Company

Lawyers for Human Rights & Legal Aid (LHRLA) was established in 1989, working with the

objective of providing free legal services and offers preventive/remedial assistance to the

women, child and youth victims of violence and abuse. LHRLA extended its services in the form

of Madadgaar Helpline in 2001. “Madadgaar” (The Helper) is the first National Helpline to

provide services such as counseling, providing referrals to access legal aid and other protection

systems, managing data base of GBV cases, awareness raising and linkages with media.

SUMMARY

A principal characteristic of the challenges faced by Pakistan is the basic human rights violation, with an increasing trend of Gender Based Violence (GBV Cases as its apparent from the UN report (2011), Pakistan ranks 145th state among 187 world states in human development. This calls for a serious response interrelating various preventive/remedial steps to remove negative attitudes, cultural taboos and practices to overcome constraints faced in the toil to bring justice to the masses. Existing approaches of working towards stabilizing the country’s deteriorating situation have proved inadequate to implement in a society characterized by absent governmental legal aid. This begs the question as to how to implement sustainable programs to counter Gender based Violence in Pakistan.

The purpose of this project was to address Gender Based Violence in Pakistan by working to

strengthen and sensitize existing protection systems operating at the provincial levels, and

develop a pool of lawyers to provide free legal aid to women survivors and improve visibility of

helpline.

The project as a whole attempted to respond to the chronic problem of how to ensure the accessibility of GBV victims to legal aid and other referral systems and empower youth to address GBV issue at a larger scale to create awareness and inform youth about their rights and how to protect them. In a short duration the pilot project, which was implemented in four cities of Pakistan and with limited resources at hand, was able to achieve considerable success in increasing the number of victims to approach through increased visibility of the facility while the created pool of lawyers effectively provided legal aid to many of them, as being demonstrated by the provided data. The lawyers did a commendable job by dealing more than the double cases of GBV. In a short period of 15 months project achieved significant results and surpassed the set target of 90 cases by providing legal aid to total 220 victims of Gender based Violence. The overwhelming response provides us an opportunity to create more spaces like this project to address the GBV issues and make this project first of its kind while achieving unanticipated targets. More than 1000 youths were sensitized on the Gender based Violence, out of which 40% youth were enrolled as Madadgaar youth Advocates. The extensive media coverage and community outreach activities further supported in meeting the goals of the project. The project covered four cities however huge demand for such initiatives in other parts of the country was recognized. Lawyers are willing to work to provide legal aid for the GBV survivors. Hence a systematic program must be devised to utilize these opportunities. With increased number of victims accessing legal aid, project provides an evidence for the demand of legal services and awareness rising on legal rights. 15 months duration is not sufficient to achieve the desired results and assess the impact. Hence such projects shall at least be of three years duration.

NARRATIVE REPORT

Introduction

LHRLA with the assistance of ADB launched a pilot project “Addressing Gender Based Violence in

Pakistan.” The goal of this project was to address the growing incidence of Gender Based

Violence (GBV) in Pakistan through increased level of awareness and improved access of GBV

victims to protection mechanisms. The project contributes towards ADB’s mandate to improve

gender equality in developing member countries.

The proposed pilot project “Addressing Gender Based Violence in Pakistan” was designed to

work through two pronged approach; i) On protection side, it worked to strengthen referral

systems operating at the provincial levels, through developing a pool of lawyers for providing

free legal aid to women survivors and through improving visibility of the service available in

shape of Madadgaar National Helpline ii) for prevention, the project worked through the already

organized youth groups at the academic institutes and developing them as activists through

capacity building, knowledge sharing and providing them recognition as role models.

PROJECT AND ITS TARGETS

The following were the targets to be achieved through implementing this pilot project:

b. Through promoting helpline number and available services to public at large

2. Sensitize youth on Gender based violence and create team of advocates to combat

Gender violence in the community.

Establishment of the Project Management Unit

LHRLA established Project Management Unit of three project staffs and making strategies for

implementation of project activities as per project proposal and plan. Leadership of LHRLA,

provincial staff at focal points level and other staff at Madadgaar Helpline Karachi played a vital

role in implementation of project.

Project Management, Partnership, Institutional Arrangements

LHRLA hired three full time staff members for carrying out project activities. For technical

support consultants have also been hired for activities such as development of website & Online

Database, training manual and Workshop Coordinator for training.

Project staff was provided with technical backstopping from LHRLA. Activities are being

implemented strategically. A mechanism of M&E was developed to assess the project progress.

Impact assessment tools were developed and available to be administered after the project

completion. Targets/indicators which had been set through DMF & work plan were monitored by

Project Coordinator. Monitoring visits were carried out to gauge the performance of the project

at the provincial level after completion of training of resource pool. Additionally, the Project

Coordinator and leadership of LHRLA visited all target cities to monitor and assess the

implementation status of activities. Project also engaged Madadgaar Helpline’s staff at provincial

capitals for achieving the project targets.

Structure of Project Personnel:

A Project Management Committee (PMC) was set-up and full time project staff hired to implement the project. The LHRLA Executive Committee provided oversight function in the proper and timely implementation of the project activities based on the work schedules. The Project Coordinator provided monthly project update reports to the Board of Directors for this purpose. Project staff had weekly project coordination meetings for smooth day-to-day operation of project activities. The LHRLA Finance Unit has assigned a project bookkeeper for proper accounting of project funds. Included in the monthly report to the Management is a financial report of the project.

Output 1 Increased Participation of Youth in Identification and Raising Awareness in GBV Issues The Output was aimed to involve youth for prevention of GBV and developing leadership skills through workshops at the four provincial headquarters Karachi, Lahore, Quetta and Peshawar. Youth were involved in all events conducted during this project. Workshops for Empowering Youth on Gender-based Violence Four 1- day workshops “Empowering youth on Gender-based Violence” were conducted on 18th May at Greenwich University, Karachi (70 members of youth groups from 9 educational institutions), 12th September at Shahid Shakir Club, Peshawar 24 youth of different institutions, 14th September at Boy Scout Association, Quetta, (90 students) 1st October 2013 at University Of The Punjab, Lahore (50 students) were sensitized on gender based violence and relevant laws. The secondary objective was to raise awareness on responsibility of youth who are going to participate actively in decision making process in the field of gender equality in the future and to promote values of gender equality in attitudes and behavior of youth. Output 2 Improved Access and Dissemination of Information about Available Services For GBV Survivors

It was aimed to improve access and dissemination of information about the services available to

the GBV survivors. The helpline number “1098” is a gateway to the services and so it was

important to get more and more people aware of this number.

Website developed Development of a website was another important objective to be achieved under this project to create awareness of the services available as well as to keep updated information on the working of the helpline and data on the lawyers’ resource pool and activities Link: www.madadgaar1098.com Launching ceremonies of 1098 Madadgaar Helpline held in 3 Provinces Madadgaar National Helpline organized the launching ceremony of 4 digit unified code Helpline number “1098” and the national Lawyers Resource pool established with the support of ADB in the 3 cities Peshawar on 9th October, 2013 Lahore on the 29th October, 2013 and Quetta on the 21st, November. Near about 100 personalities participated who belong to various international and national organizations, stakeholders, civil society, referral partners and students. (Detailed Report is attached as annex no. 2) Awareness campaign organized for promotion of 1098 Another awareness activity was done in April 2014 for promotion of 1098 in the youth and aware them on venues available to them for seeking help in advent of Gender based violence they foresee in their surroundings did an awareness campaign in the two main cities Karachi and Lahore. The campaign in each city was designed to educate youth and masses on Gender based Violence. The youth trained through these campaigns would be then forward this knowledge to others. The Campaign had three components

1- Open Air workshops and theatre in different educational institutions across Karachi 2- Youth Conference on “Role of Youth to combat Gender Based Violence” in Karachi and

Lahore 3- Banners were placed on popular sites around Karachi Banners containing slogans both

in English and Urdu, to condemn Gender Based Violence and to raise voice and act to fight the evil were placed on various important spots around the city of Karachi, with an aim to reinforce in public the need to act in face of GBV

Output 3 Strengthened Networking and Referral Systems through Capacity Building and Coordination

amongst Service Providers, Academia and Media

To achieve reach the GBV survivors and increasing their access towards legal aid, it was important to strengthen the existing referral network. Our first challenge under this head was to develop a resource pool of volunteer lawyers to provide the free legal aid to the GBV survivors. Criteria for the selection of lawyers were developed. A Performa of Resource pool lawyers was

developed to assess the willingness and availability for the cause. Women lawyers were given priority to include in resource pool to address GBV at national level. As against the target of 50 lawyers to be mobilized, Madadgaar got response from 177 lawyers in the four provinces showing their willingness to be part of the initiative.

Meetings with the Lawyers each at 4 provincial head quarters Collective meetings with the interested lawyers were conducted in Karachi, Lahore, Peshawar & Quetta to identify various lawyers. They were briefed about pilot project and its rationale and their role for dealing the GBV cases. It was decided that the stipend to be given on every alternative case would be 10000.Rs, 5000.Rs at the time of filing the case and the remaining 5000.Rs on final decision. Lawyers were advised for building their capacities through learning and harmonizing themselves with the modern tools and techniques for professional success. Selection of Lawyers LHRLA selected total 51 lawyers for the resource pool to address gender based violence who were then provided training on gender based violence. Lawyers were selected on the basis of their prior experiences in dealing GBV cases. Memorandum of Understanding (MoU) was signed with the selected lawyers (Annexure 13). The pool included: 29 lawyers from Provincial headquarters, 09 from Lahore, 10 from Peshawar and 10 from Quetta and 22 from Karachi. Women lawyers were given priority and were empowered through this platform. Out of 51 lawyer participants there were 38 female lawyers. Developing Training Manual: A senior advocate of Sindh High court was hired as a consultant for developing the training manual for capacity building of lawyers on gender based violence. Senior management of LHRLA also provided support in the content design of the manual. This manual is a practical and flexible instructional document. It contains six substantive modules and focuses on gender based violence, international conventions, related national laws, practical strategies for elimination of gender based violence. Manual was further updated and improved after training sessions and participants’ suggestions. Capacity Building Sessions of Resource Pool “Training sessions of Lawyers to build their capacity to address Gender-based Violence in Pakistan” were held from 24th June till 27th June, 2013 and 29th- 30th August, 2013 in Karachi. Methodology of the training included interactive lecture/discussion, group work, exercise and field visits. Efforts were made to emphasize participatory approach. Knowledge on overall GBV situation in country, constitutional and fundamental rights, national & international laws related to GBV, phenomenon of legal aid, how to reach out victims, counseling

skills and investigation methods including forensic investigation as well as medico-legal examination was imparted. Field visits to Citizen Police Liaison Committee (CPLC), Medico Legal Department, and Lawyers for human rights & legal aid (LHRLA) & Madadgaar National Helpline were included to develop a deeper understanding of these young lawyers about the different departments involved and how they work. The first session was attended by 23 participants 4 lawyers were from Lahore, 5 from Peshawar, 4 from Quetta and 10 from Karachi. Out of 23, 17 were female and 6 male lawyers. Action plan was finalized and reporting mechanisms were communicated. It was decided that they will provide legal aid voluntarily whereas miscellaneous cost will paid to the lawyers for selected cases of GBV. It was decided that they will also impart this training to other lawyers to sensitize them with GBV and laws related to it. The second session had 28 participants, out of which 5 lawyers were from Lahore, 5 from Peshawar, 6 from Quetta and 12 from Karachi. There was maximum participation of female lawyers, out of 28 lawyers there were 21 females. LHRLA/Madadgaar formalized their commitment by signing a memorandum of understanding (MOU) with the volunteer lawyers. (Detailed Report in Annexure no. 5) Periodic Meetings

In total 7 periodic meetings were held throughout the length of the project for sharing progress of the lawyers dealing the legal cases of GBV survivors and plan future strategy to identify the cases of GBV by visiting jails and shelters and arrange awareness camps on free legal aid at different places so that Madadgaar will be able to help more people who need assistance. Issues faced by lawyers were discussed and solutions were sought. Guidance was imparted in case handling, increasing ratio of free legal services, promotion of 1098, and supporting activities. (Detailed Report in Annexure no. 6) Development of Online Database of Resource pool Lawyers: To work virtually with the lawyers and to get information about GBV cases an online database was developed on Madadgaar’s webpage. Lawyers were trained to enter their case information in the data base, manage the data and have easy access to information. Link of Database: www.madadgaar1098.com(Details annexed as annex no. 8) Liaisons with Academic institutions: Madadgaar Youth Advocates clubs were established at various institutes to mobilize youth to support and participate in activities to create awareness amongst the masses. Meetings were held with heads and management of institutes and introductory sessions were conducted for students aimed to promote the helpline and build the youth advocates pool. Media Linkages Having effective linkages with media, dissemination of information pertaining to GBV cases is quite frequent and is added advantage for creating mass awareness on the subject of GBV and knowledge about legal procedures.

In total 29 press releases about data sharing of violence against women and about project related activities & events were issued. The press releases published in 165 newspapers, displayed on 107 online links of various news websites. Media briefings were also held on cybercrime and honor killing in project duration. TV appearances were made by Madadgaar Team to talk about gender based violence situation in

Pakistan and steps to be taken. Apart from it, electronic media also covered different activities &

events of GBV pilot project.

LHRLA also organized an exclusive media program “SawalHai Pakistan Ka” (means: It is matter of Pakistan) in collaboration with Aaj TV (which is one of the top 5 TV channel in Pakistan) in the closing ceremony. The purpose of this program was to share the experience of participants for session and views about justice system in Pakistan. (Detailed Report in Annexure no. 11)

2.1 Narrative on Achievement of the Planned Project Outcome and Impact

The structure and system of this project was designed in a way that helpline is strengthened and sustained. The lawyers trained selected and trained to serve GBV victims, are now in better position to help the survivors and are now proactive in their efforts to extend legal aid to this vulnerable group free of cost. Youth sensitized through the activities were made a part of youth advocates club, to actively participate in community activities targeted towards educating, sensitizing and raising awareness on the issue. Contrary to the expectation, boy’s response was 30-40 % higher than female. Not only that they were vocal and open to the ideas of addressing gender based violence through attitudinal changes. Subjects like early marriages, forced marriages, acid crimes and other forms of violence were raised through youth forums boys. One of the major achievement of this project was that 220 cases were addressed, which was unanticipated at the project inception stage and surpassed the set target of 90 cases. Another important element of this projects was to sensitized women lawyers, and to bring them into the main stream. Through this project a lot of women lawyers connected with the helpline, some of them being very active. Madadgaar’s outreach to the lawyer’s network has been considerably. The project is rated successful and could be replicated in other parts of the country. 90 GBV Survivors Received Legal Aid Due to overwhelming response of lawyers and successful training at Karachi, the lawyers shown their enthusiasm and start collecting GBV cases from shelters, helplines and did commendable work by taking more than the double cases of GBV. Although they were told there is only limited cases support available, their response was overwhelming leading us to a realization to create more spaces to address the GBV issues. The high number of cases coming to the helpline highlighted the gap in availability of legal services and creates demand for further research and mapping of legal aid services & legal awareness. Increase in Referral Network At the inception of project the number of referrals was 1134 which were increased by 4.5 % and now total to 11 86 in 2014. Resource Pool Madadgaar was supposed to develop the resource pool of 50 lawyers at national level, but Madadgaar got overwhelming response of lawyers and more than hundred and seventy seven (177) lawyers showed their interest to be a part of resource pool. Although the project limitations did not allow all the willing lawyers to be included in the resource pool, they still offered to provide the services to the gender based violence victims. Each lawyer was considered as one referral, therefore there were 177 referrals established. (Annexure 9) More than 1000 Youth Activists are awarded and sensitized about GBV issues

The target was to sensitize 90 youth. However in total, more than 1000 youths were sensitized on the Gender based Violence, out of which 40% youth were enrolled as Madadgaar youth Advocates. Increase in callers and walk-in Clients: In 2012, total 6915 calls were entertained, including incoming & outgoing calls. With increased awareness and information dissemination about helpline, Madadgaar observed more than 10% increased per month in calls & walk-in clients. Annexure 7

2.2 Measures to Ensure Sustainability of Outcomes

Project was designed with an idea of sustained helpline supported with a strong network of service providers and referral system. Due to dearth of legal experts to deal the GBV cases and lack of free legal aid, the project’s main concern was to develop a lawyer’s resource pool at the provincial level. Another element of sustainability of the project was the mobilization of already existing youth groups at the academic institutes who have been sensitized about GBV issues. These youth groups will provide a platform for other similar initiatives undertaken by other development partners and will continue to serve as advocates/activists. Increased networking with media and other likeminded CSOs under the project has also created a demand for improved service delivery and preventive measures for tackling the GBV issues. As a project result and recommendations from stake holders and communities following initiatives have been undertaken by Madadgaar Helpline to meet the increasing demand for support by GBV survivors.

1- A 24/ 7 helpline is already in progress to help serve the increasing volume of calls.

Violence usually occurs at night as observed and thus it is important that the helpline is

open to take the call whenever it comes.

2- To make Data Management efficient and effective all aspects of the data gathering it’s

feeding and management is being outsourced giving us more time foe data analysis and

advocacy efforts.

3- Outreach initiative for vulnerable communities have been initiated Madadgaar Teams are

regularly visiting street Children and remote areas for awareness and cases identification.

4- Legal aid camps are being set up as well in shelters and desks at governmental

educational institutes are under way.

5- Regular project assessment meeting were held with lawyers and other stake holders for

smooth running and tracking the progress. In order to sustain the project efforts

interaction and collaboration continues with an aim to increase helpline outreach to the

vulnerable communities. Resource Pool enthusiastically addressing the gender based

violence by providing the legal aid to GBV survivors. They are making the difference by

taking various initiatives. For instance, Madadgaar National Helpline Lahore along with

resource pool organized an awareness raising session on empowering women on Gender

based violence & women rights on 21st August, at DarulAman Lahore. During this session

it was noticed that women were residing here mainly due to gender based violence

including domestic violence, forced marriages, honor killing, and they wished to leave the

shelters go back to their home.

6- On the visit to Darul Aman on 26th August, nine female inmates were released from Darul

Aman in free consent with the help of resource pool. These female inmates were

provided with free legal aid by filing petition in the court of Judicial Magistrate District

CHALLENGES FACED

Law and order situation of the city posed problems for implementing certain activities

before the deadline

Since legal system is slow and expensive, providing legal aid may need resources.

Given the growing demand for legal aid, project faced challenges in providing

adequate resources

LHRLA had the provision of 90 charged legal cases in this pilot project, but now it is going beyond this number even double of this number. Therefore, it was quite a challenge for LHRLA to pay the administration costs of the exceeding number of cases.

As a civil society Madadgaar has been involved in many projects over the course of operation but this was the first ever experience working with a bank. It was quite a challenge to understand the Bank’s procedures and comply with financial systems which are mainly pertinent to large scale projects and organizations. There were certain agreement clauses which are not clear till date.

3. LESSONS LEARNED AND RECOMMENDATIONS Following are the key lessons learned and good practices that could be replicated in future programming to advance gender equality and women’s rights in a similar fund initiative.

There is more need to work with Youth sensitizing them about the GBV issues and it could be effective in tackling this issue.

Looking at the overwhelming response from lawyers to take part in this project, more such initiatives are required to be able to accommodate them.

In future project reporting finances will have to be made looking at the strength of civil society and shorten the system as per the strength of the organization.

The management of LHRLA monitored the project. Since there wasn’t a well developed mechanism a need for having proper monitoring mechanism needs to be in place

The project covered 4 cities but there is a huge demand for such initiatives in other parts of the country. Lawyers are willing to work to provide legal aid for the GBV survivors. Hence a systematic program must be devised to utilize these opportunities. Only 15 months duration is not sufficient to achieve the desired results and assess the impact. Hence such projects shall at least be of three years duration.

4. INSTITUTIONAL STRENGTHENING – WHAT IS THE EFFECT OF THIS PROJECT TO YOUR ORGANIZATION’S CAPACITY TO DEVELOP, IMPLEMENT AND MONITOR GENDER AND DEVELOPMENT (GAD) PROJECTS? LHRLA already works as a role model and has been successful and recognized by the Federal and Provincial Governments. It has a public private partnership with a 4- Digit unified code (1098) granted. However this project has given LHRLA more avenues to create network of lawyers and mobilize resources in dealing the GBV cases. The helpline will build on these linkages with the lawyers and youth trained and keep working in the future with them. The number of calls received has increased and will keep increasing as a result of this project. The capacity building of lawyers and youth to handle GBV are in itself sustained activities. Since it was a first ever experience for LHRLA to work with a bank, it was an opportunity for LHRLA to build its capacity in understanding the ADB’s procedures and systems. The project facilitated interaction with various stake holders, including but not limited to lawyers, ministries and government officials, heads of academia, and youth. The project started off as an initiative to strengthen the helpline. It was a crucial agent in building capacity of staff and other stake-holders partner organizations, civil society, police officials, lawyers and in building strong linkages with them.
