Resolution No. 12-55 RESOLUTION APPROVING EXTENSION FOR THE PRELIMINARY PLAT OF ASPEN RIDGE SUBDIVISION, NORTH LIBERTY, IOWA TO NOVEMBER 9, 2013. WHEREAS, said real estate was preliminarily platted, and WHEREAS, the City of North Liberty Code Section 16.16.030 states, “Approval of preliminary action shall be effective for a period of eighteen months”, and WHEREAS, the last recorded final plat of this subdivision was approved on November 9, 2010, and WHEREAS, this approval will extend the approval of the existing preliminary plat to November 9, 2013, WHEREAS, the owner and developer has filed with the City Clerk a request for an extension of the preliminary plat for the property described as Aspen Ridge Subdivision, and NOW, THEREFORE, BE IT RESOLVED that the City Council of North Liberty, Iowa, does hereby approve the extension of the preliminary plat of Aspen Ridge Subdivision, North Liberty, Iowa until November 9, 2013. Resolution No. 12-56 RESOLUTION APPROVING THE PHEASANT LANE STREET IMPROVEMENT AGREEMENT BETWEEN THE CITY OF NORTH LIBERTY AND NORTH LIBERTY ASPEN RIDGE LLC FOR THE CONSTRUCTION OF PHEASANT LANE IN NORTH LIBERTY, IOWA.

WHEREAS, the City Council desires to enter into an Agreement for Pheasant Lane Improvements with North Liberty Aspen Ridge;

WHEREAS, North Liberty Aspen Ridge has executed the Street Improvement Agreement for the improvements to Pheasant Lane to permit the City to construct the street to be utilized as a detour route for the Highway 965 Improvement Project; and

WHEREAS, it is the parties’ desire to agree and establish, in writing, their

understanding regarding said agreement.

NOW, THEREFORE, BE IT RESOLVED that the City Council of North Liberty, Iowa, does hereby approve the Pheasant Lane Street Improvement Agreement with North Liberty Aspen Ridge, LLC setting forth the terms and conditions under which the Pheasant Lane project will be completed.
