CAMPER RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT (THE “AGREEMENT”)THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE THE OWNER(S) OF ANY CAMP BOW WOW® (“Camp”), HOME BUDDIES BY CAMP BOW WOW® (“Home Buddies”), THEIR FRANCHISOR OR RELATED PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ AND UNDERSTAND IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.

In consideration for your dog(s) (“Camper”) being permitted to come to Camp or to be served by Home Buddies, you agree to all of the policies, procedures, release, terms and conditions set forth below. The following Agreement will apply at each Camp or Home Buddies location regardless of ownership, as well as to Camp Bow Wow Franchising, Inc., a Delaware corporation, and its affiliates, employees, owners, agents and representatives (collectively, each Camp, Home Buddies and Camp Bow Wow Franchising, Inc. shall hereinafter be referred to as “CBW”).

1 All Campers must:

• be current on Rabies, Distemper, Parvo and Bordetella vaccinations,

• be at least 4 months of age (only required for Camp);

• be spayed or neutered if 6 months of age or older (only required for Camp);

• be in general good health and free of ticks and fleas (only required for Camp);

• be non-aggressive towards other dogs and people (only required for Camp);

• not be protective of toys (only required for Camp);

• complete the Camp Bow Wow® interview process to CBW’s satisfaction in its sole discretion (onlyrequired for Camp);

• meet all municipal and state licensure and other requirements;

• have a quick release collar that contains an identification tag bearing the Camper’s name and guardian orowner's current contact information; and,

• be leashed when entering and exiting Camp (only required for Camp).

2. Food. Campers will be fed in accordance with the instructions provided in the Camper Application or instructions you later provide. While at Camp,Campers do not get fed lunch. If you want your Camper to eat lunch, you must provide the Camp a container marked with your Camper’s name and feedinginstructions.

3. Camper Cam TM and Video Release. To watch your Camper having A Dog Gone Good Time® at Camp, log onto www.campbowwowusa.com and clickthe Camper CamTM button. By using the services offered by CBW, you agree to allow CBW and any of their affiliates to use your Camper’s name and any imageor likeness of your Camper taken while at Camp, in any form or format, for use, at any time, in any media, marketing, advertising, illustration, trade orpromotional material. This provision is binding on you, and all of your successors, heirs, legal representatives and assigns.

4. Personal Property. CBW WILL NOT BE LIABLE FOR ANY LOST, STOLEN OR DAMAGED PERSONAL PROPERTY BELONGING EITHER TO YOUOR YOUR CAMPER. IF YOUR CAMPER CAUSES ANY PERSONAL PROPERTY DAMAGE TO THE CAMP, THE SITE WHERE HOME BUDDIES SERVICES AREPROVIDED, ANOTHER CAMPER OR OTHERWISE, YOU WILL BE LIABLE FOR THE FULL COST OF ALL TREATMENT, RE- PAIRS AND REPLACEMENTS.

5. Fees. You must pay for all services and products by credit card, cash or check. All payment is due at the time you pick up your Camper from Camp orat the time services are completed by Home Buddies. You give your express permission for CBW to charge any credit card you provided for unpaid services orproducts upon the date services were supposed to have been completed. You further agree to pay any collections costs and the cost of any returned orchallenged check or debit charges.

6. Training and Interviews. You hereby consent to the Camp’s use of your Camper for staff training, dog training, and new camper interviews while your Camper is in our care. You acknowledge that dogs in camp for training or interview purposes may not meet all camper qualifications.

7. Cancellation and Refund Policy. You will be charged the equivalent of one (1) full day of doggy day care, if you fail to cancel a reservation for doggy day care twenty four (24) hours in advance of drop off time. You will be charged one (1) full day of boarding, if you fail to cancel your boarding reservation at least forty eight (48) hours in advance of drop off time. Notwithstanding the above, if your boarding reservation is within three (3) days of a nationally recognized holiday, you must cancel your reservation within seventy two (72) hours or you will be charged a no-show fee equal to two (2) nights of boarding. Refund policies differ between each Camp and Home Buddies location and are available upon request.

8. Aggressive Dogs. Although CBW loves all dogs, to come to Camp, your Camper may not be aggressive and must pass CBW’s interview process in CBW’s sole discretion. Your Camper may be separated from other Campers or asked not to return to Camp if he/she exhibits aggressive or other unacceptable behavior. Such determinations will be made at the sole discretion of CBW.

9. Abandoned dogs. No Camper may be left at Camp after the scheduled pick up time without communication from you. If your Camper is left at Camp without any contact, instruction or notification regarding its pick up from you or your authorized representative, your Camper will be deemed “Abandoned” at7P.M. on the seventh (7th) day after the scheduled pick up date. If your Camper is Abandoned at Camp, CBW will become its legal owner and guardian. CBW will, in its sole discretion, determine whether to re-home the dog or relinquish it to a shelter or rescue of CBW’s choice. YOU FULLY UNDERSTAND AND AGREE THAT IF YOU ABANDON YOUR DOG AT CAMP, YOU MAY BE UNABLE TO RETRIEVE POSSESSION OF YOUR DOG AND WILL HAVE NO RECOURSE AGAINST CBW.

10. Duty to Disclose. You must disclose on a continuing basis, any and all medical or other conditions, including but not limited to personality concerns or behavioral incidents that in CBW’s sole discretion, may affect, limit or prevent your Camper’s ability to participate in any Camp activity or Home Buddies service.

11. ACCEPTANCE AND ACKNOWLEDGMENT OF RISK. YOU FULLY UNDERSTAND THAT: (a) THERE ARE INHERENT AND POTENTIAL RISKS INVOLVED WITH INTERACTIONS BETWEEN HUMANS AND DOGS, AS WELL AS BETWEEN DOGS AND OTHER DOGS, WHICH MAY RESULT IN PROPERTY DAMAGE OR BODILY INJURY, INCLUDING BUT NOT LIMITED TO, PERMANENT DISABILITY, SICKNESS OR DEATH TO HUMAN OR DOG; AND (b) THERE MAY BE OTHER RISKS NOT KNOWN TO YOU OR CBW, NOR READILY FORESEEABLE AT THIS TIME (COLLECTIVELY, “RISKS”). YOU FULLY ACCEPT AND ASSUME ALL RISKS AND RESPONSIBILITY FOR ALL RISKS, INCLUDING, WITHOUT LIMITATION, ALL LOSSES, COSTS AND DAMAGES INCURRED AS A RESULT OF YOUR CAMPER’S PARTICIPATION AT ANY CAMP, INCLUDING ANY VETERINARIAN EXPENSES INCURRED ON BEHALF OF OR CAUSED BY YOUR CAMPER. “SICKNESS” INCLUDES ANY ILLNESS NOT LIMITED TO BORDETELLA (KENNEL COUGH), BLOAT, OR ANY OTHER FORM OF CONTAGIOUS DISEASE.

12. Veterinarian Liability and Care. CBW will have the right to obtain medical treatment for your Camper, if, in CBW’s sole discretion, it appears that your Camper may be ill, injured or exhibits any other behavior that would reasonably suggest that your Camper may need medical treatment. Reasonable efforts will be made to contact you when CBW determines that medical treatment is necessary, but if CBW is unable to contact you or your emergency contact, CBW and the veterinarian may rely on this Section 11 as your consent to treat your Camper. You hereby grant the veterinarian and CBW the right to make medically necessary decisions for your Camper’s treatment, and release the veterinarian and CBW from all liability for the same. If you are unable to be reached but your emergency contact is reached, you hereby grant your emergency contact the right to make medically necessary decisions for your Camper’s treatment. CBW will first attempt to seek treatment from the veterinarian provided in the Camper Application (“Designated Veterinarian”), but will have the right to seek veterinary treatment from an alternative veterinarian if: (i) the Camper needs urgent care and another veterinarian is closer, (ii) CBW is unable to reach the Designated Veterinarian, or (iii) CBW is unable to transport the Camper to Designated Veterinarian. If a Camper passes away at Camp, it will be brought to its or the nearest veterinarian. YOU WILL BE FULLY RESPONSIBLE FOR ALL COSTS RELATED TO ANY MEDICAL TREATMENT, INCLUDING WITHOUT LIMITATION, THE COST OF ANY TRANSPORTATION FOR THE PURPOSE OF SUCH TREATMENT. You must also provide veterinary records to CBW upon request, and you hereby grant CBW permission to request and obtain veterinary records directly from your Designated Veterinarian, if CBW is unable to obtain necessary records from you.

13. Trade Secrets. I understand that during my tour of this Camp Bow Wow® facility, I may see confidential information, intellectual property, and trade secrets(collectively, “Proprietary Information”) that are the unique and exclusive property of Camp Bow Wow Franchising, Inc. I acknowledge that Camp Bow Wow Franchising, Inc. has spent considerable money and effort developing and guarding the Proprietary Information and that any unauthorized disclosure or use of this Proprietary Information would be wrongful and would cause irreparable injury and harm to Camp Bow Wow Franchising, Inc. and its affiliates. By signing this form, I agree that I will not, at any time, publish, disclose, divulge or in any manner communicate the Proprietary Information to any person or entity or use such Proprietary Information, directly or indirectly, for my own benefit or for the benefit of any other person or entity. I recognize that my participation in this tour does not grant me any property rights, by license or otherwise, to any Proprietary Information. This constitutes my entire agreement with Camp Bow Wow Franchising, Inc. with respect to the subject matter hereof.

14. WAIVER, RELEASE AND INDEMNIFICATION. YOU HEREBY AGREE TO EXPRESSLY AND FOREVER GENERALLY WAIVE, DISCHARGE CLAIMS, INDEMNIFY, RELEASE FROM LIABILITY, SAVE, HOLD HARMLESS AND DEFEND CBW, their invitees, owners, officers, directors, employees, contractors, volunteers, agents, representatives, lessors, and all others having an interest in any CBW party (collectively, the “Releasees”) from and against ANY AND ALL INJURY, LIABILITY, CLAIMS, LITIGATION, ACTIONS, SUITS, COSTS, LOSSES, DAMAGES, ATTORNEY’S FEES, EXPENSES OR DEMANDS OF EVERY CHARACTER WHATSOEVER on account of, arising out of, resulting from or relating in any way to (i) any act or omission of the Releasees, (ii) your Camper’s participation at any Camp, services provided by Home Buddies, or otherwise. YOU AGREE THAT THIS RELEASE IS BINDING ON YOU AND YOUR SUCCESSORS, HEIRS, LEGAL REPRESENTATIVES AND ASSIGNS. YOU ALSO EXPRESSLY AND FOREVER RELEASE CBW FROM ANY DUTY TO PROTECT YOU OR YOUR CAMPER FROM INJURY OF ANY KIND, AND AGREE THAT ANY IMPLEMENTATION OF SAFETY PRECAUTIONS BY CBW WILL NOT WAIVE CBW’S RIGHT TO BE INDEMNIFIED AS PROVIDED HEREUNDER, AND SUCH PRECAUTIONS WILL NOT ALTER THIS RELEASE. I INTEND FOR THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY OF CBW TO THE GREATEST EXTENT PERMIT-TED BY LAW; I AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, THE REMAINDER OF THIS AGREEMENT WILL REMAIN IN FULL FORCE AND EFFECT.

Doggy Daycare & Boarding Checklist

• Ensure your pup’s vaccinations are current (Rabies, Distemper, and Bordetella) • Provide a copy of the vaccinations from your Veterinarian that clearly show the expiration date for

• Bordetella is required every 6 months for oral vaccine and yearly for intranasal and injectable

• Flu vaccine is required for out of state customers and NJ Campers that travel out of state. Otherwise it is not required but STRONGLY recommended for our in state customers

• For safety reasons, all campers MUST wear a quick release (“snap”) collar while at Camp

• A pet ID tag MUST be affixed to the collar

Frequently Asked Questions Q: Can I bring my dog’s bed?

A: Of course! We want your pup to be as comfortable as possible while they’re away from home. However, please don’t expect it to be returned in the same condition. That said, don’t leave anything with us that you consider sentimental. Sometimes, dogs will tear up their beds when they’re ‘camping’ with us, even though they wouldn’t do this at home. We’re not sure why, perhaps they miss you or have some anxiety when they are staying with us. Q: Should I bring my dog’s food?

A: Yes, we highly recommend that you bring your own dog’s food. Even though we have food at Camp, changing a dog’s food quickly can give him an upset stomach, lead to stress colitis and possibly even bloat. Your pup may also be allergic to an ingredient in food other than his and it is best not to find this out when they’re boarding with us. Anxiety (even if it’s happy anxiety) can also cause an upset stomach, so it’s best if your pup eats the food that they’re used to. In the event that your dog runs out of food due to an extended stay, or for any other reason, we typically have 3 different types of top shelf house food to choose from. __________ Initials

Q: Can I bring treats and toys for my dog?

A: Absolutely! However, we rarely see dogs playing with toys in their cabins because they’re usually tired from being in the play yard the majority of the day. If you’d like to bring toys, they must be safe. NO natural bones, antlers or anything that can chip or split and get lodged in a dog’s throat. NO raw hides!!! NO rope toys. NO human toys. Some examples of acceptable toys are Kongs, Busy Buddies or anything made of hard, indestructible rubber. __________ Initials

Q: Will you be able to give my dog his medications?

A: Yes, but you must give us the medicine in the original vial. Please don’t give us medication in a pill dispenser or baggie. We need to know exactly what the medication is and who to contact in case of an adverse reaction. We can also administer eye drops, ear drops, lotions, etc. We CANNOT administer any medication that needs to be injected. __________ Initials

Q: If my dog has been vaccinated against Bordetella (i.e. kennel cough, canine cough), can they still get sick?

A: Yes. Every Camper here is required to be vaccinated for Canine Cough, but just like the human flu, it can still be contracted. Canine Cough can be picked up at the dog park, a restaurant patio, a walk around the neighborhood block, at the local pet store, the vet’s office, and yes, while at daycare. Canine Cough is not life threatening, but it is contagious and if not treated can develop into a more serious condition.

Q: My pup came home from daycare with some scratches and/or a cut. How/why did this happen?

A: Campers in daycare can come home with bumps, scratches, cuts, small bites, etc. Since dogs play with their paws and mouths, these small injuries can occur from time to time. Some dogs have a more rough/rowdy play style, and just like kids playing on the playground, can occasionally come home with unexplained scratches, etc. Our counselors are in the play yard to monitor rough and rowdy play and to separate dogs if necessary. Counselors will re-direct dogs’ attention to break up play or occasionally Campers will be given a short cabin break to give them a chance to calm down. Any medical costs that may arise out of rough play at Camp, are your responsibility per the Camper Application that was signed on your pup’s first day at Camp. __________ Initials
