Feb. 18, 1910 – Shakopee’s mayor called citizens together to meet with the city council for the purpose of discussing methods and plans for the better operation of the electric light plant. Feb. 25, 1910 – Judge ad- vocates playgrounds for city’s juveniles. Motion carried. Commissioner Coffel abstained from voting. Water Superintendent Crooks provided a report of current water operations. Mr. Crooks provided an update with Chaska.net. Commission consensus was to send formal letter to City of Chaska Administrative Services Director, proceeded by a phone call detailing letter. Planning & Engineering Director Adams provided an overview of Valleyfair’s Water Connection Charges. Mr. Adams provided background, historical consumption figures and a timeline schedule to the Commission regarding the issue. Motion by Engler, seconded by McGowan to approve the provided milestone timeline and to direct staff to meet with Valleyfair and report back at the May 5, 2010 Commission meeting. Motion carried. The Metropolitan Area Master Water Supply Plan was discussed by Mr. Crooks. The Staff agrees with the Plan approval by the legislatively established Metropolitan Area Water Supply Advisory Committee. Line Superintendent Athmann provided a report of current electric operations. Cable failure and potential cause from directional boring by Qwest near Fed Ex was discussed. MMPA Hometown Wind Power update was presented by Mr. Adams. The turbine is generating power when operating. Mr. Athmann presented the results of the formal bid process for the Single Bucket Truck #611 replacement. Low bid was 1% over estimate. Low bid was ABM in the amount of $91,234.00 and the bid meets all of SPUC’s specifications for the single bucket truck replacement of Truck #611. Motion by Engler, seconded by Coffel to accept the low bid of ABM in the amount of $91,234.00 to replace Truck #611. Motion carried. Marketing/Customer Relations Director Petrich advised the Commission on the Load Curtailment Programs. Staff will bring back a resolution to the Commission to continue both load curtailment programs. Utilities Mgr. Van Hout provided information on the MMPA Oak Glen Wind Farm Project. Item 9f: Follow-up on Geothermal Inquiry, was received under Consent Business. Mr. Adams provided a Pike Lake Substation update. A project development schedule was presented and discussed. Mr. Adams proposed a Street Lighting Efficiency Upgrade Program. Commission consensus was to authorize an evaluation of the lights and to report back with a report reviewing a 10 yr. window to upgrade the street lighting in the program. Commissioner Engler provided an update on the Management Staffing Search Process. President Mars proposed a workshop to discuss the search progress for March 22, 2010. Finance Director Schmid presented the proposed updated Utilities Manager Job Description. Motion by Engler, seconded by Coffel to approve the Utilities Manager Job Description as presented. Motion carried. The Utilities Manager Interim Appointment was discussed. Commission President Mars had asked Line Superintendent Athmann to serve in that capacity and he accepted the position. Motion by McGowan, seconded by Engler to appoint Line Superintendent Athmann to the position of Interim Utilities Manager. Motion carried. The tentative commission meeting dates of April 5 and April 19 were noted. Motion by Braun, seconded by Engler to adjourn to the March 22, 2010 meeting and workshop. Motion carried. MEMBERS PRESENT: Commissioners Mars, Braun, Engler, McGowan, and Coffel by phone. Also present, Interim Utilities Manager/Line Superintendent Athmann and Michael Romans, appointed Commissioner to be seated April 5. Motion by McGowan, seconded by Engler to adjourn to the Management Staffing Search Work Session. Motion carried. Work session discussion covered an updated job description for the Utilities Manager, manager skill sets and an update from the subcommittee on the selection process. President Mars noted that no formal actions had been taken during this work session. The tentative commission meeting dates of April 5 and April 19 were noted. Crooks (Published in the Shakopee Valley News on Thursday, April 15, 2010; No. 5047) RESOLUTION #966 A RESOLUTION OF APPRECIATION TO NANCY HUTH WHEREAS, Ms. Nancy Huth joined Shakopee Public Utilities in October, 1971 as a Billing Clerk and during her tenure of thirty two and one half years, has held various positions, including her current position as the Accounts Payable/ HR Specialist which she was promoted to on April 24, 2008; and WHEREAS, Ms. Huth always strived for excellence in contributing to the efficient operation of Shakopee Public Utilities and has been extremely dependable and responsible in performing her duties; and WHEREAS, Ms. Nancy Huth will retire from her position as Accounts Payable/HR Specialist with Shakopee Public Utilities on April 9, 2010; and NOW THEREFORE, BE IT RESOLVED BY THE SHAKOPEE PUBLIC UTILITIES COMMISSION, that it does hereby express its deep appreciation to Ms. Nancy Huth for her thirty two and one half years of dedicated service to Shakopee Public Utilities. BE IT FURTHER RESOLVED, that the Shakopee Public Utilities Commission extends its best wishes and congratulations to Ms. Nancy Huth as she enjoys retirement. Crooks (Published in the Shakopee Valley News on Thursday, April 15, 2010; No. 5048) RESOLUTION #967 A RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR WATERMAIN REPLACEMENT WITH THE 2010 CITY OF SHAKOPEE STREET RECONSTRUCTION PROJECT WHEREAS, the Shakopee City Council has ordered an improvement to the areas defined in the 2010 Street Reconstruction Project for street, sidewalk, sanitary sewer, storm sewer, curb and gutter, and street lighting, and WHEREAS, the Shakopee Public Utilities Commission desires to replace the existing watermain, valves, hydrants, and service lines to the curb stop valve at cost to the Shakopee Public Utilities Commission, and WHEREAS, the Shakopee Public Utilities Commission on March 1, 2010 approved the Preliminary Engineering Report, as shown on the attached engineering drawing, and WHEREAS, the Commission has previously established a reconstruction fund charge to fund such costs, and WHEREAS, no costs for the street restoration are applied to the Shakopee Public Utilities Commission on this project. NOW, THEREFORE BE IT RESOLVED BY THE SHAKOPEE PUBLIC UTILITIES COMMISSION THAT, in consideration of the savings and coordination the Shakopee Public Utilities Commission approves the watermain and associated appurtenances replacement as recommended in the Preliminary Engineering Report prepared by the city staff and as approved on March 1, 2010 by the Shakopee Public Utilities Commission, and hereby concurs with the plans and specifications and authorizing the City Council’s advertisement for bids. THEREFORE BE IT FURTHER RESOLVED, the funding for this project comes from the Commission approved reconstruction fund charge. Crooks (Published in the Shakopee Valley News on Thursday, April 15, 2010; No. 5049) RESOLUTION #968 A RESOLUTION ESTABLISHING A LOAD CURTAILMENT PROGRAM WHEREAS, it is the intent of the Shakopee Public Utilities Commission to offer a Load Curtailment Program and make it available to qualifying customers of Shakopee Utilities, AND WHEREAS, this program is intended to be generally available to commercial or industrial customers billed on a standard “demand” rate, and who: - are able to curtail their load either by reducing specific loads or shifting a portion of their load to off-line generation, - are able to meet all technical and administrative arrangements required by Shakopee Utilities to provide notification and confirm the performance of the timeliness and amount of the reduction in load, - have entered into an agreement with Shakopee Utilities for such curtailment for the following months of May through April, and have been accepted by Shakopee Public Utilities into the program, AND WHEREAS, the terms of the program including participation qualifications, limitations, and other terms, are contained on the Attachment to this Resolution, NOW THEREFORE BE IT RESOLVED that Resolution #844 is repealed upon this resolution taking effect, AND THEREFORE BE IT RESOLVED that the Load Curtailment Program is offered by the Shakopee Public Utilities Commission, in accord with the terms and limitations set out above and in the Attachment to this resolution as minimum requirements, AND BE IT FURTHER RESOLVED that electric service provided under this Load Curtailment Program continues to be subject to all other standard terms of electric service and rates, and to any specific terms or limitations contained in agreements between the Shakopee Public Utilities Commission and the customer enrolled in this Load Curtailment Program, AND BE IT FURTHER RESOLVED that this Load Curtailment Program is offered to customers of Shakopee Utilities per the terms contained above and subject to the specific acceptance by the Shakopee Utilities, which acceptance can be made on behalf of the Commission by its staff, AND BE IT FURTHER RESOLVED that all things necessary to carry out the terms and purpose of this resolution are hereby authorized and performed. Line Superintendent Athmannprovided a report of current electricoperations. Cable failure andpotential cause from directionalboring by Qwest near Fed Ex wasdiscussed.

MMPA Hometown Wind Powerupdate was presented by Mr.Adams. The turbine is generatingpower when operating.

Mr. Athmann presented theresults of the formal bid process forthe Single Bucket Truck #611replacement. Low bid was 1% overestimate. Low bid was ABM in theamount of $91,234.00 and the bidmeets all of SPUC’s specificationsfor the single bucket truckreplacement of Truck #611.

Motion by Engler, seconded byCoffel to accept the low bid of ABMin the amount of $91,234.00 to replaceTruck #611. Motion carried.

Marketing/Customer RelationsDirector Petrich advised theCommission on the LoadCurtailment Programs. Staff willbring back a resolution to theCommission to continue both loadcurtailment programs.

Utilities Mgr. Van Houtprovided information on the MMPAOak Glen Wind Farm Project.

Item 9f: Follow-up onGeothermal Inquiry, was receivedunder Consent Business.

Mr. Adams provided a PikeLake Substation update. A projectdevelopment schedule waspresented and discussed.

Mr. Adams proposed a StreetLighting Efficiency UpgradeProgram. Commission consensuswas to authorize an evaluation ofthe lights and to report back with areport reviewing a 10 yr. window toupgrade the street lighting in theprogram.

Commissioner Engler providedan update on the ManagementStaffing Search Process. PresidentMars proposed a workshop todiscuss the search progress forMarch 22, 2010.

Finance Director Schmidpresented the proposed updatedUtilities Manager Job Description.

- have entered into anagreement with Shakopee Utilitiesfor such curtailment for thefollowing months of May throughApril, and have been accepted byShakopee Public Utilities into theprogram,

AND WHEREAS, the terms ofthe program including participationqualifications, limitations, andother terms, are contained on theAttachment to this Resolution,
