A Special Meeting of the Council of the City of Manassas, Virginia, for the purpose of conducting a budget work session, was held second floor conference room at City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Vice Mayor Ken Elston, Council Members Michelle Davis-Younger, Theresa Coates Ellis, Ian T. Lovejoy, Pamela J. Sebesky, and Mark D. Wolfe; City Manager W. Patrick Pate, City Clerk Lee Ann Henderson, City Attorney Craig Brown, Finance and Administration Director Diane V. Bergeron, Community Development Director Liz Via-Gossman, Fire and Rescue Chief Robert Clemons, Jr., Police Chief Doug Keen, Paralegal Rose Spring, and Budget Manager Stott Mason

Mayor Parrish called the meeting to order at 5:30 p.m.

The City Clerk reported that the news media had been notified of the meeting in accordance with the Freedom of Information Act.

1. Discussion: Outstanding Budget Related ItemsFinance and Administration Director Diane V. Bergeron outlined the proposal made by

Council Member Lovejoy at the budget work session held on May 1, 2019. There was discussion regarding the history of the Museum Expansion project and a prior proposal to house the museum and the library in a shared building.

Council Member Ellis noted that the community is against an increase in the tax rate and proposed allowing private developers to improve the South Grant streetscape and using the Merchant grant to perform some of the current museum displays, if the Merchant family agrees.

Council Member Wolfe noted that the investment in the Gateway property was part of a long term vision for the community.

COUNCIL MEMBER WOLFE MOVED that the budget be presented for first reading as the City Manager presented it. Seconded by Vice Mayor Elston. Roll Call Vote: AYES – Elston, Sebesky, Wolfe; NAYS – Davis-Younger, Ellis, Lovejoy. MOTION FAILS.

There was discussion on the relationship between the South Grant Street Beautification Project and the Public Safety Center Project. City Manager Pat Pate noted that some of the frontage improvements needed for the Public Safety Center project are included in the South Grant Street Project.

VICE MAYOR ELSTON MOVED that the budget be presented for first reading using $2.5 million in one-time Gateway sales proceeds to adjust the tax rate down approximately 0.04 cents. Seconded by Council Member Sebesky. Roll Call Vote: AYES – Davis-Younger, Elston, Sebesky; NAYS – Ellis, Lovejoy, Wolfe. MOTION FAILS.

Council Member Sebesky stated that a great deal of time and effort has been put into the South Grant Street project and that Council has already directed staff to bond the project. She stated that every citizen survey has shown that the citizens want investment in the community.

Council Member Davis-Younger questioned what the impacts will be if the Council continues to put off things in order to keep the tax rate level.

Council Member Lovejoy stated that tax burden is a struggle and that City of Manassas tax bills are low compared to surrounding jurisdictions because income levels area also low.

COUNCIL MEMBER LOVEJOY MOVED that the budget be calibrated to a one penny tax rate increase by removing the Museum Expansion Project and taking the rest of the necessary funds from Gateway land sales. MOTION FAILS for lack of a second.

Council recessed at 7:01 p.m.

Council returned at 7:10 p.m.

COUNCIL MEMBER WOLFE MOVED that the budget be presented for first reading as originally proposed except moving the Museum Expansion project to future years. MOTION FAILS for lack of a second.

COUNCIL MEMBER ELLIS MOVED that the budget be presented with a one penny increase to the tax rate by eliminating the South Grant Street Beautification project, and taking $2.5 million from Gateway sales proceeds to buy down capital project debt with preferential treatment given to the Public Safety Center project. Seconded by Council Member Lovejoy. Roll Call Vote: AYES –Ellis, Lovejoy; NAYS – Elston, Davis-Younger, Sebesky, Wolfe. MOTION FAILS.

Mayor Parrish noted that the budget as originally presented would be the budget that will be considered on May 13, 2019.

Mayor Parrish declared the meeting adjourned at 7:25 p.m.

WHEREAS, Manassas recognizes the importance of equality and freedom; and

WHEREAS, the City of Manassas’ Lesbian, Gay, Bisexual, Transgender, and Questioning (LGBTQ) community are a vital part of all fields and professions and contribute to a stronger community; and

WHEREAS, the City of Manassas is dedicated to fostering acceptance of all its citizens and preventing discrimination and bullying based on sexual orientation and gender identity; and

WHEREAS, Manassas is strengthened by and thrives upon the rich diversity of ethnic, cultural, racial, gender and sexual identities of its residents; all of which contribute to the vibrant character of our City; and

WHEREAS, the Centers for Disease Control (CDC) recognizes that LGBTQ teens are at higher risk to be the victims of violence and have increased suicide rates; and

WHEREAS, it is imperative that young people in the community, regardless of sexual orientation or gender identity, feel valued, safe, empowered, and supported by their peers, educators, and community leaders.

NOW, THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim and recognize June 2019 as

Lesbian, Gay, Bisexual, Transgender, and Questioning (LGBTQ) Pride Month

in the City of Manassas and urge citizens to recognize the contributions made by members of the LGBTQ community and to actively promote the principles of equality and liberty.

WHEREAS, the City of Manassas includes approximately 5,300 adults age 60 years and older who richly contribute to our community; and

WHEREAS, each May, the United States Administration for Community Living recognizes older adults for their contributions to the nation; and

WHEREAS, we acknowledge that what it means “to age” has changed, for the better; and

WHEREAS, this year's theme for May is "Connect, Create, Contribute," which encourages communities to recognize the contributions of older adults and the key role they play in the vitality of our neighborhoods, networks, and lives; and

WHEREAS, the City of Manassas can provide opportunities to enrich the lives of individuals of all ages by: involving older adults in the redefinition of aging in our community;promoting home and community-based services that support independent living; encouraging older adults to speak up for themselves and others; and by providing opportunities for older adults to share their experiences.

NOW, THEREFORE, I Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim hereby proclaim the May 2019 as

AN UNCODIFIED ORDINANCE SETTING THE REAL ESTATE TAX RATES FOR TAX YEAR 2020

1. BE IT ORDAINED that by the City Council of the City of Manassas, Virginia, meeting in regular session this 20th day of May, 2019, that there shall be levied upon real estatewithin the City of Manassas the following taxes for tax year 2020:

(a) The real estate tax year in the City of Manassas is July 1st to June 30th.

(b) Real Estate in the City of Manassas: One Dollar and Twenty-Eight and ThreeTenths Cents ($1.283) per one hundred dollars ($100.00) of assessed valuation.

The City’s current, abandoned automobile ordinance authorizes the police department to impound any vehicle that lacks a current license plate, or a current county, city or town license plate or sticker, or a valid Commonwealth safety inspection certificate or sticker; and has been in a specific location for four days without being moved; however, the enforcement of a current safety inspection sticker alone is not currently authorized. Taking into consideration citizen complaints of vehicles that are abandoned, lacking current safety inspection stickers, and the Code of Virginia, 46.2-1157, which reads, “No owner or operator shall fail to submit a motor vehicle, trailer, or semitrailer operated or parked on the highways in the Commonwealth to such inspection or fail or refuse to correct or have corrected in accordance with the requirements of this title any mechanical defects found by such inspection to exist”, I am asking to amend and reenact the ordinance related to parking a vehicle without a current Commonwealth license plate or decal, to reflect Parking a vehicle without a current Commonwealth of Virginia license plate, decal, or safety inspection sticker.

RE: Special Use Permit #2019-05: All Saints Catholic Church, 9294 Stonewall Road

WHEREAS, the Bishop of the Catholic Diocese of Arlington has applied for aspecial use permit (SUP), pursuant to §130-241 and §130-125(5) of the Manassas City Zoning Ordinance to amend the conditions of SUP #1997-04 to allow a freestanding digital changeable message sign; and

WHEREAS, the Community Development staff has reviewed the application and RECOMMENDS APPROVAL subject to specific conditions; and

WHEREAS, the City of Manassas Planning Commission held a public hearing on April 3, 2019, after full compliance with all state code public hearing notice and posting requirements and RECOMMENDS APPROVAL subject to specific conditions; and

WHEREAS, the Manassas City Council held a public hearing on May 13, 2019, after full compliance with all state code public hearing notice and posting requirements; and

WHEREAS, among the purposes of zoning called out in Chapter 15.2-2283 of the Code of Virginia is “to facilitate the creation of convenient, attractive, and harmonious community”; and

WHEREAS, among the matters to be considered in drawing and applying zoning ordinances and districts called out in Chapter 15.2-2284 of the Code of Virginia is “the suitability of property for various uses”; and

WHEREAS, the City Council upon careful consideration finds that approval of SUP #2019-05 is justified by public necessity and convenience and general welfare, and is consistent with reasonable zoning practices, and that the cumulative effect of the activity proposed will not be detrimental to the character and development of the adjacent land, and is in reasonable harmony with the City’s land use plan and policies; and

WHEREAS, the City Council finds that a comprehensive list of conditions and safeguards can eliminate or mitigate the negative impacts of the proposed use sufficiently to justify approval.

NOW, THEREFORE, BE IT RESOLVED that the Manassas City Council does hereby APPROVE SUP #2019-05 in regular session this 20th Day of May 2019, subject to the conditions listed on the attached pages.

RE: Special Use Permit #2019-05, All Saints Catholic Church

On May 13, 2019, the Manassas City Council held a public hearing for Special Use Permit (SUP}

#2019-05 to amend the conditions of SUP #1997-04 to incorporate a Comprehensive Sign Plan

under Sec. 130-123(f) ofthe zoning ordinance. The Comprehensive Sign Plan would allow a

freestanding digital changeable message sign on the All Saints Catholic Church Campus.

During the public hearing, Council referenced changeable message signs located at St. Thomas

Methodist Church (8899 Sudley Road), Pennington School (9305 Stonewall Road), and Seton

School (9314 Maple St) and questioned how the conditions proposed for the All Saints Catholic

Church changeable message sign compare to the conditions incorporated at these sites. In

response, the following information is provided:

• St. Thomas Methodist Church- A free-standing changeable message sign was approved

by the Board of Zoning Appeals in 2007 as a variance prior to the creation of the zoning

ordinance provision allowing consideration of a SUP for Comprehensive Sign Plans.

Under BZA #2007-03, the sign was approved to be slightly larger and taller than

permitted under the zoning ordinance and was required to be turned off between the

hours of 12:00 am and 5:00am each day. It should be noted that, unlike the current

request at All Saints Catholic Church, St. Thomas Methodist Church is located directly

across from single-family detached residential land uses, with the nearest residential

property located approximately 110 feet away from the sign.

• Pennington Traditional School- As a public school, Pennington Traditional School is

exempt from sign permit requirements under Sec. 130-125(a)(3) ofthe zoning

ordinance, which states that "signs erected by or required by public entities or public

utilities" may be displayed without a permit.

• Seton School- A wall-mounted changeable message sign was approved by SUP #2015-

03 under the Comprehensive Sign Plan provision of the zoning ordinance. The conditions

proposed for SUP #2019-05 are consistent with those established for Seton School, with

the exception that the Seton School sign must be turned off overnight from 10:00 pm

through 6:00am. Similar to the sign at St. Thomas Methodist Church, the Seton School

changeable message sign is located directly across the street from single-family

detached residential land uses, with the nearest residential property located

approximately 40 feet from the sign.

The purpose of the Comprehensive Sign Plan SUP is to review the specific location and unique

characteristics of each site and establish conditions as appropriate for each case. While the City,

as part of the SUP review process, consistently limits the time period during which signs can be

illuminated when the site is immediately adjacent residential development, the All Saints

Catholic Church sign will be located along a primarily business corridor directly across from

industrially-zoned property. The nearest residential property is a multifamily apartment

building located approximately 450 feet from the proposed sign. Based on these

considerations, staff does not recommend conditions to limit the time period during which the

sign can be illuminated.
