs and addressed by DfT Minister Mike Penning MP. Mr Penning spoke about the importance of motorcycling and pledged to bring the motorcycle test review to a positive conclusion. Organised by RAV partners, the Auto Cycle Union (ACU), British Motorcyclists Federation (BMF), the Motorcycle Action Group (MAG) and the Motor Cycle Industry Association (MCI), Lobby Day promoted several key messages. These combined the importance of keeping awareness of the rider licensing review and the type approval campaign high among MPs. Other key policies which emphasised the social and economic importance of motorcycling and the industry were also highlighted. The Government has been conducting a review of the motorcycle test and there is an expectation that a properly revised, fully on road test will start to be available from 2013. It is important that the Government fulfils this commitment and Ministers have expressed their determination to do so. The Third European Driving Licence Directive will also be implemented in 2013. This will bring further pressure on motorcycling, business and jobs unless implementation is conducted properly. There are also concerns about a DSA proposal for a register of motorcycle trainers. Riders and industry are concerned about European proposals for a new ‘Type Approval’ framework which covers the design and construction of motorcycles. The proposals are complex and could result in significant costs and bureaucracy to business and riders. This could threaten jobs and economic development, particularly in the area of so-called ‘anti tampering’ proposals. Unclear timetables, a lack of clarity for technical requirements and the undemocratic aspects of so called ‘Delegated Acts’ (where officials can make regulations without proper scrutiny) are also causing concern. The Government’s close attention to the proposals has been welcomed, but as the issue progresses through the European system, it is vital that the Government maintains a strong line during ongoing European negotiations. Government also needs to do more to maximise the opportunities that motorcycling can bring to transport policy, environmental policy, the economy and business. In particular: · The motorcycle industry’s economic contribution – over £7billion per annum, according to an MCI 2010 survey. Government should include the industry in business policy development and support the motorcycle, components and accessory manufacturing base and supporting industry sectors as part of the Prime Minister’s policy to ‘rebalance’ the economy. Triumph Motorcycles in particular is the UK’s largest solely British owned volume automotive manufacturer and, along with other British manufacturers, deserves wider recognition. · Motorcycle sport is worth over half a billion pounds per annum to the UK economy (MCI/ACU/AMCA survey). Government needs to take action to support efforts to safeguard the sport, particularly efforts by the sport governing bodies to bring better standards to off road motorcycle sport. · With motorcycles still emitting on average significantly less Co2 than the car average, Government is called upon to embrace the ‘PTW option’ in transport policy and including motorcycling in strategies to reduce transport Co2 and also to support the emerging alternative powered motorcycle sector.

VisorDown – Brits pay highest proportion of tax on fuel

British motorists pay the highest proportion of tax on fuel in the European Union.

60 per cent of the cost of unleaded petrol is made up of fuel duty and VAT, a rise of more than 20 per cent since 2001.

VAT is charged on fuel duty, so as duty rises, VAT increases too.

Chancellor George Osborne hinted that he would make no concessions to motorists in his budget next month. Fuel

duty accounts for £27 billion each year to the Treasury in revenue, cutting it by 1p a litre would cost the Treasury £500

million.

Without fuel duty and the VAT added on top, unleaded petrol would cost 52.8 pence per litre, meaning it would cost

£9.50 to fill up a 2012 Honda CBR600RR.

More and more commuters are switching to motorcycles, partly due to their impressive MPG figures. Honda claim

their CBF125 can reach 134mpg. Although real-world figures are closer to 90mpg, the CBF will go three times further

than a car using the same amount of fuel.
