RESERVATIONS AND PAYMENT: Operator accepts paymentby credit and debit cards issued on the following networks:AMERICAN EXPRESS, VISA, MASTERCARD, or DISCOVER. Anyother person or entity (including a travel agent) who receivesmonies from participants does so strictly as an agent ofparticipants. Tender of payment to Operator constitutesacceptance of these terms of sale. Full payment is applied tothe credit card entered into the system at the time of booking.Online bookings will be accepted up to 4 days prior toscheduled departure. All reservations made 14 days or less priorto departure will be charged a $25.00 Special Handling Fee tocover costs associated with expedited processing of thebooking. After payment is made, all revisions are subject to a$25.00 per booking fee, plus any supplier fees.

LIABILITY STATEMENT: Travel Impressions, Ltd. and its parent,subsidiaries, affiliates and representatives (collectively, "TI"), actas an agent for travel suppliers and you understand and agreethat TI shall not be liable for any loss, injury, expense or damageto persons or property resulting, directly or indirectly, from (1)the acts of omissions of travel suppliers, including but notlimited to delays, overbookings, cancellation of services,cessation of operations, accidents or failures of equipment, orchanges in fares, itineraries or schedules; or (2) acts of God, fires,earthquakes, floods, climatic aberrations, acts of governmentalauthorities, civil unrest, strikes, riots, theft, disease, accidents orfailures related to the public internet, telecommunications linesor facilities, or third party technology systems, or any othercause beyond the control of TI. Under no circumstances shall TIbe liable for any special, incidental or consequential damagesarising from the foregoing.

INTERMEDIARY DISCLOSURE: TI assists you in finding travelsuppliers and making arrangements that meet your individualneeds. We consider various factors in identifying travel suppliersto you and recommending specific itineraries. In this role, weare acting as an independent third party and not as a fiduciary.TI acts solely as sales agent for travel suppliers and is notresponsible for the actions or inactions of such suppliers. Wewant you to be aware that certain suppliers pay us commissionsas well as incentives for reaching sales targets or other goalsand from time to time may also provide incentives to our travelcounselors. Certain suppliers may also provide compensationto us for various marketing and administrative services that weperform for them, such as granting them access our marketingchannels, participating in marketing programs and supportingtechnology initiatives. From time to time, we may enter intoother business relationships with suppliers and thesearrangements, including levels and types of compensation andincentives we receive, are subject to change. In identifyingsuppliers and recommending itineraries, we may consider anumber of factors, including supplier availability and yourpreferences. The relationships we have with suppliers may alsoinfluence the suppliers we identify and the itineraries werecommend.

TERMS OF PURCHASE: Please note that separate terms andconditions dictated by the applicable supplier will apply to yourreservation and purchase of products and services. You agree toabide by such terms and conditions, including payment of allamounts when due and compliance with the applicablesupplier’s policies, rules and restrictions regarding availabilityand use of fares, products and services. You understand that anyviolation of any such supplier’s terms, conditions, policies, rules

or restrictions may result in (a) your forfeiting any monies paidfor such reservation or purchase, (b) cancellation of yourreservation or purchase, (c) your being denied access to anyflights, hotels or other products or services, and (d) Operatordebiting your account for any costs Operator incurs as a resultof such violation. You acknowledge that you will be responsiblefor all charges, fees, duties, taxes and assessments arising out ofyour purchase of the travel products from Operator.

CANCELLATION AND REFUND POLICY: The right to a refundis limited if a participant changes plans prior to or after the trip istaken. All requests for refunds must be submitted (certified mailreturn receipt requested) in writing through the booking agent tothe Operator or directly with Operator if the booking was madedirectly with Operator except in the case of pre-trip which can bedone over the phone. Operator shall then process your refund andmay retain a $50 processing fee if a refund is given. All appropriatereceipts/vouchers and documentation must accompany the refundrequest. No refund will be made for package features theparticipant opts not to use. “No show” penalties could be up to100% of the package or component costs. The rights and remediesmade available herein are in addition to any others available underapplicable law. However, Operator offers refunds under thisagreement with the express understanding that endorsement of arefund by participant(s) constitutes a waiver of any such additionalrights and remedies against Operator. See “Cancel for Any Reasonand Travel Protection Plan” section below for details on our CancelFor Any Reason Waiver.

CHOICE OF LAW; RESOLUTION OF DISPUTES: ThisAgreement is governed by the laws of, and disputes shall bevenued in, the State of New York, without reference to its choiceof law doctrine. All disputes, claims or controversies arising outof or related to the services of this agreement shall besubmitted to mediation and if the matter is not resolvedthrough mediation, it shall be submitted for arbitration. Unlesswe agree otherwise in writing, any mediation and/or arbitrationshall take place in the State of New York, New York County, andshall be administered by, and pursuant to the rules of, theAmerican Arbitration Association. Disputes shall be arbitratedon an individual basis. There shall be no right or authority forany disputes to be arbitrated on a class action basis or in apurported representative capacity on behalf of the generalpublic, other travel customers or other persons similarlysituated. The arbitrator’s authority to resolve disputes and tomake awards is limited to disputes between you and us alone,and is subject to the limitations of liability set forth above.Furthermore, disputes brought by either party against the othermay not be joined or consolidated in arbitration with disputesbrought by or against any third party, unless agreed to in writingby all parties. No arbitration award or decision shall be givenpreclusive effect as to issues or claims in any dispute withanyone who is not a party to the arbitration. Should any portionof this section regarding the arbitrator’s authority to resolvedisputes between only you and us be stricken from thisagreement or deemed otherwise unenforceable, then this entiresection shall be stricken from this agreement. The provisions ofthis section may be enforced in a court of competent jurisdictionand the party seeking enforcement shall be entitled to an awardof all costs, fees and expenses (including attorney fees), to bepaid by the party against whom enforcement is ordered. Thisarbitration provision is made pursuant to a transaction involvinginterstate commerce, and shall be governed by the FederalArbitration Act, 9 U.S.C. Sections 1-16, as it may be amended.

DOCUMENTS: Documents will be sent twenty one (21) daysprior to departure and if you book before that time, once fullpayment is received. Document reissue fee is $25.00 perbooking plus any supplier fees.

CHECK-IN PROCEDURE: Failure to check-in for your flight atthe appropriate time may result in denied boarding and arefund may not be granted. Check-in times vary bycarrier/airport and all participants are required to check with thecarrier for the most current information.

PACKAGE PRICE: The package prices include only itemsspecifically stated in the participant(s) itinerary. Certainsecondary features of a package (e.g., cocktail party, freesports, etc.) are based on supplier policy and may bechanged, added or deleted after printing of literature.Operator has the right to substitute services oraccommodations in similar categories for items listed inthe literature.

PLEASE NOTE: Operator reserves the right to re-invoiceparticipant(s) in case of an error made in computing tourprice, or in the event that a change in tax or hotel rate, orif a service fee or surcharge is imposed by the hotel orairline. Foreign government departure taxes, fees andtourist cards may be collected at the destination by therespective government authority. Please be advised thatcertain mandatory hotel-imposed charges, including, butnot limited to, daily resort or facility fees, may beapplicable to your stay and payable to the hotel operatorat check- out from the property. You may wish to inquirewith the hotel before your trip regarding the existenceand amount of such charges.

PROOF OF CITIZENSHIP AND ENTRYREQUIREMENTS: Participant(s) are responsible fordetermining and obtaining proper documentationincluding any visas or other travel documentation thatmay be required. Failure to carry proper proof ofcitizenship may lead to denied entry to aircraft and/orforeign country. All participants are required to check withthe appropriate consulate or embassy for the respectivedestination for entry requirements that apply to them andtheir travel companions. No refunds will be made ifincomplete or improper documentation results in deniedboarding or entry. A valid passport may be required andshould be valid for a minimum of 6 months after yourreturn date.

CANCEL FOR ANY REASON WAIVER AND TRAVELPROTECTION PLAN: The Cancel for Any Reason Waiverand Travel Protection Plan (“Plan”) contains both non-insurance (Section I) and insurance (Section II)components. Enrollment in the Plan is optional and onceenrolled, the cost associated with the Plan will not berefunded.

Section I Cancel For Any Reason Waiver is a non-insurance component and is provided by TravelImpressions, Ltd.
