3 USE OF MOBILE PHONES AT COUNCIL MEETINGS
Councillors may be aware of the issues with regard to the voting system at Council Meetings on Level 6. The issues are due to interferences with the signal strength of the voting system. This may be caused by wireless devices being used as wireless hotspots. To prevent further interferences from occurring, Councillors are requested to switch off the wireless hotspot function on their mobile device in the Meeting Chamber. Councillors may still use their mobile device to access the internet. We will continue to monitor this situation and should the problems continue, we will look at other options to rectify the problem. 4 NOTIFICATIONS TO UPGRADE OPTUS TELECOMMUNICATION FACILITIES WITHOUT DEVELOPMENT CONSENT AT AN EXISTING BUILDING - CNR MAGDALA AND PITTWATER ROAD, RYDE, AND AT No. 160 ROWE STREET, EASTWOOD
Notification from ‘Urbis’ ‘Urbis’ on behalf of ‘Optus’ have notified Council on 11 May 2012 of their proposal to upgrade the existing telecommunications facilities at an existing building located on the corner of Magdala Road and Pittwater Road, Ryde.
In brief, the proposals consist of the following:
• Replacement of 3 existing panel antennas
• Installation of associated ancillary equipment
The new facility will integrate with the Optus Service for increased data rates and better mobile broadband performance. The proposed works are being undertaken by Optus as required by the provisions contained in the Commonwealth legislation Telecommunications (Low Impact Facility) Determination 1997. Under this legislation the proposed development is permitted without Council’s consent. ‘Urbis’ has provided Council with a bundle of documents comprising of:
• A letter advising of the proposed facility upgrade • Details of proposed facility • EME Report, and • References to information on the effects of radio emissions on health.

It is noted that Council has been notified on 11 May and has until 21 May 2012 to provide written comments on the proposal. Council will be responding by urging ‘Urbis’ to consider any concerns raised by the members of the local community before carrying out the installation of this facility. Notification from ‘Daly International’ ‘Daly International’ on behalf of ‘Optus’ have notified Council on 9 May 2012 of their proposal to upgrade the existing telecommunications facilities at 160 Rowe Street, Eastwood.
The proposal mainly involves the following:
• Removal of existing diplexers behind panel antennas; • Undertaking internal works within the existing equipment cabin; and • Undertaking associated ancillary works including Installation of new feeders, fibre and
power connection.

6 IPWEA NSW EXCELLENCE AWARDS - WINNER
At the 2012 Institute of Public Works Engineering Australia (IPWEA) NSW Excellence Awards the City of Ryde won the category Environmental Enhancement Project or Initiative. The IPWEA Excellence Awards recognise excellence in innovation, development, completion and management of local government and public works projects. The winning project was Stranger’s Creek Bio-retention Basin and Creek Rehabilitation which was completed by Public Works staff last financial year. The City of Ryde’s winning submission will now be included in the IPWEA Excellence Awards book and Showcase Journal.

8 PLANNING PROPOSAL - 461-495 VICTORIA ROAD, GLADESVILLE
Council has received a planning proposal for the site known as 461-495 Victoria Road, Gladesville which currently contains an enterprise park in the Gladesville industrial area. The owner of the site is seeking a rezoning of the site for additional land uses, including ‘bulky goods premises, garden centre and hardware and building supplies’ under Ryde Local Environmental Plan 2010. The proposal also includes an amendment to the Ryde Height of Buildings Map to include maximum RL’s over the subject site. A Planning Proposal is the first step in the NSW Government’s new Local Plan Making process (the “Gateway Process”) which came into effect 1 July 2009. The intended outcome of the planning proposal is to enable the redevelopment of the land for a Bunnings warehouse and bulky goods premises. A zoning map of the subject site and surrounds has been attached. Concept plans of potential development to occur on the site have been submitted with the proposal. Any future development on the site would be subject to a future Development Application should the amendments to the Ryde LEP 2010 be supported by Council and the Department of Planning. It is planned to report the results of the preliminary assessment of the Planning Proposal to Council in July 2011.

9 UPGRADE OF PITTWATER ROAD (HIGH STREET TO EPPING ROAD) - Stage 1 - Coxs Road to Bronhill Avenue, North Ryde.
Summary During the excavation of the road shoulder between Coxs Road and Carramar Avenue, unexpected physical conditions were revealed (“latent conditions”). As a consequence, additional funding will be expended. A final estimate will be determined once the extent of the conditions are understood. As the project has now been inadvertently been pushed forward, covering two (2) financial years, the net effect to the delivery programme will be the cascading of 2012/2013 projects accordingly. Therefore allowing no net change to Council’s overall fiscal position. Background: Extensive community consultation was undertaken in 2011 which resulted in changes to the proposed design of some parts of the road upgrade and provision of a Shared User Path. The amended proposal was assessed in a Review of Environmental Factors (REF) under Part 5 of the Environmental Planning and Assessment Act 1979. This report was incorporated into the REF. The revised REF was presented to Council on 13 December 2011. Council passed a resolution at its meeting on 14 February 2012, which enabled construction on Stage One of the project to commence. Stage One involves upgrade works on Pittwater Road south from Carramar Road to Bronhill Avenue which includes the Shared User Path for pedestrians and cyclists. In addition, the necessary drainage, water quality improvement works, including the Gross Pollutant Trap (GPT), landscaping works will be completed as part of the Stage 2 works. The City of Ryde 2010/2011 Capital Works Program includes a budget allocation of $947,000 to extend the upgrade of Pittwater Road works further south from Carramar Avenue to Bronhill Avenue and to take into consideration provision for pedestrians, cyclists, water quality improvements and landscaping. The current budget includes carry-over funds ($320,000) from the previous financial year 2009/10. The balance portion of work will be carried out in subsequent financial years as funding is allocated under its four year delivery plan. Whilst undertaking the excavation of the foundation of the road shoulder between Coxs Road and Carramar Avenue the ground conditions were found to have been saturated. A perched water-table was discovered which has infiltrated material between the almost impervious clay layer and existing bedrock. Every alternative construction method was investigated prior to making the decision that the path of least resistance was to remove the perched water-table and extend the excavation below the table to bedrock. The decision was made to continue the upgrade works as the cost of stopping the works and remobilisation was greater than the cost of mitigating the risk caused by the latent conditions.

These upgrade works will rectify the current deteriorating condition of the road and improve the safety of motorists, cyclists and pedestrians.

10 RYDE RIVERWALK PROJECT - PM2010/73 - Bill Mitchell Park to Glades Bay Park.
Working details of the project thus far are: Bill Mitchell Park to Glades Bay Park - A community Workshop was facilitated with approximately 45 pre-registered members of the community on 2 May 2012 from 6.30pm to 9pm. Discussion focussed on the Ryde Master Plan and how the proposed walk is a small section of a much larger plan. The session was designed to draw out community feedback on the range of issues and opportunities presented by the project. The received feedback covered topics including – impacts upon private property, other examples of boardwalks in and around mangroves, the desire for a low impact path, concerns about vandalism and concerns about the impact upon the local Aboriginal heritage sites, amongst others.
Minutes of the meeting and responses to questions presented by nearby residents will be made available on Council’s website in coming days. Issues and opportunities outlined will be reviewed. A range of options to be presented for further discussion at the next community Workshop meeting scheduled for Wednesday 30 May 2012.

11 YAMBLE RESERVE - Proposed Construction of Alterations to Existing Amenities Building.
Council’s Project Development Unit, Public Works has engaged the NSW Department Public Works, Construction Services Group for the construction of proposed alterations to the existing amenities building at Yamble Reserve, Ryde. These works will form part of the proposed all abilities playground. Under the provision of circular Public Works Circular C2006-55 (Department of Commerce as a Contractor to Agencies (see ATTACHED), Council is able to directly engage the services of Department of Commerce as a contractor for capital works projects without the need to follow Council’s procurement policy. It is proposed to utilise the services of NSW Public Works, Department of Commence for some projects which are deemed to be beneficial to Council.

At its meeting of April 10 2012, Council resolved to write to the Local Member for Ryde and other State Government Ministers regarding an announcement to establish a taskforce to investigate the feasibility of redeveloping the Ivanhoe Place Housing Estate in Macquarie Park. The Local Member, the Hon. Victor Dominello MP has responded to Council’s approach to advise that he has written to the Minister for Finance and Services (the Hon. Greg Pearce) asking that he respond to the concerns raised in Council’s resolution. Mr Dominello has also asked the Minister to liaise directly with Council in relation to its concerns. At the same time, the Minister for Family and Community Services (the Hon. Pru Goward) has written to acknowledge receipt of Council’s letter and has advised that “As the matter you have raised falls within the administration of the Hon. Greg Pearce MLC, Minister for Finance and Services and Minister for the Illawarra, I have arranged for your correspondence to be forwarded to Minister Pearce for direct reply”. The resolution of April 10 2012 was made in the following terms: RESOLUTION: (Moved by Councillors Yedelian OAM and Maggio)
(a)That Council writes to our local member, The Honourable Victor Dominello MP and the Ministers for Housing (Honourable Pru Goward) and Finance (Honourable Greg Pearce), in relation to Ivanhoe Estate and request that they provide Council and tenants:
• with timely, honest and comprehensive explanation of their plans. • assurances that there will be a transparent consultative planning process. • assurances that no residents will be removed from their homes against their
wishes as a result of any redevelopment. (b)That the redevelopment process (if any) includes tenants as stakeholders and listens to
their voices and concerns and takes into account the strong sense of the Community in any decisions taken.
(c)That Council request that the Ivanhoe Estate Tenant Group be represented on the
taskforce.
(d)That as a major stakeholder, City of Ryde Council be represented by all Central Ward Councillors on the taskforce.

13 NOTICE OF EXHIBITION OF PROPOSED AMENDMENT TO AFFORDABLE HOUSING SEPP RELATING TO GROUP HOMES
The Department of Planning and Infrastructure (DoPI) has placed on exhibition a proposed amendment to State Environmental Planning Policy (Affordable Rental Housing) 2009 (AHSEPP”) in relation to group homes. The draft instrument is entitled State Environmental Planning Policy (Affordable Rental Housing) Amendment (Group Homes) 2012 and proposes the following changes: �Insert definitions of “permanent group home” and “transitional group home” which will clarify what a reference to “people with a disability” means and what a reference to “socially disadvantaged” can include. Currently the AHSEPP refers to the definitions in the Standard Instrument Principal Local Environmental Plan. �Amend clause 45(1) to impose a 10 bedroom limit for group home developments when approved as complying development. �Insert the definitions of “people with a disability” and “people who are socially disadvantaged” into the Standard Instrument Principal Local Environmental Plan so this is consistent with the AHSEPP. The combined effect of these amendments seeks to ensure that group homes approved as complying development under the AHSEPP will be of a suitable size and cater to the appropriate persons. Group homes larger than 10 bedrooms will continue to be permitted but development consent will be required from the relevant consent authority (i.e. any developments larger than 10 bedrooms cannot be approved as complying development). Implications for City of Ryde > What can currently be approved as complying development? A group home proposed by or on behalf of a public authority can be built without consent if the development does not result in more than 10 bedrooms within one or more buildings on a site. In other situations, a complying development certificate is required but there is no limit on the size of the group home that can be approved. The proposed amendment will introduce a limit of 10 bedrooms for group homes being approved as complying development. Providing a limit on the size of group homes that do not require Council consent is supported. > Where are the development standards for group homes? The development standards for group homes are contained in Schedule 2 of State Environmental Planning Policy (Affordable Rental Housing) 2009. No changes are proposed to these standards. > Group Homes are not subject to payment of Section 94 contributions

Group homes are generally in the form of supported accommodation with special needs of tenants managed by the sponsoring organisation (such as State health and welfare authorities). > Definitions provide consistency and clarity. No objection is raised to the insertion of definitions for “people with a disability” and “people who are socially disadvantaged” in the AHSEPP as this will assist in interpreting the legislation and provide consistency across planning instruments. It is not proposed to make a submission to the DoPI on the proposed amendments to group homes legislation.

Confirmation of Minutes from 13 February 2012 The Minutes from the meeting held on 13 February 2012 were confirmed and endorsed. Matters arising from previous Minutes:- Ryde – Shared User Path Mr Dodds advised that he had a very positive meeting with the Deputy Director General, Policy and Regulation, Transport for New South Wales, Mr Tim Reardon last Thursday. Mr Reardon has advised that he will support Council’s application to the Minister for the use of PMD’s in Macquarie Park and advised that he is confident he will be able to get PMD’s exempted in Macquarie Park for a period of two years. Mr Dodds advised that once approval has been granted and subject to budget, he will be seeking partners (eg. Optus) to undertake a trial. Mr Dodds also advised that he spoke to NSROC who have advised that they are putting a submission together regarding infrastructure for NSW Transport and have confirmed that part of the submission will include the use of PMD’s and increasing funding for everything except roads. Mr Dodds advised that he has been in further discussions with RMS since the last Traffic Committee Meeting and confirmed that paths will only become shared user paths when they physically and technically comply. Developer on Blaxland Road to reinstate the footpaths as shared user paths Mr Desai advised that when the developer rebuilds the footpath, it will become a shared user path. Calibration Marks for Bicycle Odometers Mr Desai advised that the calibration marks will be finalised this week. Meadowbank Bridge Lighting Mr Desai advised that the lighting is now in service. West Ryde Line Marking Mr Desai advised that this line marking is now complete.

Bike Plan (Update) Mr Salomon advised that he had been requested to provide Council with a quotation for works associated with undertaking a review of the current Bike Plan and from the review to make recommendations to Council. The committee discussed some areas which are considered priorities for Mr Salamon (if engaged to undertake the works) to include in his review. Mr Salomon advised that if engaged to undertake the review, he would arrange an initial workshop and also some one-on-one sessions with stakeholders to obtain relevant information and priorities.

Bike Locker Eastwood (Update) Mr Desai distributed copies of the Cycleway Capital Works Program 2011/12 and 2012/13 to all Committee members. Mr Desai advised that the installation of the Bike Locker at Eastwood would be completed by June 2012. Mr Dodds advised that if additional funds were required for lighting and the swipe card system, he would explore the possibility of other projects being swapped around in order to obtain the funding to fully complete the project prior to the opening of the Eastwood Bike Locker.

Macquarie Park Shared Path (Waterloo Road) – Update Mr Desai advised that construction has commenced on the shared path from the Macquarie University end towards Lane Cove Road and confirmed that in a couple of weeks, the pedestrian refuge in Khartoum Road will be built. The Committee recommended that upon completion of the project, Council staff arrange for a media release to be prepared (with a photo opportunity) for distribution in local newspapers.

Mr Torrisi advised that the bus shelter is grey and as visibility issues could arise, requested Council to put some reflectors onto the shelter. Gutter Crossing from Kent Road to Lane Cove Road Bike North thanked City of Ryde for repairing the gutter crossing on the shared user path from Kent Road to Lane Cove Road. Signage under railway line on Victoria Road Bike North thanked City of Ryde for adding signage to the shared user path under the railway line on Victoria Road.

15 CUSTOMISED SEATING PROJECT- Partnership with Medowbank TAFE Youth Outreach Program
The City of Ryde has partnered with the Northern Sydney Institute of TAFE Youth Outreach program to build a series of customised benches and seats for Memorial Park and a section of the Ryde River Walk. TAFE Youth Outreach runs the Youth Connections Program for 15-18 year olds across the local region including the City of Ryde LGA. The program targets young people who may be at risk of disengaging from the school system and offers the young people opportunity for vocational training two days a week. The Customised Seating Project engaged young people engaged to develop designs for seating in the park based on a brief from Council staff. The designs were impressive, well thought through and insightful. Council staff were pleased with the designs produced. The students designs were presented to Council staff and approved for build on Monday 14 May.

On 22 November 2011, Council resolved that a report be made through the CIB of any meeting between the Mayor and a State Minister or Local Member where Council business is discussed.

On 22nd March 2012 the Mayor and General Manager met with Hon Greg Smith MP. The Minister was given an update on the redevelopment of the Civic Precinct.
On 4th May 2012 the Mayor and General Manager met with Hon Victor Dominello MP. The Minister was given an update on the redevelopment of the civic precinct, existing Part 3A developments and their current status and Council’s position on Smalls Road and Cudal Reserve.
On 11th May 2012 the Mayor and General Manager met with Hon Anthony Roberts MP. The Minister was given an update on the redevelopment of the civic centre and Council’s position on Smalls Road and Cudal Reserve.
