Item on the Consent Agenda: Resolution 2020-154 - Corona Virus Aid and Relief for the

Economic Security Act. Vote unanimous by the four board members present.

Ordinance 2020-148 in its entirety. This substitute: 1) removes the prohibition against a

person being placed on a board or authority when they have been previously removed for

cause and 2) removes the prohibition against serving on two terms. Motion made by

Motion made by Vice-Chairman Davis, second by Chairman Turner to remove Consent

Agenda Item #23: Resolution 2020-149 to the agenda. Vote unanimous.

Commissioner Hambrick asked for to be removed from the agenda completely. Vice-

Chairman Davis amended his initial motion.

Motion made by Vice-Chairman Davis, second by Commissioner Franklin Warner to

remove Consent Agenda Item #23: Resolution 2020-149 from the agenda for

consideration.

County Attorney Chuck Reed provided a substitute to Consent Agenda Item #20:

Resolution 2020-146. This substitute amends the days of the Whole Committee Meetings

to the second and fourth Tuesday of each month at 5:30 p.m.

Motion made by Chairman Turner, second by Vice-Chairman Davis to approve. Vote

unanimous.

Motion made by Vice-Chairman Davis, second by Commissioner Franklin Warner to

approve the agenda as amended. Vote unanimous.

IV. PRESENTATION:

RESULT: PRESENTATION OVERVIEW

1. Veteran of the Month

Clayton County honored Lieutenant Colonel Charley James as Veteran of the

Month.

V. PUBLIC COMMENT:

Citizens will be given a three (3)-minute maximum time limit to speak before the Board

of Commissioners about various topics, issues, and concerns. Following thirty minutes

of hearing from the public, the Board of Commissioners will allow the remainder of

citizens who have signed up to be heard at the next Tuesday business meeting.

1. Teresa Talley of Hampton, Georgia spoke about trash issues and property taxes in

the county, specifically wanting control over the trash pick-up and a list of

properties in the county that need attention. She does not want any extra charges

being added to her trash bills.

2. Brenda Harrison of Morrow, Georgia spoke about her eligibility for serving on

two county boards. She wished to rescind her initial resignation and believes she

should not be removed from either board; she referenced two past resolutions that

allows citizens to serve on one than one county board.

3. Timothy Vondell Jefferson of Riverdale, Georgia spoke about both the Quality of

Life and the Beautification of Clayton County. He also spoke about corruption

within a county board, hotel issues, and problems within the county jail.

4. Melvin Hyman III of Clayton County, Georgia spoke on the Citizens Review

Board, and how there needs to be serious changes in the behaviors of corrupt

police officers in Clayton County.

5. Alvin Farmer of Clayton County, Georgia spoke about several issues, including

recycling in the county and providing more money for the Public Defender’s

Office.

6. Terrie Farr of Clayton County, Georgia spoke about her ongoing issues she is

having with her property. They are destroying her culture, property, and have

already destroyed her land- she asked the board for direction in finding a solution.

7. Orlando Gooden of Clayton County, Georgia spoke about the planning for the

retreat and how the crime has gone significantly down in the county. He also

talked about how the county needs to get to a point where there is no longer an

oversight of Economic Development, no failing schools, and the Fire and Police

Academies are in order.

8. Robb Leatherwood of Riverdale, Georgia inquired about agenda add-on

emergency items- specifically the resolutions that have been added to tonight’s

agenda. He asked who is making these requests and why the information and

changes made were not given prior to the meeting. He also recommended a

transfer station and the campaigning of Keep Clayton Beautiful as two resolutions

for solid waste collections.

Contract for Clayton County, Georgia.

DRC Emergency Services, LLC, located in Galveston, Texas. Funding is

available through the Emergency Management Agency’s General Fund. As

requested by the Department of Fire/EMS Services. Pursuant to Section 2-114 of

the Clayton County Code of Ordinances, General Purchasing Methods.

Competitive sealed proposal process. Acquisitions greater than $74,999.99.

Unless otherwise provided herein, formal sealed proposals must be obtained for

any item or service which is expected cost in excess of $74,999.99 or is expected

4. Recommendation for Award: ITB #20-84 Roadway Guardrail Services

Annual Contract for Clayton County, Georgia.

available through the Transportation and Development Department’s General

Fund and the 2015 SPLOST Fund. As requested by the Department of

Transportation and Development. Pursuant to Section 2-113 of the Clayton

County Code of Ordinances, General Purchasing Methods. Competitive sealed

bidding process. Acquisitions greater than $74,999.99. Any commodity, good or

service that is expected to cost in excess of $74,999.99 or is expected to generate

5. Recommendation for Award: PSA #20-129 Legal Services with Hugh Cooper

for Juvenile Court

Hugh Cooper, Esq., located in McDonough, Georgia, for three (3) years in

the amount of $60,000.00 per year for a total of $180,000.00. Funding is

available through the Juvenile Court Services Indigent Defense Fees. As

requested by the Department of Juvenile Court. Pursuant to Section 2-94 of the

Clayton County Code of Ordinances, General Purchasing Methods. All

department of central services; exemptions are to be narrowly construed with the

default being procurement through a competitive process. When a competitive

for public places, or other creative/artistic endeavors that require a particular and

demonstrated skill or talent to include, but not limited to, artists, musicians, and

writers; (2) printed copyright material including published books, maps,

periodicals and technical pamphlets (not including software for computer

systems), except where a greater savings can be realized by a quantity purchase;

(3) dues, memberships, and board member fees; (4) subscriptions; (5) utilities,

where there is no reasonable basis for competitive procurement, for example,

electric power, water, and sewer; (6) legal services procured by the chief staff

attorney; (7) "professional services" which refer to services that require

specialized knowledge and training, often through long and intensive academic

preparation, or in-depth experience in a particular field or discipline. Professional

services generally consist, in material part, of advice, evaluation, consultation,

training, planning, design, obtaining information/direct assistance, or other effort

involving the exercise of judgment, discretion, and knowledge, including, without

limitation, a service provided by a person whose profession is licensed or

regulated by the state or federal government and other related agencies. (8) legal

advertisements including, but not limited to bid/proposal solicitations placed by

boards that are required by law to publicly advertise their meetings or actions in

the legal organ of the county; (9) antiques and other unique assets of historical

value; (10) purchases made from, or the disposition to, other federal, state and

local governments, associations and state universities and colleges when

determined by the director to be in the best interest of the county.

7. Recommendation for Award: SWC #20-150 Purchase of Safety Equipment

for Fire/EMS Department, Clayton County, Georgia.

Utilizing the Statewide Contract #99999-SPD-SPD00000156-0003 with Fisher

Scientific, located in Pittsburgh, Pennsylvania for $301,600.00. Funding is

available through the Fire Other Machines and Equipment Funds. As requested by

the Department of Fire/EMS Services. Pursuant to Section 2-120 of the Clayton

County Code of Ordinances, General Purchasing Methods. Governmental and

affiliated entity purchase. The county may purchase services and incidental

commodities from other federal and state or local governments when determined

to be in the best interest of the county. Documentation to substantiate this decision

will be maintained by the department of central services. Such purchases where

cost is in excess of $74,999.99 or is expected to generate revenue greater than

$74,999.99 shall be approved by the board of commissioners.

8. Recommendation for Award: CP #20-160 Purchase of IT Products and

Accessories for the Information Technology Department, Clayton County,

Georgia.

Utilizing the Sourcewell Purchasing Cooperative Contract #081419 with SHI

International, located in Somerset, New Jersey for $186,466.00. Funding is

available through Information Technology Minor Computer Equipment Funds. As

requested by the Department of Information Technology. Pursuant to Section 2-

119 of the Clayton County Code of Ordinances, General Purchasing Methods.

Cooperative purchase. The county may participate in a cooperative purchase for

commodities, equipment, and services when determined by the director that it is

in the best interest of the county. The sponsoring entity, whether federal, state or

local must have performed a competitive procurement process and entered into a

contract that stipulates allowance for other governmental entities to purchase the

same commodity, equipment or service from the supplier at the same price and

under the same terms and conditions as extended to sponsoring entity. If such

arrangement has not been made a part of the contract, written permission from the

sponsoring entity and the awarded supplier must be obtained. The director or

his/her designee must certify that the acquisition of the commodities, equipment,

or services are consistent with the contract commodities, equipment, and services,

and of equal or lesser price, of those commodities, equipment and services offered

to the sponsoring entity. Documentation to substantiate this decision will be

maintained by the department of central services. Cooperative purchases where

cost is in excess of $74,999.99 or is expected to generate revenue greater than

$74,999.99 shall be approved by the board of commissioners.

9. Recommendation for Award: ITB #20-91 Design/Build of the Nassau

Building for Clayton County, Georgia

$2,200,000.00 / Brad Construction Company II, LLC, located in Fayetteville,

Georgia. Funding is available through the SPLOST 2009 Funds. As requested by

the Department SPLOST Program Management. Pursuant to Section 2-113 of

the Clayton County Code of Ordinances, General Purchasing Methods.

Competitive sealed bidding process. Acquisitions greater than $74,999.99. Any

commodity, good or service that is expected to cost in excess of $74,999.99 or is

expected to generate revenue greater than $74,999.99 shall be acquired through

the competitive sealed bid process except as otherwise provided in this

Purchasing Code.

10. Budget Amendment 2-3 / FY21 Superior Court (Drug Court)

To carryforward additional revenue collected for Drug Court.

11. Budget Amendment 4-1

To amend the budget to recognize interest earned and to provide additional

funding for the Jail Security project.

12. Senior Victim Assistance Coordinator - District Attorney

On behalf of the Office of the District Attorney, Human Resources is requesting

the following staffing changes: Delete Victim Assistance Coordinator, G/S 17/12

– (Salary 41,532) – Total Compensation 58,327 Reclassify Victim Assistance

Coordinator, G/S 17/6 – (Salary 38,549) – Total Compensation 54,696 to Senior

Victim Assistance Coordinator G/S 19/6 (Salary 42,577) – Total Compensation

59,599.

The approval of this position will result in a savings for Clayton County, as well

as streamline and increase efficiencies and productivity of staff and operations

within the Office of the District Attorney.

The District Attorney’s focus is on streamlining, cost effectiveness, and

productivity. The request promotes the focus.

The budgetary impact of this request results in a savings of $53,424.

13. Order for Remission (John Mitchell) - State of Georgia vs John Mitchell,

Defendant and Free At Last Bail Bonds. Surety - Case No. 2019CR01467-MG -

$1,757.50.

14. Resolution 2020-140- A Resolution to provide for the establishment of the net

mill rates after credit (rollback) for values added by reassessment for Clayton

County’s fiscal year 2020-2021; to authorize the levy and collection of property

taxes at such rate required by the State of Georgia, to cover expenditures

associated with the maintenance and operation of the county and activities

necessary and incidental thereto; to cover expenditures associated with the

provision of fire services; to authorize the mill rate credit (rollback) equal to taxes

collected from the one percent Local Option Sales Tax; to authorize the Chairman

to execute the certification of official rates together with any other document

pertaining to such mill rates; to provide for an effective date of this resolution;

and for other purposes.

Synopsis: This Resolution allows the mill rates to be set at a rate of 19.995

mills on all taxable property lying within the unincorporated areas of Clayton

County and 15.089 mills on all taxable property lying within the incorporated

areas of Clayton County.

15. Resolution 2020-141- A resolution authorizing Clayton County to enter into an

Aging Subgrant Agreement with the Atlanta Regional Commission providing for

services to be rendered in connection with Older Adult Programs; to authorize the

Chairman to execute the Aging Subgrant Agreement, and otherwise to perform all

other acts necessary to accomplish the intent of the resolution; to authorize The

Chief Financial Officer to amend the budget to reflect appropriations and

expenditures all as may be required under the terms of the Aging Subgrant

Agreement; to provide an effective date of this resolution; and for other purposes.

Synopsis: This resolution authorizes the County to enter into an Aging Subgrant

Agreement with the ARC financed by a grant from the U.S. Government through

the Georgia Department of Human Resources from July 1, 2020 through May 31,

16. Ordinance 2020-142- An ordinance to amend the Code of Clayton County,

Georgia, as amended, specifically, Code of Clayton County, Georgia, Part II,

Chapter 62 "Offenses and Miscellaneous Provisions", Article II "Quality of Life

Code" by amending Section 62-205 "Off-road parking or storage of unlicensed or

inoperable vehicles, trailers or equipment" by repealing the current subsection (b)

thereof and substituting in lieu thereof a new subsection (b).

Synopsis: This ordinance amends the Code of Clayton County, Georgia, as

amended, specifically, Code of Clayton County, Georgia, Part II, Chapter 62

"Offenses and Miscellaneous Provisions", Article II "Quality of Life Code" by

amending Section 62-205 "Off-road parking or storage of unlicensed or

inoperable vehicles, trailers or equipment" by repealing the current subsection

(b) thereof and substituting in lieu thereof a new subsection (b).

17. Resolution 2020-143- A resolution authorizing Clayton County to accept a

donation from Can’d Aid’s Crush It Crusade on behalf of the Clayton County

Parks and Recreation Department for the purpose of creating a recycling program

in the recreation facilities; to authorize the Chairman to accept the grant on behalf

of Clayton County and to execute any necessary documents, and otherwise to

perform all other acts necessary to accomplish the intent of the resolution; to

authorize the Chief Financial Officer to amend the budget to reflect

appropriations and expenditures all as may be required under the terms of the

grant; to provide an effective date of this resolution; and for other purposes.

Synopsis: This resolution authorizes Clayton County to accept a $8,021.99

donation from Can’d Aid’s Crush It Crusade to assist the Clayton County Parks

and Recreation Department, Recreation Facilities, for the purpose of creating a

recycling program within the Department.

18. Resolution 2020-144- A resolution authorizing Clayton County to approve a In

Kind Match that will allow Clayton County Senior Services to continue providing

transit services through Clayton County CSA Transit for the needs of the senior

population in Clayton County; to authorize the Chairman to execute any

documents and to otherwise perform all acts necessary to accomplish the intent of

this resolution; to authorize the Chief Financial Officer to amend the budget to

reflect appropriations and expenditures all as may be required under the terms of

the aging subgrant agreement; to provide an effective date of this resolution; and

for other purposes.

Synopsis: This resolution authorizes the County to approve the In-Kind Match

which will allow Clayton County Senior Services to continue providing transit

services, through Clayton County CSA Transit, for the needs of the senior

population in Clayton County.

19. Resolution 2020-145- A resolution authorizing the Clayton County Juvenile Court

to apply for, and if awarded, accept the 2020-2021 Victims Of Crime Act

(VOCA) Grant Program funding for FY 2020-2021; to authorize the Chairman to

execute the agreement, and otherwise perform all acts necessary to accomplish the

intent of this resolution; to authorize the Chief Financial Officer to amend the

budget where necessary to reflect an appropriate revenue source and expense; to

provide an effective date of this resolution; and for other purposes.

Synopsis: This resolution authorizes Clayton County to enter into a Grant Award

Agreement with the Georgia Criminal Justice Coordinating Council and in

accordance therewith accept federal grant funds in the amount of $100,168.00

with a local cash match of $18,234.00, to be used for program expenses in

connection with the Victims of Crime Act (VOCA) and the Court Appointed

Special Advocate program (CASA).

20. Resolution 2020-146- A resolution of the Clayton County Code of Ordinances

establishing a time for the Board of Commissioners to meet for Committee of the

Whole meetings scheduled for the second and fourth Wednesdays of the month;

to provide an effective date of this ordinance; and for other purposes.

Synopsis: This resolution authorizes the Board to hold Committee of the Whole

meetings on the second and fourth Wednesdays of the month at 5:30 p.m. at its

offices located at 112 Smith Street, Jonesboro, Georgia.

21. Resolution 2020-147- A resolution to authorize County staff, in coordination with

the Clayton County Solid Waste Management Authority, to recommend a plan for

County-wide Garbage and Solid Waste Collection and Disposal; to authorize the

Chairman to perform all other acts to accomplish the intent of this resolution; to

provide an effective date of this resolution; and for other purposes.

Synopsis: This resolution authorizes County staff in collaboration with the Solid

Waste Authority to convene, review the current services available to County

residents and commercial businesses, perform an independent study of the most

cost effective options, and provide a plan related to County-wide Garbage and

Solid Waste Collection and Disposal to the Board of Commissioners within a 60-

day period.

22. Ordinance 2020-148- An ordinance to amend the Code of Clayton County,

Georgia, as amended, is hereby further amended, specifically, Code of Clayton

County, Georgia, Part I, Chapter II “Administration,” Article III “Boards,

Commissions, and Authorities,” Division 1, “Generally,” Section 2-56 to set

forth process for Board and Authority appointments; to repeal conflicting laws,

ordinances, and resolutions; to provide severability; to provide an effective date;

and for other purposes.

Synopsis: This ordinance amends the Code of Clayton County, Georgia by

amending Part I, Chapter II “Administration,” Article III “Boards, Commissions,

and Authorities,” Division 1, “Generally,” Section 2-56, subsection (1).

23. Resolution 2020-149- A resolution authorizing the Clayton County Board of

Commissioners to order the removal of members appointed to two Boards or

Authorities; to authorize the Chairman to perform all acts necessary to accomplish

the intent of this resolution; to provide an effective date of this resolution; and for

other purposes.

Synopsis: This resolution authorizes the Board to order the removal of members

appointed to two Boards or Authorities.

24. Resolution 2020-150- A resolution authorizing the conveyance of a Permanent

Easement over certain property in Clayton County to lay and construct electrical

utility pipes, lines, structures and/or facilities in order to provide services to the

new International Water Park; to authorize the Chairman to perform all acts

necessary to accomplish the intent of the resolution; to provide an effective date

of this resolution; and for other purposes.

Synopsis: This resolution approves a Georgia Power Easement, at Clayton

County International Water Park, Parcel 001, located at 2300 Highway 138 S.E.

Jonesboro, Georgia 30238.

25. Resolution 2020-151- A resolution to amend the Clayton County Civil Service

Rules and Regulations, Rule 5 “Compensation Plan”, to provide for limits of

annual leave accumulation and payment of accrued and unused annual leave; to

repeal any and all conflicting laws, ordinances, resolutions, rules and regulations;

to provide for severability; to provide an effective date of this resolution; and for

other purposes.

Synopsis: This resolution authorizes an amendment to the Clayton County Civil

Service Rules and Regulations, Rule 5 “Compensation Plan”, Section 5.407

“Annual Leave Accumulation” is deleted in its entirety and replaced with a new

Section 5.407.

26. Resolution 2020-152- A resolution to initiate an amendment to the agreement for

the provision of indigent defense services between Clayton County and Lister,

Holt & Dennis, LLC; to provide an effective date of this resolution; and for other

purposes.

Synopsis: This resolution authorizes Clayton County to enter into an Amendement

to the contract for indigent defense services with Lister & Holt, LLC dated

January 7, 2014 to reflect the change of the name of the firm previously known as

Lister & Holt, LLC to Lister, Holt, & Dennis, LLC.

27. Resolution 2020-153- A resolution to authorize the consolidation of County Code

Enforcement under the Clayton County Corrections Department; to authorize a

supplement to the Warden’s salary as consideration for these additional

management responsibilities; to authorize the Chairman to perform all other acts

to accomplish the intent of this resolution; to authorize the Chief Financial Officer

to amend the budget to reflect an appropriate revenue source and expense relating

thereto; to provide an effective date of this resolution; and for other purposes.n

Synopsis: This resolution authorizes the implementation of the Code Enforcement

Consolidation Project attached hereto as Attachment “A” for the consolidation of

Code Enforcement functions and personnel to be reassigned and managed by the

Corrections Department under the supervision of the Warden.

28. ADD ON: Resolution 2020-154 - A resolution authorizing the approval of

CARES Act grant funds that must be spent before September 1, 2020.

Item approved with Consent Agenda.

29. ADD ON: Resolution 2020-155 - A resolution authorizing entering into an

agreement to purchase COVID-19 rapid testing cartridges and the use of

equipment.

Item approved with Consent Agenda.

County Attorney Reed requested an Executive Session on personnel and litigation.

Motion made by Chairman Turner, second by Vice-Chairman Davis to go into Executive session

for personnel and litigation at 7:40 p.m. Vote unanimous.

Motion made by Vice-Chairman Davis, second by Chairman Turner to reconvene the Regular

Business Meeting at 8:18 p.m. Vote unanimous.

County Attorney Reed had two (2) settlement agreements for the Board's approval:

1) Christopher Craven versus Clayton County and Ronnie Square for an accident that occurred

on or around January 10, 2019 at or near Richardson Highway and Mount Zion Road in

unincorporated Clayton County, Georgia; settlement total $20,000.00.

2) Prime Tower Development, Incorporated versus Clayton County for zoned property located at

2236 Mount Zion Parkway, Jonesboro, Georgia.

Motion made by Vice-Chairman Davis, second by Chairman Turner to approve the two

settlement agreements. Vote unanimous.

There being no further business to discuss, motion made by Chairman Turner, second by

Commissioner Franklin Warner to adjourn the August 4, 2020 Regular Business Meeting at 8:25

p.m. Vote unanimous.
